Today we stand before the world as a nation:

With an extraordinarily large population living in poverty and severe hardship; over 140M

With one of the largest populations of out-of-school children in the world; over 18M

Where insecurity, terrorism, banditry and kidnapping continue to threaten lives and livelihoods, just recently 37 young Nigerians in their productive age lost their lives

Where millions of Nigerians struggle with hunger and food insecurity; over 40M Nigerians will be in extreme hunger by the end of 2026.

With unacceptably high rates of infant and maternal mortality; Nigeria today is the worst place to be born.

Where youth unemployment and underemployment remain alarmingly high; over 35M

Where drug abuse and substance misuse increasingly threaten our young population; today 14% as against global average of 6%

Where life expectancy remains among the lowest globally, today 54 years against global average of 74 years

And the list goes on.

This reality demands serious, sober and honest reflection. Socrates taught that “the unexamined life is not worth living.” By the same principle, an unexamined nation cannot successfully chart its future. We must therefore ask ourselves: Are we cursed, or have we become the curse through the choices we have made and the failures we have tolerated?

The answer cannot be that Nigeria is cursed. We are a nation immensely endowed and blessed. Our greatest problem is not a lack of resources; it is the failure to convert our enormous resources into human development, productivity, security and shared prosperity.

Only yesterday, Senator Rabiu Kwankwaso and I returned from a two-day visit to Sokoto State. We held extensive consultations with people from different parts of the state on insecurity, out-of-school children, poverty, youth unemployment, drug abuse and other challenges confronting our people.

In concluding the visit, we went to the Internally Displaced Persons camp at Ramin Kura within Sokoto metropolis. What we saw was deeply troubling. Thousands of women and children live in deplorable conditions, displaced from their homes and deprived of the basic necessities of life. Many of the children have no access to education. Mothers and children have limited access to basic healthcare. These are Nigerians who should be living in their communities, going to school, farming their land, conducting their businesses and contributing to the economy. Instead, they live as displaced persons in their own country.

Aburi was only settled by the Military Junta led by Gowon to accommodate the errant Ojukwu who had refused to attend past meetings of the Supreme military council headed by the HoS and Commander-n-Chief .

Now imagine Abacha calling for a SMC and Marwa as then military governor of Lagos state saying he will not show up in Abuja and feared for his life that Abacha should move the conference to Togo so he can attend - you obviously know how that will end .

Gowon tried to get Ojukwu to reason but it was clear that Ojukwu insisted that Gowon either step down for him or grant his Eastern region full autonomy but with every right to remain in Nigeria.

When Gowon finally created states out of not just Eastern Nigeria and finally liberated the minority people that was when Ojukwu's madness began.


Abure should never be considered as a constitutional conference as we already had a working and valid constitution until Ironsi and his boys took over and no one elected Gowon or Ojukwu to debate or rework our existence.

What transpired on 20 November 2025 in the courtroom of Justice James Omotosho was not merely a judicial error; it was an act of raw judicial banditry and a deliberate desecration of the 1999 Constitution of the Federal Republic of Nigeria (as amended).

1. The Death of the Rule of Law: Section 36(12) Defied

Justice Omotosho himself declared in open court on 4 November 2025: “No written law, no conviction.” Yet, sixteen days later, he proceeded to convict Onyendu Mazi Nnamdi Kanu under dead, repealed legislation—the Terrorism (Prevention) Act 2011/2013 and the Customs and Excise Management Act (CEMA). Section 36(12) of the Constitution commands in clear, unambiguous language:

“A person shall not be convicted of a criminal offence unless that offence is defined and the penalty therefor is prescribed in a written law.”

A repealed statute is a dead law. It carries no legal force, creates no offences, and prescribes no valid penalties. By refusing to perform the mandatory statutory transition into the Terrorism (Prevention and Prohibition) Act 2022 as commanded by Sections 97 and 98(2), Justice Omotosho manufactured a conviction out of thin air. A savings clause is an administrative bridge; it is not an offence-creating enactment.

2. Institutional Decay and Executive Subversion

This perversity reveals a deeper institutional sickness. The current Attorney General of the Federation, Lateef Fagbemi SAN, and Justice James Omotosho have weaponized the federal judiciary to execute an executive agenda. Where General Sani Abacha used military tribunals, this administration uses federal judges to turn the Constitution into a worthless piece of paper.

This total collapse of judicial integrity is why millions of citizens across Nigeria have completely lost faith in the legal system. Ogundimu) and then ignore those very precedents to secure a politically dictated verdict, the court ceases to be a temple of justice—it becomes an instrument of state tyranny.

3. The Test Before the Appellate Courts and the NJC

IPOB remains mindful of courageous jurists who refused to bow to executive intimidation—such as Justice Oladotun Adefope-Okojie and her panel at the Court of Appeal, who delivered the historic 13 October 2022 judgment discharging Onyendu Mazi Nnamdi Kanu. That landmark decision stands as an unshakeable monument to judicial bravery, which no lower court has the constitutional authority to override.

The ultimate test now rests squarely before the Court of Appeal and the National Judicial Council (NJC):

To the Appellate Court: The appeal must be listed and heard without further executive delay. The court must confront the fundamental constitutional question: What living written law defined the offence on 20 November 2025? Where no such law exists, the conviction must be quashed.

To the NJC: The Council must examine the conduct of a judge who publicly stated the constitutional rule, acknowledged the repeal of the statutes, and yet knowingly entered a conviction under dead laws.

The burden is on the gavel, not the prisoner. You cannot build a lawful conviction on a dead statute, nor can you substitute judicial expediency for constitutional supremacy.
