A Federal High Court in Lagos yesterday sentenced 38-yearold Chibueze Onedigbo to 10 years imprisonment for drug trafficking. Onedigbo, a businessman, was charged by the National Drug Law Enforcement Agency, NDLEA.
He was arraigned before Justice Musa Kuya on a onecount charge bordering on the offence. Justice Kuya in his judgment held that the sentence was in line with the sentencing guideline recently released for Federal High Court judges. “I have considered all the above, and I am of the view that the prosecution has discharged his burden of proof.
“I have listened to the plea for leniency by the accused and have taken into consideration all that has been said.
“In any case, the court is duty bound to sentence the accused, having found him guilty. “More so, the court is guided by the sentencing guideline recently released for Federal High Court judges. “Consequently, I hereby sentence the accused to 10 years imprisonment, from the day of this judgment.
The court also ordered that the drug exhibits in custody of the NDLEA be destroyed within 30 days, if there is no appeal against the judgment. The convict was arraigned on August 29, 2013.
He had pleaded not guilty to the charge, and was granted bail for N5 million with one surety in like sum. NDlEA prosecutor, Mr. Linus Nor, had told the court that the convict was arrested on April 7, 2013, at the Murtala Mohammed International Airport.
According to Nor, about 210 grammes of cocaine was recovered from the convict during the outward clearance of passengers on board a Qatar Airline flight.
He said the convict had concealed the drug substance in a black leather bag. He told the court that the convict was thereafter, handed over to the agency for prosecution.

A woman caught with 4.450 kilogramme of cocaine at the Murtala Mohammed International Airport, Lagos has blamed her ill-health for her involvement in the illicit act.
Abdulrasaq Modinat Alake, a trader, is one of two women apprehended at the Lagos airport by officials of the anti-narcotic agency, the National Drug Law Enforcement Agency (NDLEA).
Some of the reasons adduced for their involvement in drug trafficking include ill-health and lack of support from their husband.
NDLEA in a statement yesterday said the two suspected female drug traffickers are currently assisting narcotic investigators with relevant facts relating to the exportation of 4.450kg of cocaine to India and 7kg of cannabis to China.
Modinat, 44 years old and indigene of Kwara State told investigators that she became involved in drug trafficking after she suffered an ailment that took away all her resources.

The Code of Conduct Tribunal, CCT, has adjourned the trial of Senate President Bukola Saraki over an alleged false asset declaration to November 5 and 6. This followed the pending judgment of the Court of Appeal‎ on the trial of the Senate President.
The Prosecuting counsel‎, Rotimi Jacobs, had prayed the tribunal to adjourn the trial out of respect for the appeal court, which reserved judgment on the suit filed by Saraki to stop his trial for alleged false declaration of assets. But Saraki’s lawyer, Mahmud Magaji, argued that the trial should be adjourned sine die.
Reacting, Chairman of the CCT, Danladi Umar objected, saying the defendant might “go and relax”.
He therefore gave a two-week time-off, ruling that trial would continue on November 5 and 6. Also, Saraki was ordered to take his seat in the accused box after Mahmud Magaji, his counsel, failed to stop the action.
Magaji had made an application that the trial be halted on the grounds that there was a pending suit at the appeal court, which is yet to deliver judgment on the matter. ‎

A 38-year-old man, Olumide Ogunbolude has been arraigned before an Ebute-Meta Chief Magistrate’s Court in Lagos State, for allegedly defrauding his in-law, Taiwo Elegbede, of over N9m. The money was meant to be used to purchase a Range Rover SUV.
The incident happened in Alagbado area of the state and the defendant’s wife happened to be a sister to the complainant.
She was said to have introduced her husband to Ogunbolude as a dealer, when he needed to purchase a car in 2013. Following the introduction, the accused was paid an initial sum of $39,500, before being given an additional N1.6m.
Ogunbolude’s inability to produce the car a year after receiving the money led the complainant to report the matter to the police in April, 2015.
The suspect however pleaded for more time and was alleged to have later issued a dub cheque when he could not meet up.
Following the issuance of dub cheque, Ogunbolude was then arrested and charged to court on Tuesday by detectives from the State Department of Criminal Investigation, Yaba, on three counts of fraud, stealing and issuance of a dud cheque.
The charges read in part, “That you, Olumide Ogunbolude, sometime in October 2013, on Ogo Oluwa Street, Alagbado, Lagos, in the Lagos Magisterial District, with intent to defraud, did obtain the sum of $39,500 and the sum of N1.6m only, total of N9,105,000 from one Taiwo Elegbede under the pretext that you are in a position to assist him to purchase a Range Rover 2011 model, a representation you knew to be false.
“That you, on May 11, 2015, with intent to defraud, did issue an Enterprise Bank cheque leaflet no 19511754 for the sum of N9, 105, 000 in favour of one Taiwo Elegbede, and when presented for payment at the bank, was dishonoured for insufficient funds to the credit of the drawer of the cheque in the bank in which the cheque was drawn.”
According to the police prosecutor, Matthew Ibe, the offences were punishable under sections 312, 285 and 313 of the Criminal Law of Lagos State, Nigeria, 2011.
Ogunbolude however pleaded not guilty to the charges, while his defence counsel, F.S. Oladele, applied for his bail in liberal terms.
In his view, the Chief Magistrate, I.O. Adelaja, granted the accused bail in the sum of N500,000 with two sureties in like sum.

