Does "being alien to the law" and "not necessarily using it" mean the same thing to you as "INEC server does not exist"?

Do you now have to support a silly lie to prove your patriotism?

If INEC did not use a server, how then were they able to use Card Reader for voter verification?

Are you even aware that, based on the existing INEC tenets, deliberate failure to use the Card Reader for voter verification is grounds for election cancelation? This was done both in 2015 and 2019.

So if there was no server, how was the Card Reader able to verify voters?

It simply means it is not advisable in the Presidential Tribunal matter. Anything not backed by the Constitution and the Electoral law does not hold any water no matter how many times you say it.

Later someone can file a case on whether or not, INEC spent the money as budgeted. But as you can see that doesn’t help Atiku currently.

OAUTemitayo:

Did electoral officers input election results into card readers in your presence at polling booth?

If they did, did the party agents sighted and signed to the transmission?

I don't know why you are giving Atiku false hope.

The only results recognized by law is the result sheets signed by party agents and electoral officers.

That's what Atiku should use to prove his case not one server that many voters don't even know exist.

You nailed it.

How do they expect us to value a result nobody knew existed over the results authorised Electoral officials counted and announced in person publicly under the watchful eyes of everyone?

INEC did NOT say that Atiku's claim is "not advisable" or admissible by law. They PLAINLY DENIED the existence of their server.

Is that too complicated for you to grasp?

See, I don't want to call you names, but your position here goes to show how dishonest and shallow your other assertions elsewhere could be.

MaziOmenuko:
INEC may just have made this case easier for Atiku. He just needs to prove that INEC has a server which is easier because so many electoral officers are available to testify that they were indeed mandated by INEC to upload their results to the servers. It would have been more difficult to prove that the figures he reeled out were the actual election results than to prove that a server did exist.

One would think that INEC would have maintained that the results reeled out by Atiku were fake. For them to say they don't have a server is a big miscalculation. A copy of the proposal INEC made to the national assembly to increase their budget so they can acquire servers is available. He can still find some INEC staffs, retired or in active service that can attest to the existence of servers.

Not exactly. Proving a Server existence is one thing (almost impossible - those that claim to have heard of server did not). Do you know it can be as simple as Dedicated server hosting account? Also Atiku needs to prove that authenticity of the results he has over the ones announced by INEC.

Then there is the biggest hurdle, the current law does not support electronic results. That was one of the provisions the amended law had. But Mr President declined.
Re: INEC Server: The Easiest Way Atiku Can Make His Case by pchukwudi: 1:48pm On Jun 15, 2019
There's a huge difference between:
1) proof of 100% server usage in result collation and
2) proof of server existence.

The case here is not about proving that the server was 100% used for result collation.

The case is about INEC denying that its server exists.

Atiku's application was for SERVER INSPECTION. Not for result validation.

Why is INEC denying the existence of its server (contrary to its own documented public assertions) if no evidence of illegality can be found following a thorough audit/inspection of the server?

Seriously, you guys should stop being stupid.

Sorry on the typo.

Yes, INEC say they don't have.

The burden of proof now is on Atiku. So let Atiku provide INEC’s Server.

Bros, I believe Atiku has better luck in mining business than providing any physical server. grin

Proof of server existence is very EASY.

Simple, how did INEC conduct voter verification with card reader if there was no server. It's 100% IMPOSSIBLE to do that.

If they insist that they do not have a server, they will by necessity accept that they did not do voter verification with card reader. In that case, the election will have to be canceled.

It is more than that. Like most big organisations, INEC can have servers and computers for office use.

Atiku needs to prove that a particular computer or server was set up and used for for the Presidential election.

INEC has a database of registered voters and other vital data. There should have a Server computer for those.

But point blank, INEC doesn't have any presidential election server with the kind of results he is parading.

INEC shamelessly DENIED the existence its SERVER - even though you just admitted (and it is clear to every normal human being) that INEC has a server.

So quit your excuses for lies, lawlessness, and government rascality. When the chips are down, you will all surfer the consequences of your sycophancy and collective stupidity.

You are not getting the point. If INEC had insisted that no results were uploaded to the servers, it would have been more difficult for Atiku to prove otherwise. INEC said they have no servers! So the onus is on Atiku to prove they had servers which, to me, is very easy. If Atiku proves they indeed had a server, then he can as well submit that his results were real. I believe INEC goofed. This gets more interesting.
According to the electoral act, what are the procedures for conducting an election that a political agent should accept as standard for signing results sheets?

The result sheets you said were inputted into the card readers, in who's presence? were the party agents there when the results were entered? what is the way of verifying that the results in the alleged server were verified by party agents? Has Atiku been able to prove that the results in the alleged server is different from the collated results on the election result sheets signed by electoral officers and countersigned by the agents of which each had a copy given to him?

How do you tell us to use a result that nobody witnessed its computation as binding result when electoral act only recognise manual result sheets?

I don't know why you people sha want to scam?

Atiku is asking for Server Presidential Results were transmitted to.

