Have you been paying rent for using the house? Your siblings can't own a share of the property and only you and your brother will have use of it. What benefit are they currently receiving from owning part of the property?
You could reach an agreement with them to value the rental income from the property and then pay this amount after which you will receive your share of the rent (1/11th) or you could buy the property from your father's estate and then receive a share of the proceeds since it is sentimental to you.
You should not deprive your siblings of the enjoyment of the property or proceeds because it is sentimental to you.
all sons have the right to use a part or all part of his father's house... I saw that online yesterday, just wanted to point that out...

Nobody is asking nobody not to have some proceeds in thier father's house...

Thank you all for the inputs, I have learned a lot by bringing it to the open...

I personally see it as a bad deal to sell, but my people need the cash... And my people out numbered me 9 to 2 so there's only little I could do...

Also I feel for my younger brother who can't help but feel a little entitled about everything, he was the closest to pop when he was alive and lived with him till his death, and I will cut him a little slack here for being entitled he had genuine reason for that, but majority is for sale, and from the comments here, we will do a deal...

We recently moved here permanently over a year ago, so we are not enjoying rent free for 10 years like some people think...

I pray we do the right thing and hopefully everyone is satisfied... Like I said it's not a now thingy, maybe a little over 5 years time Sha,

Bro, you are simply being selfish. My answer to your question is yes, the inheritance can be sold without your consent, because the inheritance is not yours alone but the family. And it is not mandatory for every single member of a family to agree before a family can take a decision, unless you want to go against the family and make the simple issue messy.

If the property is large enough, then it can be physically divided so that every heir may inherit and do as he/she pleases with his/her share.
If you have enough money, then you can offer to buy the rest out - subject to their consent.
Otherwise, the majority interest should prevail over your minority rights; most courts would uphold their right to sell the property and give you your legitimate share of the proceeds.

- Everyone is entitled to the house.
- if your dad had 10 car stashed away in a different state aside were u reside.. u haven't seen the cars, you have even used any of them.. and u are cash strapped, won't you consider selling some or all of the cars to raise money (now you may not have considered who might have been emotional attached to the car.
- you obviously are at disadvantage being amongst the least siblings. Next of kin will be far from you so you decisions may be rarely consider in grave circumstances.

I've experienced what you're going through. It really helps that you guys are civil. FOR NOW! But in the absence of a will, the default in any probate court is a "democracy". One beneficiary, one vote. Thus sell carries the day. Trust me I understand the sentiment to childhood homes, but justice especially fair justice and equity has to be dispassionate.

yeah you are right, selling is not entirely a bad thing, we don't collect rent, people working beside and outside our house were surprised we were the landlord, me and my bro be Og's mehn, we live our life and bother nobody, only privilege is rent free and you'd think we are just another student...


It's one of the siblings dropped account number for tenants, that's how rent is collected, I never collect rent etc.. .

When it comes to issues like this, my only advice to u is just let them go ahead with their decisions over that property, like I always say "mi o le mi wahala" , you still have a long way to go than getting yourself into a mess with ur siblings, and to think u are from a polygamous home, it's better u let them sell, get your share and move on with your life or you ignore the share and plan your own life. And it' not a now thingy, even if it will be sold eventually, not in the next 5 years at least... I just want to know if majority win works in this kinda situation or dosent...

I mean it's an inheritance right, we all have equal rights and all, 8 want to sell, 3 don't want to sell, majority rules say 8 win, but everything I have been reading online says no sale without my "consent"... So I'm thinking like since my "consent" is NO, they can't sell...

Maybe I should add, nobody will cheat anybody in the aftermath of a sale, everyone would get theirs...

My issue is isn't there some clause in the law that covers for a scenario where the property in contention is my home, grew up in it, knew everyone, live and still living with evidence, also I know for a fact that pop will never sell, out of the blue about to be up for sale by people who needed an address and later description when they were coming cuz they needed money....


They just trying to use my house for cash out, why should they? The day they came, they all left except 1, not my fault they like visitors, cuz they never come..

Good day all,

It's pretty simple, can I be forced to sell my inheritance?

My late pop passed away 4 years ago, he had 11 surviving children from 4 wives, me and my younger brother were the last kids from the last wife...

He left a house in Lagos which we presently reside in but in recent times it's been the topic of sale by other siblings.... our stance remain 'NO SELLING'

Additional info

1-Me and my bro are in our early and mid 20's,we live in one of the apartments

2-The remaining siblings all have families of their own outside Lagos

3- Money is obviously the Motive for selling, but its emotional and psychological for us, dunno if this count, but id also add that my younger brother is a 'son of the soil"here, schooled here and erythane before pop passed, 3 of the siblings have never been here before. Older folks call popman "Baba Shade" we only met at the burial...

We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling...

However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too...

Which prompted my creation of the thread and asking "can our house be sold without our consent" considering we are in the minority for team "no selling"

Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us...

N/B- there is no discord or fight or anything among siblings, we all live in peace and contact mostly through phone calls sometimes.....