A TEENAGER child raped his own mother on his birthday after she gave him a pair of trainers as a present instead of cash, a court heard.
The boy attacked her as she slept off a cocktail of wine and brandy. She had got ”very drunk” and woke up at midnight to find him having sex with her.
But it was her compassion for her son which gave him the chance to rape her.
A year earlier, the boy was arrested after she made another rape allegation against him and he was freed from custody only when she retracted her accusation because he was being bullied by other prisoners.
”I have to say I find it incomprehensible that a son can treat his mother in this way”, Judge Anthony Ensor told the boy at Manchester Crown Court.
”It is a unique case in my experience and one I find very difficult to either understand or deal with.
”A very thorough psychiatric report indicates you are not suffering from a mental disorder but certainly you need treatment of a psychological mature”.
The teenager burst into tears as he was sent to detention for four years.
He admitted raping his 35-year-old mother at the family home.
Oliver Jarvis, defending, said the boy, who has an eight-month-old child by a teenage girl, had faced an ” horrific” time in custody following the new rape charge.
”He has had severe beatings, he has been spat on regularly by other inmates and he had to be put on a segregation wing”, he said.
Mr Jarvis said it was clear that although the boy did not have a mental illness, he suffered from behavioural problems which needed urgent treatment

The Nigerian Army on Tuesday set up “a high powered” Board of Inquiry to investigate alleged malpractices and involvement of its personnel in the 2014 Ekiti and Osun States governorship elections.
In February, SaharaReporters posted audio recordings and transcript of meetings of some leaders of the Peoples Democratic Party, PDP, with some army officers on how to use the military to rig the gubernatorial elections in Ekiti and Osun States in 2014.
“The audio recordings and affidavit were provided by Sagir Koli, a Captain in the 32nd Artillery Brigade stationed in Ekiti State, who has since fled the country for fear of retaliation.
“Capt. Koli recorded the conversation on 20th June 2014 when he was asked to accompany his Commanding Officer, Brigadier General Aliyu Momoh, to the meeting. The venue was Spotless Hotel in Ado-Ekiti,” said the website.
Since the exposé, there had been calls by the then opposition APC and civil society organisation for the federal government to investigate the matter and prosecute the actors.
But the spokesman of the Nigerian Army, Sani Usman, said on Tuesday that the board would investigate the alleged unprofessional and unethical conduct of some Nigerian Army personnel during the two elections.
The Nigerian Army also charged the board to investigate similar instances “in any other State in Nigeria where other allegations of misconduct were made during the 2015 general elections in the country”.
He said as part of its terms of reference, the board was to also review the involvement of the Nigerian Army formations/units and its personnel in elections and other duties “in aid to civil authority”.

A housewife, Bose Ayinde, on Tuesday told an Igando Customary Court, Lagos, that she had not seen nor heard from her husband for the past 10 years.

Bose, a 39-year-old trader, told the court that her husband, Nureni, with whom she had three children in their 18-year-old marriage abandoned her for 10 years.

“My husband abandoned me and the children, he got a job in Owerri 12 years ago and stopped calling me 10 years. All efforts to reach him proved abortive.

“I always travel to Abeokuta in Ogun to see his parents and informed them that their son was no longer calling me.
“They always tell me that I should be patience that he will call me that he used to communicate with them.
“I used to beg them to give me his new phone number so that I can call him but they refused,’’ she said.

The mother of three accused her husband who was not in court of lack of care.

“I have been the one paying the house rent and paying the children school fees, he did not call to ask for the children wellbeing nor visit home for once.

