Goodluck Jonathan or Muhammadu Buhari? Muhammadu Buhari or Goodluck Jonathan? Both have their strengths and weaknesses. A renowned Naij.com guest author Japheth Omojuwa compares the two most prominent candidates in the 2015 race to the presidential seat. General Buhari is running as a presidential candidate for the 4th time in a row. The only difference between his current effort and the three previous ones is the fact that this time, he goes to the polls as a clear favourite. Surely, there must be a reason why a man who, it looked like, never had a chance in the last 12 years is now solidly placed to win. The reason? Two words: Goodluck Jonathan. President Jonathan said he deserved credit for the APC becoming what it is today. The president is right, but he missed the irony in his own assertion. He wants the world to believe the APC exists because his government created an enabling environment for the opposition to thrive when, in actual fact, the opposition rose on the hills of Jonathan’s incompetence. General Buhari has always been a phenomenon in the North – he still is – but the same could not have been said of the South until the run-up to the 2015 elections. Why is that? Because of the same old gee, Goodluck Jonathan. Nigeria’s current president has failed so many times many Nigerians are inclined to choose to vote for just about any form of matter over him. Where exactly has Jonathan failed and why his failures should not be overlooked? The president’s most telling failure is his inability to address the insurgency in the North. For many years, the president’s disposition to Boko Haram was: “they are killing themselves to make my government look bad”. This position was echoed by the president’s men and allies. The belated response to the of 59 Buni Yadi boys in Yobe, the absurd delay in even believing the Chibok girls were truly abducted until some 18 days later, the Kano rally dance that came 24 hours after the Nyanya bomb blast, and several other shocking responses to Boko Haram’s activities sold the president out as being indifferent to the pains of Nigerians who live under the constant menace of terror. Meanwhile, General Buhari’s history as a no-nonsense leader proves he will not approach Boko Haram with kid gloves or underrate the terror group, to which President Jonathan has confessed. Corruption and government accountability are major issues in this election, and understandably so. A November 2012 report says some N5 trillion was either misappropriated or outright stolen under the Jonathan administration. At least N1 trillion was stolen under the guise of fuel subsidies, if the House of Representatives’ report is correct. There is the $20 billion the then- Central Bank governor and now Emir of Kano HRH Muhammed Sanusi II said wasn’t remitted to the Federation Account. Two days ago, he was on CNN’s Amanpour insisting the government’s explanation for that was not satisfactory. Another former CBN governor, Prof Charles Soludo, insisted some N30 trillion has been lost due to the current administration’s mismanagement. As these words get written, the government has not issued a reasonable response to his charges. They offered a lot of emotional tantrums through President Jonathan’s campaign and the Ministry of Finance. On this front, Buhari comes out on top again because of his reputation of never being the one about amassing wealth or using his privileged position to loot the country. He is generally perceived as upright. His choice of Pastor Yemi Osinbajo helped to cement that perception. The third major deciding issue for this election is the economy. The Nigerian economy is walking on tightropes. The government likes to claim it has made Nigeria Africa’s No.1 economy. The economy was rebased in 2014. All the government did with the “rebasing” was to account for the inclusion of new sectors like the entertainment industry and telecoms into the calculation of the country’s GDP. This was accumulated over the previous 20 years or so, but the government has sold this as one of its achievements. Pictures of Cameroon were presented as completed road projects of this administration, and an image of a housing estate in Lekki was used as that of completed housing projects in the Northeast. Four out of every five Nigerian graduates are out of jobs. Extreme poverty is unacceptably high, the naira is seeing worst trading days ever. Perhaps, the greatest picture of that reality is Aliko Dangote, Africa’s richest man, losing $7b in November 2014 alone; since then, he has lost enough money to make another person the 2nd richest on the continent. Nigeria’s foreign reserves continue to take a plunge. Its debts, local and foreign, continue to rise. It is all a mess out here. This is what the elections are about. It is a direct Yes/No referendum on president Jonathan. Not a few people voting for General Buhari will do so just to vote against President Jonathan . Voting Buhari is the right thing if this really is about the future of Nigeria. Of the two available