The Independent  National Electoral Commission, INEC, yesterday postponed indefinitely the Anambra Central senatorial re-run election scheduled for Saturday, March 5, 2016.

Announcing the postponement at stakeholders’ meeting at the Professor Dora Akunyili Women Development Centre, Awka, the state Resident Electoral Commissioner, REC, Dr. Lawrence Azubuike said this followed a court order obtained by the Peoples Democratic Party, PDP, that it should be included in the exercise.

Though, the REC did not elaborate, Vanguard gathered that a Federal High Court, sitting in Abuja on Monday ordered INEC to include the PDP in the rerun election.

INEC bars PDP
INEC had barred the PDP from participating in the rerun poll following a Court of Appeal judgment of 7th December, 2015 nullifying the election of the party’s candidate, Mrs. Uche Ekwunife in the national assembly election held on March 28, 2015.
Curiously, March 5 will be the ninetieth- day as the Court of Appeal had on December 7, 2015 directed INEC to conduct the rerun within 90 days without PDP participating.

But the PDP approached the Federal High Court sitting in Abuja, praying INEC to include it in the rerun. The PDP prayer was granted on Monday, thus necessitating the postponement of the poll indefinitely by INEC.

Reacting to the judgment, the candidate of All Progressives Grand Alliance, APGA, in the rerun election, Chief Victor Umeh described the Federal High Court ruling as absurd.

According to him,  the principle of law is that every decision of the court above should bind on all courts below, arguing that a Federal High Court could not assume jurisdiction in a matter already decided by the Court of Appeal.

He threatened to drag the Federal High Court judge that presided over the matter to the National Judicial Commission, NJC, for what he described as ‘brazen impunity and misapplication of the law’.

Umeh accused the former governor of the state, Mr. Peter Obi of being the mastermind in all the plots against him, insisting that “we shall crush him and all his evil plans.”

Though PDP has not officially announced its candidate for the re-run, it was gathered yesterday that former Governor, Obi is being positioned as the PDP consensus candidate.

Former Commissioner for Information, Culture and Tourism during the Obi administration, Chief Joe-Martins Uzodike told reporters in Awka that Obi would be persuaded to join the race.
He said: “Top PDP members have been mounting pressure on Obi to contest the senatorial election and the former governor has no option but to oblige. PDP is yet to submit the name of its candidate for the election and we are pleading with Obi to run.

“We know that once he is chosen as our candidate, he will win the election in view of his popularity in the zone and in the entire Anambra State.”
But the national chairman of APGA, Chief Victor Oye described PDP’s plan to draft ex-governor Obi into the rerun poll as a wishful thinking, adding, “we are not afraid of any person in this election as we have the capacity to crush any candidate.”

He also argued that since Obi did not participate in any primary of PDP, he is therefore not even qualified to take part in the re-run election.

Coalition welcomes postponement
Meanwhile, a group which calls itself the Anambra Central People’s Coalition welcomed the postponement, arguing that it was not the first time INEC would postpone election after fixing a date.

In a statement signed by the coordinator, Elder Emeka Anazulike, women leader, Mrs. Rosemary Okeke, among other people, the group wondered why INEC should rush the election when there were still some unresolved issues pertaining to the election.

“The postponement will give equal opportunity to parties that are in court to put their houses in order before the re-run,” the statement said.
Despite the postponement, the APGA candidate continued his campaign yesterday in parts of the senatorial zone, asking the electorate not to be deterred by the statement that came from INEC.

Recalling materials
In another development, the Independent National Electoral Commission, INEC, has recalled all the materials already being delivered to Anambra Central senatorial election earlier scheduled for Saturday back to its headquarters following the indefinite postponement of the exercise by the commission.

It was gathered in INEC that the materials being withdrawn had no PDP logo on them and following the Federal High Court ruling directing INEC to include the party in the election, the materials had to be recalled.

Meanwhile, it was gathered yesterday that INEC has already appealed against the ruling of the Federal High Court directing the postponement of the election and inclusion of PDP in the exercise.

Following the development yesterday,, many aspirants started putting up their posters in parts of the senatorial zone.
Some of the candidates who spoke on the matter expressed happiness that they would have more time to campaign.

The supreme court has no jurisdiction over national assembly elections. They don't even have the right to hear the case. The decision of the appeal court it final.
this is a preelection matters which should not even be entertained by the tribunal in the first place.

if the national assembly election matters got to the supreme court, majority of the cancelled election would have been reversed. Even if the appeal court doesn't entertain it, the supreme court will do the needful.

The Court of Appeal sitting in Enugu, yesterday reserved ruling for Thursday March 3, 2016 on an application asking the court to set aside the judgment of December 7, 2015 which nullified the election of Senator Uche Ekwunife. This development has added to the
controversy trailing the Anambra Central senatorial election rerun . The rerun is expected to hold on Saturday March, 5, 2016.

