The United Kingdom Charity Commission appointed an interim manager for the Mountain of Fire and Miracles Ministries International since August 2019.

The UK charity regulator appointed an interim manager for the church following a 2018 inquiry which raised concerns over mismanagement of funds.

The inquiry was launched after MFM with an average income of £4m annually repeatedly failed to file financial information on time.

The commission also found two alleged incidents of fraud by former employees involving significant sums, both of which were not reported until a number of years after the frauds were discovered.

It then suspended the church Board of Trustees led by Dr Daniel Olukoya and appointed Adam Stephens of Smith & Williamson as Interim Manager.

Other trustees suspended include Florence Sankey O.A, Oluwafemi Emmanuel Oladipo, Bamidele Omotayo, Kehinde Williams, and Enock Sunday Olaniyan.

The commission however, didn’t state which of them engaged in fraud but it stated that the lead trustee had an issue without expressly mentioning Olukoya.
When contacted, one Stephanie at the Charity Commission press unit told SaharaReporters that she can’t disclose if the church had been returned to its original trustees until further checks were made.

SaharaReporters had in 2018 reported that a pastor and former members of the church alleged that Dr Olukoya and MFM had willfully and intentionally evaded United States Customs Service duties and had evaded tax payments to the government.

The pastor of a Maryland branch in the US averred in court filings that MFM and its General Overseer, Olukoya, engaged in "fraudulent activities" in the United States of America, claiming that MFM International was in the practice of knowingly and deliberately making false claims to evade U.S. Customs duties and taxes on books exported from Nigeria to America.

The nature of the activities stems from the fact that Olukoya shipped prayer books (specifically, “70 Days Prayer & Fasting” and “Pray Your Way Into...” to various U.S-based MFM branches with a cover letter categorising the books as “donations” to be distributed to local parishioners.

However, once delivered to the United States, instructions were then emailed to U.S. pastors by MFM International and or MFM USA instructing them of the price they must charge parishioners in selling these books.

The pastors were then instructed to remit the earnings of their sales to MFM International.

Angered by the report, Olukoya filed three libel suits against the Publisher of SaharaReporters, Omoyele Sowore, in Nigeria and another one before the District Court of Maryland, United States.

He said he was constrained to take legal action against Sowore, SaharaReporters Media Group Incorporated, and the Incorporated Trustees of Sahara Media Foundation for their alleged failure to desist from publishing false and malicious articles against him and his church.

While all the cases in Nigeria have been dismissed, that of the US is still ongoing.

Some Nigerian pastors recently questioned the rationale behind the inclusion of religious centres and charity organisations into the Company and Allied Matters Acts signed by President Muhammadu Buhari into law on August 7, 2020.

Several of the pastors have been hit by Charity Commission sanctions over the years in the UK for fraudulent activities.

Under the new law, religious bodies and charity organisations will be strictly regulated by the Registrar-General of the Corporate Affairs Commission and a supervising minister.

CAMA provides that the commission may by order suspend the trustees of an association or a religious body and appoint an interim manager or managers to coordinate its affairs where it reasonably believes that there had been any misconduct or mismanagement, or where the affairs of the association are being run fraudulently or where it is necessary or desirable for the purpose of public interest.

Children of God was accused by numerous members of child abuse. It later rebranded to The Family International.
The Children of God was established in the late '60s by David Berg, a traveling preacher. They believed in "free love" that reportedly involved female members recruiting with sex (sometimes known as "flirty fishing"wink and survivors say children were regularly abused. Both Rose McGowan and Joaquin Phoenix grew up in the Children of God.

"There was sexual abuse for myself from the age of 4, not just from my dad who got convicted, but from various other members of the cult, some related, some not," Verity Carter, who grew up in the cult, told BBC News. "I wasn't comfortable with the things being done to me but if I asked a question I got beaten or put on silence restriction. I was punished a lot because I was never able to stop asking questions."

