I will say it in capital letter, IT IS A PURE LIE AND TOTALLY IMPOSSIBLE.
The level of Authorisation for a transaction requires higher authority in most banks. The average HOP or BM does not have the power and may have to refer it to an higher authority.
Does it mean all the officers did not check the benefiary account name and number well?

And if you run a business, you will not pay tax on your profits unless your profit exceeds N50 million naira.
Despite all this, you people still run to social media making noises about tax law! tax law!
What is the problem. If one were to address every ignorance on the social media concerning the tax law, one will only discover that 365 days is too small for a year. |

Phones › Re: Help Please: How Can I Retrieve My Powerbank. by ppogba: 7:35pm On Jan 01 |
zoedew: On the Law as it stands today in Nigeria I do not agree with you. The Law firmly is that a bak can neither place a PND on a customer’s account or reveal details of his account to a third party without a court order and that is regardless of his signed consent in his account opening documents. Releasing the number at that point in time constitutes no legal error for the bank. The bank can deny they never gave it to him. There are a thousand and one places the customer could have gotten the number if the bank wants to argue. The bank can PND on the account with an excuse as simple as " Go to your branch for documentation" and that can be well defended. It amazes me the way people think it is easier to sue banks and win especially with filmsy issues as this. I have said it in another post, a brutal branch manager will lure the old thief to the bank, invite him to the office, get the plain police officer on duty invited alongside him and show him the CCTV footage. The kind slap that will land on his face will make him to forget there are professionals called lawyers. The question no one as answered is, will issue be handled the same way if the innocent customer is a sibling of the Branch Manager? |

Osanoghodua1: That's not how banking operates. What happened is not connected to banking, it's outside the banking operating system. So the bank is not obligated to act. In banking, what do you call what happened?
I once worked in the bank.
The right thing was what the CSO did by calling the thief maybe he mistakenly took it, now that it has been established that he's a thief, the right thing is to use the law to access his KYC that is with the bank and track and arrest him, this time, he will be charged to the court, if he denied it, he has to produce the receipt of the power bank and the giver will produce his backed with CCtv footage. This is stealing by trick, I don't know the fine necessary for such. Oga, I worked in BANKS in various capacities. Who says that is not how banking operates? Will the HOP or superior officer not get hold of him if the OP were to be his sibling? An experienced team will put a lien on his account with a narration that can protect the bank in case the idiot wants to prove nonsense. Something like " contact your original branch" or any other reason. Are you saying because according to you it is out of banking operation, the CCTV footage is nonsense when the need arises? Somebody that should be lured to the bank, a plain cloth police officer ushered into the Manager's office with him before being showed the footage. Lily livered, inexperienced officers. What is risk to the bank in releasing the phone number? Could the innocent boy not have gotten the number elsewhere ? |
Phones › Re: Help Please: How Can I Retrieve My Powerbank. by ppogba: 3:58pm On Jan 01 |
zoedew: He will sue the bank for placing an unlawful lien on his account and will recover against the bank. That is the Law in Nigeria today. Which sue? He has a right to sue that an unlawful lien was placed on his account though. However, the bank has a reason to justify the lien too. The only problem being that they may not be willing to go the whole hog for the customer. Getting the police involved will shorten the process and if he is brought to the bank to see the CCTV footage himself, the police will shakara him there and then and threaten to be a witness against him in court. At the time the owner asked for his number, the bank faced absolute no risk in releasing the number to him. |
Phones › Re: Help Please: How Can I Retrieve My Powerbank. by ppogba: 3:49pm On Jan 01 |
Osanoghodua1: the bank can not do that If he wants it he should go through the court and police. It's best he leave it because it will cost more but his house is known. The bank can if the HOP knows what he is doing. What case do you think the old thief has? Experience is lacking these days. |
Phones › Re: Help Please: How Can I Retrieve My Powerbank. by ppogba: 3:46pm On Jan 01 |
saintbillion: The bank staff are already aware. They know i gave him my powerbank. They called him but he refused to return it and keep blocking every number that is been used to call him An experienced HOP will put a lien on his account , block or flag it as the case may be. Let him go and call his lawyer. |
