The lawyer asks CCB to take constitutional action within 30 days, or it will ask a court to compel it to do so.

A Lagos-based law firm, Lawflex, has asked the Code of Conduct Bureau (CCB) to prosecute the Labour Party presidential candidate in the 25 February election, Peter Obi, for failing to declare the assets he stashed in tax havens while serving as a state governor.

In the letter written on Thursday, signed by Olukoya Ogungbeje and received by the CBB the same day, the firm said its purpose is to bring to the CCB’s notice an investigation on the issue done by PREMIUM TIMES.

The PREMIUM TIMES 2021 investigation provides details of Mr Obi’s investments in some notorious tax havens which he did not disclose in his mandatory CCB filings before and after leaving office as governor of Anambra State.

The businesses were set up and operated overseas, including in notorious tax and secrecy havens in ways that breach Nigerian laws.

Other prominent Nigerians involved in similar offshore dealings include the former Aviation Minister, Stella Oduah; the acting Managing Director of the Nigerian Ports Authority, Mohammed Bello-Koko; former governor of Osun, Gboyega Oyetola and his Kebbi State counterpart, Atiku Bagudu. They have all denied any wrongdoing.

The law firm said that Mr Obi flouted the code of conduct for Nigerian public officials and urged the CCB to “act appropriately” by arraigning the former governor before the “Code of Conduct Tribunal for contravention of the Code of Conduct for Nigerian Public Officers as spelt out in the Fifth Schedule to the Constitution of the Federal Republic of Nigeria 1999, (As Amended).”

Violation
Mr Peter Obi failed to declare his offshore holdings and their associated assets. As a governor, he also continued to operate and maintain foreign accounts including with Lloyds in the UK.

The former governor admitted that he did not declare these companies and the funds and properties they hold in his asset declaration filings with the Code of Conduct Bureau, the Nigerian government agency that deals with the issues of corruption, conflict of interest, and abuse of office by public servants.

He said he was unaware that the law expected him to declare assets or companies he jointly owns with his family members or anyone else.

After becoming the governor, he continued to be a director of Next International (UK) Limited for 14 months.

Ultimatum
Mr Ogungbeje urged the CCB to immediately investigate the violation and invite Mr Obi for questioning.

The lawyer warned that if the CCB refuses to take constitutional action within 30 days, his firm would seek a “judicial review by way of an Order of Mandamus in a court of competent jurisdiction in a bid to compel performance of public duty.”

If Bukola Saraki a serving Senate President was made to stand trial before the CCT for not declaring his assets honestly, an ex-governor that underperformed should stand trial.

If Justice Walter Onnoghen, a serving Chief Justice of Nigeria stood trial before the CCT for not declaring his assets diligently, a second runner up should stand trial.

Nobody is above the law. As an Anambra man, I need justice!

The petty thief must return what he looted from Anambra. If he claims it was not looted, then he must inform the CCT why he didn't declare it as a public official. No other way about it.

Obidîot must stand trial for stacking our money in tax havens- facts.

Even the people wey de talk this talk know say dem just de make noise.

PO and DATTI no be saint o. But in today's Nigeria, I don't think there is any politician as clean as they are.

You can't say that about tulumbu.
Tinubu is a catalogue/encyclopedia of fraud, drugs, thugs, fake identity, and so on.

Bring it on. The victory will be sweeter.

It's not a dead case. Has nothing to do with elections.

It's a code of conduct Tribunal matter.

His name was not struck out of the publication. It's still there.

The doctrine of double Jeopardy doesn't apply here. No one has taken him to court on the matter before.

Obidîot must stand trial- facts.

Expecting Obi to be nailed with Pandora is more like saying Tinubu would be nailed with the dead drug case.

If Obi supporters are down playing this, then Tinubu's case can also be downplayed

Tinubu's "alleged" case does not come in here. Tinubu's case "allegedly" occurred more than 30 years ago.

Tinubu wasn't convicted - facts.

Even if he was convicted ( which he was not and will never be), he'll be very eligible to contest because it's passed the 10 years restriction the CFRN 1999 provides for ex-convicts.

Pandora's case is going to court for the first time. It's a novel case.

He doesn't need to be sent to jail. A pronouncement by the CCT that he is guilty of dishonesty makes Obidîot ineligible to contest election in Nigeria till after 2031- facts.

Obidîot must be prosecuted.

The petty thief must stand trial - facts.

It's because the case is more than 10 years and the constitution prevents it from stoping a person from contesting.

The CCT trial will not stop the petty thief from contesting. It will only find out why he didn't declare his assets as Anambra Governor if he didn't still them, chikena. It has nothing to do with Elections. It's a public service matter.

It's not at the state high court or federal high court. It's at the code of conduct Tribunal. You get?
