Let me clarify. I applied for spousal visa June last year and was declined. Then I appealed and they withdrew their original decision December. Then February they asked me to submit my passport for visa, its two weeks now. How can they hold on to my passport for 8 months to issue visa? How do I travel elsewhere when the need arises?

You applied for a spousal visa, application was declined, you appealed and they decided to overturn.... .... ..... Yipeeeeeeeeee

Now you want your passport back, because they seem to be your wasting time? It's like salt and mess situation in one's mouth... ..... .. .. ....... .. .

Do you have any need to use your passport now? If you do, request for your passport back, without the spousal visa, use the passport and return it back Iater....
Patience they say, is a virtue... .. .. .. ...... .

You can say that again. For this kind of case, a lawyer is definitely required. The home office would surely overturn decision and the courts would put the repatriation bills on the home office accounts........ ..

Hi, Spouse Visa Application

- Submission : Nov 2015 (in India)
- Refusal : Jan 2016
- Appeal : Feb 2016
- Listed : July 2016
- Still awaiting court date

My Local MP wrote to immigration this month and they replied, upto 11 months on average and in some cases longer from the date the hearing was LISTED to get a court date.

My question is, How is the appeal courts on the day? is it formal, informal etc? what sort of questions do they ask?

Am I able to submit new evidence to the courts? Tickets to India in Feb 2016 and Oct 2016? new pictures with my wife? Whatsapp chat, Skype call logs etc?

I did not (and I wish I did my research) submit call logs with my wife in the original submission and the ECO belive my marriage is not genuine. What questions will the courts ask on the day of the appeal.

Your answers will help me a lot in preparing when the day awaits

You should have started saving and printing communication logs from last year already... .. .. .... .. . ...

Paid for the normal appeal process, Spouse visa to be heard at Tribunals.

I just want to say, you guys are God sent! Your comments here have helped a lot of people including myself and my spouse. Oga Lexus I hail ooh!!
I am one of them silent followers.
So my wife and I got married in 2015 . I did the "return to naija" thinking naija was the place to come to in 2013, oh boi it is a hard place all those uncles who promised you big jobs and connections omo no one helped. only person that helped was for nysc.

After getting married in 2015 and a baby on the way, I decided to move back to the UK, I got a Job and earning good money 45k and above. Unlike the miserable N100,000 naira per month in naija, lol 2 nites in sip pay. So my wife came to visit in 2016 she gave birth to my child at a hospital we didnt pay nhs nothing and we were not charged. my wife and child moved back to naija

So that birth thing made me afraid that they would refuse my wife spousal visa as per nhs treatment on visiting visa but speaking to people they encouraged us to put in for the application as both my child and myself are british and nhs no charge us. I ticked all the financial criteria plus all the other criteria's

I attached photos, ticket print outs, our dubai holiday photo's and tickets with our baby, bank statement pay slips etc
Timeline(wife non priority)

Online application submited- Dec 24th 2016
Biometrics - Dec 29th 2016
Documents sent-4th Jan 2017
Documents returned- Feb 10th 2017

HA the money no plenty joor! Lol if you put down pampers money plus cerelac, feeding allowance. Money no even dey to go suya sport watch champions league.

I think the reason why they might have been fast was maybe for the fact we said 28th of Feb for travel date. I did not do priority because my wife couldn't travel earlier due to this so called "bond" contract you have to sign with the bank you work for. If she leaves within the first 2years her referee would have to pay 2million. So we waited to respect the contract.. .. hence I did not bother using priority... the money go enter ticket...

Just a thought that crossed my mind, not saying it's going to happen. But be mindful that the NHS delivery you experienced (just might) be raised at point of entry...... . Madam should prepare a story incase........ .... ....

Assuming your Msc was conducted in English (not hausa, Yoruba or igbo), you are good to go.
Just get a letter to back the Msc up.
NB: Start saving and printing all logs. Start sending emails to each other (discussing sweet nothings), like emails are going out of fashion.........

It took a week to get mine. I did same day application interview this was done in. the UK only question I was asked was how I got my citizenship and also someone had to sign the back of my babies photo's in one of the pictures he didn't write his middle name. Luckily for me I told him to sign 4 pictures. And I had an extra one.
Getting his Nigerian passport in the uk now that was a nightmare
Hopefully if your child's British passport is done it would boost your application especially with this new ruling where the Judges mentioned the interest of the British child. In my application cover letter I kept hammering that point "in the best interest of the British child"

Get your wife to send a self addressed envelope (next day delivery), and a letter explaining her mistake, and also include a telephone number, incase they need to contact her.
