An American who has naturalised in Nigeria, Mr. James Tillery, on Thursday challenged the legality of his aborted extradition by the United States Federal Bureau of Investigations from Nigeria.



He told the Federal High Court, Lagos that the process was flawed, as the FBI did not follow due process, the News Agency of Nigeria reports.



According to Tillery’s lawyer, Mr. Tayo Oyetibo (SAN), said the US Government did not show respect for Nigeria’s law in the planned extradition.



The naturalised Nigerian was arrested on August 13 at his office in Victoria Island, Lagos and is being detained by the police at Alagbon Close, Ikoyi.



The attempt to extradite Tillery to the US was aborted by Immigration officials at the Murtala Muhammed International Airport, Ikeja.



He was alleged to have committed sundry offences in the US between 2003 and 2005.



Oyetibo said, “The arrest of Tillery by the Nigeria Police on the authority of a US District Court and handing him over to the FBI is preposterous.



“The officials did not show respect for the laws of Nigeria … Nigeria is not a lawless nation. Due process should be followed in the process of extraditing him.”



He urged the court to protect the rights of the applicant and order his release with immediate effect from “illegal detention.”



Oyetibo said the detention was an affront to Nigeria’s sovereignty and an infringement of Tillery’s rights.



According to him, the extradition violated Sections 5 & 6 of the Extradition Act Cap E25, Laws of the Federation.



There was no written request addressed to the Attorney-General of the Federation by any Consular officer,” he added.



Counsel to the police, Mrs. Susan Ezema, said the applicant was arrested because of the treaty between the US and Nigeria.



She said the applicant was arrested as an American and that Interpol was empowered to hand over a country’s citizen to the requesting country.



Justice Mohammed Idris ordered that Tillery should be given medical attention by his personal physician.



He adjourned the case till August 31 for judgment on the substantive application.

@Wales, it does not matter what crimes he committed, he has a point. The US cannot invade a foreign country and kidnap one of its citizens. If they want to extradite anyone, then they have to follow the letter of the law, just like they would expect any foreign government to do in their own country. They cannot come and do anything they like because they feel like it.

James Tillery is an American by birth not a Nigerian btw.

Send him back to face the music. American citizenship is virtually impossible to renounce, so Tillery holds dual citizenship. They picked him up as an American and NOT a Nigerian. His lawyer is splitting hairs and wasting time; 'Nigeria's not a lawless country' indeed.

let me do you one better, the US invaded pakistan to kidnap a pakistani citizen (not a US citizen) and extradited him to the US to face charges. the guy shot and killed several people outside the whitehouse.

i hate when people just pre-judge others and beside we always wanna condemn our own which is quite unfortunate,there have been cases where American authority have came to Nigeria to kidnap people and take them to America to prosecute but because due process wasn't follow the presiding judge discharge and acquit them and they were brought back to Nigeria,so see we can just let people come here and infringe on our law no matter the circumstances.Beside this people are more corrupt than us and even people from other countries like the Mexicans,purto ricans,Jamaicans,Italians,Europeans[eastern block]and Asians[chinese ]do more crimes than Nigerians in America and still when they leave the shore of America they cant be apprehend and the law enforcement wouldn't deer to go there and kidnap them ,they will follow due process, please I'm not in support of crime but for crying out loud we not the most corrupt country on this planet, and instead of putting on the blame on our citizen abroad we should blame the government and our politicians for looting our money and taken away all the opportunities meant for the citizens,imagine if all our stolen wealth is put into good use for the development of this country,imagine what our country will be like and the opportunities young and all people would have,so let handle our problem because American will never allow any country treat his citizen anyhow under any circumstances,why should we?

when Americans are arrested in other countries and even jailed,their authority will come and negotiate and asked for the person or persons to be released no matter what the crime is,and everyone knows this so why should we let people come here and take our citizens without proper process and you cant even take an American offender outside there ,they will tell you he'll be prosecuted there or even send a diplomat to deal with it and they always have their way even in odd situation ,why cant we emulate that i protect our own?

His citizenship should be revoked because he must have lied on the Nigerian citizenship application about being wanted for criminal activities.The Nigerian citizenship should be revoked and he should be extradited back.Nigeria should not be a hiding place for criminals.Including the people that do 419 in America and run back to Naija.They should be sent back to face the music.If you can do the crime, you better be ready to do the time.

He is now a Nigerian and his fundamental human right must be protected. It will be wrong for our police or the Nigeria govt.to honour this extradition without due process. Doing so will impinge negatively on our sovereignty and national respect.

. I dont think, it is technically possible to remove him from nigeria. The last time obasanjo did illegally, they tried to impreach Obasanjo.