options, President Jonathan is a failed president. In a sane world, he would not even dream to be a candidate, let alone become one. General Buhari used to be a dictator. He has since learnt democratic tenets having, without resorting to violence, trusted the courts three times after losing previous elections. It is obvious he is in this because he firmly believes he can be the wise old man who sets Nigeria on the road to socio-political and economic recovery. General Buhari gets my vote. Easily. It is the most logical decision. In a country where money and materialism hold sway (including in the so-called religious houses), those who are able to share dollars will certainly turn many heads. What will matter in the end is how much Nigerians want “change” . Another four years with Goodluck Jonathan would be a disaster for Nigeria. One needless controversy that seems to have been laid to rest in Nigeria is that the President lacks the constitutional power to either suspend or sack the Chairman of the Independent National Electoral Commission. He can only do so by acting on an address of at least two- thirds majority of the Senate. What seems to be in dispute now is whether the INEC Chairman can be forced to go on leave ahead of the end of his tenure on June 24, 2015. The issue of leave and conditions of service defined by Public Service Rules remains debatable for political office holders, many of whom work Monday to Sunday, putting in an average of 15 hours daily. While political office holders like the Chairman of INEC may draw one or two guidelines from the Public Service Rules, they are not in any way bound by them because their structure or system of work is completely different from that of the civil servants or public servants, as the case may be. If the president or governor is a public servant, that means he is also subject to the Public Service Rules and expected to go on pre-disengagement leave! Section 156 (2) of the 1999 Constitution states that, “Any person employed in the public service of the Federation shall not be disqualified for appointment as Chairman or member of any of such bodies (i.e. INEC, NPC, RMAFC, etc.): Provided that where such person has been duly appointed he shall, on his appointment, be deemed to have resigned his former office as from the date of the appointment.” This is a clear-cut provision that shows beyond any iota of doubt that the Chairman of INEC IS NOT AND CANNOT BE A PUBLIC SERVANT. Interestingly, the current Chairman of INEC, Prof Attahiru Jega, was once a public servant, being a university lecturer, and bound by Public Service Rules before his appointment in 2010. But once he crossed over to INEC as a political appointee, he ceases to be bound by that code. It is safer to describe the likes of Jega as political office holders rather than public servants in order to avoid any confusion. That is why their remuneration is determined by another political body, Revenue Mobilisation Allocation and Fiscal Commission. They may need a few of the provisions of the Public Service Rules as a guide but are not subject to them. Do we need any constitutional amendments to further make the point clearer? We cannot solve all our problems through the instrumentality of law. As a matter of fact, it may be argued that the problem of Nigeria is not the absence of law but surfeit of it. The British have no constitution, or to choose the words of M.E. Boutmy in Studies in Constitutional Law, they “have left the different parts of their constitution just where the wave of history had deposited them; they have not attempted to bring them together, to classify or complete them, or to make a consistent and coherent whole.” Yet, the whole world will agree that the United Kingdom is sufficiently governed by law. The fact is, the rule of law and constitutionalism (obedience to constitutional principles) have been so much internalised such that it is safe to say these developed nations are governed by Convention rather than Constitution. That should be our dream in Nigeria rather than the current mischief of engaging unpatriotic lawyers to look for loopholes in every law with a view to exploiting them for selfish ends. Again, if compliance with the law is a function of the number of pages in the constitution of a country, then Nigeria should have been a role model for the world. Regrettably, however, it is as if the more the number of laws in Nigeria, the higher the rate of lawlessness. Let’s take one example. The United States introduced the 25th Amendment because they would not accommodate a President that is not as fit as a fiddle. Clause 3 of that Amendment reads: “Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice- President as Acting President.” This is the precursor to Section 145 of the 1999 Constitution of Nigeria: “Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President.” It is evident we copied Section 145 from the US. But while successive presidents of the US have abided by the spirit and letter of this clause, what