INEC said they don't have such server where results were transmitted to.

The question is not if INEC has any server or computers. Afterall the INEC website is on a Server.

Also the request has already been ruled upon at the Court of Appeal earlier.

Here is the link on what INEC said
https://www.nairaland.com/5242978/atiku-pdp-asking-us-server

The petitioners, through their lead counsel, Dr. Livy Ozoukwu, subsequently filed an application on May 8, 2019, seeking an order of the tribunal permitting them to access and inspect the INEC’s server into which results and other data were allegedly transmitted during the February 23 poll.

With the case for Atiku's residential ambition depending largely on winning the notion that INEC had results on their server that favoured him, here is the easiest way Atiku can win the argument at the Tribunal.

Atiku and his legal team need to provide and present the following details:
The alleged INEC Server location, its IP address, brand, total number of units, installed capacity, processing power, configurations, purchase receipts, suppliers, server administrators, pictures of the servers, election results transmission logs to the server, user accounts and finally tell us how he got the information with supporting witnesses who are ready to testify in court.

Note: With INEC coming out to say they do not have any Server that transmitted or received, processed and stored Presidential Results, it is now burdened on Atiku to prove it exists with supporting evidence and witnesses.

They already provided Mac ID of the server which is a unique ID and are ready to invite officials of Microsoft corporation

You guys seem to be twisting this stuff so bad. To what end?

Here's the actual summary of the application, per Punch report:

The Peoples Democratic Party and its candidate in the February 23 presidential election, Alhaji Atiku Abubakar, have filed a fresh application for access to information contained in the smart card readers and “central server”, which it said the Independent National Electoral Commission used for the conduct of the disputed election .

The application is very clear. Stop twisting the semantics to say what it did not say.

so in Your view, Atiku should be declared winner because INEC has a sever? Have you bothered to take a look at the results he generated from the so called sever? And again you want to say that All party Agents present at each polling unit in the country Signed Fake results sheets? Because his results are completely in variance from what was signed and announced by INEC officials. There are a lot of serious questions, the issue of sever or no sever to me is not even amongst them

U don't need a sever to do that in my opinion. Each card reader can programmed for a specific polling unit. Your problem is that you do not know the difference between "what was done" and "what can be done".

The reality is that it was IMPOSSIBLE for the Card Readers used in 2019 (and prior elections) to run data base applications independent of an external server.

But what do you know? You are probably a 19 year old kid who watch too many spy movies.

Guy stop abeg. Did you vote on the Card Reader or you thumbprinted on ballot paper?

Apart of being used to accreditation (verifying you are a valid Voter, the card reader is completely ignorant of every other aspects of the day's activities. Like where ballots where snatched, voters that went home without voting, those that manually got accredited, etc.

Card reader authenticated and identified each voter. Number of accredited voters is documented by card reader.

Yes. But what of those that where manually accredited from the register?

Also is the card reader aware of the party you voted?

Finally the constitution only recognise the results announced and signed off by INEC officials, as well as party agents at the polling units. Any other results are inconsequential and not acceptable by law.

From the video available in public domain, manual accreditations are aptly documented and forensically verifiable.

The onus of proof of manual accreditations rest on INEC subject to forensic verification.

I will ignore the sore taste on your comment.

At the bold, INEC say it did not transmit the 2019 Election Results to any server. Results were manually announced and collated at various centres.

It is now left for Atiku to prove his claim with supporting evidence and witnesses.

INEC said they don't have server.

Atiku is just wasting is time. Even if somehow he could provide concrete proof that a server exist with transmitted results, how will he convince the court that the manually collated results that were signed by over 100k party agents and security operatives should be rejected and results from an INEC server that is known to PDP alone should be accepted as the authentic results?

You don't get the point. INEC has submitted to the tribunal the none existence of a server. That is what Atiku needs to prove exists. He may not need to prove any other point in court. If it is proved that INEC has servers that collated results, then it could easily be proved that the results Atiku reeled out are real.

Just go on twitter and see how INEC is being shamed with videos of them talking about their servers prior to election. You can search for Mike Igini's interview with channels TV where he was bragging about how it will be difficult to rig the elections because the results are transmitted from pooling units straight to INEC servers.

Atiku is not contesting the results announced by INEC. That is the main issue.

He has an entirely different results that is totally different. He said a whistle-blower got it from, wait for it - am INEC Server!

His own total is even higher than the one from INEC. Also Buhari even performed better in South East in Atiku's own.

Don’t be easily swayed by what you see on social media. PDP is more interested in proving their case on social media than before the tribunal because they know they have no case. Mike Igini’s interview proves nothing. The PEPT will rule on PDP’s application to inspect INEC server and I can assure you that the application will be thrown out because there is no server to inspect.

Again, proving the existence of a server is not enough to prove that the results on the server are authentic and more valid than those manually collated and signed by party agents. EU observers today said they are not aware of any server that results were being transmitted to. My point is, it takes more than the existence of a server to nullify the results manually collated and signed by accredited party agents.
