I was refused UK family visit visa base on my bank statement. ECO stated that my bank statement is violatile, not sourced and funds limited. ECO stated that my circumstance is very important. First of all am not sponsoring myself, siblings are sponsoring like before when first visited my sister who is a British citizen.I submitted all support documents from my sponsor which the ECO sounded not have a problem with that. I only presented my bank statement to show the amount my bro deposited as a sign of contribution which I stated in my application.i was not give right to appeal, what can I do other than reapply?can I appeal base on human right?
I do understand how you feel regarding the refusal of family visit visa. Unfortunately, visit Visas cannot be appealed. The only option is to address the reasons for the refusal and then reapply. Good luck.

w.r.t. timeline, my wife's application was submitted online on 16th October
Biometrics @ VI on 24th October
Supporting Documents was posted via DHL on 27th October. We have not received any email from HO to acknowledge receipt, however DHL tracking showed that my supporting documents was received on 31st October

Hubby received an email today at 1:57pm I saw it at 2pm that his passport is ready to collect. I called him and said babes they close at 4 please go there now I cant wait any longer.

He collected his passport today and his visa was issued!!

Time to book his return flight!!

Justice Rita Ofili-Ajumogobia took agents of the Economic and Financial Crimes Commission (EFCC) on a wild goose chase as she traveled with them from Lagos to Benin and Asaba in search of properties she claimed her late mother bequeathed to her. However, the search was futile as the judge was unable to show agents the said properties she allegedly inherited from her mother.

An EFCC source told SaharaReporters that a bus carrying Justice Ofili-Ajumogobia and a team of anti-corruption agents first arrived in Benin City, the capital of Edo State, because the judge had claimed that some of the $900k she wired abroad from bank accounts in Nigeria was income from properties she ostensibly inherited. She had told EFCC agents that her brother, Donald Ofili, and a lawyer based in Asaba, the Delta State capital, were managing the said properties. However, agents who traveled to Benin City to verify the existence of the houses claimed by the embattled judge as the source of some of her income did not find a single property.

Our source said that the judge, who sat in the back of the bus, often covered herself with a wrapper and muttered into a hand-held device as they drove her to Benin City. According to the source, EFCC agents let the judge be, but occasionally asked her to let them talk to her brother, Mr. Donald Ofili. However, on their arrival in Benin, the judge’s brother reportedly spoke on the phone to EFCC agents, asserting that their mother owned homes in the city, but confessing that his sister had asked him to claim that the $120k he wired into her account came from rental fees. The operatives said that, on discovering that her brother had blown open her game, Justice Ofili-Ajumogobia changed tunes and claimed that a lawyer not known to her brother managed the properties. She also told stunned agents that she could not recollect the addresses of the properties. When agents reminded her that her brother also claimed not to know the addresses of the properties, the judge urged the agents to proceed to Asaba, claiming she would then have enough time to contact the mysterious Benin lawyer.

Upset by the judge’s evasive manner, EFCC agents demanded to speak with the lawyer in advance as they drove to Asaba. Justice Ofili-Ajumogobia reportedly rang the so-called lawyer and handed her phone over to an EFCC agent. The man then promised the EFCC agents that he would be waiting to receive them in Asaba, adding that he was visiting a community outside Asaba.
However, once the EFCC agents arrived in Asaba, the judge told them that the lawyer who reportedly managed her properties had traveled to Owerri. Furious, members of the EFCC team demanded to speak again with the lawyer, but his line had been switched off. They demanded that the judge take them to the properties, but she again said she did not know the address. The irate EFCC operatives spent the night in Asaba, but seized the judge’s phone to ensure she would not use it to plot against them. As they disembarked from the bus, the agents discovered that the judge had another phone hidden in her wrapper, which they also took away.

Our source said that, despite taking away the second phone, they discovered the judge continued to mutter under her wrapper during the journey back to Lagos. Once in Lagos, a female EFCC detective searched the judge and discovered that she had hidden up to five phones underneath her clothing. She had also concealed an iPad.

According to our EFCC source, an initial check of the phones showed that the embattled justice was using different phones to communicate with her suspected accomplices perhaps tutoring them to lie to investigators about the source of her inexplicable cash transactions. The source said the phones retrieved from the judge would also be sent to experts for forensic checks.

