Chief Judge of Enugu State, Justice Innocent Umezulike, Friday, reserved for November 28 ruling on the motion asking him to dismiss and strike out a suit filed by Mr. Charles Okafor and others demanding the cancelation of the November 1st 2014 ward congresses of the Peoples Democratic Party (PDP) in Enugu state.

The application for dismissal of the suit number E/446/2014 was made by Chief Alex Izinyon, SAN, the counsel to first defendants, the PDP, who based his argument on the fact that the court lacks the jurisdiction to entertain the suit, which he said, was an abuse of court process and that his clients, PDP, was not properly served.

Chief Izinyon, who led a team of over six lawyers including; Emeka Etiaba, Obinna Nanka and M.O. Fagbemi, told the court that a similar suit filed by Chinenye Orji, Cletus Akalusi and Orji C. Orji on behalf of themselves and other delegates elected during November 1st ward congress of the PDP in Enugu state, was going on at Federal High Court Abuja.

He said that the Abuja Federal High Court had earlier granted two injunctions first restraining PDP from tampering with the result of the November 1 ward congress and or conducting a fresh ward congress in Enugu State, and also another injunction restraining Mr. Ikeje Asogwa from parading himself as chairman of the party in Enugu state as Elder David Aja remained the Acting chairman of the party following the resignation of the former chairman, Engr. Vita Abba.

Charles Okafor and others had approached the Enugu Chief Judge’s Courtchallenging the validity of ward congress of the PDP  insisting that no ward congress took place in the state on November 1st 2014.

But Izinyon Friday argued the 38-paragraph motion supported by three exhibits, including certified copy of the result of the ward congress of the PDP conducted in Enugu sate on November 1st, 2014, that there was a ward congress of the party on the said date and that already some delegates elected at the congress had approached an Abuja Federal High Court demanding that nobody should tamper with the list of delegates elected at the congress.

Citing several authorities, the Senior Advocate of Nigeria submitted that when a court is already entertaining a suit with subsisting orders, and similar suit with the same subject matter is filed in another court of equal jurisdiction, the latter would be struck out as abuse of court process.

Arguing that the issue of jurisdiction transcends the rule of the court as it is the spinal cord of any matter, Chief Izinyon urged the court to dismiss the suit also on grounds of improper service as required by Section222 of the Constitution, noting that the PDP National Headquarters instead of being served directly at Wadata Plaza Abuja, was served through a liaison office.

The counsel to second set of defendants (Chinenye Orji, Cletus Akalusi and Orji C. Orji), Tagbo Ike, accompanied by other lawyers concurred with the submission of Izinyon, adding that the matter was an intra-party one which the court has no jurisdiction of entertaining.

But the counsel to the plaintiff, Sam Orji who cited several authorities argued that the suit was not an abuse of court process and urged the court to rather strike out the motion.

Justice Umezulike, however, fixed ruling on jurisdiction for Friday November 28, 2014 which is the eve of the PDP House of Assembly Primaries

Public opinion in Enugu is against Chime. Even those that are pretending to remain with him are beginning to question their "blind loyalty".

Truth is that Chime has nothing to offer anybody. Not to politicians, not to the ordinary folks

Let's even assume that he goes to the Senate, what will that mean to those pretending to stick with him? Appointments? as a first time senator, that will be as hard as hell. Projects? same same.

So it is just a project that will favour only him. He wants to go to the red chambers and stretch his long legs and answer Senator.

Don't mind the sly man. Chime cannot be trusted. He was making peace with cudgel in hand. On one hand, he reached an understanding with the Ekweremadu camp before President Jonathan, then he returned to Enugu only to have his people file suit No.

E/439/2014 seeking to stop the Deputy Chairman of Enugu PDP, Elder David Aja from parading himself as Acting Chairman of the Enugu PDP. But Aja is the rightful Acting Chairman, and also the only person empowered to convene a meeting of Enugu PDP in line with the PDP constitution. The PDP National Working Committee also affirmed the position of party's Constitution at its 388th meeting on 30th October and conveyed same in writing to the PDP, Enugu, but only for Emperor Chime and turncoat Ken Nnamani to disobey the constitution and the NWC's directive to summon another illegal meeting to purportedly affirm Ikeje Asogwa as Acting Chairman.

