which means they cannot be questioned about any decision they make concerning the naira notes? because I know that the cbn has a legal department and they must have gone through all these details before embarking on this project.
I think not really, because the constitution also spoke about the Naira in particular. Whether they can seize to recognize any Naira as legal tender is what I don't know. That's exactly why they're in court.

APC will have nothing less than 80% in Oyo, but may still lose the election. PDP will win state election in landslide

Based on the Supreme Court injunction, they are by law. Once the injunction is vacated, then they are not. It's a temporary injunction, so I don't see the reason for argument here. Since he's party to the case, then it's binding on him to follow it.

I see...

Therefore, the Supreme-Court order was for the FG to halt its supposed POLICY,, no matter which Independent Institution is implementing it.

Ok.
it's very clear now.

So,, back to the main topic.
Executive Order??
Or Supreme-Court Order.??

Which One Supercedes?
The supreme court interprets the law, and can only cancel an executive order if it's against the constitution which is the supreme law of the land. That is exactly what is being determined, the legitimacy of the naira withdrawal.

This is not necessary. Governors openly disobeying the Commander-in-Chief is reasonable felony.

Today El-Rufai wants to help us ordinary people to defend democracy by disobeying the president and the CBN acting within its own constitutional provision.
Ha! What's this again. I'm not even sure you know what felony is.
Politics / Re: Elrufai Vs Buhari: Declaration Of State Of Emergency -the Constitutional Pathway by Upworkwriter007(f): 4:56am On Feb 17, 2023
The president's order automatically comes to effect the moment the supreme court injunction expires and it'll def expire before April 10. So no need to write all these stories. This issue has shown the level of emotionalism and illiteracy in Nigeria.

BTW, the president gave till April 10 to deposit 1000 and 500. He only ordered that it shouldn't be recirculated and only the 200 should be. Soo, I don't get the fuss here. Or did I miss something.

Talking about the Independence of the CBN,,
The CBN is as Independent as INEC.

If you sue the FG based on the things which INEC did, and you didn't include INEC as part of the defendants, then you really didn't sue INEC.

Same thing with the CBN.
CBN is independent.

..
Then,, talking about the Supreme-Court Order..
I think I understand what you're trying to say.

BUT THEN,, THERE ARE DIFFERING VIEWS ABOUT THAT HERE ON THIS THREAD..

SO,, I NEED TO BE BETTER CONVINCED.

I NEED TO KNOW WHICH ONE IS THE ABSOLUTE TRUTH, AND NOT BASED ON PERSONAL-OPINIONS AND BIASES..
Guess what? Even the FG and CBN didn't make this defense in court. Do you know why? On this matter, the CBN is executing the policy of the federal government. Omo, which kind thing I dey see for Nairaland. grin grin grin grin

Nothing supercedes a presidential executive order. It can only be revoked by the president himself if it is deemed to be grossly unconstitutional.

Presidential executive orders are final.

For the number 3 question, the executive and judiciary are equal, but the head of the executive (president) supercedes all in the land.
What's this? Soo if the supreme court orders the president to vacate office, the president can easily issue an executive order? Which clowns are these? Ha! Supreme court can even remove buhari. The fact that buhari is publicly issued a decree automatically makes him guilty of contempt of court. Omo, the kind of things people say on Nairaland shocks me.

the most sensible question people should ask these governors is that if eventually, the supreme court rules in favor of CBN and fg and cbn refuses to accept the old notes, will these governors bear responsibility for the naira in their states?
Actually, constitutionally, all notes ever issued by the CBN remains the property of the CBN at all times.

President Buhari has declared 500 and 1000 illegal and that decision stands!!!.

It's very unfortunate that there is nothing state governors can do about it, they will only succeed in deceiving their followers ..

Those governors who are daring Buhari will end up complicating issues for their citizens, putting the citizens to more pains and agony, thereby making them to hate APC more..

All Banks across the Nation are working with CBN, and follow instructions from Emefele..

So after telling your citizens to use the old notes , where would they deposit the money at the end of the day, the same bank that is under CBN that is currently rejecting old notes?

No wahala, he should create central bank of Jigawa then, but a wise business man can never engage in that kind of business suicide..

Only uninformed idiots who will still turn around and rebel against the same governor tomorrow can be deceived with such lies

Urchings should also move to Kaduna and Jigawa too.. grin grin grin grin

I think you're the uninformed one here. CBN orders cannot be canceled, changed, altered by Any executive or legislative action. Supreme court orders automatically becomes binding even if those laws are made in error. In an instance where it is, then only the supreme court can alter itself. If this is not so, then supreme court can rule on election matters and they'll simply choose to ignore.

How does 40% of Nigerians without a bank account endure? Also, for how long? The problem is that we don't know when it'll end. If we do, it'll be easier.

You don't understand. 40% of Nigerians don't have a bank account. Most people live on the 1k 1,500 daily labor pay, dropping 500 naira for their wives to cook stew per day. How do these people survive. How do they adapt? Stop being myopic. People are really hungry.

What does INEC need cash for? What kind of logistics payment that runs in millions that INEC cannot pay using e-channels? Nigerians should just end all this obsession with cash!

Mahmood should not fail and blame it on cash (CBN). If anyone should be complaining about cash, it should be village people, bus drivers and market women who handle small amounts of cash, not men like INEC chairmen who control millions of naira.
INEC Pays a lot of people in cash, without it, this election can't hold.