A senior EFCC source confirmed the drama with Justice Ofili-Ajumogobia, adding that the agency was considering revoking the judge’s administrative bail, accusing her of making moves to undermine their investigative tasks.

@justwise, the second option is not applicable to degrees taught in Nigeria as Nigeria is not recognized as an English speaking country under the UKBA.

It all look spot on. I will suggest you take off your Nigeria degree certificate. Your U.K. Certificate is more than enough.

@justwise and @foreveryour201, from what i read about the english language requirement, if using degree to meet the english language requirement, one has to have it assessed through NARIC. providing just the certificate and letter of proficiency in english is not enough. You need to submit the NARIC assessment, degree certificate and the english language proficiency letter.

Sorry about the refusal and the ill health of your mum. Regarding the English requirement, Nigeria is not recognized as a Majority English speaking country. Since you use the degree criteria to meet the english language requirement, you should have had it assessed by NARIC. All your husband needed to do was to get his degree cert., letter confirm english proficiency, and your husband's academic transcript. Your husband only need to create an account with NARIC and upload these documents, pay about 56gbp, and the certificate will be with you provided you use your UK address.

Secondly, regarding getting a letter from your property manager, I guess he is just scared. You only need to let him use the condition statement or clause "If your husband is been granted the visa that entitles him to live and work in the UK". I guess that will solve it. Also know that this is your entitlement.

Thirdly, if you submitted all the documents that they claim you did not submit, accept it. Have this in mind that most caseworkers are not educated and professionals. They have in the past used someone's decision for my wife. we made a laugh of the refusal letter. Just know that these people are under pressure and careless of the emotional torture applicants go through.

My candid advise is in agreement with Lexusgs430 advise. Just address the reasons on the refusal letter and reapply. If you read through the first page to the present page, I don't think you will want to go through the appeal process. All the best.

I understand your plans. My main concern is about your baby whom was born while in previous marriage. HO may see it as infidelity to your ex just as my friend's case was. We can only proffer a reasonable cover between now and the time you make their application. It's better to cover every loopholes with truth. We can only do our best and believe in God to perfect his plans for us. Keep your communications with your baby mum from the date you started your communication after your divorce to the day you will file for them. Good luck!

I no know ooo, it's left for my wife to answer the question. You know if one work for something, one will appreciate it. if it comes easily without sweat, one won't know the value. She no sabi wey ti people (we wey they no born for UK) dey pass thru to get the pali, the thing dey come her front door easily. Abeg make una pray for us make the application go smooth. from what i don read on this forum, i no get strength for appeal. I don even repent part-time for this application.

@ Lexusgs430, I pray it will not hunt us. The thing is my wife is not really keen on relocating from Nigeria to UK 1. because of her job, and 2. She sees UK as too boring and prefers U.S. The thing is no one knows tomorrow and what it will bring.. I'm just doing what I have to do as a husband and for my kids when they arrive into the world.

@Lexusgs430 regarding the laminated document, i emailed sheffield on tuesday last week as you advised, they never reply me sef. in addition to this, I posted supporting documents from here (Nigeria) via DHL on 27th October, it was signed and received at Sheffield on 31st October. Up till now, no email has been sent to my wife to inform her that supporting documents has been received. abi they no day send email?

Good morning all.

@abakilikiboy my advise to is to be prayerful because your application MAY not be an easy one. My former flatmate very similar issue as you. He impregnated his current wife while in marriage with his ex. his divorced. when he got his papers, he filed for his baby and baby mum and their application was refused. Why? He filed for divorce after obtaining his papers. the reason for divorce with his ex as stated on the extract of divorce was as a result of infidelity from his ex. HO further stated on the refusal that his child with his current wife was born while in marriage with his ex. to cut the long story short, they concluded that the infidelity was on his part. They further classified his marriage with his ex as bogus marriage all with the intention playing on the immigration rule. As at the last time i communicated with him in June this year, it was still a negative news.
However, do not be discouraged by my friend's experience. My candid advise is do not rush into marriage yet for the purpose of bring your baby mother over to the uk. Get your red passport first before entering marriage with her, and use this time to gather lots of info, documents, and establish subsisting relationship, communications, pictures and holiday trips with your baby mum so as to boost your application. @toksys to my understanding on the financial requirements, and considering the fact that your Spouse's income is from two sources, that does not qualify you to go for 6months income with one employer. If your spouse's income over the past 12months from various sources exceeds £18600, then you have met the 12months route. Provided you have the pay slips and bank statement as evidence. This is my opinion, I stand to be corrected.

