Asset freezing is a legal process which prevents a defendant
(usually an apparent fraudster) [1] to an action from dissipating
their assets from beyond the jurisdiction of a court so as to
frustrate a potential judgment . It is widely recognised in other
common law jurisdictions [2] and such orders can be made to
have world-wide effect. It is variously construed as part of a
court's inherent jurisdiction to restrain breaches of its process .
The jurisdiction arises in part from the Judicature Act 1873 ,
which provided that "A mandamus or an injunction may be
granted or a receiver appointed by an interlocutory Order of the
Court in all cases in which it shall appear to the Court to be just
or convenient..." Relying on this, Jessel MR in 1878 declared, "I
have unlimited power to grant an injunction in any case where it

The sad thing is Nigerians refuses to believe these people are looters. They refuse to target these people that have milked the country dry. They refuse to hold these thieves responsible. Many folks that are poor and suffering in this NL will still be defending all these rogues. We cannot blame Buhari for all the decay that have been going on in this country. The country is broke. InvertedHammer: They are not even related. Also, I did a little research on how much £20 from 1969 is and discovered it's present value is approximately £230 of today. 230 = 103, 500 Naira today. That is at 450 Naira to the pound. 103,000 Naira is not a lot but not a child's play when you consider how many are to be paid out. Many must have made losses yet it was a tidy little sum. harveyspec: If the nigerian government think they have a case against him,they would have to involve interpol who after investigations and having been satisfied that a prima facie case has been established against him goes to a court of competent jurisdiction to secure an arrest,search warrant or mareva injunction to freeze his assets!! They will not just freeze his assets because a Nigerian court so orders.Even President Obama cannot order the freezing of anyone's asset without an order from a court of competent jurisdiction!! Missy89: Here's the simple fact of the situation. The assets in the United States are only six which by estimate wouldn't exceed the $150 million mark at approximately $25 million each, give or take. Both of them don't have an offshore account in the states in a bid to avoid IRS and the scrutiny of the CIA, which would be their undoing. Its a simple case of diplomatic lobbying to get them extradited to Nigeria or get the feds to get them on money laundry charges and poof, they are sent to Nigeria. Assets owned by them can't be leased or sold neither can it be used as collateral for loans, they can only access funds in investment funds (if they have one). Even if the assets in the states are tied up in the courts which I doubt, it only accounts for approximately 11.1% of the total funds, so not a bug deal if the bulk of the money in Europe can be accessed. |