However, in event the application is sustained by the five-man panel of justices led by Justice H. M. Ogunwimuji, the fresh election already scheduled by INEC may be put on hold. This is also coming after a Federal High Court, sitting in Abuja had ordered INEC to include PDP on the ballot for the coming polls. The Appellate Court presided over by Justice A.H. Yahaya had last December ordered the Independent National Electoral Commission, INEC to conduct fresh election in the senatorial zone within 90 days after nullifying the election of Ekwunife on the basis of improper nomination and sponsorship by her party, the PDP.

But dissatisfied by the judgment and following other judgments by Appeal Court sitting in Abuja as well as the Supreme Court to the effect that issue of nominations and sponsorship of candidates should not be entertained by the tribunal, Ekwunife had returned to the appellate court asking that the judgment ousting her from office be set aside insisting that allowing it to stand would amount to grave injustice. However, at the hearing of the application, Counsel to Ekwunife, Alex Izinyon in his submission said the judgment ousting Ekwunife remained a nullity as the court lacked jurisdiction to look into the issue of nomination and sponsorship of her candidacy more so when the same court upheld the elections of Senator Andy Ubah (Anambra South) and Senator Stella Oduah (Anambra North) despite coming from the same “legal embryo”.

“The issue is that we are saying that the court of appeal having decided issue of nomination and sponsorship of candidate as the main issue nullifying the election of Ekwunife, they had no power or jurisdiction to go into that area at all, therefore, if that’s the case, the judgment they have given relating to that is a nullity and should be set aside. “We are not saying review it, we said they had no power to go into that one because that was the summary of the issue that was determined in that judgment. The other two senatorial districts came up and they were decided the other way round, why should it be an exception, they came from the same legal embryo, same primaries, same political party. “Therefore, there was no basis for that judgment against her; now we also said that since the issue has been settled even by the Court of Appeal in Abuja on the Taraba matter.

“When it is sponsorship and nomination, it’s a no go area for the tribunal and it’s been affirmed by the Supreme Court. So, this is the issue,” he said. On the issue of 60 days as provided in the Electoral Act as a period within which election appeal matters must be dispensed with, Izinyon said the issue at hand had nothing to do with election, insisting that “in law when the law says 60 days, it has to do with when you are doing election appeal proper. We are saying here that there is no issue about election appeal, The issue before the court now has nothing to do with election, we are not talking about 60 days”.

Two things may happen
1.It is assumed APC doesn't present any candidate in the election. Since nomination of candidate is over. APC can't replace him. Our constitution never forsee o situation like this. The election is just half way. No winner has been declared yet.
2. It is not a candidate that is been voted for, but a party. If that's d case, the deputy can stand in his place or the runner up in the primary election of the party.

He is a perfect symbolism of the acclaimed ‘can do’ Nigerian spirit. His life is a testimony of the basic principle of life that with determination, man can achieve anything. His life story embodies the maxim that nothing is impossible for the willing heart. All these virtues, and many more, cooperated together to make the life of Oba Sunday Ajiboye, a lawyer-turned-first class king, the Onisan of Isan Kingdom in Oye Local Government Area of Ekiti State, sparkle like diamond. An award winning author, the royal father stood tall recently as President Goodluck Jonathan bestowed him with the national award of Member of the Federal Republic, MFR.

A classical zero-to-hero story, Oba Ajiboye, as a child, had a long-running battle with poverty and a terrible sickness that stunted his growth and almost deformed him, threatening his future. Although many were the childhood afflictions of the royal father, he overcame them all. After becoming Oba, he had to endure school life to bag his Master’s degrees and later qualify as a lawyer. He never allowed royalty to jeopardize his childhood desire of becoming a lawyer. Now, he wants to surpass his own expectation, and raise the bar for himself. “I want to have a PhD in Law,” he tells ICON when asked his yet-to-be fulfilled ambition.

Born close to 60 years ago, the monarch, as a young boy, had to stop his education after his elementary school which he started in Ikere-Ekiti, rounding it up at his homestead, Isan-Ekiti, also the home town of the state’s governor, Dr. Kayode Fayemi.

Since his poor parents could not afford the meager fees required for his secondary education, he dropped out and reverted to the farm for a period of time. When the fortunes of the family picked up a little, he returned to school, Ajayi Memorial Modern School, Ayede-Ekiti, near his town. He worked for a brief period before proceeding to Ekiti Divisional Teachers Training College, Ikere, “which was free, being under the Universal Primary Education Programme (of the ruling Unity Party of Nigeria, UPN, in the old Western Region).” And because trainee-teachers were also being paid N80 monthly at the time, he was able to save enough money to enroll for his General Certificate of Education, GCE.

