He still have cases to answer. The emphasis is necessary.
I was wondering if people commenting actually read the news piece. The Supreme Court just ordered a retrial. Period!.

This is a funny position by the Supreme court. Section396(7) of the Administration of Criminal K=Justice Act (ACJA) provides as follows:
'...notwithstanding the provision of any other law to the contrary, a Judge of the High Court who has been elevated to the Court of Appeal shall have dispensation to continue to sit as a High Court Judge only for the purpose of concluding any part-heard criminal matter pending before him at the time of his elevation and shall conclude the same within a reasonable time : Provided that this subsection shall not prevent him from assuming duty as a Justice of the Court of Appeal.”

The purpose of this provision is to cure the requirement of a matter to be tried afresh when a judge is elevated in order to save time. This is the current law today so why is the Supreme court relying on old, time-wasting provisions? The conviction is not quashed on the merits but on this issue already clearly addressed by statute? Tanko and co, na wa o!

I wonder why some people cannot comprehend simple English. The supreme court only asked for the case to be reassigned to a judge that has jurisdiction over the matter. I don't know why some are jubiliating ...he is not yet a free man yet tongue

When the judge was elevated to the appeal court, why didn't he request to the NJC to reassign the case since he is no longer a fed high court judge? That the case may be judge by a fed high court!/its wrong of him to judge a case as fed high court judge when is being promoted and now an appeal judge.

Federal Government lawyers are stupid. Ministry of justice is very stupid and they think they can take Nigerians for a ride? Its an intentional act to give Orji the edge.


However, Kalu also flawed. You are giving judgement by the fed high court? He jumped the appeal to go to the supreme court to get a judgement ? Who does that? He could claim that the person who gave him the judgement is also the same appeal judge but its still no excuse. The case could have also been reassigned. On the technicalities of the appeal, its null and void too for the case should have gone to the appeal and not the supreme. Supreme was not to even hear the appeal in the first place. Nonetheless, because the judiciary is a mess under the present government, rule of law is trash.

Neway, they didn't set him free per say so Orji ain't free really, just that he was sent back to the high court for another trial by another judge.

My point is, you have to pay a price to get that position. If the Igbos don't build intertribal bridge, stop feeling like superhumans, cease the agitation for secession and end online name callings, the quest to get a Nigerian president of Igbo extraction will remain a mirage.

Justice Eko explained that the declaration was on the ground that Justice Mohammed Idris was already a Justice of the Court of Appeal, as at the time he delivered the judgment sentencing the appellants.

He held that a Justice of the Court of Appeal cannot operate as a judge of the Federal High Court.

The apex court, therefore, ordered the Chief Judge of the Federal High Court to reassign the case for trial
.


He was not discsrged and acquitted. The case will be assigned to another judge and retried.

Some times we need to cut this judges some slack. The basis of this judgement is fair to Kalu, the lower court should be blamed. The judge that sentenced Kalu did not have any power to do so. Be it technical as it is, it is a strong point for the defence under law. The supreme Court couldn't have done otherwise once it was proven, so we cannot blame them. Infact, doing the opposite would be complete miscarriage of Justice against the defendant. He may be guilty but a new judge, qualified to pronounce it under the law will have to do so.

Actually, the judge has the power to sentence him. The ACJA empowers the elevated judge to sit on this part heard criminal matter. Thus, a high court judge that has been elevated to Appeal court can conclude on cases he was already handling as a judge of the high court.
