Enugu Chief Judge bars PDP from accepting Ward Congress results

There was another twist to the crisis rocking the Enugu State chapter of the Peoples Democratic Party (PDP) Thursday when an Enugu High Court restrained the party from using or acting on the list or names purporting to be the list of delegates elected during the recent ward and local government congresses, pending the hearing and determination of the substantive suit on the matter.

The Enugu High Court order is coming barely two weeks after an earlier order by the Federal High Court sitting in Abuja that restrained the national leadership of the party from tampering with the result of the November 1, 2014 ward congresses conducted by the Elder David Aja-led State Executive Committee of the party in Enugu State.  The order is yet to be vacated.

Ruling on a suit filed by one Charles Okafor challenging the  validity of the alleged congress, the Enugu High Court presided over by the Chief Judge of the State, Justice Innocent Umezuluike, also ordered an accelerated hearing of the substantive suit, citing the urgency of the matter.

It further granted the plaintiff seven days within which to file his statement of claim and serve same on the defendant (PDP) and granted the defendant fourteen days to file its statement of defence and serve same on the plaintiff. The matter was adjourned to 8th December, 2014 for definite hearing.

It would be recalled that the Acting State Chairman of the party, Edler David Aja had said that the ward congress was conducted “peacefully” in Enugu State and proceeded to publish the names of  the three-m an delegates elected during the congresses held in 260 wards in the state.

But the Chairman of Governor Sullivan Chime faction,   Chief Ikeje Asogwa had countered the Acting Chairman’s claim, saying that the congress never held in Enugu due to the non-arrival of members of the electoral panel and materials from Abuja on the scheduled date.

The two conflicting orders of the Abuja and Enugu courts, which are said to have equal jurisdiction,  has created further confusion in the party and the national leadership is expected to decide on the way forward.

But the development has confirmed the collapse of the truce brokered by President Goodluck Jonathan between the warring parties.

It has further confirmed the speculation that Governor Chime and his men may move to another party to conduct the 2015 elections since the order may have been intended to prevent the PDP from fielding any candidate in Enugu State.

But some Party stalwarts who reacted to the fresh court order said that the intention of the plaintiff might not be realized as the interim injunction would not last beyond 14 days

A lot boiling in the coal city. Currently, no side is happy. Chime ppl are especially pissed. Its in the mill that a core loyalist, Mmamel, earlier penciled down for Udi/Ezeagu Fed rep couldn't hold it anymore. He went ballistic few days ago, came to punches with Jide, Gov;s brother and ended up biting him! Called him fullish brother of a fullish governor. He wanted a refund of his N8m use to purchase pdp nomination form and miscellaneous moneys showered on excellency brother to secure annonting for the ticket now zoned back to Udi, with excellency brother being prepared. Story dey long.

MEMBERS of Enugu State House of Assembly Thursday held a secret sitting at the hallowed chambers, where it approved N11 billion loan requested by Governor Sullivan Chime, to enable his administration complete ongoing projects and also offset previous loan facility obtained from a new generation bank, which interest rate was jerked up astronomically.

The House in sitting passed a resolution that “this honorable House do resolve to authorize the state government to obtain loans of one billion naira and ten billion naira respectively from UBA Plc to re-finance facility from GTB and fund infrastructural projects in the state.”

Speaker of the House, Mr.   Eugene Odo, had last week adjourned sitting till December 2, which observers believed was to prevent looming impeachment against him for crossing sword with the governor, following his formal declaration to run for governorship in 2015.

However, following the news of the emergency sitting Thursday, hordes of journalists besieged the Assembly but were prevented from entering the chambers for coverage of the proceedings.

Briefing newsmen after the secret meeting, the Deputy Leader of the House who is also the Chairman of House Committee on Information, Chief John Ukuta, said: “I can assure you it (closed door) wasn’t intentional but it is within the Standing Order of the House to us usually leave our public gallery closed or open and it has nothing to do with the sensitiveness of what was actually discussed.

