Justice Rilwan Aikawa of the Federal High Court sitting in Ikoyi, Lagos, on Tuesday, November 21, 2017 adjourned further hearing in a N4.9billon fraud case involving a former Minister of Aviation, Femi Fani-Kayode, to December 5, 2017.

Fani-Kayode is standing trial alongside a former Minister of State for Finance, Senator Nenadi Usman, Danjuma Yusuf and a company, Joint Trust Dimensions Limited, on a 17-count charge bordering on money laundering to the tune of N4.9billion.
At today’s sitting, a prosecution witness, Teslim Ajuwon, an employee of Zenith Bank Plc, told the court how he received a letter from the Economic and Financial Crimes Commission, EFCC, requesting for the account opening documentation, certificate of identification and statement of account of the second defendant, Fani-Kayode, who is one of the bank’s customers.

He also told the court that following receipt of the letter on March, 2016, he forwarded the required documents, which were duly signed by him, to the EFCC.

Consequently, the prosecution counsel, Rotimi Oyedepo, sought to tender in evidence the letter received from Zenith Bank dated March, 24 2016 as well a statement of account No. 1004735721 in the name of Fani- Kayode.

The document, which Oyedepo described as “extremely relevant to the issues before the court”, contains the entries from January 22 to July 31, 2015.

Oyedepo, therefore, urged the court to admit the documents as evidence, adding that the witness had complied with all the necessary provisions in law.
However, Norisson Quakers, SAN, counsel to Fani-Kayode, objected to the admissibility of the statement of account, saying, “The prosecution did not comply with the provision of Section 90(1) of Evidence Act.”

He also argued that the issue of certification could not be done orally.

“It did not emanate from the bank; no officer of the bank had certified it. My Lord, the EFCC is not in any position to do the certification of the documents,” he added.

He, therefore, urged the court not to admit it as evidence on the grounds that it lacks merit and violates Section 104 of Evidence Act.

Also, counsel to the first defendant, Chief Ferdinand Orbih, SAN, aligned himself with the arguments advanced by Quakers.

He said: “My Lord, I urge you to mark the document as rejected.”

Giving further testimony, the witness, who works as compliance officer with the bank, told the court that the account was generated upon request by the EFCC.

He said: “The request was sent to the Information Technology Department and the statements were printed out in my presence.

“The statements were compared with the entries in the bank’s computer system.

“The certification was done by me, and I signed the certificate of identification.”

Justice Aikawa adjourned the case to December 5, 2017 for ruling on the documents and continuation of hearing.

Singer, Nikki Laoye, has aired her opinion on the lingering topic on why should Pastors go about with armed guards instead of having faith in the Holy Spirit.

In the eyes of international rating agency, Moody's Investors Service (Moody's), Nigerian banks have declined in some key evaluation criteria.

And the result is a downgrade of its rating of many of Nigerian banks, including those which had enjoyed strong perception of the agency over the years.

Moody’s in its latest ratings report  downgraded to B2 from B1 the long-term local currency deposit and issuer ratings of four Nigerian banks: Access Bank Plc (Access), Guaranty Trust Bank Plc (GTBank), United Bank for Africa Plc (UBA) and Zenith Bank Plc (Zenith) and the long-term local and foreign currency issuer ratings of Bank of Industry, a Nigerian development bank in a report released on Friday.

It also downgraded to B3 from B2 the long-term foreign currency deposit ratings of Access, GTBank, UBA and Zenith, as well as those of Union Bank of Nigeria plc (Union), First Bank of Nigeria Limited (FBN) and Sterling Bank Plc (Sterling). Concurrently, Moody's downgraded the baseline credit assessments (BCAs) of Zenith and GTBank to b2 from b1.

The rating action follows Moody's downgrade of Nigeria's government bond ratings to B2, with a stable outlook, from B1, with stable outlook, on 7 November 2017 and reflects (1) the government's reduced capacity to provide support to Nigerian banks in times of stress and (2) the banks' significant holdings of government securities linking their credit profiles to that of the government. The decision to downgrade banks' long-term foreign currency deposit ratings follows the downgrade of the relevant country ceiling for foreign currency deposits to B3 from B2.

