Human rights lawyer, Chief Mike Ozekhome (SAN), said efforts had begun to secure release of former Governor of Ekiti State, Mr Ayodele Fayose, from Economic and Financial Crimes Commission (EFCC) custody.

Ozekhome said this in an interview with the Newsmen in Abuja on Thursday.

Fayose, whose tenure as governor ended on Monday, had on Tuesday reported at EFCC office in Abuja to answer to some allegations levelled against while in office as governor.

Ozekhome said “Fayose’s lawyers are already taking steps to enforce his fundamental human rights by getting him released.


“Yes, his lawyers will go to court to enforce his fundamental human rights.

“The EFCC has no right to keep him for over 24 hours.

“If they have done that by obtaining a Magistrate Court’s Order that will be in the form of “holding charge” which has been declared unconstitutional and illegal by the Supreme Court.

“Holding charge is illegal. It is unconstitutional.’’


Ozekhome said that the section of the Administration of Criminal Justice Act (ACJA) permitting a magistrate to detain a suspect for 14 days was illegal.

According to him, any action outside the provisions of Section 35 of the Constitution which specifically provides for 24 hours, is illegal and unconstitutional.

He explained that the ACJA allowed for detention of a suspect for 14 days, but that Section 35 of the Constitution made it clear that a person could only be detained for 24 hours.

“So, when there is a clash between the statute, like the ACJA, and the Constitution, the Constitution prevails by virtue of Section 1(3).

“If they have gotten an order for two weeks from the magistrate court, it is unconstitutional,” Ozekhome stressed.

Recalls that Ozekhome was among Fayose’s supporters who accompanied him to the EFCC on Tuesday.

He had said that the present administration was governed by constitutionalism, and that it was a constitutional democracy.

When contacted for update of Fayose, especially on the detention, Head, Media and Publicity of EFCC, Mr Wilson Uwujaren, he simply said, “there is no update at the moment.”

EFCC had all the time to do their due diligent investigation if they had a case against him.

EFCC should charge fayose to court if he is guilty, i don't support corruption. efcc should also be getting ready to arrest aregbosola, okorocha and others, it is evident that these guys looted billions. they must also remember ganduje. the fight against corruption should not be a one-sided affair

Ekiti major problem is poverty, wealth creation and job creation. Skill development and entrepreneurship should be encouraged via soft loan. Stimulate the economy. He should pay workers too.

Education is not their problem they are well educated but living in abject poverty because they depend only on Govt money aka salary.

there is one professor in almost every family in Ekiti state but all these professors are paupers that barely can afford to feed well.

Poverty is the real problem in ekiti, they are one of the poorest state in Nigeria with the worst debt profile almost bankrupt.

Anymore promises from Mr. Lifeless gives me tremendous amount of palpitations and loss of faith in him and his ruling party. Before he assumed power, he made a lot of promises and made our hearts to swell with the joy that we are finally going to have a leader that is truly on the side of the masses, the common man. After over 3 solid years on the throne as president, our hopes, dreams and aspirations were not only lost, but shattered as well due to the lifeless state of the nation today. We realized that we have been conned, scammed, tricked, deceived and disappointed by a LIFELESS leader who BELONGS TO NOBODY BUT BELONGS TO EVERY NORTHERNER. I have withnessed a leadership that is filled with vile for members of the opposition party. Even though we are in a democratic dispensation, Mr Lifeless has severally disobeyed court orders by restraining and detaining civilians who have not been convicted by any law court. This makes me wonder if we are being ruled by a dictator as president.

WHEN MR LIFELESS SAYS He will make Nigeria to be "LIVEABLE" again, the reverse will surely be the case if we give him another chance to continue from where he stopped.

Presidency ordered EFCC to detain Fayose indefinitely – PDP alleges



The Peoples Democratic Party (PDP) on Monday alleged that the “Presidency has directed the Economic and Financial Crimes Commission (EFCC) to incarcerate, indefinitely,” the outgoing governor of Ekiti State, Ayodele Fayose.

In a statement issued by the National Publicity Secretary, of the PDP, Kola Ologbondiyan, PDP claimed that the “information at the party’s disposal and all over the social media indicate that the Presidency has put the commission on alert to arrest the governor at midnight today and detain him indefinitely.”

PDP alleged that the directive by the “Presidency is not unconnected with the plot to use the EFCC and other security agencies to incarcerate the governor owing to his persistent criticism of the President Muhammadu Buhari-led APC government.”

The statement added, “This uncompromising stands of the outgoing governor against the present
administration was the reason Ekiti State was invaded and taken by force during the last governorship election.

“By 12 midnight, the governor’s residence is expected to be surrounded by armed men of the EFCC under the pretense that they had information of his plot to escape. This is to achieve their plan to humiliate the governor and portray him in bad light to the public by dramatising his arrest.

“Nigerians can recall that it was the governor who offered to submit himself to the EFCC despite the commission’s clear display of bias and partisanship as demonstrated in its various actions, especially its tweets and putting the governor on security watch-list.

“EFCC even unprofessionally showed its bias in deriding the governor, making light of a very serious matter by mocking him and asking him to come before his tenure elapsed, which the governor declined in line with the constitutional immunity.

“It is now beyond dispute that Governor Fayose is not a scoundrel running away from justice. Whatever the EFCC, APC, and the Presidency’s spin-doctors may say, it is also clear to everyone that Fayose is not a coward; neither is he afraid of the EFCC.

“Fayose is prepared and ready to defend himself in the court of law. Neither the Presidency nor EFCC is a court of law. Since the EFCC said it had dusted up Fayose’s files, it should be ready to take him to court once he presents him at the agency’s office on Tuesday.

“Governor Fayose has offered to walk to the EFCC office by himself and nothing must happen to him tonight. The PDP condemns this resort to fascism by the APC government, saying the whole world should be at alert to see another demonstration of crude disrespect for the rule of law and rights of Nigerians.”