I was catching up with previous pages where I stopped, and read that HO do not accept laminated certificates. How true is this? We have posted our documents and my wife's degree notification of result is laminated. However, we have collected her degree certificate on last Friday. I want to know if they don't accept laminated certificates, should I send the degree certificate immediately? Thanks in advance for your advise.

My wife's application has been submitted online and all fees paid and appointment booked. I have gone through the checklists posted on previous pages, which I have ticked. But with regards to evidence of support, must i provide it? I have been sending money to my wife from feb 2015 part of which was for wedding preparation and up keeps, through azimo and small world fs. The amount varies as the max I sent in one transaction is £1876 and min £175.50. in total its about £8716. My question is, if I provide this, will they query the amount and do I need to write what the money was for?

Secondly, at the start of this whole process, my wife was not taking this application serious, I gave up on the application about two weeks ago as the documents I asked her to get since Feb 2016 where not forthcoming. Then, I booked my flight to Nigeria for this Friday to go visit her (and to pour out some ... as the thing don full). Last week, all documents were ready and her passport too. I want to double check with the gurus shey I still fit send my original documents from Naija to Shefield? I intend to travel with them and i have gotten the prepaid envelop with stamps.

I want to enquire if you used the priority service. if yes, have you been denied any visa before? I am hoping to use the priority service but my wife has been a denial customer to UK (4times) and US(3 times) visas. I read on TLS that one can use the priority service if one has not been denied any visa. any advise house?

Be advised that the second option is if your degree is from an English speaking country which Nigeria is not included. My candid advise is for you to get your transcript, letter confirming that your degree was taught in english, and degree certificate. If you can't meet this, then do the IELTS exam. I understand that Universities will say that they don't issue transcript by hand, my was issued by hand. My spouse used her company to receive hers. If possible and if you have it, spread some money around. N10K it enough to get it.

Using NARIC is a good option if you have all they need. it only cost approx. £57 inclusive postage.

My case was that degree certificate has not been issued. Statement of result was ussed in place of degree certificate. NARIC was still able to confirm its equivalent to level C1 which is what they confirm generally. the only difference is the additional information section recommending that I make it available should an employer or an institution requires it. I also got an Attestation letter from University which includes my spouse name, degree studied and date of completion, and also confirmed that degree cert. is going through inscription and signing and would be issued when its ready. With the NARIC letter, letter confirming degree was taught in english and Attestation letter from my spouse university, and spouse statement of result, the english requirement is met. These documents will be submitted as well with the application.

5.5.7. Overtime, commission-based pay and bonuses (which can include tips and gratuities paid via a tronc scheme registered with HMRC)
will be counted as income from employment where they have been received in the 6 or 12 months prior to the date of application as applicable. Sometimes the person will receive the same amount of income from overtime each month; sometimes overtime payments will vary, with
different amounts (if any) each month. All overtime in salaried employment will be calculated based on the approach to income from non
-salaried employment. This will be an annualised 6-month average for the overtime which will be added to the level of the gross annual salary."

If your husband is using the option of degree for the english assessment, He needs his certificate, a letter from his university stating that the degree was taught in english, his academic transcripts as well.
If you check my previous comment, I did similar, but I have not been issued my degree certificate so i used my statement of result. NARIC assessment was equivalent to level C1, but in mine, as i did not provide degree certificate, they recommended in the additional information section, that I should provide my degree certificate to potential employer or university. So with this NARIC letter, I requested from my university, a letter to confirm my name, my degree and date the degree was awarded, as stated on https://www.gov.uk/english-language/degrees-in-english.
I will include all these document in my application. I hope this helps.