“It is public knowledge now and obviously the people of Enugu State should be aware of what government is doing on their behalf. We went to move a motion for Enugu State government to obtain a loan of ten billion naira. The first one billion was for an earlier loan by government.”

I have already stated in another post that it is juts to expand his war chest. An after thought and a clear indication that he underestimated the fight.

Now bring it on.

This is how Sullivan has been ruling and ruining Enugu State. No interest in real development, just personal. No depth or vision in his programmes, just whitewashing and playing to the gallery.

If you read in-between the lines..." to offset previous loan facility obtained from a new generation bank, which interest rate was jerked up astronomically." That loan was just N1billion.

A government that could not properly service and repay N1billion loan is seeking N11bn loan, barely 6months to go. With crude oil price dropping to a 4-year low and falling, this is a callous move by Chime. Not that we have not always know that. Its just for those who saunter to this forum to defend him. With dropping monthly allocation of N3.2billion and wage bill cum overhead of over N2billion, it will take the State over 24months to repay N11bn loan sourced from a commercial bank.

Why Commercial bank loan and not bond issuance? Cluelessness of the highest order. Fools! Just making money for the banks.

And Gburugburu, the anointee; another cash and carry politician who believes that politics is trade ("afia" meaning market). He has not deemed it necessary to refute open press accusations by high-placed media houses (Leadership and Guardian) that he bribed his way into securing the failed consensus arrangement, gifting N800million house to former Chief of Staff, Ifeoma Nwobodo and helping oga to invest in shipping line.

Its a total show of shame in Enugu today.

I bet that Chime is going to face a very hard time after office, even harder than his predecessor. That is if it doesn't start before he leaves office. Securing huge loans to execute a fight against the Presidency, PDP national headquarters and his national assembly members equates to a man digging his grave.

The fact that the chihuahua Sullivan chime government inherited ZERO Debt from Dr. Nnamani's government needs to be added to the discussion.  

It is a shameless act that the chime government under darkness and at few months to the end if his government is borrowing N11b and in addition getting retroactive approval for an already borrowed‎ N7b (making a total of N18b) all within 5 months to the end of his government should be condemned by all Enugu citizens. 

USA and Elumelu should be warned that such money given without due process of the law becomes a gift and it's loan status will be challenged in court. 

It is important to also know that such loans as ISPO will require payment of N2b in the first year with a VARIABLE interest of 17% ‎and more with full payments over 3 years and the worse, payment will be deducted at source which is from the monthly federal allocation. Basically the next government will have no money  to run the government. Should this be allowed?

Meanwhile, Governor Sullivan Chime was reported to have declared his resolve to run for the Senate despite the understanding reached at the peace meeting between him and Senator Ike Ekweremadu and President Jonathan.
Sources at a the Enugu West Senatorial District Zonal meeting of the PDP, which held at Awgu Local Government Council headquarters at the weekend, said the Governor who just secured an approval for an N11 billion loan explained that he had not attended the zonal meeting all the while because he wanted to make up his mind on his post-tenure future, but that he was now more revolved than ever to go into contest with the Deputy President of the Senate irrespective of whatever it would take him.
The source added: “He told the gathering, which comprised the 5 Council Chairmen under the senatorial district and some party stakeholders loyal to him, that President Jonathan had not been firm over his discussions with him and that he was free to present himself to Enugu people since Enugu belonged to Enugu people. Our Governor reminded us that he was the chief executive of the state, hence he would rather make sure the Enugu state chapter of the did not present candidates for the 2015 than allow the PDP to make use of the list of ward delegates that emerged from the November 1 ward congressses. He told us that he was not speaking to us in confidence and that whomever wished should feel free to covey his comments to the national leadership of the PDP or even the President himself”.
The governor’s hard words at the meeting have further fueled the speculations that he could indeed be on his way to another political party where his camp would slug it out with the Ekweremadu camp.
This is even as the latest posters launched by a key governorship candidate being backed by the Chime do not bear the logo of the PDP or any other party.
Grapevine has it that the governor had before now accepted not to vie for the Senate, but with a proviso that all the remaining elective positions, namely the governorship, State and National Assembly positions would be ceded to him.

