The usual question asked by an employee whose appointment is terminated is why his appointment was terminated without his employer giving him any cogent reason for doing so notwithstanding that he has served the company diligently for a long period of time. This engenders writing of this article to explain the reasons why employers terminate the appointment s of employe es in Nigeria without giving any reason .
To be candid, employees in a private establishment in Nigeria are working at the mercy of their employer s . The employer s adopt the Yoruba adage that says, ‘ ila kii ga ju onire lo’ meaning t hat no matter how tall okro plant is , the farmer bends it with ease to pluck its fruits’ . This brings us to the legal perspective of an employer vis-à-vis employee relationship in a private employment.

Type of employment
There are two types of employment:

3. Employment with statutory flavo u r

Difference between Employment without Statutory flavo u r and Employment with statutory flavo u r
This difference is clearly explained in the case of C.B.N V. Igwillo (2007) All FWLR part 397 Sc page 1385 at pg 1401 para c as follows
‘ an employment is said to have statutory flavor when the appointment is protected by statute or laid down regulations made to govern the procedure for employment and discipline of an employee. Any other employment outside that category is govern by the terms under which the parties agreed to be master and servant ’
The import of the decision of the supreme court above is that an employer in a private employment is the MASTER while an employee is the SERVANT. So, the relationship between the employer and employee in a private employment is regulated largely by their terms of contract.
These terms of employments are contained in the policy of the company. Even though the terms the rein are solely drafted by the employer withou t the employee’s input, yet once he accept s and sign s the offer , then it becomes binding on him .

What if the terms are one sided and harsh on the employee?
No matter how harsh a law is, it will remain a good law until it is repealed. It is not the function of the court to rewrite an agreement for parties but rather to give effect to the letter and spirit of the agreement. If an employee agree s with his employer that he will be working for 22 hours in a day, so be it.
Can a dedicated employee’s employment be wrongfully terminated without any reason?
Can court order reinstatement in an employment with private establishment?
A fri end of mine working for a private firm called me some months ago and he was very sad when he narrated his ordeal. According to him he has been working for a company for some years and he was very dedicated. He said that he had the feeling that his employer wanted to wrongfully dismiss him. He asked me what were his rights because he had done a lot for the company. I told him that I don’t know but what I do know is that his emplo yer has the right to dismiss him for no reason at all. He asked me if I was kidding then I told him that if I was kidding then I learnt it from the Supreme court case of Ativie V. KNL (2008) vol 8 MJSC 82 page 99 para G-A where the court held as follows:
“the law is settled that the court will not compel an unwilling employer to retain any worker. Similarly, an employer is not bound to give any reason for terminating the appointment of a servant where such employment is not one with statutory flavour ’

What is the difference between wrongful dismissal and unlawful dismissal?
The dismissal of an employee in a private establishment can only be, at worst , wrongful, which can lead to award of damages against the employer, however, the dismissal can never be unlawful which can lead to reinstatement.

Reasons why employers in private companies prefer to dismiss their employee without giving reason.
It is safer for an employer to terminate the employment of an emplo yee by simply stating that his service is no more required than stating the reason if it borders on allegation of fraud or any criminal matter. This is because if an employee is alleged for any criminal related matter he must be given fair hearing to explain his own side in line with provision of the constitution. This is to avoid future litigation as to whether the dismissal is wrongful or otherwise .
However, where the employment policy of a company provides ways and procedure of terminating the employment of an employee then that must be followed.
The only remedies availab le to an employee of a private company that is wrongly terminated are damages, his benefits in the company and arears of salary if there is any.

EMPLOYMENT WITH STATUTORY FLAVOUR
Most of the civil service employment is with statutory flavo u r which means that the appointment is protected by statute or laid down regulations made to govern the procedure for employment and discipline of an employee.
Where a civil servan t’s appointment is unlawfully termi nated without following the laid down procedure, the court will order reinstatement of such an employee in addition to award of damages against his employer.
When can a dismissed civil servant seek redress in court?
Seeking redress by a civil servant against unlawful dismissal has time limitation. Once it is a day longer than 3 months after the termination of his appointment then the action is statute barred. This means that his case could not be entertained in court and it is bound to be dismissed if filed in court. This is the provision of section 2 a of public officers’ protection Act :
4. Where any action, prosecution, or other proceeding is commenced against any person for any act done in pursuance or execution or intended execution of any Act or Law or of any public duty or authority, or in respect of any alleged neglect or default in the execution of any such Act, Law, duty or authority, the following provisions shall have effect ‑
Limitation of time.
(a) the action, prosecution, or proceeding shall not lie or be instituted unless it is commenced within THREE MONTHS next after the act, neglect or default complained of, or in case of a continuance of damage or injury, within three months next after the ceasing thereof:

In conclusion, it is clear from the above that the employment of a civil servant is pro tected by law while the relationship between employers/ employee s in a private company is regulated by their agreement.

