jude33084: Muslims members of Southern Kaduna community in Kaduna State has asked the ECOWAS Court of Justice sitting in Abuja to order the Federal Government to pay them the sum of N105bn as compensation for failing to protect them from an alleged ethno-religious cleansing carried out by indigenous members of the community after the April 2011 presidential election.

The suit, which came up for hearing on Wednesday, was filed on behalf of the Southern Kaduna muslims by the plaintiffs – the Registered Trustees of Jamaa Foundation, Alhaji Suleiman Ahmed, Alhaji Muhammed Zailani, Malam Sale Waziri, Wada Balarabe and Yakubu Yunusa.

The Federal Government of Nigeria and the Attorney General of the Federation and Minister of Justice were listed as the respondents.

Southern Kaduna muslims claimed that the Federal Government failed to protect them from a premeditated mayhem which led to the death of 838 members of their community on April 18 and 19, 2011.

In the suit filed by their lawyer, Abdulfatah Bello, they claimed that “the premeditated mayhem was executed in Kamuru Ukulu on the 18th day of April 2011.”

They said, “In the evening of the said day while the Muslim community were enjoying the peace of the after effect of the presidential election, their habitat was surrounded by some indigenous youths who mounted illegal road blocks to and from the town.”

The plaintiffs claimed that, in the civil disturbances that ensued shortly after the road block was set up, their members lost lives and property while relevant agencies of the government failed to restore order in the community.

The plaintiffs also claimed that, so far, none of those responsible for the alleged crime has been arrested.

They therefore asked the court to declare that the failure of the respondents to provide timely protection for them was unlawful and violated their human rights, as guaranteed under the African Charter of People and Human Rights, and the UN International Covenant on Civil and Political Rights.

Also, the Southern Kaduna Muslim community asked the court to order the Federal Government to pay them a total of N105bn as compensation.

The Federal Road Safety Corps on Monday said the new Lagos State Road Traffic Law was a right step that would enhance traffic management and also return sanity to roads in the state.

Sector Commander, Lagos Command of the FRSC, Charles Akpabio, stated this during a courtesy visit to the state Governor, Babatunde Fashola, at Lagos House, Alausa, Ikeja.

Akpabio, who was recently posted to the state to head the Command, said the FRSC would support the law, adding that officers and men of the state command would not compromise on its implementation.

He said, “We have even gone a step ahead to educate motorists on the law. We believe that it will thrive more when they comply than when law enforcement officials apprehend them.

“The law is certainly not to punish, but to bring back sanity to the road, Lagos is very important to Nigeria. The new law has come at the right time and we are prepared to partner with the state.”

Akpabio said his command had decided that only certified drivers would be issued Driving Licence.

He said, “A lot of people are coming into Lagos to process their Drivers License. We will make sure that they go through the VIO first to let us know if they can drive well. As for people who sit down at home to get licence, that era is gone.”

Fashola, who commended the move to streamline the issuance of licences, said it would help reduce accidents and save lives.

The governor pointed out that the Road Traffic Law was for the safety and benefit of Lagosians rather than to punish them.

He explained that the three-year jail term recommended by the law to traffic offenders was not compulsory, but at the discretion of the judges in trials involving serial traffic offenders.

He said, “Unlike the old law where you only pay fine, this time around, you will not only pay a fine, you will either do community service, where you go and manage traffic or a compulsory training at the Drivers’ Institute.

“Sentencing anybody to jail will be the very extreme and it would have to be the discretion of the judge or magistrate where he sees that the person is either a habitual offender or somebody who has done something grievous.”

