[b]A Federal High Court sitting in Abuja yesterday stopped the Bayelsa State chapter of the Peoples Demoeratic Party (PDP) from conduting its governorship primary slated for November 19. The court made the pronouncement following a motion brought by Governor Timpreye Sylva, who was denied a return ticket.

There had been a face-off between the PDP and its governor over the second term ticket which had produced several lists of cleared aspirants, the last one was released on Sunday which sealed the hope of Gov. Sylva from contesting.

But giving the order stopping the November 19 primary, Justice Gabriel Kolawole warned the ruling PDP not to tempt the court’s might by going ahead with the exercise. However, the party said yesterday it was ready to defend its action . Justie Kolawole said the order must prevail until the determination of the motion.

Specifically, the court warned that any steps taken by the PDP in defiance of its order which may be pre-judicial and subversive, it would not hesitate to nullify such steps or decision in order to uphold and protect the sanctity of the court process and to vindicate its integrity as the established constitutional arbiter between the state and the citizens and between the citizens inter se.

The order that tied the PDP’s hands from conducting the election reads; “That in the event perhaps, unlikely that the second defendant [PDP] in defiance of these orders takes steps which may be pre-judicial; perhaps subversive of these orders and of this proceedings before the returned date adjourned to November 22, 2011, this court will without much ado, proceed to making such necessary orders to nullify such steps or decision taken once they are served with the motion exparte and or order made herein in order to uphold and protect the sanctity of the court process and to vindicate its integrity as the established constitutional arbiter between the state and the citizens and between the citizens inter se.”

Justice Kolawole has, however, directed Governor Sylva to put the defendants in the suit on notice within 72 hours of being served with same motion on notice to show cause why the governor is not entitled to the preservative orders in prayers one to three in the motion ex-parte.
Justice Kolawole further held that “in the event that the defendants when served with the originating summons on notice and enrollment in this order, the second and third defendants (PDP and its acting National Chairman. Abubakar Kawu Baraje) were unable to show such reasonable or just cause why the order shall not be made, the court will have no hesitation in either granting the said order in the way and manner couched or may grant Prayer Four as the alternative prayer in the motion exparte.

In his reaction, one of the aspirants, Hon. Henry Seriake- Dickson, told journalists that he was not aware of the court order.“ I haven’t seen the process; when we get it, we shall take action, accordingly. I am a party in this case and naturally, I have a right to be heard.”

In the motion exparte, Governor Sylva had sought:
•An order of interim injunction restraining the defendants, privies, agents, servants proxies or any other person whosoever described from conducting, organizing or holding any meeting or ward congress from embarking on any activity leading to the holding of any fresh governorship primary election for Bayelsa State.

Similarly, former Special Assistant to the President on Niger Delta Affairs, Timi Alaibe, former Director-General of Nigerian Television Authority (NTA) and proprietor of Silverbird Entertainment Group, Ben Murray-Bruce, as well as the Permanent Secretary in the Ministry of Water Resources, Godknows Igali, who were leading contenders for the party’s governorship ticket, had their fate sealed by the PDP.

The National Working Committee (NWC) of the party came up with its final decision in Abuja on Sunday, declaring that the governor and the other aspirants were unsuccessful in their bid to be cleared to contest the ticket in Saturday’s PDP primary election in the state.

According to a statement entitled “Final Decision on Bayelsa,” issued by the National Publicity Secretary of the PDP, Professor Rufai Ahmed Alkali, the NWC had reviewed the reports of the Screening Committee and Screening Appeal panel for the gubernatorial primary.[/b]

You are not ACN with all that their 'WILD-WILD-WESTERN-ALAYE-AREA-FADA-AND-SONS-PASS-THE-BATON-TO-THE-NEXT-CULTIST-POLITICS!!!. . . This over-all distabilization of 'non-governance' should not be tolerated in PDP.

You MUST return. . . chop your own 8 years. . . then hand over.

No need wasting time and resources to exchange one politicak 'dofus' (aka AGBAYA) for another.

To be frank I dont see reason why would Sylvia be wasting much of his time going to court on already concluded matter.

Will the court impose him on his party? Will court say the working committe or whatever they called themselves that said he doesnt fir to run second term are not serious?? When you belong to organization with leadership and the leadership of the organization says your service is no longer require can you force yourself on them??

Let us not forget this guy has be over stepping his boundary since when Gej was to be sworn in as acting president and he did not stop there last few weeks ago he confessed threatening to kill the president, the wife and one other man and threatening to use Boko animals to ruin his state haba please let say the truth to ourselves democracy does not madness for God sake.

Even in America today can any governor say such to Obama and mention terror organization as weapon to distablise his state and he will not be jail by now? Can Sylvia be smiling if a serving commissioner threaten him in such way? Please lets say the truth to ourselves he over jump his boundary by that statement as a head of a party in his state, as the head of goverment in his state, as Leader of people this statement is uncalled for.

And if by chance he was clear to contest this same people will rise again and say oh PDP is finish or Gej is finish, oh in our party it can not happen so Sylvia is too big for them to discipline that is Nigeria for us speaking with both side of the mouth but now PDP are doing the right for unmanned statement, too raw a statement from a leader and people are angry about it. I'm not PDP member but there should be sanction for any reckless action or utterances from any leader of any party , democracy is not all about madness or careless talk.

By the way is it a MUST to go Second Term?? If they said No let him take it with good faith or quit the party this is just simple there are other party on ground he can join so easily. No need of wasting his time and money for what can not be reversed. This is just my view.

Let all the Tinubu haters hide their face in shame. What is happening in Bayelsa never happened in any of the ACN
controlled states. Yes there were some form of imposition of some candidates but then one has to look at loyalty
before anything else.

I can't see anyplace where the court stopped the primaries. But when there are oyb's and their flies on the thread, any far stretched conclusion is aight! grin
The court has asked PDP to provide the reason why Sylva was disqualified in 72 hours, it is only if PDP does not send a rep to the court the primaries will not hold.

Sylver is just wasting his time. You can't eat your cake and have it. By the time PDP put forward their defence, Sylver will loose out completely. The fact is conducting election is a "process". The party can determine who qualifies and who does not qualify to contest their primary. What the party has no power over is if he has won the party primary and they want to subtitute him illegally. Now the party primary he is claiming he won in January was based on INEC Time Table and guidelines for April 2011 Election. This Sylver joined other governors to challenge the conduct of the governorship election in April for tenure extension and they won. The interpretation of the court judgement Sylver and others won was that all process leading to Bayelsa governorship election in April was null and void. So why is he relying on the party primary that in the eye of law not existence.

Buh he was cleared at first,I think if it were a sane country and sane voters this kind of party cannot win d election, they are confused,I just don't know why they don't do things right.if u r not clearing him then don't bt I heard he was cleared at first just for them to come again that he no dey again.with sylva,dickson,alaibe etc they are all the samething,nothing good is going to come out of their administrations than looting

What does sylva want 2 come back 2 do to finally kill of the state just as uduaghan is doing 2 delta state? Bayelsans are seriously suffering and all the governor does is to snap n place his pictures at every junction of the state. Hmmm God help bayelsa o.
