TIMELINE AND EXPLANATION OF NEW CHANGES TO THE UK IMMIGRATION RULES!

For those who prefer a quick summary, the key dates and relevant changes to the Immigration Rules to be aware of are follows:

1 January 2024: UK Student Visa rules amended to prevent most international students from being accompanied or joined by a dependent whilst studying in the UK;
31 January 2024: Permitted activities for Visitors expanded, right to work conditions for Visitors amended to allow remote working, Permitted Paid Engagement Visitor route merged into the Standard Visitor route and new Appendix Bereaved Partner, Appendix Victim of Domestic Abuse and Appendix Statelessness introduced;
1 February 2024: Electronic travel authorisation (ETA) application process opened for nationals of Bahrain, Kuwait, Oman, the United Arab Emirates, Saudi Arabia and Jordan;
6 February 2024: Immigration Health Surcharge (IHS) will increase by 66%;
13 February 2024: Fines for illegal working will triple under a new Civil Penalty regime;
11 March 2024: Care workers (SOC code 6145) and senior care workers (SOC code 6146) will not be permitted to bring dependents to the UK and care homes in England will be required to be regulated by the Care Quality Commission (CQC) in order to sponsor migrants under the Health and Care Worker visa route;
14 March 2024: A new Statement of Changes to the Immigration Rules will be laid before Parliament which will replace the existing Shortage Occupation List (SOL) with a new Immigration Salary List;
4 April 2024: The minimum salary threshold for a Skilled Worker visa will rise from £26,200 to £38,700 per annum;
6 April 2024: The requirement to renew Sponsor Licences will be removed;
11 April 2024: The minimum income requirement for partners applying under Appendix FM will be increased from £18,600 to £29,000.



6 February 2024: Increase in the Immigration Health Surcharge (IHS)
The Immigration Health Surcharge is an upfront cost paid alongside the submission of (most) visa applications so that the individual is entitled to have full access to the National Health Service (NHS) whilst in the UK. There is no limit to how often one can access the NHS. Additionally, there is no option to opt out of the Immigration Health Surcharge even if an applicant believes that they will not use the NHS or would prefer to pay for private health care.

On 13 October 2023, the UK Government announced a substantial 66% increase in the Immigration Health Surcharge (IHS). A delegated legislation committee of the House of Commons approved the Immigration (Health Charge) (Amendment) Order 2023 on 16 January 2024. It has now been confirmed that the increase in the Immigration Health Surcharge (IHS) will take effect from 6th February 2024.

On 6 February 2024, the Immigration Health Surcharge is increasing for students, student dependants, those applying for entry clearance or leave to remain under the Youth Mobility Scheme, and applications made by children under the age of 18 from £470 per year to £776 per year.

For all other relevant immigration categories for entry clearance or leave to remain in respect of persons aged 18 years or over at the date of application the Immigration Health Surcharge is increasing from £624 per year to £1,035 per year.

11 March 2024: Changes to Health and Care Worker Visa Rules For Dependants
The Health and Care Worker Visa is open to qualified doctors, nurses and other health and adult social care professionals who wish to undertake an eligible job with the NHS, an NHS supplier or in adult social care.

Currently, all Health and Care Workers may be joined or accompanied by a dependent partner over the age of 18 and/or a dependent child under the age of 18.

However, from 11 March 2024, care workers (SOC code 6145) and senior care workers (SOC code 6146) will not be permitted to bring dependents to the UK.

Care workers and senior care workers already in the Health and Care Worker route will be able to remain with their dependants, including extending, changing employer (within the above SOC codes) and settlement.​

Where a care worker or senior care worker is in the route before the Immigration Rules change, but has not yet brought dependents, they will still be allowed to bring dependents during their sponsorship on the route.

Additionally, from 11 March 2024, care homes in England will be required to be regulated by the Care Quality Commission (CQC) in order to sponsor migrants under the Health and Care Worker visa route.