But what we do at ministry of trade mark is entirely different frm wat is done at CAA.
Trademark registeration deals with registaring the products u sale in ur company.
The name u use to register those products is what is refered to as trademark, wich is a unique destintive name or logo u claim fr ur products n no one else is allowed to use it except u.
For example coca cola is a companys name registered wit CAC, pepsi is a product of cocacola company registered as a trademark in ministry of trade and investment. The name pepsi n logo is registed to that company so no any other campany can use that name fr der products.

The concept of tithing is directly against the spirit of love. It is anti-intimacy. The first time I read in Genesis where Jacob told God that he would give Him ten percent of his income if God did all that He had promised Jacob, I remember getting a sick feeling all over my spirit. It actually made me laugh out loud. I thought to myself, “This guy is both stingy and stupid.” First of all, God is telling this guy that He is going to give him all this stuff, and bless him with blessings bigger than anything anyone has ever seen. Then the guy has the audacity to say, “If you do this, I’ll give you ten percent back.” It just comes across as silly to me.

Could you imagine if my wife and I had separate bank accounts and whenever I got a paycheck, I put ten percent of it in her account and the other ninety percent in my account? When we dated, we had separate bank accounts, but when we married we share an account. Everything I have belongs to her! I don’t give her ten percent of anything; I give a hundred percent of everything. There simply is no “hers” and “mine” in LOVE.

I think the very concept of paying ten percent to God is an anti-intimacy mentality. It’s like having a business relationship with God. All accounts are separate, and at an allotted time, you pay Him for blessing. In my book “The Misunderstood God” I basically show that modern-day Christians believe God is a mafia godfather whom they pay for His protection. This is indeed how thousands of Christians view Him today. Nothing could be further from the truth about God’s heart.

The entire concept of tithing in today’s church is based on our carnal nature. We’re taught to do it or bad things will happen to us. Most people I know who participate in tithing, do so out of fear of what might happen if they don’t. Many others act all happy and excited about tithing because of all the financial blessings they claim they’ve received since they started. It’s a mine, mine, mine attitude that works ONLY on a loveless generation. To a person who loves however, 10% is offensive. Giving to get is insulting. The concept of “seed faith giving” or even "giving in faith" sounds crude and selfish. Love does not keep track of what’s given. This is precisely why Jesus said "don't let your right hand know what your left hand is doing." You can't follow Jesus' words and still be a tither.

I’ve also found that when a person loves people, they are less likely to take 10% of their income and pour it into an institution that eats up the first 85% of that money on expenses, and ends up having 15% left for helping hurting people. Lovers of people usually see right through this, and they decide to cut out the middle man and give directly to the people who need it.

One of the latest statistics on tithing in America shows that about 8% of Christians pay their tithe. Most pastors will tell you that this is a sign that people don’t love. I disagree. I think this is a sign that people DO love. Church is simply not set up for a giver to receive their blessing as they give. There is no feeling of blessing when you drop money in an offering plate that speeds by you and disappears into an office. I’ve found that when people give to people, they’re inspired and blessed right then and there, because the intimacy of such an act is inspiring. That’s real difficult to get, when your money is being put into a machine.

You don't need a series of bible verses to prove that tithing is Old Testament and not for today. Just look at someone you love with all your heart and imagine telling them that you will only bless and protect them if they give you 10% of their income. Look at one of your children and imagine making that deal. The very thought of such a thing is sickening. You don't need biblical proof of something you already know.

Love proves it.

Though not to start any argument of sort, but felt i post what i find blessed about been free from tithe.. under the new covenant. hope it blesses somebody.