Two, Chime purportedly reached a peace agreement and wants to stay in PDP, but he sent his fronts to go to and obtain a black market injunction from the notorious Chief Judge of the Enugu State High Court against the November 1, 2014 PDP Ward Congresses.

Meanwhile, let it be known that what Chime told some PDP stakeholders he invited to the Enugu meeting earlier this week to the effect that he remained in the PDP was because he was expecting to get the news of the cancellation of the Ward Congress by the PDP NWC meeting holding in Abuja that day. Unfortunately for him, the NWC never did any such thing, even though he was hoping that that the 500 million naira bribe he has been boasting that the gave to some members of the national leadership would work for him to that effect. Only Lagos and one other state's congresses were cancelled. In fact, more disappointing for the Governor, the same PDP lawyer he thought he had bought over went to court the same day to file an amended affidavit based on the true facts made available to him by the National Organising Secretary to affirm that indeed the ward congresses held in Enugu. Thus he overrode his earlier submission to the contrary.

he also told the meeting that they all were in Abuja where a red carpet was rolled out for Jonathan as the consensus candidate and boasted that Jonathan cannot turn around to stop him from imposing his own consensus candidate because what is good for Abuja is good for Enugu.

So, Chime is now in a tight corner. Now that everything is working against him, let us see how he remains in the PDP as boasted.

Here are the issues raised by the report.... a dozen and 3. Please lets leave sentiments and deal with the issues:

1. Enugu’s 7.8 IGR is the lowest percentile, compared to the other South East states.
2. Dependence on crude revenue/federal allocation: Revenue estimates in the State suggest that about 85% and 75% of the revenue was sourced through FAAC in 2012 and 2013, respectively - talk about Feeding Bottle Federalism.
3. The State has not been able to produce acceptable/realistic medium-term fiscal documents
4. Enugu runs into deficits because it lacks the mechanism to forecast the macroeconomic environment and revenue within a fiscal year.
5. Today, therefore, Enugu is sweating profusely under the heavy weight of loans/debts, which purposes and applications leave so much to be deserved.
6. Besides, the manner in which these requests are made, are in complete violation of the Fiscal Responsibility Act and further contravenes all laid down rules for an effective fiscal regime.
7. The observed ambivalence and the lack of coordination amongst the ongoing projects have compounded governance in the State.
8. There is complete absence of a Public Private Partnership (PPP) plan. In fact, so-called PPP in the State is more of a conjecture by Chime Administration for the continued deceit of Enugu people. The same goes for the continued remark about financing on-going projects.
9. The standard practice is for loans to be investment-driven or be able to catalyse production and development as in the case of key infrastructure and it should be able to offset itself. It is not really so in Enugu. Between 2011 and 2014, a total of N4.8 billion has been requested from various Commercial Banks in loans to fund the secondary education level. Sadly, they were largely ill targeted. For instance, how would 16-seater buses distributed to secondary schools with a loan of over N1.5 billion address the infrastructural decay and poor teacher morale arising from poor and inconsistent salaries?
10. How would the N13 billion Secretariat being built with loans offset the loan?

11. Indeed, the comparative assessment of revenue, expenditure, and debt stock of Enugu state descriptively portend increased danger of a bubble ready to burst.

12. In conclusion, it is imperative to warn that generally, the impact of huge public debt on economic growth may not be immediate, but could be overwhelming in the long run if it is not utilized judiciously. This makes the current debt burden in Enugu State worrisome and humongous with disastrous consequences if not checkmated immediately.

13. Enugu State is borrowing too much and thus has to bear the saddle of servicing high levels of debt. When debt is too high, as in Enugu’s case, the ability of the current State Government or future administrations to finance it decreases, leading to a high probability of default and subsequent downgrading by creditors. Too bad!

14. There is also the moral burden of a departing government acquiring an N11 billion loan instead of worrying about offsetting existing huge debts.

15. The idea of the House approving the loan in a closed-door session, and the rising political temperature in Enugu PDP over 2015, have therefore led Enugu groups and the opposition to allege, and rationally so, that the loan is an election largesse.

