What can lead to review and change of decision in the supreme court is new facts and new evidence that were not presented or were overlooked by the supreme court. One of such facts is the case of over voting after adding the 388 polling unit results and also the case of over voting in some of the 388 poling units Uzodimma is claiming. |

A common past time in Nairaland is to abuse Igbos, taunt Igbos, barrage Igbos and above all insult Igbos. Good enough there are Igbos on Nairaland who are equal to it either in response or in retort. In the larger Nigeria, it is quite fashonable these days to make uncomplimetry comments against the Igbo and to talk negatively against them. Many rain direct and or indirect diatribe against the Igbo as they feel that the Igbo are helpless and hapless at this moment. Many times I hear people say that Igbo man cannot be this or that all with impunity. Sometimes I wonder if these commentators think that Igbos are of a different country. If we are of the same country one would think that people are mindful of equity, fairness and justice. Igbos are a people of not less than 50 million inpopulation. If we continue to push them, we might push them into ,crime, social unrest , exodus or outright reaction. None of these will augur well for Nigeria. |

garfield1: oga,those are not new evidence.there is no overvoting anywhere.inec wrongly misinterprets overvoting.overvoting is when total number of votes cast exceed what is in the voters register and in imo state,total registered voters is 2 million.that is supreme court definition.for you to prove it,you must bring all polling unit voters register to prove it not card reader and this is impossible.in all the judgment of the apex court including that of yesterday,they restated this.
Secondly,on the matter of hope not being a candidate,this cannot be raised since pdp never raised the issue.you cannot bring it back again,only old evidences or matters that were dealt with can be reviewed. Again,hope and apc were never joined in the matter which was between aa and nwosu strictly.it has no effect on hope,it goes to no issues.it is settled in law that you cannot make an order to any party not joined,you pdp guys do not know the law.you just argue based on sentiments. .y man, acrreditation is what determines over voting. Mynd44: Actually the Supreme Court can change a judgment based on new evidence and/or clerical error.
In the case of Hope and Ihedioha, the argument of total accredited voted vs total votes casted can be viewed as a clerical error that was not considered by the court as these numbers are an aberration to the constitution which the Supreme Court draws its powers from Thank you my man. You see, people will think that Ozekhome is brilliant but he is human. He can forget or make mistakes. Supreme court judgement can be revied based on new facts that were not considered in the main case and or clerical errors. Going by the supreme court judgement on Imo state, there is now clear case of over voting in Imo state election . The law says when there is such a case, the election should be cancelled. Secondly, by the supreme court judgement earlier before that of Uzodimma Vs Ihedioha, APC had no candidate in that election because Uche Nwosu who was the authentic candidate, was disqualified based on double candidacy. It means that Uzodimma was not a candidate in that election. It is a pity that we do not have pragmatic lawyers in this country again. |

Election petitions are time bound. Hence the time allowed for hearing the election petition has elapsed. The Supreme Court therefore lacks jurisdiction to entertain the matter.
Section 285 of the 1999 Constitution (First Alteration) Act 2010 introduces new Subsections (5), (6) & (7) as follows:
Section 5 _ “An election petition shall be filed within 21 days after the date of declaration of results of the election.
Section 6: “An election tribunal shall deliver its judgment in writing within 180 days from the date of the filing of the petition (six months)
Section 7: “An appeal from decision of an election tribunal or Court shall be heard and disposed of within 60 days from the date of the delivery of judgment of tribunal.
With this latest amendment, electoral disputes are now to span a maximum of eight months, from Election Tribunal to Appeal.
This is very progressive as it has dealt with the problem of electoral cases dragging on for years whilst one of the parties enjoys the pecks of the disputed office. It is a judicial review. Such is not time bound |
