Gratuity is payment made to an employee on the expiration of the contract of employment after the approved years, which is separate from and additional to the payment made to him as his final entitlement. The new Pensions Act has provided a basis for the computation of this. • The new Pensions Act recommends that a gratuity payment be given to employees who are leaving an organization having worked five years and above in addition to final entitlements and Retirement Contribution Accounts (RSA) with PFA’s. • The law requires that 100% of the total final emolument (annual gross) be paid to exiting staff who has spent the minimum number of years to qualify for gratuity. • This increases to by 8% with each succeeding year until 10 years in service where it goes back to 100%. This is so because if the employee has attained the age of 50, he is entitled to 30% of his final emolument as pension. • In addition to the government option, three other options have been explored. They are as follows: • Option B: One month salary for every year spent (current salary). • Option C: 50% of current monthly salary for every year spent. • Option D: Sum of monthly salary as earned in each year. The Proposed Gratuity Payment Schedule According to the New Pensions Act, a person is entitled to gratuity after five years in service. Gratuity is computed on the final emolument of an entitled person.