Guys I was at the stakeholders briefing organised by Chime at the old govt lodge. His tone was nothing like what is portrayed above. He rather wanted everybody to support PDP saying anybody leaving PDP would not go far. He even asked the crowd whether he should stop fighting and they said no that he should fight on, something like that.

He brought up the matter of Hon Ugwuanyi and the crowd gathered still said they were following him. I was just disappointed that Uwguanyi did't say anything. Not even to greet the gathered people. My friend near me asked whether he was doll baby that doesn't talk. The State Party Chairman, Vita Abba is back and was there. He spoke after the governor.

But truly I left not knowing what the large meeting was called. There was no concrete message. Like an anti-climax.

The governor talked about a radio station that was opened just for him, Said he was ready to leave office that it is like a prison. He didn't talk about senate. I didn't hear that.

A Federal High Court sitting in Abuja on Tuesday declared Elder David Aja as the authentic Chairman of the Peoples Democratic Party, PDP, Enugu State Chapter pending the appointment of another Chairman from the area where the immediate past Chairman of the party hails from.

This is even as the PDP has confirmed that its nationwide November 1, 2014 ward congresses to elect 3-man ad-hoc delegates, validly held in Enugu State.

The development is seen as a set-back to the Governor Sullivan Chime’s camp.


Counsel to the national leadership of the PDP, Frederick C. Olisa, stated this in an amended affidavit to override his earlier submission in a different suit in line with emerging facts.

The presiding judge, Justice E. S. Chukwu, while delivering judgment in the suit filed by Elder Aja on October 27, 2014, granted all the reliefs sought by the plaintiff.

The defendants in the suit were Peoples Democratic Party, Alhaji Admau Muazu, Independent National Electoral Commission (INEC), Chief Ikeje Asogwa and Barrister Steve Oruruo.

The court declared that following the resignation of Engr. Vita Abba as the Chairman of the Enugu State Chapter of the 1st Defendant (PDP), the plaintiff as the Vice Chairman of the said Chapter, is entitled to act as Chairman of the said Chapter of the 1st defendant pending the appointment of another Chairman from the area Engr. Vita Abba hails from.”


Aja had among other reliefs asked the court to determine: “Whether having regard to the provisions of Sections 35, 45(2) and (4), and 47(5) and (6) of the Constitution of the Peoples Democratic Party 2012 (as amended), following the resignation of Engr. Vita Abba as the Chairman of the Enugu State Chapter of the 1st Defendant, the Plaintiff (who is the Vice Chairman) is entitled to act as Chairman pending the appointment of another Chairman from the area Engr. Vita Abba hails from.

“Whether having regard to the provisions of Sections 24, 35(1) and 45 of the Constitution of the Peoples Democratic Partrty 2012 (as amended), and following the resignation of Engr. Vita Abba, as the Chairman of the Enugu State Chapter of the 1st Defendant, any meeting of the State Executive Committee of the Enugu State Chapter, 1st Defendant can be validly held without the Plaintiff in his capacity as Acting Chairman, summoning the meeting on his own, or at the request of two thirds of the members of the State Executive Committee of the Enugu State Chapter of the 1st Defendant.

“Whether having regard to the provisions of sections 35(1) and 45 of the Constitution of the Peoples Democratic Party 2012 (as amended), and following the resignation of Engr. Vita Abba, as the Chairman of the Enugu State Chapter of the 1st Defendant, the Plaintiff as Acting Chairman, is the proper person to preside over meetings of the State Executive Committee of the Enugu State Chapter of the 1st Defendant for the purpose of exercising the powers of the State Executive Committee set out under the said Constitution pending the appointment of another Chairman from the area Engr. Vita Abba hails from.”