• December 8, 2011, N1.8 Billion loan (Fidelity Bank) for counterpart funding for the State Universal Basic Education Board (SUBEB).
• September 12, 2012 N1 billion Fidelity Bank loan for the expansion of agric projects in the State and purchase of machinery for State’s pineapple project.
• October 30, 2013, N835,459,032.FMCB and Skye Bank loans for counterpart funding of MDGs 2012 capital projects.
• November 26, 2013, N120 million First Bank loan for purchase of vehicles for traditional rulers.
• March 28, 2014 N1 billion UBA loan for refinance of N5 billion GTB loan earlier itemised.
• March 28, 2014 N1.5 billion (Sterling Bank) on for counterpart funding of the UBEB.
• April 16, 2014, N600 Million First Bank loan for MDGs.

All above are before the current N11bn ( and N7bn?). Nobody should tell me someone is not benefitting from all these. Who is the finance commissioner?

I loved Chime's administration to the point that there was security to some extent in Enugu especially compared to his predecessor Chimaroke. Chime also tried in building infrastructure.
However this his power grab as he is leaving office is very very annoying and wicked. Rightly said that those representing enugu had not been up and doing except Ekweremadu, but to fill the positions with his son, brother, inlaw and former chief of staff is pure greed.
Chime should have just gone to rest after his governorship and remained a stateman.

But alas am happy for the happening. As long as this doesnt degenerate into open confrontation by thugs and killing of innocent people, it will enable enugu to have a true election in 2015. And if care is not taken Enugu governorship will go to APGA.
Now the people's voices may be heard.

I pray that there will be no truce or settlement let the ballot decide.

Thanks TechRev. For above counsel and for all you said.

Your post presents the situation aptly. Once you say anything against Chime, straight, you are Ekweremmadu sent.

But I can see how you were able to pass thru your points without being so labelled (hopefully).

Truth is that there is a gangup against any decenting opinion. I, on this forum, said that Chime's programmes were not deep, that paving, painting and repainting Enugu city centre was window dressing by a leader who lacked understanding or who has no interest in dealing with the key problems of the people of the State. I even said that Chime's focus was at the easy to see city centre not even the entire Enugu city. Nsukaa, 9th Mile area, Oji River, totally neglected. Then I didn't know about his political ambition of putting all his relatives in power. I didn't know about billions in loans got in the name of projects that don't touch the life of the people.

Now, Chime's true colours are beginning to emerge. I work on the premise that the evil and atrocities of Chime as with other evil leaders will attract their rewards -destruction. The deceit and oppression cannot last forever. For Chime, I hide not my mouth in saying that the man is wicked. And what is happening now is just the beginning.

Now over to Ekweremmadu, you won't know that I don't see him, he doesn't know me and I can assure you that I have not been singing his praise in any way, anywhere, in this forum or elsewhere. Its just that belief that once against Chime then ur of Ekwere, but thank God for ppl like you.

Honestly, if you ask my opinion. Ekweremmadu and Chime are both sides of same coin. Non has really won a political victory on own efforts. They both have been fetching from the same stream of political anointing. So it's truly hightime a good political battle purifies the system. Both have been establishment people, coasting to vitory on pdp rigging machine. That's why they are both struggling for the same pdp flag. Let them both seek fresh political platforms and square equally with other candidates and we see.

But my primary focus is on Chime and I was not wrong. Many are fooled by his window dressing. Many years from now, many more people will see how much destruction he has bestowed on Enugu ppl

Chime is perfectly within his rights to seek ANY elective position he's qualified for in Nigeria! If the incumbent he wants to replace feels he's better qualified than Chime, he should sell himself to the delegates and electorate based on what and what he has achieved since he was elected as a senator; rather than sponsor all these pathetic and shameful mudslinging and dirty politicking that's presently making the rounds on the hinternet!......It's smacks of being seriously insecure with your record as a Senator!

Since when has a state gov't taking loans been seen as a criminal enterprise? These knobheads are looking at everything through their thieving goggles, and think because they have sticky fingers that everyone else would too! If you feel those loans taken weren't used for the purpose they were taken for, and if you feel the Governor has been stealing gov't funds, then either take your evidence to court or shut the fuc/k up!

