Law is much more complex than that.In Canada, holding someone (especially one who has mental health issues) against their wish is not kidnap. That is where a citizen arrest usually comes in. A police, peace officer and other citizens can hold a person or arrest a person against the person's wish if there is enough reason to believe the person is suffering from mental health issues and may cause harm to herself or others.
