Re: Canadian Student Visa Thread Part 22 by Balloo(m): 8:20pm On Jul 10, 2023
Hi, please can someone on here answer this question for me; can the student with an approved study permit, before their travel, apply for their spouse and dependants to come to Canada possibly at the same time when they plan to travel. Please bear in mind that the student did not apply for them at the same time while making his own application but wants to make the application for them after his own has been approved.

Thanks.

I really do not know, I just feel it is another avenue to see what is happening to your application if the main portal does not show any update.

What was the reason for the PFL?

If the reason is something that can be explained with evidence to show that the applicant is not guilty of what he/she has been accused of, then the best course of action will be to write a detailed structured letter addressing the subject and backing it up with evidence.

Bobomaigida:
It is PPR for a close friend after two rejections.

First Application (GC Key)
Submitted – 11/09/2021
Upfront Med passed – 14/10/21
Refusal – 7/12/21

GCMS notes revealed no detailed information, just that the VO stated that though funds seem available he/she/it was not convinced that third party funds will be available for the duration of the programme.
The sponsor was her brother in law who was based in Canada and he had provided statements of about C$51,000 with no lump sums at all, while she had paid first semester fees at Lambton college for a two year programme, after this rejection, she was in dilemma on what to do, because Lambton College does not allow deferral of admission and she was hoping to resume for Spring 2022, she actually submitted the application early to get quick processing in line with the 4 months timeline of IRCC then, since there was still time before her proposed resumption, she decided to resubmit her application, with same documents hoping that a considerate VO will look at it with favourable eyes, but guess what she was bounced again!

Second Application (New Portal)
Submitted – 8/02/22
Existing upfront med passed – 18/2/22
Refusal – 25/5/22

By this time, she had started online courses with Lambton college because spring classes had started, hoping that the second application will be successful. When the notes came out there were blunders from the VO.
The VO claimed that her whole family was travelling when she was only traveling with her daughter while her husband and son were to be in Nigeria.
The VO also claimed that the sponsor and the applicant were not bearing the same surname whereas this was not true. Applicant surname was same as sponsor who was her brother-in-law.
The VO was claimed there was little documentation to show relationship between sponsor and applicant, when picture and a letter was written to explain the relationship.
Then the VO also picked out the fact that the statement submitted did not have names on it. (MBS could not be done since the account was a foreign one) at the point of trying to scan and attach, the first page of the statement was omitted.
When the rejection came, it was time to strategize because no retreat, no surrender. She applied to get her semester tuition payment refunded, this was done after like 1 month, then she went back to the drawing board.
Since her grade was a second class upper, she decided to jettison colleges and instead pursue Masters, she applied to Northeastern University in Sept 2022 with plans to resume Fall 2023, the application was fee and she was offered a 15-month programme in Analytics, she had also applied to Toronto Metropolitan but was rejected. Then she went to start building her POF such that by the time she submitted her application it would have been perfect, and we all joined our heads together to draft a very strong SOP starting with an LOE on the last application, the LOE was used point out the blunders the VO had made in that application. She built her POF from Sept 2022 till she resubmitted a new application May 2023 for Fall 2023 intake. This time she did not do upfront medicals because she wanted to see progress with a medical request.

Third Application (GCKey) used because of the documents size
Submitted – 19/5/23
Medical req – 14/6/23
Medical done -30/6/23
Medical passed – 5/7/23
PPR – 6/7/23

Docs Submitted

Letter sent to day care in Toronto seeking for waitlisting for her daughter.
Joint account statement housing the POF (USD11,590 and N3,500,000).

Thanks for this update I think this will solve my issue too.since my agent did Visiting visa for me instead of SOWP.
Since this is an automatic at the point of entry.
I hope I'm not mis-quoting you sir?

zubizareta:

No. Once she enters Canada and enrolls as a as a student, she becomes a legal status holder and with that, u can flagpole and convert your visit visa to sowp at the border. No concerns with immigration on this.

Please beg your agent not to mess yhings up for you.

He needs to mail the school to address the issue of your admission letter that it originated from the school and that it is not fake.

Though the admission has been cancelled there is no problem, snd that is a different issue.

let the school clearly write a that your initial offer letter is genuine and that you were once admitted but because they did not receieve your tuition deposit they cancelled the admission.

This is very important to prevent the intending ban if you fail to address it well.

Please swing to action yourself. Send mail to the school.

Call them if you can

Let them confirm that you were actually admitted in the first place.

I think niagara is now having this issue, someone i know got banned because of same issue.

She is using a legal service to address it.

CanJ:
The agent helped to get the admission.
The agent said that the admission has been cancelled now because I don't pay the school fees before the time schedule. But is that how they do?

Hi Joke,

The case seems simple, however, my suggestion on tackling it will be a gamble, which might work or not work depending on the provenance of the fund.

The good thing is that they have requested you to provide statement from a commercial bank.

Get a reference from the MFB stating that you are the owner of the fund and how long the funds have been fixed, also get a statement from them that is at least six months old. This letter should also state that you have access to the funds at all times. If possible, let them include their official email address for confirmation purposes.
Liquidate the funds and move it your commercial bank account where you will generate another statement to show the inflow of the funds.

Then write a detailed LOE to explain why you had to save the money in MFB - ie They pay higher interest rate on savings, ensuring the value of the fund is maximized.
Refer IRCC to the CBN regulations on MFB especially Section 3 (a) (permissible activities) and Section 12 (b) (sources of fund) where the former states that MFB can receive deposits from any individual not just poor persons, and that as a matter of fact you are considered a high NetWorth customer because of deposit you made into the bank, while the latter states that the sources of fund for MFBs amongst which is deposit from customers which can be anyone like you. Then state that because you have access to the fund you can make use of it anytime especially when you need to make foreign payments by moving the funds to your commercial bank like you have done presently.