After scaling that hurdle, he taught for three years in a secondary school before proceeding to the College of Education, Ilorin, Kwara State, for his National Certificate of Education, NCE, in English and Fine Art. “I taught for a while after this before I proceeded to the University of Ilorin to study English Language/ Educational Technology,” Oba Ajiboye says. “I was already on the throne when I went to the then Obafemi Awolowo University in Ile-Ife for my Master’s Degree in Education Administration and Planning.

“I put my crown in the palace, with all the paraphernalia of office, to pursue my Master’s Degree programme at Obafemi Awolowo University, Ile-Ife. After my Master’s Degree, I started pursuing my PhD but having been faced with local politics in the university among the lecturers, I had to leave. Despite my chain of degrees, I had no job satisfaction because it appears I had not reached my destination.”

In 1999, he enrolled for Law at the University of Ado-Ekiti, now Ekiti State University. That initial attempt ran into a brick wall. But after concluding all registration procedure, he was told pointblank that he could not continue.

“I was screened out as having not qualified to read law,” he says. “Professor Akin Oyebode just said ‘Kabiyesi, I’ve seen and admire all your series of degrees. But, I’m sorry, this faculty cannot admit you to read law because you are deficient in mathematics. You didn’t pass mathematics and mathematics is a prerequisite for any intending student who wants to read law in this faculty.’ That was how he quietly returned my credentials to me and said ‘bye-bye, good luck.’

“In all, we were 12 that were turned back. The remaining 11 decided to go to court but I refused to go to court even though I felt cheated because mathematics was not advertised as a pre-requisite when the form was being sold. Even mathematics was not specified as a prerequisite in the JAMB Brochure. I decided not to go to court because since he is the Vice-Chancellor of the University, and the founding father of the Faculty of Law, he knows best.

“In 2000, with all degrees, I went back to write my mathematics O/level. One funny thing about the whole episode is that, eight of those teachers who supervised me when I was writing that O/Level exam were my students at University of Nigeria, Nsukka, Ikere Campus. I can’t forget that. They were taken aback when they saw me. Some wondered why, with my personality, I was sitting with them to write O/level mathematics while some others were saying that ‘could this mean that this Kabiyesi (his majesty) was not qualified to teach us, or what?

“In fact, one Mrs. Olayisade from WAEC, whose husband was also working in WAEC office in Akure, said ‘Baba why don’t you leave the rest of the exam for your children?’ But immediately she recognized who I was, she knelt down, right there in the exam hall. Every candidate writing the exam started looking at her. So, after finishing that examination, all the teachers converged to greet me, to extol my determination. To God be the glory, when the result came out, I passed brilliantly.

“So, I my mathematics and other papers back to Professor Akin Oyebode to show that I had passed the deficient paper. He shook my hand and said, ‘this is the type of person I am looking for in this University.’ So, I was offered admission to study Law. I read Law and passed with second Class Lower. I went to Law School and eventually I was called to bar. Still, I wasn’t satisfied with LLB, BL, so, I pursued LLM. Again, to God be the glory, I have finished my LLM (laughs).”

Moral? Never say ‘never’! And when there is a will, there is a way.

“Once you are determined in life,” the royal father enthuses, “there is nothing you will not be able to achieve. When there is a strong will to achieve, the sky will not be the limit, it will be your stating point. I believe in honest hard work. I teach my children the virtues of honesty and hard work. I used to tell them that if, for instance, I want to read medicine now, I can go back to JSS 3 and pick-up all the sciences and still go back to read medicine. There is no age limit.  This is what I keep telling them. Education is what you acquire from the day you came into this world till the day you say bye-bye to this world. It is a continuous exercise. I am still planning to go for PhD in Law. Now, I am a student of the National Open University of Nigeria, NOUN, undertaking a M.Sc. programme in Peace Studies and Conflict Resolution”

My Topic was changed twice. I did a very tough research work and was eventually awarded a distinction by the lecturer. NOUN students thesis and project work are being supervised by qualified lecturers from federal universities. Those lecturers can attest to the quality of NOUN graduates

NOUN is not the school for lazy people. Thousands of students in NOUN absconded when they saw the rigour, discipline and the seriousness of NOUN. When i was pursuing my BSC programme in a conventional university, i did less reading compare to that of my post-graduate programme in NOUN.

So many graduates of NOUN are admitted into conventional universities for their masters and PHD. I have personally introduced NOUN to so many people. If you are not there, you can never know what it entails.

The Imo State Governorship Election Petition Tribunal sitting in Owerri tuesday foreclosed the Independent National Electoral Commission (INEC) and 35 other respondents for failing to file their reply within the allowed time-frame in a petition filed by the Governorship candidate of the Peoples Democratic Party (PDP), Chief Emeka Ihedioha.