“His parent never call nor ask for the children. Anytime I go to them for their assistance in their granddaughters school fees, they always tell me to wait that my husband will soon come.’’

Bose pleaded with the court to dissolve the 18-year-old marriage because she was no longer in love and wanted to move on with her life.
“I am no longer in love with him and besides, I want to move on with my life, she said.

The President of the court, Mr Adegboyega Omilola, adjourned the petition till Nov. 9, for continuation.

One Seyi Egbonwan, 30, and two teenagers Wale Ojupon and Daniel Emeka, have been charged before an Ebute Meta Chief Magistrate’s Court in Lagos for allegedly stabbing a police officer , Abimbola Adesoji, to death with a knife.
They were said to have committed the alleged offence on July 25 at Ajah, Ilaje, area of Lagos, during a riot in the community.
Police prosecutor, ASP Eshiet Eshiet, informed the court that the offence contravened Sections 517, 70, 516, 317 and 309 of the Criminal Code, Laws of Lagos State.
The presiding Magistrate, Mrs Oyindamola Ogala, refused to take the plea of the accused persons, saying the court had no jurisdiction in a murder case.
The trio were charged on a seven-count offence of stealing, breach of peace, murder, assault and possession of firearms.
According to the charge, they conspired, kidnapped and killed a constable by stabbing him.

Palpable fear gripped residents of Oben community, a fast growing suburb off Sapele road in Benin City, venue of a gay party which held yesterday in a hotel, name (withheld) as it turned awry following a bloody fracas which broke out among two male lovers over alleged amorous affairs, with many sustaining various degrees of injuries.
Broken bottles, plastics chairs and other dangerous objects were freely used in the fracas as many took to their heels.
Residents of the area who thought it was the usual party that often took place at the said hotel were however shocked to discover it was a party strictly meant for gays who sneaked into the hotel dressed in female apparels with colorful make-ups.
A source who confided in Leadership said fracas started when one of the invitees identified as Ricky caught his male lover in a compromising mood with another lover who had an invitation to the same party.
An argument was said to have ensued which later degenerated into a fierce fight leaving some persons with broken heads and torn cloths.
According to a source, “We have been suspecting the management of this hotel for some time now because the last time some girls who are lesbians held a party here, we were shocked that no single male was in attendance.
“But today, I wanted to go and buy a drink at the hotel when a young man walked up to me at the gate and said to me that his people have taken over the place. I was shocked to notice that he was putting on tight leggings and wearing red lip stick and wig, so I left the place immediately.
“It was later in the night that we heard a loud noise and saw some boys fighting over another boy thereby attracting people to the scene.”