Care providers who were sponsoring workers in exclusively non-regulated activities (and therefore were not required to be registered with the CQC) before the rules change will be able to continue to sponsor these workers, including for extensions to their visa on those terms, but not hire new ones.

These changes to the Health and Care Worker route will be brought in on 11 March 2024 via a Statement of Changes to the Immigration Rules that will be laid before Parliament on 19 February 2024.

14 March 2024: Introduction of a New Immigration Salary List
On 14 March 2024, a new Statement of Changes to the Immigration Rules will be laid before Parliament which will replace the existing Shortage Occupation List (SOL) with a new Immigration Salary List.

The new Immigration Salary List will remove the 20% going rate discount to the minimum salary for shortage occupation roles.

This follows a recommendation from the Migration Advisory Committee (MAC), which will now advise the government on which occupations should be temporarily added to the new list.

Employers should anticipate a reduction in the number of occupations on the list, potentially impacting recruitment strategies in specific industries.

4 April 2024: Increase in Skilled Worker Minimum Salary Threshold
On 4 April 2024, the minimum salary threshold for a Skilled Worker visa will rise from £26,200 to £38,700 per annum and individual occupation ‘going rate’ thresholds will rise in line with the median full-time wage for equivalent jobs in 2023.

Those already on the Skilled Worker visa route before the Immigration Rules change will not be subject to the new threshold when they change employment, extend their stay or settle in the UK. The Home Office will, however, expect their pay to progress at the same rate as resident workers when they next make an application to change employment, extend their stay, or settle.

Those coming on the Health and Care Visa route will be exempt from the £38,700 salary threshold applicable to Skilled Workers, as will education workers in national pay-scale occupations.

These changes to the Skilled Worker route will be brought in on 4 April 2024 via a Statement of Changes to the Immigration Rules that will be laid before Parliament on 14 March 2024.

My employer got this, can anyone suggest what to do considering the delays with issuing new COS?

The UK Decision Making Centre is currently assessing the application submitted by the above named. We are unable to conclude the application at this time as we require additional information.

I note that C2G4xxxxxx is a Skilled Worker (Changes of Employment - ISC liable) [A rating] CoS and not a “Defined” CoS that is required for an application for Entry Clearance.

Hi Dee2016, your employer should withdraw the wrong CoS and apply for the right one immediately. Once they've applied for a new one, they should let you know the request number for this. You'll need to send this and evidence (screenshots) of your email conversations with your employer to DMC before the deadline. DMC are part of the UKVI and so know too well that a new CoS issuance takes time. DMC will give you time till you receive your new CoS and inform them of the new CoS reference number. Cheers.👍🏾

If your work requires it, your employer will request it and tell you the specific DBS level needed. Most employers apply for it on behalf of the candidate, while you furnish them with your documents such as your ID, proof of address, police character certificate etc.

Hi Mayowa94, I can see you desperately need a response to this query as you've posted it several times.

Firstly, the following are the SOC's related to data analysis - 2135, 2136 and 3539.
Secondly, all the above SOC's are eligible for the SWV however, only the first two are on the SW Shortage Occupations list.
Lastly, I wouldn't know what exactly your job/role entails, because that's what determines your SOC, but, if you deal in IT and would like to apply under the shortage occupations list, then you may want to use 2135 (as a "Data Communications Analyst" only). But if your role entails finance, or you write just Data Analyst, this may be regarded as 3539 instead, and is NOT on the shortage occupations list.

However, you may want to confirm from your prospective employer which SOC your job falls under. Cheers.😉

NEW VISA FEES SET TO COME INTO EFFECT NEXT MONTH, 4 OCTOBER 2023

The UK government have announced 'increases to immigration and nationality fees, to pay for vital services and allow more funding to be prioritised for public sector pay rises, are set to come into effect on 4 October, following legislation being laid in Parliament today (15 September).'

