Hello, How did the application go? Any update?

I have not applied yet. I will do as you and Justwise advised. Thanks.

This is not actually difficult but your explanation makes it so.

Let me get this clear..is the name in marriage certificate now ADEYEMI DEBORAH? You are saying it 'supposed' to be as if a different name is written there.

If you are married now and the name written there is ADEYEMI DEBORAH and your own name is ADEYEMI OLABODE then there is no problem.

Present your marriage certificate and use the blank space in the form for additional info to clarify things...that she got that passport before you got married.

When that passport expires she will get another one that reflects the name in her marriage certificate.

Justwise thank you. Noted

KDK:

If I am permitted to jump in here.
It is permitted to have a maiden name. Has she done the court affidavit and news paper publication for change of name? If not, you need to do that. She can travel with the passport bearing her maiden name.It is no offence. However, just for the sake of clarity, explain the names in a cover letter. Please don't complicate the story like you did here. Simply say her maiden name is this and her present name is that but she still uses her passport bearing the maiden name.
Don't sweat it, it is no issue.

KDK, thanks. We have a newspaper publication we did in 2016 but I have never submitted it in my previous application that is why I am thinking if I should go and do another newspaper publication so the ECO won't say I hided anything in my previous application. My wife has never applied for a U.K. visa before but I do write her name in my previous application under SPOUSE INFORMATION with her maiden name as her surname.

Reading this is so confusing just keep it simple..

1.What is her name before marriage?

2. What is the name in marriage certificate?

The name on marriage certificate shows my name as ADEYEMI OLABODE While her name was written as AKINYEMI DEBORAH. But now that we are married her name supposed to be ADEYEMI DEBORAH. Her current passport was issued before we got married and it shows her name as AKINYEMI DEBORAH

Good afternoon all. My name is ADEYEMI OLABODE, I have been to the UK before but I recently applied for a work visa which was refused. In my previous application I do write my wife's name as AKINYEMI DEBORAH. AKINYEMI is her maiden name and because that is the name on her current passport and the passport was issued before we got married. Though she has never applied to go to UK before. My question is this: We are expecting a baby by end of July and our baby's birth certificate will show my wife's name as ADEYEMI DEBORAH and NOT AKINYEMI DEBORAH which is the name I have beem writting on my application as spouse name. I am planning to apply to visit the UK for 2 weeks alone im October and I will like to submit our child's birth certificate with my application. Won't it cause am issue for the ECO to see my wife's name as ADEYEMI DEBORAH as against AKINYEMI DEBORAH I have been writing before? I have a change of name document for her which was done through Nigerian Tribune in 2016 but I didn't submit it in my previous application. Should I go and do another change of name for her before the delivery of our baby? Please I need your responses. Thanks. PLEASE NOTE HER CURRENT PASSPORT WILL EXPIRE IN FEBRUARY 2019

If that is the case then she doesn’t need to submit any document from UKNARIC.

Her main task now is to address the reason why her previous permit was cancelled
Okay Justwise. Thanks a lot. I even made a screenshot of section 164 of the guidance which talks about the PREVIOUS GRANT OF LEAVE so you can see. Thanks

Thank you Justwise. Her previous employer's license was revoked close to the time she supposed to extend her visa. She couldn't get another sponsor to extend her stay so she left the UK before her visa expired. She just got another job now as a pastor and want to apply for entry clearance.

I answered your question but you ignored it.
Good morning Justwise. I didn't ignore your answer to my question please. I read the section 146 in the guidance but it didn't answer my question. Kindly check section 164 of the guidance to understand what am saying please. What happen is that my sister submitted English language proficiency letter from her university and the degree certificate to meet English proficiency in 2012 when she went to UK as minister of religion migrant. She want to reapply afresh for entry clearance from Nigeria and the new law says they should send their certificate to UKNARIC for assessment. But in section 164 of the guidance they stated that points will be awarded automatically for people that had PREVIOUS GRANT OF LEAVE on Tier 2 visa. So I want to know if she wouldn't need to send her certificate to UKNARIC again for assessment once she had once been to the UK as a Tier 2 minister of religion migrant. Thanks

When she went to the UK in 2012 as a Tier 2 minister of religion migrant, the law doesn't say they should send their certificates to UKNARIC for assessment. She only submitted her degree certificate and English language proficiency letter from the university she graduated from to the embassy and her visa was issued. But now it requires sending your certificate to UKNARIC for assessment before submitting your visa application. We now read on section 164 of the Tier 2 guidance that points will be automatically awsrded for English language if u had previous grant of leave on Tier 2. That is what we want to be cleared of if she won't need to send her certificate again to UKNARIC. Thanks
Justwise, Ekpotek please respond to my question. Thanks

Someone correct me if I'm wrong, but I believe the UKNARIC certificates are issued once and are valid for life unlike IELTS that has a 2 year life span.
In my opinion, if she already has UKNARIC issued once, she should just include that same certificate to her fresh application, no need reapplying to UKNARIC to assess qualifications they have previously assessed.
This is the opinion of a small learner like me, but I think I'm correct with the little I know. Gurus in the house over to you.