happened in Nigeria in 2010 when we had the opportunity to show that we belonged to the civilised world, during President Umaru Yar’Adua’s health crisis? Some of our lawyers – the spin doctors, specialists in casuistry and sophistry – argued that the provision said “WHENEVER”, meaning that it was not compulsory for Yar’Adua to transmit a letter to the National Assembly! And the nation was needlessly heated to the boiling point. History has now come full circle and these elements are at their game once more. And whereas the constitution of the US contains just a few leaves, that of Nigeria is actually a textbook, verbose and prone to many errors, which some constitutional lawyers and commentators have identified in the past. During that crisis of succession in 2010, I had cause to point to the superfluity-cum- ordinariness of Section 5 (1) and 148 (1) of the 1999 Constitution in the light of the authority of the President that is singular, indivisible and indissoluble (Section 130), insisting that the Vice-President could not discharge the functions of the President without becoming the Acting President. Section 5 (1) was essentially imported from Section 79 of 1960 Constitution and Section 84 of 1963 Constitution, under a parliamentary system. In the present case, for instance, how can Section 156 (2) of the 1999 Constitution make it crystal clear that the Chairman of INEC is not in the public service but the same constitution proceeds in Section 318 to list “member or staff of any commission or authority…” as being in the “public service of the Federation”? Notwithstanding some of these incongruities, the redeeming feature is that the constitution is an organic document. It must be read together as a whole. And so the inconsistency in Section 318 above is cured by other provisions in the 1999 Constitution that emphasise not just the independence of INEC but that its chairman is not a public servant and consequently not in any way subject to the innumerable rules that affect workers in Ministries, Departments and Agencies. Here again is Section 158 (1) of the 1999 Constitution: “In exercising its power to make appointments or to exercise disciplinary control over persons… the Independent National Electoral Commission shall not be subject to the direction or control of any other authority or person.” The President lacks the constitutional power to direct the INEC chairman to proceed on one week let alone what is termed “a pre-disengagement leave”. Doing so would amount to constructive removal in that he will not be able to discharge the functions of his office during the time of the imposed leave. The framers of the constitution never contemplated such an absurdity. Jega’s tenure is five solid years and the constitution does not make provision for the post of Acting Chairman of INEC. I even had to buy a bigger generator due to a new freezer added by my wife for her fish business just four days ago, pls where is your 15 hours! The decadence and impunity under GEJ got to the peak with the death of more than ten young Nigerians in a fraudulent immigration recruitment exercise which has never been queried by GEJ till today except that he fulfilled his job promises to the families of the dead by making it a big campaign event last week, bros enough of these lies, I refuse to buy into your well polished and beautified sepulchre otherwise known as 2nd tern for GEJ, cheers! |

A president under whom a single woman claimed to have spent 10billion naira to hire jets, 29billion naira stollen from pension fund, military reduced to mere political goons, billions of dollars military budget shared among army officers to bribe them for election, hundreds of promising young girls taken away in Chibok like fowls, billions of naira waisted on electricity and roads with the money finding it's way to Jonathan and his cronies' private pockets, total destruction of our socio- cultural and religious heritage by using huge bribery to lure traditional and religious leaders to turn their back against decorum, just to mention but a few should be voted out, prosecuted and be left to rotten in jail. It has been my heart’s desire for years to produce a movie, although my late husband and I never produced one. I thank God for the grace to finally do so even though Friday, March 11, was my husband’s 33rd year remembrance. Since his death, I’ve been praying to God to spare my life and raise help so I can realise my dream. I decided to postpone the celebration of my birthday until now in order to combine it with the release of the movie entitled Moremi Ajansoro. For the 70 years you’ve been on earth, what would you say life has taught you? The elders say that experience makes an elder. I have experienced a lot since I got married and after my husband’s death. Although God has planned everybody’s life, but it’s just that He does not give us the opportunity to see tomorrow. I knew what I wanted right from when I was young and that has helped me a lot. Although I never knew that my husband