This is worrisome. Prwmium times is reporting a matter of public interest for Nigeria’s internet users, and users of other kinds of communication. According to them, “The Jonathan administration secretly, and in open violation of lawful contracting procedures, has awarded an Israeli firm, elbit system, with headquarters in Haifa, a $40million contract to help it spy on citizens’ computers and Internet communications under the guise of intelligence gathering and national security.” Elbit announced the contract award Wednesday in a global press release but was silent on the Nigerian destination of the contract. Its general manager, Yehuda Vered, opaquely announced that “Elbit Systems will supply its Wise Intelligence Technology (WiT) system to an unnamed country in Africa under a new $40 million contract announced on 24 April… for Intelligence Analysis and Cyber Defense,” but effusively claimed, in the statement, that his company is “proud to be selected to supply this unique system, which is already field-proven, fully operational and customisable. “Elbit Systems is a world leader in the fields of intelligence analysis and cyber defense, with proven solutions highly suitable for countries, armies and critical infrastructure sites. We hope that additional customers will follow in selecting our highly advanced and cutting edge systems in these fields as their preferred solution,” Mr. Vered added. Multiple and very reliable sources in the administration confirmed to PREMIUM TIMES that Nigeria is indeed the “unnamed African country,” and with details from the Elbit statement, our sources say the contract will now help the Jonathan administration access all computers and read all email correspondences of citizens in what is clearly, an infringement on constitutionally guaranteed freedom of expression. No single policy of this administration has so far affected, in one fell swoop, the lives of 47 million citizens, a third of the Nigerian population and about four times the number of voters who brought the president to power two years ago. Nigerian netizens, the horde of active citizens that use the computer and Internet, are the 10th in a global ranking that make them 27 per cent of Africa’s total Internet users, far ahead of Egypt [19th global ranking] and South Africa [37th in global ranking]. The growth path of the Internet in Nigeria has also been dramatic, rising from a mere 200,000 Internet users in 2002 to 47 million this year, according to data from the Global Internet user, one of the Internet audit groups. This development has not always gladdened public officials in Nigeria many who have expressed open displeasure at the use of the Internet by social media activists and the power of its possibilities as an empowering medium for popular communication. The calls for regulation have been loud in both the administration and in the Nigerian legislature. The earliest hint that the Jonathan administration had desires to invade privacy of citizens surfaced ealy April when researchers at the Munk School for Global Affairs at the University of Toronto alerted the world that Nigeria, Egypt, and Kenya were deploying Internet surveillance and censorship technology developed by an American company, blue coat, which specializes in online security. Blue Coat’s technology will allow the government to invade the privacy of journalists, netizens and their sources. Its censorship devices use Deep Packet Inspection, DPI, a technology employed by many western Internet Service Providers, to manage network traffic and suppress unwanted connections. The DPI, it appears, “makes it possible for censors to look into every single Internet Protocol packet and subject it to special treatment based on content (censored or banned words) or type (email, VoIP or BitTorrent Protocol).” DPI not only threatens the principle of Net Neutrality and the privacy of users, civic groups say, it makes single users identifiable and, in countries that flout the rule of law and violate human rights, often exposes them to arbitrary imprisonment, violence or even torture. While details on the Blue Coat contract appears to have managed to evade scrutiny up till this point, PREMIUM TIMES sources say the Elbit annunciation of the contract, opaque as it was, terribly rattled top administration officials – from the presidency to the National Security Adviser’s Office, and the National Assembly. “The presidency had wanted this contract to be a top secret,” said one of our sources. “The presidency did not envisage that Elbit was going to make it public. Monitoring computers and Internet use is a contentious issue and the National Security Adviser had tried to keep the contract secret.” Elbit says it will take it two years to complete the project, by which time it claimed, the administration will have “a highly advanced end- to-end solution, [to] supports every stage of the intelligence process, including the collection of the data from multiple sources, databases and sensors, processing of the information, supporting intelligence personnel in the analysis and evaluation of the information and disseminating the intelligence to the intended recipient…[that] will be integrated with various data sources, including Elbit Systems’ Open Source Intelligence (OSINT) solution and Elbit Systems’ PC Surveillance Systems (PSS), an advance solution for covert intelligence gathering.” The administration had indicated in the 2013 budget that it would procure a Wise Intelligence Network Harvest Analyzer System, Open Source Internet Monitoring System and Personal Internet Surveillance System at a cost of N9.496 Billion ($61.26 million). Now that the contract has been awarded to Elbit for about $ 40million, it is unclear if the National Assembly will raise questions as to what becomes of the extra $21million earmarked for the project. Investigations indicate that in awarding the contract to the Israeli firm, no tenders or calls for bids were made just as there were no public announcements. The contract was awarded following a proposal from a single vendor who dictated the contract sum and the terms of the contract. |

