‘Arms scandal: Contractor inflated helicopters’ price by $20m each’
The claims read like the plot of a best-selling thriller, with secretive arms dealers and a corruption-riddled government fighting jihadists.
The weapons deal collapses in acrimony but instead of a shoot-out, the embittered parties fight it out in court.
In this real-life saga, Ara Dolarian is the US arms dealer, Hima Aboubakar the weapons contractor and the foreign government Nigeria, which has been locked in a battle with Boko Haram since 2009.
The $246m (221 million euros) order at the height of the jihadists’ insurgency in 2014 was for weapons and equipment, including helicopters, bombs and ammunition.
It could have given over-stretched and under-resourced Nigerian troops a boost, as the better-armed rebels captured territory across northeast Nigeria, often without a fight.
But the deal collapsed in 2015 and the arms never arrived. Aboubakar sued Dolarian for fraud in California.
Aboubakar, a national of Niger, claimed the US arms dealer failed to ship $8.6 million worth of bombs and rockets, damaging his reputation as “a trusted arms supplier to the Nigerian military”.
Dolarian alleges in court documents that he was unwittingly caught up in a “money laundering scheme” and that Aboubakar’s arms money was “stolen from the Nigerian government”.
– Rare glimpse –
Campaign group Transparency International described corruption in the defence procurement sector as “the new diesel for Nigeria’s kleptocrats”.
It estimated that more than $15bn has been stolen, “leaving the military without vital equipment, insufficiently trained, low in morale and under-resourced”.
“This has crippled the Nigerian military,” it added in a new report published on Thursday, which defence spokesman John Enenche rejected and described as “a sweeping allegation”.
The defence ministry now did “government-to-government” deals and no longer used contractors, he added.
The court battle between Dalorian and Aboubakar some 12,500 kilometres (8,000 miles) from Abuja offers a rare glimpse into the shadowy world of the arms trade.
It could also shed light on how an alleged multi-billion-dollar fraud in the office of former national security advisor Sambo Dasuki might have taken place.
Pieter Wezeman, a researcher at the Stockholm International Peace Research Institute, said Dolarian’s deal with Aboubakar and his company Societe d’Equipments Internationaux (SEI) “rings alarm bells”.
Court documents show SEI signed off on the purchase of six Mi-24 and Mi-35 helicopters from Dolarian for $25m each, which Wezeman said was far above their normal value of $5m each.
Inflated prices open the door to graft, he added. “This is really a ridiculous price,” he said.

Current President Muhammadu Buhari’s predecessor Goodluck Jonathan and his administration were forced to take Boko Haram seriously after the kidnapping of more than 200 schoolgirls from the remote town of Chibok.
The mass abduction in April 2014 drew the world’s attention to the conflict, sending the government on a shopping spree for weapons.
Buhari, a former military head of state, honed in on the notoriously rotten defence procurement sector after coming to power on an anti-corruption platform in 2015.
Dasuki has been accused of orchestrating a sprawling embezzlement scheme that saw “phantom contracts” awarded for personal and political gain. – Shocking scale –
The scale of the alleged scam and how officials apparently exploited the insurgency shocked even Nigerians wearily familiar with corruption scandals.
Dasuki and scores of other defence officials were arrested and put on trial. Buhari’s government then went after procurement firms.
Last year, a committee set up by Buhari said SEI played a “major” role in the alleged scam after being awarded nearly $1 billion worth of contracts “characterised by irregularity and fraud”.
SEI deals appear in many ongoing corruption cases in Nigeria.
Two top air force officials are charged with bribery for accepting cash and a Range Rover from the company.
Aboubakar has not been charged and told AFP: “We continue to work with the Nigerian army. Forget about what the people say, they lie.”
– ‘Excessive secrecy’ –
Repeated adjournments have become a feature of the separate trials linked to the Dasuki “arms scam”.
As time goes by without a big name conviction, there are doubts about whether a significant dent will be made in Nigeria’s culture of corruption.
Buhari himself — the driving force of the anti-graft campaign — is wrestling with ill health.
Nigeria specialist Matthew Page said Buhari was not reforming a system of embezzlement “codified” by former military rulers such as Sani Abacha.
Habits that saw many senior officers get rich over decades of military rule persist, despite the return to democracy in 1999, he said.
Nearly two decades later, the defence sector is still secretive, with little or no oversight and transparency, and arms procurement still requires ad hoc approvals from the executive.
“Buhari is a dyed-in-the-wool military guy,” said Page, a former US State Department official.
“All these issues, excessive secrecy and the notion that the military operates by different rules, these are principles that Buhari prescribes to pretty closely.”
To end the constant clashes between herdsmen and farmers, create massive jobs and harvest other economic benefits, the Federal Government plans to resuscitate the 415 grazing reserves in the country.
Akinwunmi Adesina, minister of agriculture and rural development who made this known at the ministry in Abuja recently, said only 141 of the available 415 grazing reserves around the country were mapped and gazetted. Even then, he expressed doubt that any of the mapped and gazetted reserves was being effectively managed to realise the objective for creating them.
Adesina therefore said it was to address these inadequacies with a view to optimising them that President Goodluck Jonathan directed the establishment of a technical committee with the active commitment and involvement of all stakeholders, including relevant ministries, departments and agencies (MDAs) as well as states and local governments, with a mandate to develop maps and do an inventory of existing facilities for their effective utilisation.
According to him, the committee is to ascertain whether the facilities, which included those needed to facilitate livestock fattening such as water, fodder as well as veterinary and extension services existed and were adequate.
Adesina also pointed out that apart from addressing national security issues, resuscitating the grazing reserves had tremendous economic benefits, saying, “… the global Halal certified beef industry was worth $623 billion in 2011, and has leap-frog to $2.3 trillion in 2013. Argentina, Brazil, Spain and Australia are the major countries supplying Halal beef to markets located mostly in the Middle East, including Saudi Arabia where about 5 million visitors go every year for religious and other purposes. The Halal beef market is more of business than faith. The Federal Government made a case for Nigeria to be admitted to the world Halal Beef Commission and enrolled as a supplier, during the meeting of agriculture ministers at the World Economic Forum in Davos, Switzerland earlier this year, given the large number of cattle in Nigeria.”
The minister therefore canvassed for “raising and fattening cattle and other livestock at serviced grazing locations rather than roaming them from place to place in search of grass, thereby they become lean and their meat is tough when slaughtered.”
He added: “Livestock grow much faster and fatter if raised in sedentary conditions, and it makes more economic sense to transport processed meat and meat products to local and foreign markets in hygienic conditions, and according to acceptable standards than transporting live cattle.” He noted that this would eliminate much of the clashes between herders and farmers that we see today and national security would improve.
An inter-ministerial technical committee tasked with working out modalities for mapping and resuscitating the 415 existing grazing reserves and stock routes spread across the country has thereby been inaugurated. This includes ministers of environment, works, interior, water resources, science and technology as well as national planning with commissioners of agriculture of all 19 states of North-Central, North-East and North-West geo-political zones as well as some adjoining states.
Other bodies represented on the technical committee are the Office of the National Security Adviser to the President, Office of the Surveyor General of the Federation, National Orientation Agency and the International Livestock Research Institute. It has two weeks from Friday, April 11, this year to submit its report to the inter-ministerial committee.

