You are starting to mix issues. You mentioned that her case is breach of promise of marry, now you are talking about presumption of marriage under common law. If there is a presumption of marriage, then there cant be a breach of promise to marry again since the marriage is already presumed by law.

If you go by S.197 of the current Evidence act, breach of promise to marry expressly needs corroboration. If that is the case she is setting up in court she can't succeed without it. There are also judicial authorities to that effect. It is not a matter of opinion, it is express in d statute.

you didn't get me, I didnt say corroboration is not a requirement, I only said it won't be an issue, it will be very easy for her evidence to be corroborated. I brought in presumption of marriage under customary law because you said cohabitation does ipso facto raise any presumption. My point is, if cohabitation can raise presumption of marriage, how much more promise to marry.

you can but it will depending on circumstances arising from each case, some can succeed when there was a reciprocal duty to support.

He can claim for enrichment e.g. engagement gifts he gave to her with the prospect of getting married. So long it was made clear that the gift had to be returned if the purpose of the gift falls away

This case also involves a baby on way, and child maintenance is not one thing he is getting away from thats for sure.

The women are mostly the ones at fault. Ask the man what happened