A former finance minister, Olu Falae, who was kidnapped and released last week, has provided shocking details of his ordeal at the hands of his abductors, narrating how he was deprived of food and made to trek several kilometres to freedom.
Mr. Falae said he was kidnapped by six Fulani herdsmen last Monday at his Ilado farm in Akure.
The former Secretary to the Government of the Federation, who spoke to journalists in his home in Akure, said the armed hoodlums threatened to kill him every 30 minutes until they received information that money had been given to them as demanded.
“There were six of them with three or four guns and every half an hour or so they will say, ‘Baba we are going to kill you, if you don’t give us money we are going to kill you,” Mr. Falae narrated.
“On Wednesday, one of them came and said ‘look we are going to leave here on Thursday morning. Since we cannot leave you here alone, if we don’t get what we want we are going to kill you.”
“And they said they gave me until 3pm and if at 3pm they don’t get the money they would execute me. I thank God that at 21 minutes to 3pm, one of them came and said, ‘the money don complete’.”
Giving details on how he was kidnapped, he said: “When the hoodlums came, they slashed me with their cutlasses, they said I was not cooperating. And they dragged me barefooted into the bush.
“After dragging me around for about two hours, they stopped somewhere for us to rest and there they asked me to phone my wife and tell her that I have been kidnapped and taken out of Ondo State by car which was a lie.
“It was about 2.30pm on Monday, We started walking with very few stops until 2am the following morning. I suspect that I must have covered a minimum of 15km. That morning I did not take anything. So all day I had no food, no water and I walked close to 15km. How I survived I cannot really remember. I had no food in my stomach, I had no shoes, my clothes were torn to shreds.
“At some point one of them gave me a rubber slippers. We walked until about 2am. At some point they called for an Okada. At about 2.30am the Okada man took me way down I had no clue where we were going. Finally they dumped me somewhere, where I was until I was released on Thursday.
“In that place we all slept on the floor on leaves, unfortunately the rain came in the night and I was thoroughly drenched where I was lying down. One of them brought a small umbrella to cover my head, my head was covered, but the rest of my body was not covered.
“They offered me bread, but I told them I could not eat it. I demanded for a bottle of coke, which was what I drank every day to have the requisite strength to survive and to continue on the march, because they were permanently moving.
“They were changing locations at two to three times a day. I suspect because they did not want the police to succeed in tracing them,” Mr. Falae said.
He noted that although the confirmation of the payment of ransom was made on Wednesday afternoon, he was not allowed to go until Thursday morning.
“So the following morning they said I should go. One of them took ropes to stitch my buba which was already in tatters, so that it could at least stay on me and I wound not look like a lunatic while leaving that place,” he explained.
“So when I came out of the bush, I was able to find an Okada, a man riding bike, who gave me a lift to Owo.
“The place was about 10km from Owo town. The place was between Owo and Ifon. And I walked most of the distances between my farm to that place and as the farrow flies, that is about 25km that we had to trek.
“As I said miraculously I was not tired, I was not hungry and I was not afraid of them at all. Each time they said, ‘Baba we will kill you,’ I will tell them, ‘no, insha Allah, you will not kill me’.
“I did not break down, but I want to tell you that when I got back home I became completely exhausted. But I am now 80 per cent fit and I know in the next few days I will be up again.”
The 77-year-old warned that such attack should not be allowed to happen again as it could result to even graver consequences.
“It is not because of me. As for me, I am a very humble person, but by virtue of what God has made me and the status God has given me, it is an insult to our race that a man like me could be abducted by a bunch of hoodlums,” he said.
“By the way, one of them told me, he said, ‘Baba, if after you leave us you talk nonsense I will come and catch you again’. That is the kind of insult I received.”
Asked if the kidnappers were illiterates, he replied: “Only two of them could speak some English. They were between the ages of 25 and 35. They were Fulani, they spoke Hausa.”
Mr. Falae however said it was plausible that his ordeal was closely connected to his conflict with Fulani herdsmen who consistently grazed at his farm..

A former spokesperson to ex-President Goodluck Jonathan, Reuben Abati, on Monday charged journalists to hold political office holders to account, and ensure they implement viable economic policies for national development.
Mr. Abati, who was a guest lecturer at the Nigeria Union of Journalists Correspondents’ Chapel 2015 Press Week at Iwe-Iroyin, Oke-Ilewo, Abeokuta, Ogun State capital, said most economic policies of previous governments failed due to lack of dedication and sustenance on the part of public office holders.NUJ

Troops of Operation Pulo Shield (OPS) of the Nigerian Army, Port Harcourt have seized 2.3 million litres of allegedly stolen diesel worth N3.45 million from an illegal bunker site in Rivers.
The petroleum product was siphoned from the pipelines belonging to the Nigerian National Petroleum Company (NNPC).
Maj.-Gen. Alani Okunlola, the Commander of the operation, formerly known as the Joint Task Force, disclosed this to newsmen on Sunday at Tamunotonye Ama in Ogu-Bolo Local Government Area of Rivers.
Okunlola said that two suspected oil thieves were arrested at the bunker site, while several equipment used by the operators of the illegal bunker were seized during the raid.
“On Sept. 23, troops of Sector 2 of OPS of 2 Brigade Army Port Harcourt stormed Tamunotonye-Ama community and discovered a very large bunkering site which operates illegally.
“Troops during the raid discovered and seized eight large metal badges laden with stolen Automated Gas Oil (AGO), commonly referred to as diesel, while another 23 empty barges were also seized.
“Two of the eight metal badges have estimated capacity of seven tanker trucks each,“ he said.
The OPS commander told newsmen that other items found at the site were 44 large plastic tanks, 22 illegal pumping dumps, 18 pumping machines, three speedboats, two outboard engines and a lengthy hose.
He added that 19 storage tanks filled with stolen crude oil were also seized from the site during the operation.
“Two suspects in our custody will be interrogated, while the barges have been towed to Ogoloma Jetty in Okirika Local Government Area of Rivers,” he said.
Okunlola said that investigation into the activities of the operators of the illegal bunkers had begun.
He said that the investigation should reveal how they were able to operate in the area without being spotted.
The OPS commander said that under his command, the operation had increased the frequency of raids in a bid to end oil theft and illegal bunkering in the Niger Delta region.

