Being charged with illegally selling prescription drugs is a serious matter. It is quite advisable to consult with an attorney having knowledge of the illegal sales laws and penalties applicable in your case. A knowledgeable criminal defense attorney will have a sense of how to convince either a prosecutor or a jury that a defendant had no intention to sell a prescription drug, but instead possessed the drug simply for personal use, or even possessed it unintentionally. That could result in lesser punishment. When it comes to licensed healthcare professionals, an experienced attorney may be able to negotiate a plea that either allows defendants to keep their licenses, or, alternatively, lets them give up their licenses to avoid a prison term.
I thank my parents for a sound education. . . I did not even have to read from 'google' to know right from wrong! Mu che che che che che che che
A prescription drug can be sold illegally in a number of ways. For instance, a person who has a valid prescription can be convicted of illegally selling drugs if he sells or gives his drugs to someone else. And a doctor or health care provider can be guilty of a crime by writing prescriptions that are either not medically necessary or for an amount of drugs greater than a person actually needs (which sometimes takes the form of writing multiple prescriptions for one person using many different and fake names). Similarly, a pharmacist who knowingly fills an invalid prescription can also be charged with this crime.
Penalties
The penalties for the illegal sale of prescription drugs vary, depending on where the case was prosecuted (federal charges carry the same penalties,
no matter where in the country the prosecution occurs, but each state has its own sentencing provisions). A conviction for an illegal sale of prescription drugs carries rather heavy penalties.
Selling illegally is treated much more seriously than simply possessing a drug illegally. As a result, while a possession conviction could result in a fine or a misdemeanor record, an illegal sale conviction generally results in a felony record along with a prison term. Additionally, health care providers and pharmacists convicted of illegally selling prescription drugs face not only criminal penalties but also the loss of their licenses (and livelihoods).
Read it up. WHERE IS THE MONEY GOING TO COME FROM TO FINANCE THIS TROJAN HORSE FROM TROY? I am already feeling it at my doctor's office. She has cut down on her staff and does not spend more than 5 minutes on her patients. Most communication is by phone. Difficult to get appointments. FROM BAD TO WORSE!!!!
Obamacare Cons The CBO (and other non-partisan groups, as cited below) also list some disadvantages of the Act.
1.Increased coverage may actually raise health care costs. That's because many people will receive preventative care and testing who, fortunately, find out they didn't have that critical illness. However, the CBO found that additional testing, such as cancer screening and cholesteral tests, will lead to higher net medical spending. (Source: CBO,2009 Study on Preventative Health Care, August 7, 2009)
2.Those who don't purchase insurance, and don't qualify for Medicaid or subsidies, will be assessed a penalty of $95 (or 1% of income, whichever is higher) in 2014. It increases to $325 (or 2% of income) in 2015, and $695 (or 2.5% of income) in 2016.
3.About 4 million people, or 1.2% of the population, will wind up paying the penalty rather than purchase health insurance. The CBO estimates this will total $54 billion in penalties. (Source: Washington Post Factchecker, Tax Breaks vs Tax Hikes, July 6, 2012)
4.Taxes will be raised on one million individuals with annual incomes above a threshold of $200,000 and four million couples filing jointly with incomes in excess of $250,000. They would pay 2.35% (up from 1.45%) Medicare taxes on income above the threshold. In addition, they will pay a additional 3.8% Medicare taxes. This would apply to the lesser of income from dividends, capital gains, rent and royalties or income above the threshold. (Source: Smart Money, What Obamacare Means for Taxes, June 28, 2012)
5.Pharmaceutical companies will pay an extra $84.8 billion in fees over the next ten years to pay for closing the "donut hole" in Medicare Part D. This could raise drug costs if they pass this onto consumers.
6.In 2018, insurance companies will be assessed a 40% excise tax on "Cadillac" health plans. These are plans with annual premiums exceeding $10,200 for individuals or $27,500 for families. Many of these plans are for people in high-risk pools, such as older workers or union workers in high-risk jobs. (Source: Kaiser, Cadillac Tax Explained, March 18, 2010)
7.Medical-device manufacturers and importers will pay a 2.3% excise tax. Indoor tanning services already pay a 10% excise tax. This could discourage those businesses from hiring new employees.
8.Between 3-5 million people could lose their company-sponsored health care plans. Many businesses will find it more cost-effective to pay the penalty and let their employees purchase their own insurance plans on the exchanges. Other small businesses might find they can get a better plan through the state-run exchanges. (Source: CBO, The Effects of the Affordable Care Act on Employment-Based Health Insurance, March 15, 2012)
9.There are 30.1 million people who currently buy their own private health insurance. Many of them may need to get another plan if their insurance doesn't meet the minimum standards -- which haven't yet been established. (Source: Factcheck.org, The Keep Your Plan Promise, June 28, 2012)
10.In 2014,those under 65 can only deduct medical expenses if they exceed 10% of income. In addition, the conservative think tank The Heritage Foundation lists its analysis of the disadvantages of Obamacare. For more, see Heritage Foundation, Impact of Obamacare
Is it rainy season or 'TSUNAMMI' season? O ga o! I think say dem tok say Lagos na the 3rd worst city to live in. Make dem come see the 'worst city to swim in'! Mu che che che che che cheeeeeeeeeeeeeeeeeeeeeeh!!!