Look I worked for a company here some time ago, where some people within the company where trying to frame me up because they were scared , I could start a rival company to thier company. Even they tried to destroy my credit , so that I could not get finance and even tried to make it impossible for me, if I wanted to list a company in the stock exchange. they assume I was silly.  So people frame people. You wait till they prove he is guity.

But under nigeria law. I do not think it is possible. Obasanjo did illegally and they tried to impreach Obasanjo. Nigeria laws do not allow it.

that does not mean you cant take it back, again. All you have to do is to go to the embassy of america in the country you are residing and declare that you are no more a citizen. Its that easy.

You're very right. No matter what he says or signs, the fact that he's born on US soil, he is American until death. They did nothing wrong and basically came after a citizen.

James K. Tillery, 49, the former President of Willbros International, Inc., a unit of Willbros Group Inc., the Panama-based provider of oil and natural-gas services, based in Houston, Texas, was charged in an indictment today with a conspiracy to pay more than $6 million in bribes to foreign officials in exchange for contracts.

James K. Tillery was indicted along with Paul G. Novak, 41, a consultant to the company, on four counts: violation of the anti-bribery provisions of the Foreign Corrupt Practices Act, money laundering, and with two counts of authorizing corrupt payments. The bribes were allegedly made to secure gas-pipeline construction and rehabilitation business from state-owned companies in Nigeria and Ecuador.

In May, the company agreed to pay a $22 million criminal penalty to settle related bribery charges. The bribes occurred between late 2003 and March 2005, according to the indictment.

According to the indictment, Tillery was a WII employee and executive from the 1980s through January 2005. From 2002 until January 2005, Tillery served as executive vice president and, later, as president of WII. Novak was an employee of WII in the mid-1990s, according to theindictment, who later worked as an oil and gas consultant in
Nigeria, purporting to provide consulting services to companies in that field.

The indictment alleges that from late 2003 through March 2005, Tillery, Novak, a Nigerian national working with Novak as a “consultant” to Willbros, Nigeria-based employees of a major German engineering and construction company, and other WII employees conspired to make millions of dollars in corrupt payments to assist in obtaining and retaining a major gas pipeline engineering, procurement and construction project known as the Eastern Gas Gathering System (EGGS). Willbros and its German consortium partner offered to perform the work related to the EGGS project for approximately $387 million. In exchange for being awarded the EGGS project, theindictment alleges that Tillery, Novak, and others corruptly paid, promised to pay and authorized payments to officials of the Nigerian National Petroleum Corporation (NNPC), the state-owned oil company in Nigeria; the Nigerian National Petroleum Investment Management Services (NAPIMS), NNPC’s subsidiary that manages NNPC’s investments in its joint ventures; a senior official in the executive branch of the Nigerian federal government; officials of a Nigerian political party; and officials of the company that operated the EGGS joint venture. Theindictment alleges that most of the bribe payments were laundered through Novak and his Nigerian consulting company partner.

The indictment also alleges that Tillery, Novak, and other WII employees based in South America agreed to make approximately $300,000 in corrupt payments to officials of state-owned PetroEcuador and its subsidiary, PetroComercial, to assist in obtaining a project that involved the rehabilitation of approximately 16 kilometers of a gas pipeline running from Santo Domingo to El Beaterio, Ecuador. PetroComercial was WII’s client on the $3 million project.

If convicted of all charges, Tillery and Novak each face sentences of up to 35 years in prison and fines of $250,000, or twice the pecuniary gain or loss from the offense, whichever is greater, for conspiring to violate the FCPA and for each violation of the FCPA; and $500,000 or twice the value of the funds involved in the ransfer,
whichever is greater, for the money laundering conspiracy.

Willbros, a publicly-traded company that provides construction, engineering and other services in the oil and gas industry, conducts international operations through WII. On May 14, 2008, Willbros and WII entered into a deferred prosecution agreement with the Department of Justice and agreed to pay a $22 millioncriminal penalty in connection with corrupt payments to Nigerian and Ecuadorian government officials in violation of the FCPA. As part of the agreement, Willbros and WII agreed to cooperate, and have been cooperating, with the Department in its ongoing investigation.

The indictment was unsealed today after Novak was arrested upon his arrival into George Bush Intercontinental Airport in Houston. Novak returned to the United States from Constantia, South Africa, after his U.S. passport was revoked. Tillery remains at large.

The case is being prosecuted by Assistant Chief Hank Bond Walther and Trial Attorney Laura N. Perkins of the Criminal Division’s Fraud Section. It was previously handled by former Fraud Section Trial Attorney Thomas E. Stevens. The case is being investigated by the FBI and Internal Revenue Service, Criminal Investigations. Additional assistance was provided by the Criminal Division’s Office of International Affairs, the Fort Worth, Texas, Regional Office of the U.S. Securities and Exchange Commission and Nigeria’s Economic and Financial Crimes Commission (EFCC).
