Sylva situation is different from Jonathan situation. Jonathan succeeded yaradua after he died and was elected in the following elections. In sylva case, he came second in gubernatorial primary election that Jonathan won in Bayelsa. Jonathan was nominated as VP then and Sylva was given the party ticket to contest the governorship election which he was elected.

A new election was held on May 24, 2008, and Sylva, again running as the PDP candidate, was overwhelmingly elected with 588,204 out of about 598,000 votes.[9] He was sworn in again on May 27, saying on this occasion that he would form a broadly inclusive unity government.[10] On January 27, 2012, his tenure was terminated by the Supreme Court with an acting governor appointed to oversee the state until the election of February 2012.

So coming out to contest now will go against the constitution which state: A governor can only be elected twice.

In this case,there is a constitutional clash here.The accumulated period sylva has spend in power is 5years, constitutionally he is entitled to eight years max,will he be infringed off his remaining entitled 3years? Only time will tell but I think he has a case here.

Although APC tried to test the law retrospectively against Jonathan in 2023 but the Federal High court cleared him.

Ideally such law should become active for people and events that happens after it was passed.
