I wonder though whether Falana averted his mind to the fact that after the conclusion of a case there is a right of appeal which must be exercised within a certain timeframe if parties wish to and after which the principle of effluxion of time comes into play.

A pre-election matter doesn't suddenly become a post-election matter just because an election has taken place when the appellant party still has a cause of action and has not run out of time to file an appeal. The law does not say that the court of appeal is the court of final judgement rather it is the Supreme court on pre-election issues.

The mere conduct of an election does not override or extinguish the right of appeal of any party.

State the electoral act that supports the removal of a elected governor because his deputy wss disqualified?

Yes, it does because the Appeal court already passed a judgement in favour of the APC before the election.

The Court of Appeal is not the final arbiter on pre-election issues, the supreme court is. The right of appeal had not been exhausted and PDP rightly made use of the available right. Was Zamfara not a pre-election issue? Did Court of Appeal not give judgement enabling APC in Zamfara to contest? Did the Supreme court not overturn that decision hence the PDP leadership in Zamfara today? Did Falana raise this issue?

The fact that an election had been conducted did not negate an ongoing suit which the parties had a right to appeal up to the Supreme court!

A lot of people have said the judgment of the Supreme court is very funny.

First of all, the federal high court judgment which the supreme court upheld never removed th tue governor, it only disqualified the running mate.

Secondly, PDP only appealed the case after the Election not before. Apc actually won the appeal in the Appeal court.

A running mate can no longer be changed after elections he contested is won. Even at the point the High Court made the pronouncement on the APCdeputy governorship candidate, the window of nomination had been closed by INEC and it is only in the event of death that they are permitted by the Electoral Act to make any other substitutions.

Imo is not technicality.

It's the same issue of judges misled to make questionable judgment..

The judges themselves might be willing collaborators on both occasions.

The equation now seems to be balanced. Why are the two parties disturbing our peace?

Falana should focus on how to win El Zakyzaky case that he abandoned nd leave bayelsa election matter, he is not vast in law more than d 5 supreme court justices that delivered the case.

Just because he manage to win Sowore case he now thinks he is more vast than anybody in law

Supreme court don't originate cases, rather they inherites them from lower courts.

Nonsense mary odili gave a verdict on an election matter that was never existed anywhere.

Mary Odili was given a little test, but she didn't only failed woefully, but also exhibited her devilish attitude.
Too bad.

Oga, stop fooling yourself.
The case went through various appeals from high court to the Supreme Court

How old are you or what's your level of education?

Keep shut if you have nothing to say
It's not a must to comment thereby exposing your ignorance

He is really ignorant to have thought a case will just appear in supreme Court without going through the lower courts.

Why single out Mary Odili? There were 5-members on that panel and they ALL gave a unanimous judgement.
The same Mary Odili didn’t fail woefully and exhibited her devilish attitude when she gave a favorable judgement for APC on Kaduna and Nassarawa gubernatorial cases? Why are you people like this? angry
It’s your personal decision if you have issue with the Bayelsa judgement, but stop the (blame game) hypocrisy!
This singular act won’t grow and strengthen our democracy.

I love your analysis

Mary Odili and co actually understand Falana points but something blindfolded thrm to the facts before them. Selling of judgement in Nigeria court is more lucrative than Dangote and Adeunga business.

Zamfara appealed the decision while election was still going on.

Bayelsa appeal in supreme court while the election results were already declared.

Who said this

Even the whole candidates list were changed in kogi when Wada died.

Supreme Court in that scenario claimed that votes belonged to the party.
