So my question to Ike Ekweremadu remains if the amendment is passed into law, will it nullify the CCT trial of saraki because like it was said, it takes 3 people to preside over it, not two, like we see now.

I hope these senators know what they're doing because I'm starting to believe Saraki is smelling doom and he's now trying to play every card available on his table.
The Law can not be retro active.

What the Supreme ruled on was whether it has criminal jurisdiction.
The supreme court from your post held in the affirmative, however with a "but".
i.e limited criminal jurisdiction.
The issue before the court was not whether the charge was a criminal charge, Saraki only quarries the criminal jurisdiction of the cct which I earlier held that it is when the act in question is a crime. Saraki's lawyer is only trying to raise frivolous, scandalous and vexatious objection. He shouldn't have quarried the general jurisdiction of the cct. What he should've quarried was whether the alleged breach of the act amounts to crime or civil breach of trust.
The act is simply a crime

I am not the justices so I can tell. However, if there will be anything that will favour Saraki, it will come from the Supreme Court, me personally I don't trust Court of Appeal Judges. The only escape rout the Supreme Court will give Saraki is on the requirement that "the person who gave the false declaration may be invited to clarify any ambiguity". The Supreme Court will determine the word "May".In law, words are not just as u see them. Two people can define the word "May" in two different ways. In doing this, the Supreme Court will look at the mischief the law intended to correct. It will interprete the intentions of the lawmakers on the requirements of inviting the person (Saraki) to clarify the ambiguity. Take for instance the Orubebe's case, the witnesses said they wrote to Orubebe to come and clarify but he fails to come. Whereas, in the Saraki's case, he was not invited and that is why I am sensing persecution. Why giving others the time to come and clarify the form but denied Saraki same right.
In a nutshell, the word "May" will determine Saraki's case at the Supreme Court.
A Law demanding for a Suspect or an accused to defend himself in private is a violation of section 36 of the constitution on open trial and same cannot invalidate a criminal trial. The reason for the calling was to clarify ambiguity if any exist but with the kind of Kwara State Government fund lodged in his personal Account, his fraudulent intentions has been established.

The constitution bars the National Assembly from making retroactive laws (i.e. ex post facto).

Thus, even if the proposed amendment is passed by both chambers, vetoed by the president, and the NASS overrides the veto with a 2/3 majority in both houses, the law would not apply to Saraki's case because his case commenced before the enactment of the law. Also, other pending cases before the CCT won't be affected by the proposed legislation.

The proposed new law will only take effect on future cases i.e. cases commenced after the day of enactment of the amendments.
You've mastered your section 4 of the Constitution. Equally their bias can be checked in Court going by the peremptory norm of checks and balances!

Politics / Re: Saraki’s Senators’ At CCT Shrink From 81 To 12 by swagzofroyalty(m): 1:17pm On Apr 06, 2016
midolian:
Senate President Bukola Saraki has arrived at the Code of Conduct Tribunal (CCT) where his trial for alleged false declaration of assets continues.

He arrived at 10:05am in company of at least 12 senators.

Some of the senators are Ike Ekweremadu, deputy senate president; Sam Anyanwu, Dino Melaye and Andy Uba.

This is the lowest number of senators to accompany him to the CCT since the beginning of his case in September 2015  – the highest being 81.

In addition, this is the second day of his trial which started on Tuesday.

Although, this is the eighth time the senate president will appear at the CCT, his trial actually started on Tuesday.

The first time was on September 22, 2015 after the tribunal had issued a bench warrant for his arrest. He was accompanied to the tribunal by at least 50 senators on that day.

On the same day, he entered the dock, but he pleaded not guilty to 13 counts of false declaration of assets brought against him by the Code of Conduct Bureau (CCB).

The second time was on October 21, 2015 when he was accompanied to the tribunal by at least 81 senators.

And the third time was on November 5, 2015, when his lawyers  –Joseph Daodu and Mahmud Magaji  – withdrew from the case in protest of the decision of the tribunal to continue the matter despite an appeal against the constitution and jurisdiction of the tribunal at the supreme court.

The fourth time was on March 11, after the ruling of the supreme court upholding the jurisdiction of the tribunal to try him while the fifth time was on March 18 when an application to stop his trial was heard.

The sixth time was on March 24 when the tribunal ruled that his trial must continue.

The seventh time was April 5 when the prosecution called its first witness, who narrated how Saraki allegedly laundered billions of naira using fictitious names.

The senate president had gone the whole hog to challenge his trial at the CCT, but he failed at every turn.

On February 5, the apex court dismissed an appeal to stop his trial paving the way for the continuation of the case at the CCT.

On Tuesday, Danladi Umar, chairman of the CCT, dismissed Saraki’s application for adjournment.

Ruling on the application, Umar held that the issue of jurisdiction of the tribunal had already been settled by the supreme court, adding that a motion for adjournment based on an appeal challenging the jurisdiction of the tribunal at the appeal court was unnecessary.

He, therefore, ordered the prosecution to produce its witnesses, and the trial commenced.

This is purely a display of shameful ignorance as no civilised Law Enforcement Agency in the World will be publicising their investigation on the media.
This is a reason why Law Enforcement Agents in Nigeria can not carry out their Constitutional duty without an infringement on fundamental human right of citizens.
The continuous detention of the two suspects which section 36(5) of the Constitution presume to be innocent is nothing but a violation of their fundamental human right as provided by section 35 of the Constitution in that: the maximum detention is not to exceed 24 hour (a person ought to be taken to Court as early as possible) and in a case where their is no Court within the radius of 40kilometer of the agency (excluding weekend).
It is constitutionally wrong to make an arrest in order to conduct investigation. It is after the agency had conducted it's investigation and is convinced that a suspect has a case to answer that it is logical and legally permissible to make an arrest.
It is wrong for an agency to beg the court to allow him perform it's Constitutional duty to investigate or detain and for the Judge to extend the time within which an agency is to bring a suspect/accused before the court for his trial (for the agency to conduct investigation). The only to the agency can do with a suspect at the time of their investigation is to invite him if need be.
It is therefore most important for the Nigerian Law Enforcement Agents to be enlightened on how to conduct investigation, the fundamental human right, the breach and the importance to human society in order to meet up with Law Enforcement Agencies in Developed Countries.

The continous detention of this people is illegal, unconstitutional and utmost violation of their constitutional rights.
This EFCC has only being behaving either ignorantly or being challant.
Any Law Enforcement agent has a constitutional right to arrest and most minimum opportunity to detain within 24 hours (being a worst cenerior) and in exceptional circumstances of 48 hours when their is no Court within the radious of 40kilometer of the agency, as vide in Section 35 of the Constitution (weekends not inclusive).
A Judge granting the agency more time to detain a citizen more than the Constitutional limit only display his ignorance and such Judge ought to be dismissed for gross incompetence (the exercise violating the ground norm called the constitution.
Arrest ought to be the last step an enforcement agent will carry out but in Nigeria it is the first. Even on frivolous allegations without preliminary investigation agencies arrest in Nigeria.
This agencies need to be taught the importance of fundamental human right.
