Hmmm, The question is not the house or who built it. Is the land a family land or a land in the city and in whose name is the title document. This person has a strong claim. Assuming the father died intestate, who are the executors of the his estate cos in any event they are the ones to manage what he left behind. Thirdly its very unlikely that any judge will give him judgment against his mother especially if that is a family house i.e. where they all grew up. Lastly he needs to give his mother peace in her old age not rancor and tears cos those tears are like curses. Let him be guided. 20 Likes 2 Shares |

It seems he is concerned that his mom might sell it off and keep all the money for herself. It is a valid concern seem he footed the bill for the house. He should discuss the ownership of the house with her and allow her to live in it. He should have clarified ownership ever seems he sent the first one naira to his father. I also have a friend who is finishing up his father’s house, That’s was the first thing i asked him to discuss with his mum. The woman confirmed she is leaving the house to him, with peace of mind he is currently pumping in millions to renovate the whole house but he can’t sell it while his mother is alive, like some posters rightfully stated; its a family house as long as his mother is still alive. 4 Likes |

Number one is I understand that he felt maybe he's broke or he didn't have much on him and now he wants to get married. The things is as far as the mama is alive he needs to forget about that house for now.....as hurt as this might sound he needs to rent an apartment somewhere and stay there....for crying out loud you can't ask your mum to leave her husband house and go to a rentage house just to satisfy you.... I knw because you're about to start your own family you will either rent a one bedroom apartment or two and that will be expensive but all that ought to have been in your plan before returning to Nigeria. Asking your mum to pack out of a house you renovate or completed for them is a NO NO NO GO AREA. What if when u left for southie They didn't have a home and you decide to build a house for them from scratch and u wants to get married will you ask both of them to pack out. brother check am, reason am and put yourself for thier shoes. Slimslimqq: Sorry for your friend. As long as the property is in his late father's name, the property remains a family property. The mother does not even have the absolute right to it under the English laws, but she is the chief custodian of the property for and on behalf of the family. Your friend has to look for a property elsewhere. It would have been different if the property was in his name but under the late father's care. By the way, are we talking about his mother? In issues of the estate of a dead person who died without making a Will, I believe that wife comes before children. Therefore, his father's house remains a family property until the mum dies. That he sent the money used in building the house does not change anything. 8 Likes |

Law is different from common sense Law . The first port of call is the title does the house have a title? Assuming it is and is in the name of the deceased The next question is what type of marriage did they have ? Registry, Traditional or Islamic Next did the deceased leave a WILL 1. Will present= follow the will or go to court to challenge the will 2. No Will a) Registry Marriage, I believe the wife is the legal heir(ess) b) Traditional Marriage. The wife has no claim whatsoever in Yorubaland if the man has children then they inherit everything though court may exercise discretion c) Islamic........I no know book oooo 4 Likes |

He should be reasonable. He cannot live with his wife in his father's house. In Yoruba land it is not respecting and befitting. If he choose to live in his father's house then the family will choose to move out. Does he want his family to stay on the street? My advice is that he should rent a room and parlour and live there with his wife to be rather than to live with them in the family house or sending them out into the street |