Skilled Worker visa:
Up to 3 years: £625(current fee) to £719(new fee)
Up to 5 years: £1,235(current fee) to £1,420(new fee)

Health and Care Worker visa:
Up to 3 years: £247(current fee) to £284(new fee)
Up to 5 years: £479(current fee) to £551(new fee)

we applied for a work visa from Nigeria in august 2022 ..in September the COS was out we applied for the visa in October and went for the bio metrics in the same October which for the main applicant was priority which is suppose to be out in 5 biz days..so we waited for weeks and we didn't get no response from them..3 weeks later we got a response asking for additional information which we provided...now we have to wait again since mid November till December 6 before we got another email saying the application was refused because they think we are trying to deceive them with one of our document. And i was so sure we didn't give any bad document..so i contact the working place where we worked and got out reference letter from...they said they contacted them and they gave them the right response and then again to the school we went and the mix up was from the school where she did her 18month course...now we got the letter from the school and filled for administrative review.....its past 20days now that we have submitted the letter and write them about the whole issue we havent heard back from them and again i want to ask and know whats the assurance of getting the visa since we already knew where the issue came from and gotten a letter from them to back it up....

Amongst many other factors, societal and cultural values vary between the two countries - some see the UK as too liberal, and Saudi as too conservative.

They ask for secondary school transcript. It's WAEC I have and going to secondary school for transcript will take time. Will they accept WAEC certificate only?
Hi mercy87, I guess you've now confirmed the particular document that's being requested from you.
For the Statement of Comparability, apart from your degree certificate and transcript, our Nigerian WASSC/SSCE certificate should suffice for high school qualification evaluation, because it already displays the subjects and grades obtained in the exam. So you may want to put that explanation in the section for its transcript.
However, do well to enquire about this by messaging ENIC via your dashboard. Cheers.smiley

Hi MatildaPopes, a physical challenge or disability may not necessarily bar one from working in the UK health and social care sector, especially if it's an organization (eg. NHS) that has a good support system for the physically challenged. There are support workers who even use wheelchairs to work.
Domiciliary care/Home care usually involves moving from one client's home to another to look after their daily personal needs, while Care home is usually done in a residential facility. Both require some level of agility and manual handling.

That said, there would definitely be challenges while working - it all depends on your capacity. But your employer has to know some vital details of your health condition, especially if it's one that may pose a challenge for you to work effectively, so that they can advise you whether they can make provisions for your support.

Hi Eky29, I've been following your story from last year. So sorry about your plight. But you have to understand that Temporary Work visa, which is usually for volunteer/seasonal work and the like, is not the same as SW or HACW visa.
As such, UKVI may not treat its applications as extremely important, especially if the temporary work isn't on a shortage occupations list, and also considering that they're having a pile of Study and SW/HACW visas etc.

You may wish to keep following up UKVI with paid emails and calls. I think you can also pay a visit to TLS where you did your application and make enquiries. If that doesn't work out, you can then enquire at the embassy.
If there's any way your employer can also reach out to UKVI, it may be helpful as well.
That said, if nothing positive happens, you may have to cancel your application just as AdvanceDNA suggested. Your prospective employer may then re-issue you a fresh CoS, if you would still want to reapply for the temporary work.
I pray this eventually turns to your favour after all this trauma.🙏🏿

For someone with Master and first degree, both certificate are on the same course, which one of the certificate should be use for Ecctis certificate confirmation.
Also, can student copy of transcript be used?
If it's Statement of Comparability (ENIC), you can upload and have them evaluate more than one certificate. But if it's for UKVI English Proficiency Statement (Ecctis), you only need one certificate which you have access to its transcript and letter of English proficiency. They used to accept student copy of transcript, provided all the pages were stamped and signed, but I don't know if things have now changed.

Hi Mercy87, since the instruction says your high school and degree qualifications, you may need the Statement of Comparability because this is the service that can evaluate both high school and university qualifications. You have to confirm from the person requesting this if what is required of you is a Statement of Comparability or the English Proficiency Statement (Visas and Nationality Service). The two are for different purposes and have been explained extensively on this thread.