The Senator representing Bayelsa Central Senatorial District in the National Assembly, Senator Paulker Emmanuel, has carpeted the Peoples Democratic Party for “lack of internal democracy.”
Paulker, one of the disqualified governorship contenders for the PDP’s ticket in Bayelsa State, said this in Yenagoa on Saturday at a forum with members of his campaign organisation.
The Senator, who expressed his displeasure at his disqualification by the PDP’s zonal screening committee in Port Harcourt, Rivers State, recently, noted that internal democracy remained key to democracy in Nigeria.
He lamented that since his inexplicable purported disqualification, the party’s appeal panel had yet to come out with the result of their screening.
During the screening, Paulker, a three-time Senator, and a former Chairman of Kolokuma-Opokuma Local Government Area, Chief Ebikitin Diongoli, were disqualified, leaving Governor Seriake Dickson as the sole candidate of the PDP.
The candidacy of Dickson has been affirmed by the party’s delegates on Thursday.
Paulker said, “For our democracy to thrive in this country, there must be internal democracy. Without internal democracy, it is difficult for a party to reflect democracy on the playground. It is better to quarrel in the process of internal democracy than to shut out internal democracy out of our democratic experience.
“Regarding our disqualification, up till now, the appeal panel has yet to come out with the result of the screening.
“Power comes from God. Irrespective of parties, Bayelsa belongs to all of us. If a government is formed tomorrow, all of us will benefit from it. Any government in power owes all of us a duty of service.
“Like I told them at the screening panel, when they criticised me that members of the All Progressives Congress attended my ceremonies, I said the party required more Paulkers now than ever because we require ambassadors to go out of this party to canvass for votes in order for us to win.”
He said democracy had come to stay in this country, but warned of any attempt to make mockery of democracy by shutting some people out of contest for political offices.

Hamza Musa Kabir from Kano in northern Nigeria survived the massive stampede at the hajj by shedding his pilgrim’s garment after he was pinned under a man in the crush, which killed 769 people.
Reflecting on the shocking events that unfolded on Thursday in Saudi Arabia, the 55-year-old tall, thin trader told his dramatic story to AFP’s Kano correspondent Aminu Abubakar, who also performed the pilgrimage:
“We set off at sunrise from Muzdalifah and marched towards the Jamarat,” the place in Mina where pilgrims ritually stone the devil, Kabir recounted.
“We were more than halfway through the procession when the road was blocked by the police, which led to buildup (of pilgrims).
“Then the police blocked all the roads, leaving us with only one route. The situation became worse when the police allowed people returning from the Jamarat to use the same route back to their tents” where the pilgrims stay.
“From where I stood, I could see a police officer on a raised platform at a nearby control post beckoning at pilgrims returning that they should move on.
“Because those returning were moving in the opposite (direction) of the surging crowd, there was a stampede.
“People became weak from suffocation and heat. People couldn’t breathe (in the crush). Many collapsed, mostly women and the old and disabled on wheelchairs.
“I also was pinned down by this huge man I believe to be an Asian. I had to strip myself of my shroud which had become an obstacle to my escape.
“I raised my hand and grabbed the shroud of another pilgrim from Nigeria who was already standing on a fence. He couldn’t pull me up because I was pinned down by this huge man.”
– ‘Countless bodies’ –
In an act of desperation, Kabir grabbed the man’s testicles “and squeezed them which made him jump off me.
“This enabled me to use my other hand to reach for the metal bar of the fence, and grab it. I then pulled myself up with the help of another young Arab man who was standing on the fence,” reaching safety inside one of the camps where Kabir then passed out.
“I was so dizzy and weak and too weak to walk. I was spread on the floor and another pilgrim, seeing that I had regained consciousness, offered me his other shroud.
“People offered me drink and some food. I then realised that I had been bitten (on) the side, by a young man from underneath.
Kabir lost his backpack and most of his belongings except for a small bag around his neck.
“I spent, like, two hours sitting down recuperating,” he said.
“After that, I was assisted by another pilgrim from Niger to make it to the Jamarat and carry out the stoning rites.
“What I saw on my return to the scene of the stampede frightened me, because I just saw countless bodies lying on the floor covered in white shrouds, and I knew I could have been one of them.”
Still, he is not too frightened to return.
“I know I will not die until the appointed hour…. Hajj is very important to my faith, and no obstacles will discourage me from seizing another opportunity to come back.”