There are indications that the disagreements between the Christian Association of Nigeria (CAN) and one of its major stakeholders, the Catholic Church may be deeper than what the public has been made to believe. THISDAY gathered Wednseday that besides the reason so far adduced for its temporary suspension of its membership with CAN, the Catholic Church has an axe to grind with the national leadership of the organisation for its inability to carry other stakeholders along in its decision-making process. In addition, the authorities of the Catholic Church were said to have expressed concern over some recent utterances and actions of the national leadership of CAN under Pastor Ayo Oritsejafor, which it said negated the concept and spirit of behind the establishment of the organisation. According to the Catholic Secretariat of Nigeria (CSN), one of the key visions of CAN was to promote the desire of Our Lord, Jesus Christ “that they all may be one”. THISDAY gathered from a CAN source that one of the reasons adduced for withdrawing from CAN stemmed from the fact that the organisation was gradually being dragged into partisan politics, thereby compromising its ability to play its role as the conscience of the nation and voice of voiceless. Apart from politics, the Catholic Church said the Christian body had come under heavy criticism for neglecting ecumenism, which is regarded as the theological foundations of Christian unity. For instance, the Catholic group alleged that the Directorate of Ecumenism and Inter-faith, as one of the missions used by CAN for the promotion of peace and unity in the nation, was not given attention. “To cap it all, the CAN leadership was accused of not showing enough respect for the various blocs and no longer acts on consensus opinion on major issues. “CAN is not an army put in place to defend Christians against Muslims. Rather it is an association whose main objective is to promote unity among Christians and peaceful coexistence with people of other faiths. “It is unfortunate that the present terrorism in Nigeria has become a major distraction to CAN which cannot just sit down to watch the destruction of Christians and churches,” he said. Following the outbreak of terrorist insurgency which had churches as one of its key targets, the leadership of CAN found itself trying to respond to the serious security challenges facing most Christian faithful living in the northern parts of the country. Although many among the Christian faithful believe that Oritsejafor has been very proactive in trying to protect the interests of Christians by speaking out most times against attacks on innocent worshippers by the Muslim sect, the Catholic Church felt he did not consult widely before taking positions. It was learnt that though the Catholic Church may have suspended participation in CAN activities at the national level, it is making efforts to ensure things do not get out of hand. According to a source at the CSN in Abuja, Catholic Bishops are intervening in the matter and both sides are already taking measures to resolve the conflict. The source said Oritsejafor has sought for dialogue with the Catholic Church leadership in order to iron out areas of disagreements between them and his leadership. According to the source, the Catholic Church has accepted to fix a date for a meeting with the CAN leadership after the matter must have been tabled before the its Bishops conference. www.thisdaylive.com/articles/high-handedness-politicisation-forced-catholic-church-to-leave-can/137428/ |

Justice Abdul Kafarati of a Federal High court sitting in Abuja, on Wednesday vacated the November 13th exparte order made against Capital Oil and Gas in favour of the Assets Management Corporation of Nigeria to take over its assets and liabilities. Ruling on the preliminary objections raised by Capital Oil and Gas through its legal representative, Chief Wole Olanipekun, against the experte order, Justice Kafarati said, both the court and AMCOM were not established to destroy existing businesses but to negotiate repayment plans arising from any business dispute. According the ruling, the order was vacated partly because AMCOM had commenced a recovery action against Capital Oil and Gas on the 9th of November, 2012 before approaching the court for the order made on the 13th of November 2012, contrary to section 34 sub section 3 of the AMCOM act. Justice Abdul Kafarati haven dismissed the November 13 exparte order, directed AMCOM to seek a negotiable repayment plan with Capital Oil with the view to recover the proxy loan facility granted through Coscharis Motors Ltd. The court also refused the application made by AMCOM to sell the petroleum products in the sealed off deport of Capital Oil and Gas with a view to recoup parts of the disputed sum for Access Bank. The matter was adjourned to January 15th,2013 for hearing in the substantive matter. www.galaxytvonline.com/news/main-news/capital-vs-amcon-court-vacate-liquidation-order-against-capital-oil-and-gas |