would die so early, I had made up my mind that I would never marry two husbands or give birth to children for two husbands. My husband left me prematurely, so I had the opportunity to live with him for just 11 years after our marriage. I thank God for keeping me till now. I have had death threats many times, yet God has been merciful to me. Imagine a load meant to be carried by two people being carried by one for the past 33 years. In whatever situation a man is passing through on earth, he should hold on to God because human beings cannot do anything; they promise and fail. I enjoin whoever is in this type of situation to believe in God. He’s the father of the fatherless and a husband to widows. He will fight their cause. Young women should not only talk about love when in a relationship, but should find out good qualities in the man before making their choices. Spouses don’t get to know genuine love until they start living together. Young ladies should also wait to receive parental blessings before settling down. After your husband’s demise, how did you cope with the children’s upkeep? It was not easy. Whenever the children came from school, then, it was always a thing of sorrow for me. I remember an instance after one of my children completed her secondary school education and proceeded to the tertiary institution. She insisted on going further but I pleaded with her to hold on for a while since she wasn’t the only one I was catering for. We both wept bitterly because there was nowhere I could turn to. She encouraged me to do all I could because after getting married, she may not have the opportunity to further her education. God raised help at last. As part of my birthday celebrations and in gratitude for all the Lord has done for me, a thanksgiving service has been organised. God says “a thankful heart He would make fat.” The Lord promised He would stand by me and indeed He stood. He loves me so much. A woman must persevere no matter what she is passing through in her matrimonial home. How do you intend to celebrate your day? I have been to the Motherless Babies’ Home, opposite the University College Hospital (UCH), Ibadan, Oyo State. I have always wanted to do this many years ago, but could not. You seem to be a fashionable woman, what do you have to say about fashion in today’s world? May God have mercy on us. Charity, they say, begins at home, but not in this generation. I remember back then when I travelled abroad, Nigerians were part of the honoured visitors. The Americans loved to relate with us. I had some of them who asked questions such as the number of days it took me to plait my hair. Fashion starts with our language, Yoruba, which has been replaced by borrowed language and culture. The truth is that Yoruba culture and morals are embedded in the language itself, but when people have substituted its teaching with something else, how would they know about culture and the morals it teaches? Nowadays, children no longer know how to kneel down to greet their parents, instead they bark greetings at them. In our own time, we saw exposure of any part of a lady’s body an insult, but in modern times, the unmarried expose their bodies. Unfortunately, such is done in movies too. Youths nowadays do not want to dance to moral music again. What do you have to say about movies in the past and those produced now? In the olden days, there was nothing like movies, what we had was theatre. Then, we staged drama that was rich in moral and cultural lessons. We dramatised ancient events about kings and their rulership, although some other groups did comedy. People have requested for such plays into CDs for the benefit of their children. The younger generation, who are into movie production nowadays, think it’s all about making money. That is a very big mistake they are making. What are some of the challenges you faced in the course of the production of your new movie? There’s no other challenge than how to raise the money needed. All the villages we used as locations were paid for. Before, it wasn’t s,o but now, they are civilised. What’s the secret of your agility even at your age? Number one thing is God’s grace of good health. Some are blessed with money but good health is the best. Another thing is that I disciplined myself from following men around since the death of my husband. There was a time I was ill and at a point, my doctor advised me to get a man who would make me happy anytime I see him. He diagnosed the illness as loneliness and said that I could not cheat nature as a young woman. I laughed at him because I know that if I marry another man, he would want me to bear children for him and might not allow me take good care of my children. You live alone. How do you manage chores? I do all the house chores myself except fetching water and washing clothes. I still go to the market to buy whatever I need and prepare my meals the way I prefer them. How do you relax? I sing, read my Bible and sleep sometimes because I don’t know how to watch television.