If it's the former, then you need your high school (WAEC/NECO/GCSE) certificate, your degree certificate and transcripts only. -> https://www.enic.org.uk
But if it's the latter, you'll need your degree (bachelor's/master's/PhD) certificate, transcript and a letter of English proficiency from your university. -> https://ecctis.com
You can also chat with Ecctis support team via the Message function on your dashboard and enquire if they can accept student copy of your transcript (they used to accept this in the past, provided all the pages were stamped and signed by your university authority). They may also ask you to get your university to send documents directly to them via documents@ecctis.com.

Congratulations 🎉👏 to all those who recently succeeded on this journey!

For those yet to succeed, I'd recommend you focus your applications more on NHS jobs, especially if you can't meet the financial demands of private care homes.
NHS Band 3 or 4 care/support worker roles are also eligible for HACW visa, or Band 5+ if you're a qualified health professional.
And, yes, the WHO Red List doesn't necessarily affect individual applications made directly to employers.🤗

The SW visa is still open to all other eligible professions, including those in IT, Admin, Teaching etc. You can also learn a new skill (eg any advanced IT/computer packages) and explore other options aside from Care.

Having IELTS for UKVI, PCC, TB test cert etc, whilst you're yet to get a job offer is not a guarantee that you'll get one, and some of these could even expire before the actual need arises. The competition has gone beyond just having these. Focus on getting more experience/skills first before applying for jobs.

...Check county/city councils' careers websites and apply for social care assistant jobs, or any other shortage occupation that you're qualified for. You can also apply to CIC organizations (search on NHS jobs website). Most of them are willing to take people, especially candidates with a valid driving licence, for community support worker roles. Hello Generalkoke, it's so sad to learn about this.angry However, it's the ugly reality some have found themselves in. You'll have to apply great wisdom in how you choose to go about this, cos if you get into a confrontation with your current employer, they may withdraw/revoke your CoS and you know what it means - for them, they may just face a fine or loss of their sponsorship licence; for you it may mean having to go back to Naija.

If you wish to pursue it legally and need some guidance, you may seek professional counsel from a labour-matters or immigration lawyer. First of all, you may have to write an official letter to the complaints unit of your company to formally appeal your redundancy, and follow your company's rules for making such complaints.

Also, you can enquire about labour unions, such as Unison, that may be able to assist you in fighting for your rights. I've specifically searched and found the links below which I hope would provide useful information and assistance to you and others:

In addition to the suggestion already made by Dee1504, you may also wish to check out your current local county council's careers website and apply for social care jobs, or any other shortage occupation that you're qualified for. You can also apply to other nearby county councils and/or CIC organizations, in case there are no SWV eligible roles in your current local coucil. Working as a teacher in England if you qualified outside the UK:
This guidance is for non-UK citizens who qualified as teachers outside the UK.

To teach in England you will need:

- the correct visa or status
- teaching skills and experience you can demonstrate to an employer
- to pass criminal and professional safeguarding checks (these will be organised by your employer)
The correct visa or status could be one of the following:

- a pre-existing right to work in the UK, such as settled or pre-settled status under the EU Settlement Scheme or indefinite leave to remain in the UK
- a job offer allowing you to apply for a skilled worker visa
- eligibility for another type of visa

It is also very helpful to have:

- a teaching qualification (this can be from your own or another non-UK country)
- English ‘qualified teacher status’ (QTS).

Routes to QTS
There are 4 routes to qualified teacher status for teachers and trainees outside the UK:

- apply for QTS using our new online service
- apply for assessment only QTS
- apply for teacher training in England
- apply to train for international qualified teacher status (iQTS)
Your eligibility for each route will depend on:

- where you qualified
- your subject specialism
- whether you already have teaching experience
- your personal circumstances

Step 1
Applying for qualified teacher status (QTS)

Qualified teacher status (QTS) is the professional status teachers in England gain at the end of their teacher training.