These useless representatives we have in Abuja are nothing more than business-as-usual politicians! Just what the fuc/k have they done to protect and further the interests of the South East from 1999 to date!? They keep quiet when the interests of Ndigbo are being threatened, or if we're being shortchanged, and turn to fuc/king wimps! Compare them to rep's from other regions (especially the north) who raise hell anytime there's a real (or even imagined) threat to their regions interests! When the time came for AIIA to be included among the airports to be upgraded with a Chinese loan, Tambuwals house of reps -for whatever reason- refused to include AIIA Enugu; what did our useless reps do?......Fuc/kall! Princess Stella had to source for funds in-house to fund its construction! Check all over other regions and you'll notice billion dollar projects being constructed (hydro-electric dams; railways; deep-sea ports; state-enabled real-estate; export processing zones; etc); if not for the new terminal at AIIA we'd have been left with nothing but egg on our faces (forget that second Niger bridge and Onitsha river port)! All those our Senators and Members of the House of Reps are useless and are just in Abuja to massage their egos!

Sullivan Chime is no saint, but he has done more than past Governors to uplift the economic and social status of Enugu state, and he has my 120% support! He hasn't touched all areas of course, but i can cut him some slack considering what Enugu receives from the federation account! Rather what i've noticed is that with the limited funds available he's targeted specific areas that -in the fullness of time- should yield economic returns that would benefit the entire state! He has improved the states IGR immensely, and brought some measure of sanity to governance! I've noticed how readily the state gov't reacts to complaints made on this site, and this is a refreshing departure from the norm!

So like i said earlier; you hired hatchet-job twerps should give it a rest......it ain't working! smiley

Enugu judge withdraws from PDP chairmanship suit over ‘death threats’

Justice A. R. Ozoemena of the Enugu High Court, on Monday, withdrew from hearing a suit brought by Ikeje Asogwa, praying the court to uphold his purported appointment as the chairman of the Enugu State chapter of the Peoples Democratic Party, PDP.
The judge said he took the action because he had been receiving calls and messages on his mobile telephones by people he did not name, threatening to kill him and therefore would not go ahead with the case.
Mr. Asogwa, a loyalist of Governor Sullivan Chime, had instituted the suit asking the court to restrain the defendant, David Aja, from parading himself as the Chairman of the state’s PDP.
Mr. Aja was deputy to Vitalis Abba, who resigned his position and by virtue of the constitution of the party, should have stepped into the position of his predecessor. However, some party chieftains appointed Mr. Asogwa instead as substantive chairman of the party.
Mr. Ozoemena, on November 14, took full arguments on the motion on notice and adjourned the matter for November 24 for the ruling of the court.
The judge said the case file should be returned to the registrar of the Enugu State High Court for onward transmission to the chief judge of the Enugu State High Court, Justice Innocent Umezulike, for reassignment.
Worried about the development, Justina Offiah, SAN, counsel to Mr. Asogwa, described it as unfortunate.
On his part, counsel to the defendant, Ogochukwu Onyekwuluje, held that the proper thing to do was for the judge to petition the police and make available to them the phone numbers in question for thorough investigations that would bring the culprits to book.
Meanwhile, the Federal High Court, Abuja on Monday upheld the result of the Ward Congresses of the PDP in Enugu State on November 1.
Three PDP members, Orji Godwin, Cletus Akalusi and Orji Orji, on behalf of themselves and all the delegates elected in the election, had instituted a suit seeking for the declaration by the court that the list of delegates was the only valid list for the PDP delegates for primaries in Enugu State to the exclusion of all other lists.
The national chairman of the party, Adamu Mu’azu, its national organising secretary, Abubakar Mustapha, and the Independent National Electoral Commission, INEC, were joined as defendants in the suit.
The plaintiffs also sought an order restraining INEC from accepting any other list of delegates for the PDP primaries in the state.
In his ruling, Justice A.F.A Ademola, held that a valid ward congress for the election of a three-man man delegate from the 260 Electoral Wards of Enugu State took place in Enugu State on November 1 and that the list before it remained the valid list candidates returned at the election.
On the issue of jurisdiction, which the defendants said the court lacked, the judge held that the court had jurisdiction to hear the suit because the matters in contention were not simply the internal matter of the PDP.
Mr. Ademola said the delegates had been duly elected, had certain rights, and could therefore ask the court to protect their rights as delegates.

