You just quoted the defense positions against the witness and complaint. You didn't care to listen to the defense of the prosecution attorneys and see the exhibits in counter filing.

Don't jump the gun, you heard the Judge insist that the documents to be used in the court must be filed with the court and served on the other party, prosecution and defense attorneys, as the case may be.

The defense attorney didn't share those documents with the prosecution before presenting them in court. Those documents must be scrutinized, investigated and confirmed.

Jude, and his wife, have a bad case if established that funds of PSquare was diverted into unauthorized accounts and for unapproved use.

You need to prove that Peter was paid all his dues from funds diverted to the company of Jude and his wife.

You must prove that Peter consented to the divertion of the funds of PSquare into Jude and his wife's account.

You must prove that Jude and his wife establishment of that company and divertion of the funds of PSquare into the account of that company was not an illegality, fraudulent diversion of funds, theft and criminal.

It is more important for the defense attorney to prove those to the judge than the less significant matter of School he attended and graduated from. Moreover, during cross examination, he indicted that he didn't say he graduated from University of Abuja; that he only attended the university.

Those claims and documents presented by the defense attorney are subject to investigation.

The defense attorney didn't serve those documents on the prosecution to enable them prepare a defense on those claims or documents. It was deliberate and that was why the judge insisted that such documents should be served on the the prosecution legal counsel.

Many people here don't know that the lawyer is trying to show the judge that the plaintiff is not credible. If he lied about his education, who knows what else he lied about? I am not saying the fraud did not happen but a judge relies on testimonies and evidences. That is why you see that symbol of justice is a blindfolded lady with a scale in one hand and a sword in the other hand. Lady justice does not witness the event. She only hears from those involved, weighs your version against your opponents version and delivers justice with the sword. Once a judge begins to see you as a liar, then you are not a credible witness.

Even if the lawyer is able to discredit the witness, the hard facts(documented evidence, bank account transactions) and confession of Jude are very significant to his conviction..

Jude already confessed.

The company he registered to divert the funds has been proven to be owned by Jude and his wife.

There are little or no evidence that Peter got any share from the funds diverted.

There is no document, hard copy, that shows that Peter consented to the divertion of funds.

Jude is criminally indicted here. In fact, his wife can also be indicted during questioning but she can only save herself by claiming to be unaware of the activities of the company as she held the shares in proxy for her husband. She would have to claim her husband runs the company fully and absolutely, without her input.