Teachers who qualified outside the UK can work in English schools for up to 4 years without QTS. However, obtaining QTS will make it easier for you to find work and develop your career as a teacher.

This is because:

- in many English state-maintained schools, QTS is a legal requirement when the 4-year exemption period is up
- in all English schools, QTS is used to assess the quality of candidates for teaching jobs

From 1 February 2023, if you have a teaching qualification from the following countries and regions, you will be able to use our new service to check if you meet the requirements and apply for QTS in England:

Australia
Canada
the EEA
Gibraltar
Hong Kong
New Zealand
Northern Ireland
Scotland
Switzerland
Ukraine
the USA

In addition, if you have a subject specialism in languages, mathematics or science and a teaching qualification to teach 11 to 16 year olds from one of the following 7 countries, you will be able to use the service to check if you meet the requirements and apply for QTS in England:

Ghana
India
Jamaica
Nigeria
Singapore
South Africa
Zimbabwe

When you apply for QTS in England you do not need to:
- pay a fee to a training provider
- undergo any further training
visit the UK.

Over time this route will be open to qualified teachers from every country outside the UK.

How to apply for QTS:

Depending on where you qualified as a teacher, you may be eligible to apply to the Teaching Regulation Agency for QTS. - https://apply-for-qts-in-england.education.gov.uk/eligibility/start

*For Nigerian teachers, they would need to be registered with Teacher's Registration Council of Nigeria (TRCN). This is because the council would need to issue a letter of good standing for you directly to Teaching Regulation Agency in England as part of your registration process for QTS. TRCN would charge you a fee of N60,000 for this service.*

Teaching is a graduate-level profession in England, which means you must be able to show that you’ve completed a university degree.
Qualified teacher means EITHER your teaching qualification specifically shows you can teach one of these subjects, OR at least 50% of your university degree was in one of them.

You'll need to upload your certificate, along with a transcript that shows all the modules you studied and the scores you achieved.

Qualifications and experience you’ll need:

We will award overseas teachers QTS based on an assessment of each individual’s qualifications and experience against set requirements. From 1 February 2023, to be awarded QTS as a non-UK teacher, you must:

- have an undergraduate degree of the same academic standard as a UK bachelor’s degree, as verified by UK ENIC
- have completed teacher training that meets the standard of a level 6 qualification and is of at least the same length as an English initial teacher training course – for example, a Bachelor of Education or a Postgraduate Certificate in Education
- have completed a course with content that is practically and pedagogically focused
- be qualified to teach children aged between 5 and 16 years
- have at least one school year (a minimum of 9 months including school holidays but excluding time out taken for any other reason) of professional experience working as a teacher after qualifying
- have the professional status needed to be a teacher in the country where you qualified, and not be subject to any conditions or restrictions on your practice

You must also meet a certain standard of English language proficiency. This means you must be able to show one of the following. You have:

- been born in, hold citizenship of, or have studied at undergraduate level (or higher) in England, Scotland, Northern Ireland, Wales or in one of the exempt nationalities
- been taught in English at undergraduate level (or higher) – you will need to provide evidence that English has been the medium of instruction (MOI) of your degree
- sat a CEFR B2 level English language test at a secure English language test (SELT) provider and met a CEFR B2 level of English proficiency

A B2 level is equivalent to the following test scores from the approved English language test providers:

- IELTS SELT Consortium – 5.5
- LanguageCert – 33/50
- Pearson – 59
- Trinity College London – Pass
- PSI Services (UK) Ltd – Pass

Teaching Experience:
We need to know how long you’ve spent actively teaching. This can include scheduled school holiday periods, but cannot include any other time you’ve spent away from teaching.

To work out your experience, add up the time you’ve spent employed as a teacher, including any scheduled school holidays.

If you have 9 months or more (this is equivalent to 1 academic year) but less than 20 months (this is equivalent to 2 academic years), you may still be awarded QTS, but you’ll need to complete a 2-year ‘statutory induction’ period as a newly qualified teacher.