Firstly, she went out clubbin wit a new toaster n called me around 12am dat she was comin to my place after clubbin, meanin i shud stay awake 2 open d gate to my compound; she came 30mins after d call n i allowed her in. I calmly xplained to her how hurtin i was due to her recent actions n at d end of my speech, i told her ''I LOVE U'', she did nt respond, i repeated d quoted phrase, then she shouted at me sayin ''AND SO WAT?''
Secondly, i went to see her at her crib, met her already dressed n ready to go out, asked her where she was up to, and she said ''a show'', i asked wit who? She did nt respond, then i said i came to spend weekend wit her, but she wasn't concerned abt dat, she got out of d room, asked me out n locked her door, as i was tryin to plead her to remember how far we've come togeda, while holdin her hands, unxpectedly, she turned around n pushed me n i fell to d ground like a baby, ''SMH'' hurtin my arms in d process, afterwhich i allowed her to go for her show wit whoeva. After sometime minutes of her departure , she sent an apology text but i did nt bother to reply.
Thirdyly, we were togeda at my place, d toaster called her fone, n she asked him to drive down to my area, went out to meet wit him, i followed her to where d guy was, n asked her there n then to choose between me n d guy who she wanted to follow, n shockinly, she chosed d guy, n i left n went into my apartment. That was how d relationship ended.

THE Federal Government yesterday prayed an Abuja High Court for time for it to settle out of court a tussle between the First Lady, Dame Patience Jonathan and former First Lady, Hajiya Turai Yar’Adua over a prized plot of land situated at Cadastral Zone in the Federal Capital Territory (FCT), Abuja.

However, documents before the court showed that the disputed plot of land was duly allocated to Hajiya Yar’Adua’s non-governmental organisation - Women and Youth Empowerment Foundation (WYEF) by the Minister for the FCT with the Right of Occupancy dully issued to it.

Following an application by the Registered Trustees of WYEF, the FCT Minister had granted an allocation of plot 1347 Cadastral Zone after the Foundation paid the sum of N184.529, 438 as statutory Right of Occupancy, which was duly issued by the Minister for Federal Capital Territory (FCT).

Under the terms of grant, the plaintiff was given three years to develop the property based on approved building plans.

After payment of the various levies, the plaintiff paid additional sum of N76, 936,210.00 as building plan fees following which the grant and approval of the building plans were made and given in line with the master plan for Abuja.

Thereafter, the plaintiff appointed and mobilized a building company, Al-Cooks Nigeria Limited to site to develop the property at the sum of N13, 516,013,797.58.

On November 1, 2011, the Federal Capital Territory Administration sent an additional bill of N18, 529,438 being the balance of the various charges under the grant, which the plaintiff paid the next day.

Shortly after these transactions, the Minister for the FCT, without reasons, issued a notice of revocation of the said property, which it allocated to the plaintiff for the purpose of building public institution (Training/Vocational Centre). The said letter of revocation was backdated with effect from October 27, 2011.

Immediately after the revocation letter was issued, the FCT Minister, Bala Muhammed swiftly re-allocated the plot to another organization, African First Ladies Peace Centre, which the current First Lady, Dame Patience Jonathan, is believed to be a sponsor.

It was at this stage that Hajiya Yar’Adua’s organisation went to court to challenge the actions of the minister with respect to the revocation letter.

Before Justice Peter Affen, it sought and obtained a restraining order barring the Minister and the FCT administration, the Abuja Geographical Information System (AGIS) and the Attorney General of the Federation from carrying out further activities at the site.

But while the order of the court was still subsisting, the defendants in defiance of the said order mobilised workers to site to commence construction.

Faced with this act of arbitrariness, counsel to WYEF, Innocent Lagi went back to the court and initiated contempt proceedings against the respective defendants.

However, in an attempt to frustrate the hearing of the contempt proceedings, the office of the Attorney General of the Federation last Friday approached the court with a motion seeking to vacate the said order.

But Justice Affen ordered the AGF to put the necessary parties on notice and adjourned the matter for yesterday.

When the matter was called yesterday, counsel from the chambers of the AGF, Baba Sa’idu informed the court of Government’s willingness to settle the matter amicably out of court.

He added that already, his client has reached out to all the counsel to the parties before the court; a position collaborated by counsel the FCT Minister, the FCT Administration and AGIS, Felix Ibanga just as the plaintiff counsel, Lagi also confirmed the development.

Meanwhile, the case has been adjourned till September 24, 2012.