Berg died in 1994. The Children of God later rebranded and changed its name to the Family of Love, and later The Family International after it had been labeled a cult and was investigated by the FBI and Interpol.

Nearly 27 years have passed since the horror in Waco, yet many still wonder how a cult like the Branch Davidians and leader David Koresh could hold such incredible influence over its followers.

According to the American Heritage Dictionary, a cult is a religion or religious sect generally considered to be extremist or false, with its followers often living in an unconventional manner under the guidance of an authoritarian, charismatic leader, like Koresh

Here's a closer view of five of the best known cults in the United States, and the story of how their converts showed incredible devotion to beliefs outside the mainstream, often with deadly and horrifying consequences.

The Peoples Temple,Jonestown - November 18, 1978

Reverend Jim Jones was embraced by African-Americans after his fiery speeches on racial equality in America. From the 1950's until the end of "The People's Temple" in 1978, Jones was seen as a beacon of peace across the racial divide and a leading advocate for socialism.

But when Jones moved hundreds of cult members to "Jonestown" in Guyana, where he and followers believed they could create a "socialist paradise," concerned family members garnered the attention of California Congressman Leo Ryan.

The congressman sought to investigate whether some cult members were being held against their will, as relatives suggested. When Ryan traveled to Guyana to meet with Jones, he was ambushed on a plane by the reverend's followers, and died after being shot repeatedly in the body and face.

Fearing retribution for the congressman's death, Jones led 918 followers into a mass murder-suicide known now as the "Jonestown Massacre" on November 18, 1978. Most died by drinking cyanide mixed with Kool-Aid. The reverend, however, died of a self-inflicted gunshot wound to the head.

THE MANSON FAMILY - 1967-1969

Ex-convict and singer-songwriter Charles Manson was able to woo followers, especially women, into a non-religious cult that believed a race war known as "Helter Skelter" was imminent.

Manson, who described Scientology and Satanism as influential to his beliefs, told those who joined The Manson Family cult that when the African-American rebels won the war, they would be elevated by the survivors to lead the survivors in the United States.

As leader of The Manson Family, Charles influenced the murders of nine people in California, including the murder of actress Sharon Tate and four others in her home. The family also was involved in a number of crimes, including the plotting of an attempted assassination of President Gerald R. Ford.

Charles Manson was sentenced to death for his crimes, but because California banned the death penalty, he lived in prison for decades before he died on November 19, 2017.

BRANCH DAVIDIANS - 1959-1993

Formed by charismatic leader David Koresh after his expulsion from the Seventh Day Adventist Church, the Branch Davidians shared a belief that the end of the world was drawing near.

Koresh, recognized often for his musical talents on the guitar, believed he was a messiah who spoke the true word of God. He also believed all women were his spiritual wives, resulting in multiple relationships with women in the cult, married and single alike.

Members stockpiled weapons at the Branch Davidian compound in Waco, Texas, preparing for the pending apocalypse. They also caught the attention of ATF agents, who attempted to raid the compound on February 28, 1993, for alleged weapons violations.

An intense gun battle ensued, killing four agents along with six Branch Davidian members. The incident sparked a 51-day standoff that would come to a deadly conclusion on April 19, 1993.

When negotiations stalled following the release of 19 children, the FBI and state authorities moved in on the compound with tanks firing tear gas. As television cameras carried live pictures on cable and network news, a major fire erupted inside the compound as the Branch Davidians set the compound ablaze.

In the end, 76 people were killed in the building. Investigators determined those who did not perish in the fire died of gunshot wounds or from being crushed when a concrete wall collapsed.

HEAVEN'S GATE - 1974-1997

Finding meaning through the cosmos and extraterrestrial life, former University of St. Thomas (Houston) professor Marshall Applewhite led dozens of people in a cult known as "Heaven's Gate."

Launching the society in 1974 after a near-death experience, Applewhite and his followers believed the end of Earth was near, and that the planet was going to be "recycled."