@OP i dont know what your problem with Gov. Chime is ? But as for sen. Ekweremadu i dont even know him- because he only exists in abuja & not my LGA of Ezeagu. Ekweremadu might have helped chime in his re-election but it is hon. Ugwuanyi i know in 2015

Meanwhile meeting in the villa yestd night yielded no fruits for Chime who had mobilised Enugu elders he so despises for just one mission, to offer to Mr. President that he will drop his ambition to go to Senate if Ike would be pressed upon to drop his.

To Mr. President, any proposal to calm Enugu would be acceptable to him so long as Ike is allowed to contest.

So oga gobina is back to square 1. Infact he was told to go and reconcile with Ike the same he he would always tell ppl to go and reconcile with his erstwhile Chief of staff.

It might be the natural law retribution, it could be nemesis or Karma, Otil1 knows not.

Ka n'egekwa nu nti. The last has yet to come.

The Political crisis rocking Enugu State ahead of next year’s governorship election continued yesterday with 16 out of the 20 councillors of the Igbo-Eze North Local Government Area, moving a motion for the impeachment of the council chairman, Bonaventure Onuh.

Onuh is a close ally of Senator Ayogu Eze, who is believed to belong to the faction of the ruling People’s Democratic Party loyal to Senator Ike Ekweremadu, who has been slugging it out with Governor Sullivan Chime in the ongoing factional crisis over 2015 elections in the state.

The councilors on Tuesday unanimously voted to serve an impeachment notice on the chairman of the council, Mr. Bonaventure Onuh, over alleged “misappropriation and embezzlement of local government funds” within this year, totaling N1,751,2291,339.

THE gloom of the Governor Sullivan Chime led faction of the Peoples Democratic Party, PDP in Enugu State was compounded on Monday after a Federal High Court sitting in Abuja upheld the ward congresses of the party held on November 1. More than 400 kilometers away in Enugu the same Monday, the camp was further deflated by the decision of an Enugu judge to withdraw from a case where the Chime camp was expecting a counter judgment from that in Abuja.
The Chime faction lost out after its members boycotted the congress and the faction is now in contemplation whether to remain and fight within the PDP or to move out to another party and express its political prowess. A move towards the All Progressives Grand Alliance, APGA was said to be in contemplation but allegations of bad faith between both sides following an aborted transaction in 2011 when Governor Chime faced similar troubles is now said to be hindering progress in that direction."

Ok. The congress validly held is adequate. If you can leave it there I guess PDP shouldn't have qualms accepting results of a congress validly held.

Meanwhile, the Enugu Professionals Forum has decried what it saw as an assault on the integrity of the judiciary by some politicians and lawyers with respect to the lingering crisis in the Enugu State chapter of the Peoples Democratic Party (PDP).

The group said in a statement signed by the Interim President Nebechi Ugo that the threats issued by undisclosed persons to Justice Raymond Ozoemena of the Enugu High Court that forced him to withdraw from further hearing of a matter relating to the leadership tussle in Enugu PDP, were the handwork of “political desperadoes who are hell bent on subverting justice and the rule of law in Enugu State.”

So who dunnit eh

Further... "It appears that some people are bent on returning Enugu to the dark days of impunity which the Chime administration has successfully steered the State away from for the past seven and a half years. We certainly cannot allow this to happen”, the group said.

Idunbelieveit! Now pushing d blame to the other side!!! Before long those Chime administrators that attacked Ezeagu medical mission will be pushed to the other side too.

There is really no new s about town. Enugu is just so quiet. Only at the beer parlours do you see joyous drinkers gisting away on the happenstuff in Enugu politics. Gov. Chime has provided entertainment to ndi Enugu who now have what to gist about. All about Enugu, the gist is everywhere, of different colours and shades, with spices and garnishing. Chime has become a laughing stock really.

Meanwhile, the strong woman of Enugu politics, the one and only ever, the Chief of the world, Ifeoma Nwobodo clearly doesn't know how to manoeuvre the political maze that Enugu politics has become. She's completely out of her depths and her usually very noisy in-your-face- campaign train has become so quiet, not going East nor West of Nkanu land. Completely a wreck of a political voyage. Quite sad indeed. But miracle still fit happen