In his judgment, Justice Chukwu ordered that “the 4th Defendant (Ikeje Asogwa) is not entitled to hold himself out or perform the function of the Chairman of the Enugu State Chapter of the 1st Defendant not having been validly appointed.


He also ordered the setting aside of all acts performed by the 4th Defendant purporting to act or carry out the functions of the Chairman of the Enugu State Chapter of the party.

Meanwhile, in an amended affidavit in response to the originating summons in the case filed in a Federal High Court, Abuja, by the delegates elected at that congress, to safeguard the result of the congress, the PDP counsel, Frederick C. Olisa overrode his earlier submission and held that there was congress in Enugu State as reported by the Electoral Panel sent to conduct the congress.

He said that as of November 12, 2014 when he filed his earlier claim that there was no congress in Enugu State, he was not properly briefed partly because the report of the congress was still being compiled and analysed by the Office of the National Organising Secretary.

He explained that he was misled at the time of filing his earlier affidavit by a supervisor in the department of Organisation and Mobilization into believing that there was no congress, but who as it had turned out did not have credible information.

In a table attached to the amended affidavit showing states where congresses held to elect the ad-hoc delegates on November 1, 2014, Enugu was featured as number 19.

Titled, “Ward Congresses for 3 Ad-Hoc Delegates: Analysis of Reports/results Sheets” and signed by the National Organising Secretary, Abubakar Mustafa, the table provides the analysis of congresses in 34 states including Enugu State.

“In compliance with the timeline (time-table) for Congresses/Primaries leading to the 2015 General Elections, Ward Congresses for the election of 3 Ad-Hoc Delegates were conducted in 34 States and the FCT on Nov. 1, 2014 “, the National Organising Secretary said in the table.

The table itself is an attachment to a detailed report of the November 1, 2014 congresses addressed to the National Working Committee, NWC on November 12, 2014, giving the NWC members the benefit of information on how the elections were conducted in the 34 States featured in the report.

Gov. Sullivan Chime of Enugu State said on Tuesday that the PDP congresses in the state were “totally unacceptable’’ to its members and the people of the state.

Chime made the declaration at a PDP stakeholders meeting in Enugu on Tuesday, saying the congresses were not subjected to the will of the people of the state.

On the current crisis rocking the party in the state, the governor said it was a result of contrary decisions by some members of the party.

He said that going out of the PDP was the easiest way to retire from politics and that anyone fighting the party either within or without would have to exit the party.

“We are not used to what they did and called congresses. In Enugu State, the proper thing should be done; I do not have any personal struggle with anybody.

“ I believe it is a collective decision that in Enugu State, we should be allowed to choose our leaders.

“I want the people to respect decisions. Anybody trying to go contrary to our decisions is on his own.

“People who want to benefit from the PDP must learn to be compliant. We have abandoned the policy of god-fatherism and imposition.

“It is true that I have been in prison but it has given me the opportunity to touch the lives of our people. The prison will soon end,’’ he said.

The governor said the collective decision was in line with the party’s constitution, adding that the constitution of the party recognises zoning and rotation.

Chime said the party had been preparing for its forthcoming primaries in the state to elect its candidates and commence political rallies in various local government areas.

The governor called on the aggrieved members of the party to come together to build a peaceful family in the state.

Also speaking at the meeting, the former Chairman of the party in the state, Chief Vita Abba, thanked its members for their support during his tenure.

Abba urged the loyalists to remain committed and focused to make the party successful.

“I encourage you to remain focused because there is light at the end of the tunnel,’’ he said.

The meeting was attended by Rep. Ifeanyi Ugwuanyi, a preferred governorship aspirant, state executive committee members and party members from the various local government areas. (NAN)

Police orders immediate arrest of culprits

About 10 persons suspected to be political thugs led by two Development Area Administrators on Wednesday attacked the Senator Ike Ekweremadu’s Ikeoha Foundation Free Eye Treatment Project team at Oghe in Ezeagu Local Government Area of Enugu State.