As a result, believers were prepared to leave Earth by boarding a spaceship that was trailing the Hale-Bopp Comet. But in order to leave, followers had to make the ultimate sacrifice by shedding their earthly bodies.

After drinking a mix of cyanide, pineapple juice and vodka on March 26, 1997, 39 people died, including Applewhite, in Rancho Santa Fe, California. When police found their bodies, the members all wore black clothing, matching armbands and tennis shoes.

Before the group committed suicide, their website was updated to read: "Hale-Bopp brings closure to Heaven's Gate ... Our 22 years of classroom here on planet Earth is finally coming to conclusion -- "graduation" from the Human Evolutionary Level. We are happily prepared to leave "this world" and go with Ti's crew."

WARREN JEFFS FUNDAMENTALIST CHURCH - 2006

Formed by leader Warren Jeffs as a breakoff sect, The Fundamentalist Church of Jesus Christ of Latter-Day Saints had one fairly obvious difference from believers of the Mormon faith: its practice of polygamy.

Jeffs, who was excommunicated by the church for polygamy, watched as his church membership swelled to more than 10,000 members in Arizona, Utah and Texas.

Amid allegations of ongoing and far-reaching incest and sexual misconduct with minors inside the church, federal officials raided Jeffs' Eldorado, Texas ranch in 2008.

Evidence led investigators to charge Jeffs on multiple counts for sex crimes against children. He was sentenced to life in prison plus 20 years, to be served consecutively.

In Sweden, Easter is a Time for Witches
In the Christian calendar, the Thursday before Easter is a holy day that kicks off the celebration of the passion, death, and resurrection of Jesus, which culminates on Easter Sunday. In Sweden, it’s also a day when witches come out.

Known in English as Maundy Thursday, the day is called Skärtorsdagen in Swedish — a name that comes from the Old Norse word skíra, meaning “clean,” reflecting a Roman-Catholic tradition in which the Thursday before Easter was considered a day of cleansing. Skíra becomes skär in modern Swedish, and torsdag means Thursday, so the name Skärtorsdagen can be translated as “the cleansing Thursday.”

In Swedish folk tradition, Skärtorsdagen was also believed to be the day when witches flew off on broomsticks to the legendary island of Blåkulla to feast and dance with the Devil. The reasoning behind this belief was that this was the day that Judas betrayed Jesus, an act that set loose all the evil forces in the world.

This belief in Blåkulla and consorting with Satan featured prominently in the bloody witch trials that took place in Sweden during the 17th century. Between 1668 and 1676 around 300 people were executed as witches, usually accused of having stolen children and brought them to the Devil at Blåkulla. The largest single witch trial took place in Torsåker near Sollefteå in Ångermanland, where 71 people were burned at the stake in June 1675. Of these, 65 were women — a fifth of the entire adult female population of the parish!

Iceland
Taxpayers in Iceland who belong to an officially registered religious group or secular humanist organization must pay a congregation tax (Icelandic: sóknargjald, plural sóknargjöld) which is deducted from income taxes and goes to the individual's respective organization. In the past, the sóknargjald of those who do not belong to any recognized religious organization went to the University of Iceland, but this was changed in 2009. In cases of individuals not belonging to a registered religious group or secular humanist organization, the amount that would otherwise be used for the sóknargjald remains now part of the income tax budget. In 2015, the monthly sóknargjald amounted to 824 Icelandic krónur,about $US6.

Italy
Taxpayers in Italy pay a mandatory eight per thousand tax, and have the option to choose to whom they will assign the monies. This tax amounts to 0.8% of the total income tax (IRPEF) and every taxpayer can choose the recipient of the contribution on their tax form. Regardless of whether the taxpayer expresses a preference or not, the 0.8% is already included in their tax levy.

A church tax is a tax imposed by the state on members of some religious congregations to provide financial support of churches, such as the salaries of its clergy and to pay the operating cost of the church. A church tax is imposed in Austria, Denmark, Finland, Germany, Iceland, Italy, Sweden, some parts of Switzerland and several other countries. In Spain and Portugal paying a church tax is optional.