Is that not one of those 'IMMOSUN' vehicles I am seeing dia so? It sure needs 'paddles' not breaks!
Nigerian men dey use condom wella. If in doubt, visit Empress hotel (by ASG Complex, Wuse II, Abuja) in the morning when they are sweeping their compound
You are not a female. That condom stays in the wallet in the heat of passion! Trust me. If you use it once. . . the second time nko? Abi you go use condom for your girlfriend or boyfriend for ever? Especially in a polygamous/polyamourous environment?
Condom does not protect the whole skin you know. . . some akamu dey hang for 'bia-bia'! Just like 'toe-toe' juice dey hang for man leg and MOUTH! Abi dem don manufacture 'mouth-condoms' too? E get as ashawo go move wey go break ANY condom kpa-kpa! Abi you don see drunkard wey dey use condoms?
Hmmmmmmmm! Thinking. . . .After careful deliberation. . . . I think the pharmacists should be liable though. Even with valid prescription for legitimate concerns. . .the drug would have still found it's way in the hands of the criminally-insane. But no one should sell such a drug without a prescrition from a doctor. Both the owners of the pharmacy and the culpable employees should face life sentences! Period.
2)If the liability of the two pharmacists is limited to the sales or alleged sales of rohypnol to clients they do not know and never collaborated with in this condemnable crime then it is logical to believe that at best there might have been breaches of professional ethics. The law provides that such matters are dealt with by the Pharmacists Council of Nigeria a regulatory agency of the Federal Government established by Cap. P.17 LFN 2004.
Arrrrrrrrrrrrrrrrrrrrrrantus Nonsensicus!!! The careless actions of these so-called OKIJA pharmacists led to the brutal death of a young lady. It is now a criminal offence. Thank you!
thelastPope: Again, I am not questioning if its their right to seek power. Its a free world. But am asking if they should not be concerned that it didn't benefit them as a region in 40 years. You are mentioning OBJ again. I have said before for you to look at it as a region, not an individual. That is the topic. That is the question.
The Yorubas didn't give OBJ all their support because they were looking at the benefit or non-benefit of the power to their region
Simple question right?
No. The North should not be concerned if it did not benefit them in 40 years. Why should they be? They are not as materialistic as the Southerners are. The 'ranka de de ' culture does not make them think that way. As you can see, they are doing a good job with 'Boko Haram' bombing all their infrastructure and killing anything progressive around them.
Only a few individuals benefit. That is the nature of 'BLACK' politics all over Africa.
The only person I know who would reliquish power after one term as a BLACK man is Nelson Mandela, after spending 27 years in JAIL for his political beliefs. DID THE BLACK SOUTH AFRICANS BENEFIT? They still live in SQUALOR!
So please forget your 'region' talk. It is all about a few individuals!
thelastPope: Its only the North I see fighting for power back right now. So I don't think its about being ethnic. I don't see the south east demanding power back. There are sections of the south east asking for power, but it is definitely not a strong drive accross the south east like the north is doing. Don't forget this started right from the consensus candidates saga.
I ask again. Did OBJ not try to hang on with the Third Term Agenda? It is natural to fight to get to the top of the foot chain. Given the limited resources for an ever teeming population, not to mention overwhelming POVERTY! That is not criminal and not new to politics anywhere in the world. That is why the winner takes all. If you have power. . .go and fight. Free market. Even in politics. Haba!
“Anybody who doesn’t invest in Nigeria has only himself to blame, going forward, if he misses out,” said Aliko Dangote (Africa’s richest man) in an interview last month.
“I don’t really know of any place where you can make as much money as you make in Nigeria.”
thelastPope: You are right up to the point when my region rules and it doesn't really benefit me. When my region rules and there is no development after 40 years. I should then begin to ask deep questions?
YOUR region will be no better. . .trust me. Because the longer it takes. . . .the more masters you have to serve as a 'FIGURE HEAD'! See GEJ?
The North is still in power sir! And will always be.
I believe you already know the answer to your questions. Power corrupts and 'ABSOLUTE POWER CORRUPTS ABSOLUTELY'! This has nothing to do with the 'NORTH'. . .unless you are an ethnicist. In that case, I can't help you. Many apologies. Next please.
thelastPope: You are talking about individuals. Am talking in terms of a region seeking power. Get the perspective? Am asking why a region seeks power considering is wasn't really beneficial in the past in terms of development. Try and understand.
Regions do not exist by themselves. Individuals make up regions right? It is typical with ALL REGIONS! I gave you examples! If your region has not tasted power. . .then wait till then and let us see if it will leave peacefully. Shikena!
It is called survival of the fittest in evolution.
thelastPope: So you are saying they just want it for power's sake? That doesn't make any sense except they are saying they are only interested in one Nigeria when they are ruling.
And why just want it when you cannot use it to develope yourself?
Is that strange? Abacha and Yaradua left in coffins. Did OBJ not want to hang on to power via Third Term Agenda with Ghana Must Go Bags? Let us see if GEJ will leave quietly. You need to put this 'power' thingy in perspective. Of course.
You wait till YOU get there. Then come back and tell us how it feels.
Very natural with the less-evolved races of mankind!