The primary driver of the rating action, according to the global rating agency, is the weaker capacity of the government to provide support to banks, in case of stress, as reflected in the downgrade of the sovereign issuer rating to B2 from B1. Subsequently, Access' and UBA's long-term local currency deposit ratings and Bank of Industry's long-term issuer ratings no longer benefit from a one-notch uplift from their b2 BCAs (or standalone credit profile, as is the case for Bank of Industry) as these are now at the same level as the government bond rating. The long-term local currency deposit ratings of Sterling, Union and FBN have been affirmed at B2, as their b3 BCAs continue benefiting from one notch of government support uplift.

The Nigerian Central Bank and the Ministry of Finance have since faulted the rating by the Moody's, saying that since Nigeria was last rated by Moody's (as B1 stable) in December 2016, Nigeria has successfully emerged from a protracted recession and recorded important improvements across a broad range of indices.

While we respect the right of Moody's to make this decision, we strongly disagree with the premise and must address some of the conclusions upon which the decision rests,” the response stated.

The Federal Government pointed the attention of Moody's to Nigeria's return to economic growth of 0.55 per cent in Q2 2017, and returning business confidence, as evidenced by a PMI index of 55.0.

EXCEPT President Muhammadu Buhari intervenes, the Niger Delta region could be thrown into another crisis, following allegations that the cabals in the Presidency have collected $500 million bribe from the current Board of the Niger Delta Development Commission, NDDC, to elongate their tenure.

Among those who have allegedly received the largesse on behalf of the cabals include Abba Kyari, chief of staff to the president, and Abubakar Malami, SAN, attorney-general of the Federation and Minister of Justice.




A coalition of pressure groups under the aegis of Eastern Niger Delta Coalition, ENDC, in a petition to Buhari dated November 9, 2017 entitled: “Protest against the purported extension of the tenure of the present Chairman and Managing Director of NDDC) Board”, said the so-called extension was not only morally wrong, but also does not stand on any legal high ground.

The group therefore gave the present leadership of the NDDC board December 5, deadline within which it should be terminated, saying “a stitch in time saves nine.”

The petition which was signed by Alali Bokutengo; Miebaka Harrison

Nsan Ebirien and Cordelia Etuk-Udo, was obtained by journalists in Abuja on Sunday.

It reads: “Sir, may we use this medium to register our protest against the purported elongation of the tenure of Senator Victor Ndoma-Egbe (Chairman) and Obong Nsima Ekere (Managing Director) of the NDDC. To say the least, this attempt is criminal, offensive, satanic and an anathema to the peace and development in the Niger Delta region as well as the harmonious co-existence of all the ethnic nationalities spread across in the 9 (nine) oil producing states.

“The so-called extension is not only morally wrong, it does not also stand on any legal high ground. It is insinuated that the said elongation coup was originated through a legal memo by the AGF, Abubakar Malami (SAN). This whole exercise is offensive and contrary to the extant/explicit provisions of the relevant sections of the NDDC Act.

“Our finding reveal that the Chief of Staff, Abba Kyari and AGF, Abubakar Malami, have collected $500 million as bribe from the current board of the NDDC to elongate their tenure. We are therefore calling on President Muhammdu Buhari to intervene and do the right thing because millions of dollars have been exchanged between the Chief of Staff and some other persons in the Presidency to ensure that this current board’s tenure is extended thereby truncating the rotational arrangement according to Section 4 of the NDDC Act, which provided for the rotation of chairmanship of the board as between “member states”.




The coalition said it had seen a hurriedly released letter signed by the Permanent Secretary, in the Office of the Secretary to the Government of the Federation, Dayo Apata denying any tenure elongation for the present governing board, saying the denial was wrong.

The ENDC said, “Sir, please this fraud should not be allowed to stay a day longer because of the consequences it would bequeath on the region.

The peaceful co-existence among tribes and ethnic nationalities would be shaken to its foundation and rather replaced by mistrust and mutual suspicion- an invitation to breakdown of law and order.

“At this point may we humbly ask: Is this elongation plan a kudos to Senator Victor Ndoma Egba and Nsima Ekere for their effective implementation of the Niger Delta Regional Development Master plan? Is it on grounds of high prudent financial management? Is it on their competence or what?

“We actually thought Nsima Ekere should be explaining to the anti-corruption agencies how he renovated just the MD’s office at a whooping N400 million. Or how the present board spent over N65 million on emergency repairs without adherence to the Procurement Act.
“This present board of the NDDC is the most inept, corrupt, divisive, slow and uninspiring. No wonder the board is popularly referred to as “10% board”.

We posit therefore that the present leadership of the NDDC be terminated not later than the 15th day of December, 2017. A stitch in time saves nine.”
