A federal high court in Abuja has dismissed a suit filed by Chukwuemeka Nwajiuba seeking to nullify the candidacy of Bola Tinubu as the presidential candidate of the All Progressives Congress (APC).

The suit, marked FHC/ABJ/CS/942/2022, was filed by the former minister and the incorporated trustees of Rights for All International (RAI), a non-governmental organisation.

The suit also sought to void the primary that produced Atiku Abubakar as the candidate of the Peoples Democratic Party (PDP) for the 2023 presidential election.

The plaintiffs in the suit filed through Okere Nnamdi alleged that the primary that produced Tinubu as the APC presidential candidate was tainted by corruption and widespread vote buying, adding that the majority of the delegates were bought with dollars.


The plaintiffs also queried Tinubu’s source of income and his educational qualifications.

In Atiku’s case, the plaintiffs alleged that he also engaged in vote buying.

Delivering judgment on Thursday, Inyang Ekwo, the presiding judge, held that the court lacked jurisdiction to hear the matter on the grounds that the plaintiffs do not have the locus standi to file the suit.

The judge condemned the involvement of RAI, a non-governmental organisation, in politically motivated cases.

“It is only in this country that an association registered for charitable purposes will venture into partisan politics with such audacious sense of impunity,” he said.

“At this time in the political journey of this country, politics and political activities must be left to those who are authorized by law to do so.

“This action by the first plaintiff (RAI) is an outrageous act and an aberration to all known principles of the law of associations. In short, it is the height of lawlessness and ought to be stopped forthwith.


“Associations registered under Part F of the CAMA 2020 must understand the limits of their operations under the law. Where they fail to do so, the legal sanctions will apply.”

The judge further ordered the dissolution of RAI and asked the Corporate Affairs Commission (CAC) to take over the group in accordance with the provisions of the law on the dissolution of bodies registered pursuant to Part F of the CAMA 2020.

The Federal High Court (FHC) sitting in Abuja has dismissed a suit filed by Chukwuemeka Nwajiuba, and a group, Incorporated Trustees of Rights for All International (RAI), compelling the Independent National Electoral Commission (INEC) from accepting or publishing the Presidential candidates of the All Progressives Congress, Bola Tinubu; and the Peoples Democratic Party, Atiku Abubakar.

Nwajiuba, a former Minister of State for Education, purchased the APC presidential form for N100m, but polled only one vote at the June 8 primary.

The plaintiffs who filed the suit on June 22, also attached as evidence video recordings showing Rotimi Amaechi and a PDP Presidential aspirant, Dele Momodu lamenting that delegates to their respective primaries sold their votes.

In the suit marked: FHC/ABJ/CS/942/2022, Nwajiuba and RAI approached the Court with 25 issues for determination. The APC, PDP, Tinubu, Atiku, the Attorney-General of the Federation (AGF) and the Independent National Electoral Commission (INEC) are the 1st-6th defendants.

Specifically, the ex-minister asked the court to determine:

- whether the composition of the delegates of the APC contravened Article 11(A) 12(1) and 13(1) of the constitution of the APC.

- if the composition of the delegates at the PDP primary contravened Section 33(1) and (5) (c) of the constitution of the party.

- whether having regards to the clear unambiguous and express provisions and tenor of Sections 6(6) (A) (B) and (C) read alongside Section 15(5) of the 1999 Constitution, the court has the inherent judicial powers to nullify, cancel and declare as illegal the Presidential primaries of the APC and the PDP.

- if all the votes cast in favour of Tinubu and Atiku at the special national convention of the APC and PDP are illegal, null and void and of no effect whatsoever on the grounds of corruption and selling of delegate votes and voter inducement.

- if having regards to the express provisions of paragraphs 1 and 8 of the 5th schedule of the 1999 Constitution, the corrupt conducts of the “third defendant (Tinubu) and the 4th defendant (Atiku) in buying votes and corruptly inducing delegates with dollars and naira in various sums to secure their votes at the special national convention… disqualifies them from further seeking, contesting and holding the office of the President.”

In seeking 26 reliefs, the plaintiffs asked the Court to:

= rule that Atiku and Tinubu along with their agents bribed delegates with dollars and the votes they got should be declared illegal.

= declare that the conduct of the 3rd (Tinubu) and 4th (Atiku) defendants who by way of corrupt inducements of delegates with US dollars which being a foreign currency and non-legal tender in Nigeria under the CBN Act… used the dollars for the inducement of votes in favour of the 3rd (Tinubu) and 4th (Atiku) defendants has rendered the votes they scored at the special convention of the 1st defendant (APC) and the 2nd defendant (PDP) illegal, void and invalid and of no effect whatsoever and thus inhibiting (Tinubu and Atiku) from benefiting from the proceeds of their gross illegalities.”

= return the 2nd plaintiff (Nwajiuba) as the duly elected/nominated Presidential candidate of the 1st defendant (APC) being that by the operation of Section 90(3), the 2nd plaintiff, Hon. Chukwuemeka Nwajiuba, is the only contestant out of the 10 contestants whose source of N100m is verified and complied with in the Electoral Act as contained in the print out of the names of the bank statement.”

= declare that both the APC and the PDP have the obligation to observe the federal character principle in the selection of Presidential and Vice-Presidential candidates and that INEC ought not to accept any nomination that contravenes the country’s constitution.

Delivering judgment on Thursday, Justice Inyang Ekwo of the FHC, Abuja held that the court lacked jurisdiction to hear the matter on the grounds that Nwajiuba was not accredited nor contested in neither the APC nor PDP Presidential Primaries hence lacks the locus standi to institute the case.

On the 1st plaintiff (RAI), the judge held that the body was not an Aspirant in the election and the provisions of Companies and Allied Matters Act (CAMA), 2020 do not give the Non-Governmental Organisation (NGO) a legal right to institute the case.

The judge condemned the involvement of RAI in politically motivated cases.

"The 1st plaintiff used his registration to undertake a political agenda.

“It is only in this country that an association registered for charitable purpose will venture into partisan politics with such audacious sense of impunity. Politics should be left for those authorised by law to do so."


“I therefore make an order dissolving the 1st plaintiff (RAI) forthwith,” he directed.

He also ordered the Corporate Affairs Commission (CAC) to take over the dissolved RAI and deal with it in accordance with the provisions of the law on dissolution of bodies registered pursuant to Part F of the CAMA 2020.

Justice Ekwo further dismissed the suit for lack of merit.