Macron hosts Africa summits on Sudan, post-Covid finance

French President Emmanuel Macron this week hosts African leaders and chiefs of global financial institutions for twin summit meetings that will seek to help Sudan into a new democratic era and provide Africa with critical financing swept away by the Covid-19 pandemic.
A conference Monday attended by several heads of state will aim to rally support for the Sudan government under Prime Minister Abdalla Hamdok in the transition after the 2019 ousting of longtime strongman Omar al-Beshir.
This will be followed by a summit Tuesday on African economies that will try to fill a financing shortfall of almost $300 billion caused by the Covid-19 pandemic.
Both meetings, held in a temporary exhibition centre under the shadow of the Eiffel Tower in Paris, will be a chance for Macron to show himself as a statesman on Africa whose influence goes beyond the continent's francophone regions.
With some two dozen African heads of state due to attend Tuesday's summit, it will be one of the biggest in person top level meetings held during the Covid-19 pandemic.
It should also see a rare visit to France by Rwandan President Paul Kagame as Paris presses for reconciliation with Kigali after a historical report made clear France's failings in preventing the 1994 genocide.
- 'Explore opportunities' -
Hamdok told AFP in an interview ahead of the meeting he hopes Sudan can help wipe out a $60 billion foreign debt bill this year by securing relief and investment deals at the Paris conference.
Sudan's debts to the Paris Club, which includes major creditor countries, is estimated to make up around 38 percent of its total $60 billion foreign debt.
"We are going to the Paris conference to let foreign investors explore the opportunities for investing in Sudan," Hamdok said.
"We are not looking for grants or donations," he added.
Hamdok and his government have pushed to rebuild the crippled economy and end Sudan's international isolation under Bashir, whose three-decade iron-fisted rule was marked by economic hardship and international sanctions.
Sudan was taken off Washington's blacklist of state sponsors of terrorism in December, removing a major hurdle to foreign investment.
But many challenges still lie ahead.
His government has been pushing to forge peace with rebel groups to end conflicts in the western region of Darfur as well the southern states of South Kordofan and Blue Nile. - 'New, cheaper, longer' -
Africa has so far been less badly hit by the Covid-19 pandemic than other global regions -- with a total of 130,000 dead across the continent -- although the human catastrophe in India shows it is way too early to sound the all clear.
But the economic cost is only too apparent, with the International Monetary Fund warning in the autumn that Africa faces a shortfall in the funds needed for future development -- a financial gap -- of $290 billion up to 2023.
A moratorium on the service of public debt agreed by the Paris Club and the G20 in April last year was welcomed but will not be enough on its own. Many want a moratorium on the service of all external debt until the end of the pandemic.
"We are collectively in the process of abandoning Africa by using solutions that date from the 1960s," Macron said last month, warning that failure would lead to reduced economic opportunity, sudden migration flows and even the expansion of terrorism.
International financial leaders attending will include IMF chief Kristalina Georgieva as well as World Bank managing director of operations Axel van Trotsenburg.
Serge Ekue, the president of the West African Development Bank (BOAD), told AFP that Africa needed much longer loan maturities that went beyond seven years and interest rates that were 3 percent rather than 6 percent.
"In West Africa, the average age is 20. You walk in (Ivory Coast's biggest city) Abidjan and there is incredible energy," he said, noting that Africa had seen growth rates of 5-6 percent in the last years.
"The issue is therefore not so much a moratorium as obtaining low rates. Because it is better to issue new, cheaper and longer debt than to obtain a suspension," he said.