The Tithing Dilemma
I recently had someone email me, asking me what scriptures I could produce that would prove that tithing is an Old Testament law that no longer applies to the New Testament. Though there are many scriptures that can prove this point beyond a shadow of doubt, I chose not to give them to this man. In fact, I rarely give scriptural references to back up the things I preach or write about. If I am right about the things I say, it should speak for itself. The truth of my words should stand on their own. This is especially true when it comes to the subject of tithing. I honestly feel that any Christian who has love in their hearts can simply reason their way through the idea of it, and come to the conclusion that it’s not New Testament. The reason why so many Christians today need a bible verse to back up something is because they don’t have love in their hearts; and hearts that are void of love, are blind.

Imagine, you’re standing outside of a beautiful three-story mansion that is owned by God Himself. Way up high on the third story is a window. Behind that window is a room full of all the blessing. Now imagine you have a hundred pebbles in your pocket and it’s your job to hit that "blessing window" with ten out of a hundred of those pebbles. Once the tenth pebble hits the window, the owner of the house comes and opens the window and pours out blessing on you.

This is obviously a picture of tithing as we have been taught in Church today.

The difference between the Old Testament and the New, is that now YOU OWN THE HOUSE! Not only that, but your room is the blessing room, and you’re the one in charge of opening the window and heaping out blessing. You’re still standing in front of the window, but now you’re on the inside looking out. People in New Testament times look pretty silly standing on the inside of that window hitting it with ten of their pebbles waiting for it to open.

You might be asking, “Well then how do I get the blessing for myself?”

This is the part that is invisible to the vast majority of Christians today. In the Old Testament, God would bless someone who gave. If they gave a gift to someone, they could go home and wait for a blessing to come to them. God was teaching them that there is a blessing that comes with giving. He was preparing them for the New Testament times when giving IS the blessing.

Sadly today, because so many Christians don’t love, they give, and then wait for a blessing to come back to them just like the Old Testament people did. They don’t feel the blessing in giving because they don’t love the person they gave to. When I give my wife a new dress or a piece of jewelry, I don’t walk around the corner and say to myself, “I can’t wait to see what kind of blessing I’ll get for this.” When I give to Angie, I walk around the corner and thank God that I was able to make her eyes light up like that. I thank Him for giving me the blessing of being able to touch her heart in that way. The moment it leaves my hand, I feel a shower of blessing all over me. When I see her face get excited and tears come to her eyes, I am blessed!

Sadly, today's teachings on giving and tithing are all based on selfishness. It’s heartbreaking to hear people exchange the beauty of giving for something so ugly and self serving. It’s sad when people today give with the mindset of planting a seed. It’s no longer giving when there’s something in it for you. It’s also sad when someone says that they give because God told them to. God shouldn’t have to tell you to give. If you love, you’ll give no matter what. I have found that all modern-day Christian mindsets concerning giving are based almost one-hundred-percent on a loveless give-for-gain mentality.

If you are changing your own oil, remember to keep track of the mileage and date, so you know when it’s time to do the next service. Otherwise, you’ll be trying to remember the exact date and mileage of your last change, or you may forget to do your oil change altogether.

1 contact the country embassey where the university is located. ask them relevant questions ? at times the embassey may request for an official letter for that purpose and a little amount of cash. pls do it .it worth it.

2 consult ministry of education in abuja . at times school may be accredited in her country but unfit for nigeria education standard. mary abacha uni in niger is a typical example. this might also cost you. do it. it is better

3 ensure the institution program is accredited by relevant authourity where the school is located. make the use of website to checj on agency responsible for validating schools programs. eg in the germany FIBAA is the only responsible agent to vaiidate business course.

lastly. make sure , you document are valid (i.e)waec ,passport and other traveling document are intact and free of fraud. this might be an obstacle for you to proceed into nysc after you complet your degree if there isa little suspect of fraud, ASK ME ANY QUESTION ABOUT STUDY ABROAD

6. Do not drive away when You are Stopped:
If you have nothing to hide, DON'T drive away when police stops you on patrol or at checkpoints. If you flee, they may think you have motive or armed. Even if you car papers are not up to date, it will be wise to wait and sort it out than ending up in the hospital or the morgue .

10.When You Hear The Police Siren Move Out Of The Way:
The Nigerian police uses the siren to quickly get out of traffic on nigerian roads or to make way for them when they are transporting money. So when they are on their siren
and you dont move out of the way, they automatically see you as a threat and shoot at your car or brutalize you.