The Assets Management Company of Nigeria (AMCON) will Monday re- open the premises of the Capital Oil and Gas Industries Limited in Lagos for operations. Confirming the re-opening to THISDAY Sunday night, AMCON’s Chief Executive Officer, Mr Mustapha Chike Obi, said the organisation would move its officials into the depot to oversee the finances of the company. AMCON had shut down the premises of Capital Oil consequent upon a court order which directed it to freeze all the assets belonging to the oil marketing company over N48.014billion indebtedness to it. THISDAY investigation revealed that the decision to re-open Capital Oil was aimed at curbing the current fuel crisis in the country, which worsened over the past few days due to the closure of the depot. This came as investigation revealed at the weekend that the current fuel crisis being witnessed across the country despite the claims by the Nigerian National Petroleum Corporation (NNPC) that it had supplied sufficient product that would meet Nigeria’s fuel consumption has justified government’s campaign for full deregulation of the downstream petroleum sector. THISDAY checks revealed that the closure of the company’s 196 million litres -capacity storage tank often used by the NNPC for products storage has hampered products distribution across the country, adding to the worsening fuel crisis. An industry stakeholder, who spoke to THISDAY last night on the lingering fuel scarcity, posited that libralisation of the downstream petroleum sector was central to the reform of the oil and gas industry as it remained the only solution to incessant scarcity of petroleum products in the country. The source said in the event of the NNPC, not being able to supply the market with enough petrol, due to government’s delay in payment of its subsidy claims, the supply chain would be completely crippled. While noting that consumers would enjoy fairer deal in a deregulated market, the source urged government to intensify discussions with the various groups who had been campaigning against full deregulation, with a view to making them understand that deregulation is in the best interest of every Nigerian. However investigations by THISDAY at the weekend revealed that most petrol stations did not open for business. There were long queues of vehicles in the few that had products. Some of the buyers complained of product under dispensing at most filling stations, while others alleged extortion by filling station attendants before they were allowed to buy fuel. Investigations also revealed that most of the filling stations in Lagos, south east, south west, Abuja metropolis and parts of the north have been dispensing fuel at between N110 and N120 a litre as against government’s approved N97 a litre. www.thisdaylive.com/articles/amcon-to-re-open-capital-oil-depot-monday/131686/ |

The Asset Management Corporation of Nigeria (AMCON) and the management of Capital Oil and Gas Limited have agreed to re-open the depot of the oil and gas company in Lagos. This follows a meeting Friday between AMCON and Ifeanyi Ubah, the Managing Director of Capital Oil. A Federal High Court sitting in Abuja, last week gave AMCON an order to freeze all the assets belonging to Capital Oil and its Managing Director. Capital Oil subsequently shut down its operations. Sources said the decision to re-open Capital Oil was aimed at curbing the current fuel crisis in the country, which worsened over the past few days due to the closure of the depot. The source further disclosed that it was however agreed that AMCON would also move its people into the depot to oversee the finances of the company, so that it would not be diverted to other uses. "They also agreed that Capital Oil will keep certain percentage of the finances to meet the operating costs, while AMCON will retain certain percentage to offset Capital Oil’s indebtedness to AMCON," said the source. Ubah and Capital Oil are indebted to AMCON to the tune of N48.014 billion and the order of the Federal High Court came on the heels of a worldwide order (mareva injunction) granted by a London High Court also last week against the assets of Ubah and his company. The order by the UK court was granted sequel to an application by Access Bank Plc to preserve its assets pending the determination of the suit brought before it by the bank. In its response to an ex-parte order for the temporary forfeiture of its asset, which was obtained by AMCON, Capital Oil last week shut down its depot and warned that the immediate shut down of operations would affect supply of petroleum products around the country. The company said in a statement that Nigerians would be worse for its predicament in view of the strategic importance of the company to product distribution in the country, as its storage facilities accounted for 35 per cent of petrol used in the country. Before Friday’s decision to re-open the company’s depot, another temporary relief had earlier on Thursday came the way of the oil marketing company when a Federal High Court in Abuja vacated an earlier order it made granting the AMCON immediate possession of properties belonging to the company and Ubah. http://www.thisdaylive.com/articles/capital-oil-re-opens-amcon-to-oversee-finances/131549/ |