The constitution of a number of countries such as the United States could be and have been interpreted as both supporting and prohibiting the levying of taxes unto churches; prohibiting church tax could separate church and state fiscally, but it could also be favorable treatment by the government. It is explicitly prohibited in India for the state to levy taxes on religious grounds under Article 27 of the Constitution of India. In Australia there is no specific constitutional exemption. Section 116 of the Constitution of Australia precludes the Commonwealth of Australia (i.e., the Federal parliament) from making laws for establishing any religion, imposing any religious observance, or prohibiting the free exercise of any religion, but it does not make any specific reference to taxation. Religious organisations are however exempt by virtue of legislation by the various Federal & State parliaments giving them charitable status.

Austria
Every recognized religious group in Austria can collect church tax at a rate of 1.1%, though currently only the Catholic Church makes use of that opportunity. Church tax is compulsory for Catholics in Austria. This tax was introduced by Adolf Hitler in 1939. After World War II, the tax was retained in order to keep the Church independent of political powers.

Denmark

The members of the national Church of Denmark pay a church tax, called "kirkeskat". The rate varies among municipalities with a minimum of 0.4% and a maximum of 1.3% of taxable income in 2019. The tax is generally around 0.7% of taxable income. The collection of the church tax is administered by the Danish tax authorities, but the church tax is not considered as a genuine tax by, for example, Statistics Denmark, but as a "voluntary transfer from households to the state".

The church tax does not cover the entire budget of the Church of Denmark. An additional 9% is paid by the government through block grants ("bloktilskud"wink, which means that people who are not members of the Church of Denmark also finance its activities through taxes.[8]

Finland
All members of either the Evangelical Lutheran Church of Finland and the Finnish Orthodox Church (the two state churches of Finland) pay an income-based church tax of between 1% and 2%, depending on the municipality. On average the tax is about 1.4%.

Formerly, to stop paying church tax, one had to formally leave the church by personally going to local register office and waiting during an allowance of time for reflection. This requirement was removed in 2003 and currently a written (but not signed) statement to the church suffices. The majority of resignations since 2005 are now handled through a web site, Eroakirkosta.fi. If one is a member of the church when the year begins, they will pay taxes for the whole year. Studies show that church membership resignations in Finland are mainly due to the general secularization of society, not because of tax avoidance.

Sweden
The members of Church of Sweden pay church fee, which varies between municipalities, but can be as much as 2%. Church and state are separated as of 2000; however, the burial tax (begravningsavgift) is paid by everyone regardless of membership.

In a recent[when?] development, the Swedish government has agreed to continue collecting from individual taxpayers the annual payment that has always gone to the church. But now the fee will be an optional checkoff box on the tax return. The government will allocate the money collected to Catholic, Muslim, Jewish and other faiths as well as the Lutherans, with each taxpayer directing where his or her taxes should go.

Switzerland
There is no official state church in Switzerland. However, except Geneva and Neuchâtel, each canton (state) financially supports at least one of the three traditional denominations – Roman Catholic, Old Catholic (in Switzerland Christian Catholic Church of Switzerland), or Evangelical Reformed – with funds collected through taxation. Each canton church tax may formally have to leave the church.[clarification needed] In some cantons private companies are unable to avoid payment of the church tax.

In Geneva and Neuchâtel there is no church tax : each taxpayer is free to make a voluntary tax deductible contribution or gift to his church, either directly to the beneficiary or using the canton (state) tax system.

United States
In the United States, the Establishment Clause of the US Constitution prevents the US federal government and (through incorporation doctrine), the 50 state governments from imposing church taxes. In 1947, the US Supreme Court ruled in Everson v. Board of Education that "No tax in any amount, large or small, can be levied to support any religious activities or institutions, whatever they may be called, or whatever form they may adopt to teach or practice religion."