Assessment only QTS:
You could also apply for assessment only QTS while you earn a salary as a teacher or you could apply to train to teach in England.

Assessment only QTS means experienced teachers with a degree can gain QTS without doing a teacher training programme. You can apply to a UK government-approved teacher training provider in England for an assessment showing you meet the standards for QTS. You do not need to visit the UK to be assessed and gain QTS.

You will not have to visit or train in England. However, you will need to be assessed at your place of work by an examiner from your teaching training provider. Your teacher training provider can explain what type of school you must be working in to undergo assessment only QTS.

Assessment only costs:
Fees range from about £1,500 to £4,000, but vary between providers and may be substantially more if you’re outside the UK. Check with individual providers for more details.

Step 2
Search and apply for a teaching job:

You will first need to search and apply for a teaching job in England. You can use the UK government’s Teaching vacancies service to search for available teaching roles. - https://www.gov.uk/find-teaching-job

Before you apply for a teaching job, contact the school to make sure it is a Home Office licensed sponsor. If the school is a sponsor, it can help you apply for your visa. Schools can also become sponsors to employ you.
Only you have been assessed/interviewed by your prospective employer and deemed qualified for employment, they would then make a conditional offer to you, and finally a Certificate of Sponsorship (CoS) subject to a satisfactory pre-employment checks.

Step 3
Apply for your Skilled Worker visa:
The main visa route for non-UK teachers in England is the skilled worker visa.

You’ll be able to apply for your skilled worker visa if:

- you have a job offer from a school that is a licensed Home Office sponsor
- you can speak, read, write, and understand English https://www.gov.uk/skilled-worker-visa/knowledge-of-english
- your salary meets the requirements for a skilled worker visa

Salary requirement for a skilled worker visa:
The salary threshold you must meet depends on whether you have qualified teacher status (QTS) and the region you are applying to work in.

This table shows the minimum salary non-UK teachers must earn to be eligible for a skilled worker visa, by region and status (QTS and non-QTS).

a. Inner London:
- QTS £34,502
- Non-QTS £24,254

b. Outer London:
- QTS £32,407
- Non-QTS £22,924

c. London fringe:
- QTS £29,344
- Non-QTS £20,594

d. Rest of England:
- QTS £28,000
- Non-QTS £20,480

Inner and outer London
The skilled worker visa thresholds match the minimum salary set in the national teachers’ pay range.

London fringe and the rest of England
For teachers without QTS, the skilled worker visa threshold is above the minimum salary set in the national teachers’ pay range.

However, schools have some flexibility in how they set salaries. You may be able to negotiate a different rate of pay if the salary on offer does not meet the skilled worker visa requirements.

The salary requirements for a skilled worker visa apply whatever type of school you work in (funded by the UK government or in the private sector).

Working part time as a teacher:
You can work part time, but your salary must meet the threshold for a skilled worker visa. There are 2 requirements:

- your part-time salary must be at least £20,480
- the full-time equivalent of your salary must meet the minimum set for your region and status (with QTS or without QTS)

Hi Solufemiwa, sorry if you misunderstood my comment. This matter has been handled in some previous pages here.

First of all, there are two ways you can request your Ecctis (Naric) statement:
A. Hard copy or
B. e-Statement (which is the main bone of contention in this discussion).

A. - has an indefinite validity (and costs more) while
B. - has a validity period of only 3 months (but costs less).

And I went ahead to explain in my previous comment why this is so - that the e-Statement has a secure electronic chip in it, which is like an electronic signature, that is used to verify it.
This e-Statement is made in such a way that the electronic signature remains valid for only 3 months, after which you have to request a new e-Statement and re-download to use again.

I have attached here a screenshot of my conversation with Ecctis support team sometime last year regarding this e-Statement issue.

I hope this is clearer. However, you can contact Ecctis via your message portal on your dashboard so that they can explain it better to you.