The annual project in which an estimated 10,000 people from the five local government areas of Enugu West Senatorial Districts are expected to benefit from free eye treatment, free drugs, free eye glasses and free eye surgeries had commenced on November 17 in partnership with Community Eye Savers.

The humanitarian project started well on its third day at the St. Theresa’s Secondary School, Oghe in Ezeagu LGA when the hoodlums who were armed with dangerous weapons stormed the venue to unleash mayhem on the officials.

Speaking to reporters, the Executive Director of Ikeoha Foundation, Mrs. Cindy Ezeugwu, said they were totally taken unawares as the Ikeoha Foundation was a household name in the State and its medical mission always looked forward to by the masses.

She said: “We had successfully carried out the 2014 edition of the project in Udi, Oji River, and Awgu local government areas. So, Ezeagu was slated for today. We had set up the venue with canopies and chairs as well as our facilities as usual. We had accredited over 600 people and attended to two elders and Igwe Sylvester Ozoekwem, the traditional ruler of Umumba Ndiuno that morning. The turnout was massive.

“Everything was going on smoothly until over ten thugs led by the Administrator of Ezeagu North Development Area, Hon. Okwudili Onuora popularly called Ayaya and the Administrator of Ezeagu South Development Area, Hon. Chukwudi Fred Ezinwa, who also known as Commodore stormed the venue, a catholic school within a Catholic Church premises, and commanded us to stop attending to the people.

“They said we should pack our things, but we told them we must inform the community, the people we were serving. While we were trying to explain with even the people protesting, they descended on us and the venue, destroying the canopies, breaking the chairs, some on people’s heads. They inflicted so much injury on my people, very deep wounds and gashes. They destroyed some equipment and confiscating our cameras, tapes, and memory cards. Our Fundraising Manager, Obiora Obasi and Cameraman, Ogoo Chinedu, for instance, sustained deep cuts. Ogoo’s nose was broken and he fainted. The commotion and mayhem was just too much”.

The Executive Director said the police eventually intervened, although the Administrators were released almost immediately they got to the Aguobuowa Divisional Station.

Asked if she read any political meanings to the incident, knowing that the Development Area Administrators were political appointees of the State, Mrs. Ezeugwu said she was not a politician and did not want to get involved in Enugu politics.

She explained: “All I know is that the Ikeoha Foundation has so far strictly stayed out of politics; even when this year schools were barred from participating in the Ikeoha Quiz Competition where winning schools and runners up usually take home educational equipment, while the students themselves get N500,000 each once they gained admission into the University, we refused to go public about it.

“When we procured 20,000 units of anti-malarial drugs from a highly reputable international pharmaceutical company for distribution to health facilities in the senatorial district to curb the high incidences of malaria-related sickness and death and it was sabotaged, we refused to talk, just to stay out of politics.

“This particular programme was well publicised and it is something the Foundation has been into over the years to help our people. So, I don’t know why anybody in his or her right sense would conceive idea of attacking us, our partners and medical team working for the good of the poor masses. It is so unfortunate”.

One of the victims, Mr. Obiora Obasi, Programme Officer whose head and arms were badly broken told reporters amidst bleeding at an Enugu private hospital that he was beaten to stupour.

In his account, a Programme Officer at the Foundation, Mr. Uzo Michael, said he left to Enugu with the Divisional Police Officer, DPO, Mr. Donald due to a petition by the Chairman of the Local Government claiming that members of the medical team were coming to demonstrate and cause trouble, hence should be stopped.

“The DPO and I went to see the Police Commissioner who after listening to me said it was a noble cause and that I should return to Oghe to continue with the programme; but on return, I saw the whole place so riotous like a war zone”, he added.

It could be recalled that contractor handling the National Youth Development Centre attracted to Ezeagu LGA by Senator Ekweremadu was initially prevented by the Council Chairman from commencing work at the site last year, causing delay.

When contacted, the Police Public Relations Officer in the State, Mr. Ebere Amaraizu said the Commissioner of Police had ordered that the culprits be arrested immediately and brought to the State headquarters, while full investigation should commence.