Yes that’s true. Read section of 150 of the link on english language requirement posted by Justwise.
Ekpotek, I have read the section 150 but that talks about APPLYING FOR LEAVE TO REMAIN. She is not applying for leave to remain but want to apply afresh for ENTRY CLEARANCE from Nigeria. So we want to know if dhe doesn't need to apply for UKNARIC certificate conversation once she was granted a PREVIOUS LEAVE as Tier 2 minister of religion migrant. Please read section 164 to understand what am saying and let me know sir so she won't be confused. Thanks

Good morning justwise, Ekpotek and all other gurus in the house. Please I need this information for my sister. My sister went to the UK as a Tier 2 Minister of Religion migrant in 2012. She came back to Nigeria because her sponsor's license was revoked and couldn't renew her visa, she didn't overstay. She just got a new job as a Minister of Religion migrant and she want to apply for the visa. The question is this. Did she still have to send her degree certificate to UKNARIC for evaluation inorder to meet the English language requirements or she doesn't need to. Because she said she read it somewhere in the guidance that whoever has been in the UK as a Tier 2 migrant in their PREVIOUS GRANT OF LEAVE will be awarded 10 points automatically for English language. Please we just want to be sure so she won't submit an invalid application. Thank you all.

Good morning VO and all gurus in the house. My name is Olabode. Please I want to ask a question which I think might help other people as well. Please can you list a country you had a stop over as one of the countries you have been to in U.S. visa application. For example, if you are coming from UK through air france and you had a stop over in france can you list U.K. and France as countries you have been to? Thanks

My dear, I have been there before, if this information are not on your COS, your admn review won't be successful, I was refused based on this reasons too, I reapplied and addressed the issues raised by the Eco, my sponsor stated my job duties on my new COs, stated the aims of the charity and also stated on the COs that I won't be filling a permanent position, my visa was refused again, the eco stating the same reason, I felt like giving the dumb Eco that accessed my application a very hard knock and slap, well I went for an admn review, the refusal was overturned,

Thanks for your contribution Ujugirl. The result of the review came out and and the reviewer said he has revoked the reasons to refuse my application. This happens because my sponsor was able to add those information after my refusal on sponsors note. The reviewer now issued me another refusal and stated that HE IS NOT SATISFIED THAT THE JOB THAT MY SPONSOR IS GIVING TO ME IS A FIELD WORK. But all my job descriptions shows that its a field work. I am given another opportunity to do the review but my sponsor said they would issue me a new CoS dat I shouldn't go for another review. Congtats on your decision overturning!

Even after they stated clearly that the role in CoS did not meet the criteria for a field worker” under the meaning in Appendix A part 111(c) of the Rules you are still claiming that it was a delibrate act?

Have you or your sponsor studied Appendix A part 111(c) of the Rules to know if indeed your role met the requirement?

They can issue you a new CoS but the issue of your role has to be addressed on it.

Okay Justwise I will inform them to address the issue on new CoS. But that Appendix A part 111 (c) of immigration rules only talked about valid CoS and not about field work. If I want to re-apply now and I am asked whether I have been refused a UK visa before, did I need to mention the revoked refusal and new refusal or only the new refusal reason and date? Thank you.
Travel / Re: General UK Visa Enquiries - Part 3 by buddiemm: 9:47pm On Oct 25, 2017

Applying with new CoS is not the issue here, the issue is that your role did not meet the criteria. Your sponsor need to study the refusal letter and amend the CoS to meet the criteria

Thanks Justwise. My sponsor said they can't access the CoS again as it has been marked as USED after the administrative review. That is why they are suggesting if they should issue me a new CoS. The ECM had revoked the first reason why my application was denied and said I can apply for administrative review for this new refusal notice but I think they deliberately denied my application. Please what do you think I can do.

Why were you refused?

Justwise. I applied for administrative review for a decision to refuse my charity worker visa application so the following are the response from the administrative reviewer.

Administrative Review under the Points-based System (PBS)

You applied for entry clearance to the United Kingdom under Tier 5 of the Points Based System. Your application failed to meet the qualifying criteria and was refused on 15/09/17. Your request for Administrative Review was received by this office on 25/09/17.

I have reviewed your application and I am satisfied that the decision to refuse you entry clearance was correct. However, I enclose a new Refusal notice with amended reasons for refusal. Your original refusal has been revoked because the reasons cited were incorrect.

Whilst I am satisfied that the master CoS did include some information about your sponsor’s mission statement and how your role would advance it and that the CoS did state that your role was not permanent but linked to temporary grants, however, I am not satisfied that the role ascribed to you is “field work” under the meaning in Appendix A part 111(c) of the Rules

I have no idea what type of field work job you got CoS for. The ECO feels that you're not qualified for the visa as your CoS does not correspond to a field work as would be describe in Appendix A part 111(c). Since they have withdrawn the previous refusal letter and issued you with another one, the application process has ended unless you are qualified for another admin review which i doubt.
