James Faleke To Appeal Kogi Election Ruling by HzRF(m): 5:12am On Jun 13, 2016
James Faleke, the running mate to the late All Progressives Congress (APC) gubernatorial aspirant, Abubakar Audu, has said he will appeal today’s ruling on his petition against Kogi state gubernatorial election.


Speaking to journalists in his Abuja resident, Faleke said although he would have to consult with his lawyers, he will be appealing Justice Halima Mohammed’s ruling.


Faleke said:” I watched the verdict of the tribunal on TV, one thing I can say is that, the judge’s have delivered their own judgement, I will consult my lawyers, upon which I am very certain that we will appeal the judgment.”

“I am not a lwayer but I can say that it (the judgment) is not in tune with our constitution,” Faleke said.

He said the court is wrong to have ruled that he had no locus standi in the case.

However, a non perturbed Faleke asked his guest to find something to eat.

“Please there is food, find something to eat. We are celebrating!” he said.


A Federal Capital Territory Court on Monday, June 6, ruled dismissed an application by Faleke challenging APC’s nomination of Yahaya Bello as governor of Kogi state.

The party following the death of it former flag bearer for the state, Abubakar Audu had asked Faleke to stand in as a running mate to Bello.

Meanwhile, Kogi state governor, Alhaji Yahaya Bello has hailed the judgement of the election petitions tribunal sitting in Abuja, which in a unanimous decision today, upheld his victory at the poll.

He said the decision of the Bench Lords has further justified his election as the governor of Kogi state, saying the victory belongs to the people of Kogi state, our party APC and lovers of democracy across the nation.

Faleke has a tenable case. The election petition tribunal really failed to consider the merit of his case. He should exhaust all legal channels to get back his mandate.

Lawyer will just eat this guys money, 1, He did not participate in all the process as required by law because he wasn't in the primary election so giving the ticket ab initio was like handling the governorship to PDP hence they gave the ticket to runner up, as it stand Yahaya bello participated in all election process as required by law.

2, This Faleke is a member house of reps representing a constituency in Lagos state and at the same time claiming to be Kogi governor, talk about eating cake and still having it.

3, My fear for Faleke is at the end of this drama he will be politically irrelevant both in Lagos and Kogi

Is he suppose to contest in the first place, a representative from lagos and still claiming kogi state, which side are you mr Falake, this is even enough to disqualify him.

Tell us what you know about the Nigerian constitution and electoral law.
You think Yahaya Bello or the Kogi PDP wouldn't have brought this up if it was a case?

it is good 4 democracy, let him go up 2 suprem court. 1 need 2 knw if electoral act(inec law) is more suprem than nigeria than constitution, let SC set a precedent incase of next time. Kodus 2 falaki

In the case of CPC vs Ombugadu. Page 45 of the judgement. The supreme court affirmed that votes belong to the candidate and also affirmed that a primary expires as soon as a winner emerges. So Bello really has no claim over primaries section 141 of the electoral act as amended was enacted to correct what is called the amaechi mischief in legal parlance. That section affirms that a CANDIDATE that does not participate FULLY in all stages of an election cannot be declared WINNER. Note the emphasis on CANDIDATE and WINNER. not party but candidate. It is a no brainer to know that votes belong to candidate and not to party. The judgement of the kogi tribunal did not come to those who are conversant with electoral cases as a surprise. The kogi case is a political case and justice can only be done at the apex court- the supreme court. Expect political judgements from the first two courts- tribunal and appeal. Bello knows he is in trouble hence his resort to using scare tactics to prevent the major actors in the case- faleke and wada from apealing.

He has a slim chance of winning, the tribunal did a nice job only that there is limit to when a party presents its candidate.
Faleke should get stronger legal team.

APC played it's game well, reconciliation should be considered.

KOGI- PLOT TO PREVENT WADA AND FALEKE FROM GOING ON APPEAL REVEALED.

There are indications that following the tribunal ruling that controversially dismissed the petitions of James abiodun faleke and former governor idris wada, plans have been set in motion to ensure that the major petitioners do not proceed on appeal. This plan was hatched when the tribunal judgement was procured from the trial judge via the influence of the president court of appeal- justice zainab bulkachuwa. Our source who is an insider in the Bello camp revealed that the first stage of the plan was to purchase the judgement for over a billion naira. The next stage is to deny both parties of the judgment transcript so that they cannot file their appeals on time- thus giving the court of appeal the opportunity to throw the appeals out on the technicality of late filing. Already that plan is underway as the tribunal chairman, justice halima muhammad has been incommunicado since last week. Without her presence, the judgement transcript cannot be released. Another aspect of the plan is to use the security agencies to harass and intimidate the petitioners. Already, many people are held up in underground cells undergoing torture to force them to implicate the petitioners in crimes so they can be picked up and forcefully prevented from going on appeal.

That 1.5 billion naira worth tribunal ruling cannot survive the scrutiny of the apex court. The trial judge knows that. No wonder she started complaining of malaria while reading the judgment.

The votes belong to the party, therefore the party can transfer it to any tom dick and harry...
Why didn't parties reclaim the mandate from governors who defected to other political parties... undecided
That election had already been won technically...by Abubakar Audu..
