MISLEADING WITH HALF-TRUTH.
1. STADING DEBIT: Debtors accounts are placed on automatic debits by the system, hence any money that come is automatically debited to the tune owed at the time.
2. GLOBAL SATNDING INSTRUCTION: In August 2020, CBN introduced the GSI to enable banks to debit accounts of loan defaulters in other banks.
How the Global Standing Instruction (GSI) Works
Legal Basis: The GSI is an instruction signed by the borrower as part of the loan agreement, authorizing their creditor bank to recover the debt from any and all accounts they hold across other participating financial institutions in Nigeria.
Last Resort: Banks are expected to use the GSI as a last resort, after other recovery means have been unsuccessful.
Scope of Recovery: The GSI can only be used to recover the principal loan amount and the accrued interest. Penal charges are excluded from GSI recovery.
Eligible Accounts: The GSI applies to all qualifying accounts linked to the borrower's Bank Verification Number (BVN). These include:
Individual savings accounts
Individual current accounts
Individual domiciliary accounts (Naira and foreign currency)
Investment/deposit accounts
Electronic wallets
Joint accounts (though the CBN may provide further clarification on protecting the rights of third parties).
Process: The Nigerian Inter-Bank Settlement System (NIBSS) manages the operation of the GSI, leveraging the customer's BVN to identify and debit funds from accounts in other banks upon the creditor bank's request. The bank does not need to notify the customer immediately before initiating the GSI, as consent is part of the initial loan agreement terms and conditions.

Note: You cannot be owing bank A, refuse to pay, and put money in bank B. GSI was instituted to protect banks from people who usually take loan from one bank, refuse to pay and start doing transactions in other banks.