In the past, some states established state religions and imposed church taxes to provide financial support; indeed, after the ratification of the Bill of Rights, the Establishment Clause protected these state churches from interference by the US Congress.[citation needed] In Massachusetts and Connecticut, the Congregational church was tax supported. When it was announced that the presidency had passed CAMA into law, a particular PDF document was being shared on social media about how this law would aid the ease of doing business in Nigeria. To my greatest surprise, after reading through the law, it became clear that religious bodies and charity organizations that have been giving succour to the oppressed people of Nigeria (who are denied basic amenities by the huge corruption in public service) will now be strictly regulated by the whims and caprices of the Registrar General of Corporate Affairs Commission and the Supervising Minister.

1. By virtue of section 839 of CAMA 2020, it provides that the commission may by order, suspend the trustees of an association and appoint an interim manager or managers to manage the affairs of an association where it reasonably believes that there has been any misconduct or mismanagement of the association, or where the affairs of the association are being run fraudulently or where it is necessary or desirable for the purpose of pub interest. See section 839(1).
Subsection 2 of section 839 provides for another procedure for the suspension of trustees. The trustees can also be suspended by an order of court upon a petition by the commission or one-fifth of the members of the association. However, the petitioners must present reasonable evidence or such as requested by the court. A comparative perusal of subsections 1 & 2 suggests that, while the court requires evidence, following a petition to suspend trustees, the commission simply needs to believe, to desire for some other interests disguised as public interest, to suspend trustees.
It also suggests that the powers of the commission override that of our courts. The belief and desires of the Registrar General and the Minister becomes superior to the judicial powers of the court under subsection 2.

Therefore, the conclusion is that petitioners do not need the court to suspend trustees. All they need to do is appeal to the belief and desires of the Registrar General or the supervising Minister.

2. Section 823 (1) recognizes the appointment of trustees by a community of persons bound by custom, religion, kinship or nationality. How then could the commission appoint a manager, who may not have anything in common with the community to manage the affairs of the association?

3. Section 839(7) provides that after an enquiry into the affairs of the association, if the commission is satisfied as to the matters in subsection (1) (where you have the ambiguous and dictatorial clauses like “reasonably believes”, “deem it necessary or desirable”, “public interest.”) it may suspend and remove any trustee.

4. Section 842 (2) gives the commission the power to direct transfer of credits in dormant accounts of NGOs. The banks are to inform the commission of dormant accounts of NGOs in its custody and if after 15 days there is no ‘satisfactory’ response from the association of evidence of its activities, the commission may (without any judicial proceedings) dissolve an association and direct a bank to transfer monies from the association’s dormant account to another account (without a court order). Even EFCC requires a court order to forfeit accounts. This is the height of dictatorship in a country where the biggest crimes are committed by public officials.

CONCLUSION
Prof. Chidi Odinkalu had raised a red flag on similar provisions two years ago. It is now clear that this is a tactical manoeuvre to entrench the NGO Regulation Bill through the backdoor.
These provisions are pushing the nation into a dangerous terrain in a country with palpable religious tension regarding the licensing of religious organization. This is a country where the tax collected are not accounted for and inquiries via the Freedom of Information Bill are usually frustrated. There are various empirical evidence to show that lives have been touched by NGOs, but there is no evidence of the utilization of collected revenues in the lives of average Nigerians.
The freedom of association as guaranteed by the constitution is sacred and should not be tampered with in a nation like Nigeria. NGOs and religious organizations are major sources of hope for an oppressed people. The UK Charity Commission represents a responsible government that has demonstrated integrity in the implementation of its budget and provision of basic amenities to its people. The idea of copying the jurisprudence behind the regulation of NGOs from other climes and pasting same on the CAMA 2020 is counter-productive- and our legislators need to rise above copying and be creative and bespoke in the formulation of policies. We need to focus on the utilization of revenue collected by government to better the lives of the people.
