Iamgrey5:you should remember APC only got an injunction from the 'appeal court" to participate in the election few days to election. appeal court delivered their judgement after election . the judgement did not remove the governor but you cannot go into an election without a deputy. since inec window for substitution of candidates is over; it means Lyon went into the election without a deputy which is also against the Constitution on joint tickets. falana is no longer thinking properly. 1. the only judgement before election was that of the high court disqualifying APC. 2. APC only got an injunction to participate in the election. 3. appeal court delivered it judgement after election. 4. legal precedent said pre election cases are allowed to run their course in Nigeria court even after election. 1 Like 2 Shares |

I beg to disagree. In the case of Yahaya Bello. He ran even without a deputy because Faleke refused to run with him. The same Supreme Court upheld that election and said it is the party on the ballot and not the Candidate. The Governor elect then nominated a deputy who was never on the ballot. The court is very very wrong; if Audu's deputy in Kogi state then, Mr Faleke has no influence or benefits on the votes given to him and his principal. He was replaced with Bello and new deputy, He went to court and lost; why did the same court sack elected governor because of deputy's name change which there is no evidence he even forged his certificates. This is simply an emotional judgement by the court with no legal backup. 3 Likes |

Lostz:Apc actually won the case in Appeal. Check the supreme court judgment very well, The judges set aside the judgment of Appeal court and affirmed the judgment of Federal high court. However, the federal high court judgment did not disqualify Apc as a party because there was no legal justification. 2 Likes |

So the several APC members, the SC removed last year after the elections on certificate forgery......what should happen? He didn't speak up then? 2 or 3 HoRs-Elect were removed by the SC last year in Yola, so the SC had no jurisdiction because? Oga, na waoh! |

Iamgrey5:That is a function of when decisions were entered by the courts. You cannot force the courts to pass a decision until it is ready. It is not a sound argument that elections had been conducted and therefore any existing right of appeal is expired! |

Dansuqi:He is correct only in your eyes. He actually shot himself in the foot. If he agrees that the case has already been decided at appeal before election held, then says the tribunal should have been referred to hear it after elections, does it not make the tribunal superior to the appeal court then, if for example the tribunal gives a judgement in favour of PDP, does it not nullify the appeal court judgement and who does the APC appeal to? Will it not become an abuse of court process for the appeal court to entertain a matter it has previously given judgement on while the tribunal set aside it's judgement? |

Our politicians should stop this trend of losing and election and running to court to win the election. Power belong to the people. And when the people have given their mandate, on who's mandate do you want to rule even if you get a verdict too. It's a recipe for disaster This practice is inimical to democracy. They are like Oranges and apple Sir. The point been that even though Obi declined. The party which was the owner of the ticket still has to be on the ballot. They can replace her. That was what the Supreme Court interpreted in the case of Bello. For example God forbid if Degi had passed away God forbid after the election before inauguration would the APC ticket had become invalid? No. The Apc as the owner of the ticket would have nominated someone else just like it happened in Kogi and affirmed by the Supreme Court. That is the point am trying to make. Lostz: |