“The Enugu state command of the Nigeria police have commenced a full scale investigation into the alleged incident of 19/11/14 where some suspected hoodlums numbering about ten and  yet to be identified allegedly invaded St. Theresa’s Catholic Church compound Oghe in Ezeagu venue of Ikeoha Foundation eye examination,” the PPRO said in a statement Wednesday.

...I read in a paper where they were saying” Enugu State workers are the least paid in Africa” it is terrible and you said you are developing infrastructure? What are you developing? Is it the leader that will be going on the road? Are they not human beings that will be going on the road? That is what I said; there is more debt in this government than any government in the past. That is not what PDP as a ruling party stands for. These people are strangers to the party and fortunately because of one reason or the other, they have found themselves where they didn’t dream in the past and they have started misbehaving.

Enugu PDP crisis: Chime’s camp suffers another set back after court dismisses caseBy Emmanuel Uzodinma on November 20, 2014

A Federal High Court sitting in Abuja, on Thursday, dismissed a motion for joinder brought by some members of the Enugu State chapter of the Peoples Democratic Party, PDP, seeking to be joined in the suit (number FHC/ABJ//CS/816/2014) filed by Mr. Orji Chinenye Godwin, Chiefs Cletus C. Akalusi and Orji C. Orji on behalf of themselves and all Delegates elected on November 1, 2014 Ward Congress against the PDP, the National Chairman and the National Organising Secretary as well as the Independent National Electoral Commission, INEC.

This is even as an Enugu State High Court presided over by the Chief Judge of the State, Justice Innocent Umezulike, on the same day granted a motion for joinder brought by Mr. Orji Chineye Godwin, Chiefs Cletus C. Akalusi and Orji C. Orji seeking to be joined in the suit (number E/446/2014) brought against the PDP by Mr. Charles Okafor of the Enugu State chapter of party.

Mr. Okafor is praying the court to declare that no ward congresses held in Enugu State on November 1, 2014.


He is also asking that the delegates, who emerged on the date should not be used for the purpose of primaries or subsequent processes.

The Court in Abuja presided over by Justice A.F.A Ademola, ruled that the applicants had no Locus Standi, as they were not necessary parties for the determination of the suit and therefore could not be joined in it.

The court also heard the main suit before adjourning it for judgment.

Chief Solo Akuma, SAN appeared for the plaintiffs, while Chief Mrs. AJ Offiah SAN appeared for the defendants in the suit.


It could be recalled that counsel to the national leadership of the PDP, Frederick C. Olisa, had on Tuesday confirmed that the party’s nationwide ward congresses to elect 3-man ad-hoc delegates validly held in Enugu State.

This was contained in an amended affidavit by the PDP counsel to override his earlier submission to the contrary in line with emerging facts.

Meanwhile, granting the motion for joinder by the trio of Mr. Orji Chinenye Godwin, Chiefs Cletus C. Akalusi and Orji C. Orji, the Enugu High Court presided over by Justice Umezulike held that there was nothing in the law to shut out the applicants from being heard in the matter.

Counsel to the applicants Chief Tagbo Ike with Chuma Oguejiofor and nine others, argued that the applicants were people to be affected if they were not joined in matter haven emerged in the ward congresses in Enugu State chapter of the PDP.


The court fixed Friday, November 21 for hearing of the substantive suit.
Mr. Sam Orji appeared for the plaintiff, Mr. Charles Okafor, while Mr. Emeka Etiaba represented the PDP.

EMOTION rose in Enugu, the Enugu State capital, on Wednesday, as the Federal High Court in Enugu remanded the leader of Biafran Zionists Movement (BZM), Benjamin Onwuka and 10 others in prison for alleged treason.

They were arraigned on a four-count charge bordering on treason and attempt to intimidate and instill fear in President Goodluck Jonathan and Governor Sullivan Chime through their activities in BZM.