The counsel representing the 1st respondent, Chief Adeniyi Akintola (SAN) noted that the parties were not properly served, and that the All Progressives Congress (APC) supposed to have been served in her headquarters in Abuja instead of Owerri.

Aligning with that submission, the 37th Respondent (APC) counsel, Chief Nelson Ezerioha observed that the service to the client was fundamentally defective and therefore null and void, stating that in that circumstance, no motion could be moved until all the necessary services were duly concluded.

While the 15th respondent, Robert Okwuego, who was the APC agent in Oru East during the governorship election, said that he had not personally served, the counsel for the 13th and 14th respondents, S.N. Nnadi admitted that his clients were duly served and was ready to go on with the matter.

Counsel to the Petitioner, Chief Mike Ahamba (SAN) objected the submissions of the respondents, noting that such amounted to eroding of justice and urged the tribunal to go on with the pre-hearing session having had parties put on notice through the pre-hearing questionnaires which they had dully answered.

He further observed that the ‘antics’ or delay tactics employed by the respondents in the matter does not promote “nobility and honour” on the part of the counsels to the respondents, and therefore urged the tribunal “to avoid case management and proceed to case hearing”.

In his ruling, the tribunal chairman, Hon. Justice David Wyom over-ruled the respondents’ counsels, stating that once the parties have been served whether at the headquarters or her branch office, it was service duly done.

The tribunal also ruled that having duly served the respondents, that is, INEC and 34 others (2nd to 36th) and having failed to file their replies on time, they are therefore foreclosed in the matter.

I agree. In concept "killing PDP" doesn't mean slaughtering the members; but some of these illiterates could interpret it that way which could be disastrous. I think Buhari needs to be more cautious of his utterances now.

Information To Graduands

A)     All those who have completed their programmes and have been cleared for convocation are to sign for and receive academic gowns and guest invitation cards from their Study Centres with effect from Thursday, 8th January, 2015. The accompanying hoods are to be collected from the University’s Headquarters in Lagos from Monday, 12th January, 2015.

They are required to present the following for sighting at the points of collection of the items:

i)       evidence of the payment of a fee of N10,000.00 for the use of Academic gowns payable at Skye Bank; Account No. 1770364597.

ii)     evidence of payment of alumni fees (N5,000.00) payable at Skye Bank;  Account No.1770364597

iii)     evidence of payment for Regularisation of Admission fee (N6,000)

iv)     duly completed clearance form

The sum of five thousand (N5,000.00) Naira will be refunded on the return of the Academic gowns and hoods.

Both items must be returned not later than Tuesday, 20th January, 2015 from 9:00a.m. Failure to return the gowns by the prescribed date shall attract a fine of N1, 000.00 per day.

All Graduands are required to pay the sum of two thousand Naira (N2,000.00) only for the convocation programme at the venue on Saturday, 17th January, 2015.

B)      Graduands are requested to assemble at designated location(s) at the National Theatre on Saturday, 17th of January, 2015 between 6:30 a.m. and 8:00 a.m.  They must be fully robed and on a queue according to their Schools.

NOBODY, INCLUDING GRADUANDS AND THEIR PARENTS/ GUARDIANS, WILL BE ADMITTED INTO THE HALL, AFTER 9:00A.M.

C)     Commercial Photographers/Video Operators will be charged five thousand Naira only (N5,000.00) to operate at the venue for the period with exception of Hall I.  All those interested in functioning as Photographers/Video Operators are required to make payment to the Cash Officer in the Bursary of the University between 9:00a.m and 3:00p.m from Monday, 12th January, 2015. The receipts issued should be presented at the Media & Information Unit where the certificate of accreditation will be issued.

D)     All Graduating Students must wear the prescribed academic gowns. The Security officers will strictly enforce the “No gown No entry” policy

No form of luggage or handbags will be allowed at the arena.          Graduands are advised, without exception, to comply with    this information.

To access the Convocation Arena a graduand is requested to present a tally which bears his/her School name and a number. The    tally will be distributed at the entrance on a “first-come- first-served” basis

It is a breach of Security to find a graduand seated in Hall I without a tally assigned to him/her.

All guests of the University (properly identified with their Invitation cards) are to be seated in Hall I not later than   9:30 a.m. All other guests are to be seated in Hall II

     a.     Three (3) parking lots have been provided for use at the Theatre Complex. Guests are to be parked in areas indicated in their Invitation cards
     b.    Towing Vehicles are available on standby to tow away   any vehicle parked on the roadside or places  outside the designated parking lots.

 

GRADUANDS ARE NOT ALLOWED TO LEAVE THE CONVOCATION VENUE BEFORE THE END OF THE CEREMONY. GRADUANDS ARE STRONGLY ADVISED TO COMPLY WITH THESE ARRANGEMENTS.
