Two main cult groups in the Niger Delta engage each other in a shoot-out over the formula for sharing money realised from hostage taking

Militants recently re-enacted the ugly incidence of wanton killing and destruction of properties in Port-Harcourt and its environs. The scenario was reminiscent of what took place in the state almost one year ago, which led to the deployment of the Joint Military Task force, JTF, in the state, and subsequent declaration of curfew in the state capital and its environs. More than 30 persons were said to have died in various locations in the current crisis.

Though no curfew has been imposed in the state capital, security has been beefed up by men of the JTF to ward off further insurgence by the militants. The atmosphere is tense and soldiers are subjecting the residents of the flashpoints to scrutiny. The renewed insurgence is a fall-out of the clash between two cult groups led by Farah Dagogo and Soboma George. Both of them have been on the wanted list of security operatives in the state.

The two kingpins are from Kalabari ethnic group, with Farah coming from Bakana and Soboma from Buguma. But Soboma fled to Abonnema town for refuge when he was chased out of his ancestral home by security operatives who had declared him wanted for his role in last year’s mayhem in the state. Farah leads the Niger Delta Strike Force, NDSF, while Soboma heads The Outlaws.

Newswatch gathered that the militants had agreed that bunkering was a free for all business, but that certain percentage of ransom taken from any hostage would be shared among the gangs. The source said that Soboma violated the agreement on a few occasions. He was also alleged to have betrayed the confidence reposed in him by Farah because his gang pocketed the ransom from hostages.

The two groups first clashed at midnight on July 29, at Abonnema in Akuku Toru Local Government Area of the state. There was prolonged battle on the high sea. Farah was said to have pitched tent with one Egbere Papa group, and they chased the Soboma group to Abonnema in an attempt to capture one Hassan of the Soboma group ‘dead or alive’ for intercepting and seizing imported arms belonging to Farah.

The rampaging militants from the NDSF were said to have succeeded in killing the said Hassan of The Outlaws group, but failed to bring back his corpse to Farah, their boss. Angered by the fact that the boys did not complete the assignment, Farah ordered them to return to Abonnema to bring Hassan’s corpse to him. The boys complied and eventually retrieved Hassan’s corpse from a mortuary in Abonnema, and brought it.

Farah was said to have unleashed the attack as a way of venting his anger on Abonnema community for accomodating Soboma into the community. Sources said the community resisted all entreaties from Farah for them to send out Soboma, because the elders insisted that since Soboma ran to the community for safety it was wrong to reject him and send him out from the area, more so, when he is from Kalabari ethnic group.

Another source said the remote cause of the clash was the N350 million allegedly received as ransom from some foreign nationals kidnapped by the militants. According to the source, Soboma’s men who were more in number and the architect of the hostage taking felt that they should take the lion’s share of N230 million, while Farah’s group takes N120 million. Farah felt cheated by the sharing formula and took the war to Soboma’s Abonnema territory.

In the ensuing battle of the two camps, many people lost their lives and property worth millions of Naira were destroyed. Sagir Musa, a Lt Col, and spokesman of the JTF in Port Harcourt confirmed that one soldier and two militants were also killed in the gun battle.

Consequently, the Abonnema people, especially women and children have deserted the community and have taken refuge in neighbouring communities, including Degema, headquarters of Degema Local Government Area, while so many others ran to Port-Harcourt. The Abonnema council of chiefs has called on the state government to intervene in the situation. Olu Fubara, the spokesman of the council of chiefs urged the state government to intervene before the situation further escalates.

The militants later shifted base and continued fighting along the coast. Consequently, on Friday, August 1, the battle spilled into Port-Harcourt, and the theatre of war was Dockyard area of the metropolis. That night, residents of the area knew no peace following sporadic shooting from the two gangs. One pregnant woman, was killed in the crossfire.

The latest clash of the militant gangs in Port Harcourt was preceded by the invasion of Harry community, the home town of late Marshal Harry, former chieftain of All Nigeria Peoples Party, ANPP, in the state.

Sagir, the JTF spokesman said his men mobilised to the scene of the clash at the Dockyard where they engaged the militants in a shoot out and eventually overpowered them and forced them to retreat to the creeks. He said there was no casualty on the side of the JTF, but that a corpse was found floating near the Nigerian Ports Authority, NPA Dockyard, after the clash between the soldiers and the militants.

Some 16 people who sustained injuries from the recent clashes were taken to Teme Clinic in Mile 1 area of Diobu, Port-Harcourt. The clinic houses an International Non-Governmental Organisation that provides free treatment to accident victims. Newswatch learnt that one of the victims died while others were still receiving treatment.

Since then, residents of the flash points in the metropolis have continued to relocate to areas they consider safe. Areas being deserted are Borokiri near the old Port-Harcourt Township, Bundu waterside and Abonnema Wharf areas.

In neighbouring Bayelsa State, there has also been battle of supremacy between another group of militants and men of the JTF, in Agge community in Ekeremor LGA of the state. This was because men of the JTF invaded the community in search of militants’ hideouts. The search is coming on the heels of attack August 2, on a JTF base located in Bomadi in Delta State, in which some militants carted away arms and ammunition belonging to the soldiers.

Consequently, the JTF invaded Agge and destroyed several houses and property. The destruction is said to be of the same magnitude as the mayhem at Odi by soldiers a few years ago.

Newswatch gathered that more than forty militants are warming up for fresh battle against the soldiers for allegedly causing pains to the people. But tension is still mounting on the riverine community as most of the inhabitants have deserted the area for fear of being caught in the crossfire. One person was said to have died in the incident.

A number of arrests were made by the soldiers though the exact number was not confirmed. Lt.Col. Chris Musa, commander of JTF, Bayelsa State, said the soldiers recovered one double-barrelled gun and three boats during their house-to-house search at Agge. He challenged the community to produce the militants and the ammunition taken away from the JTF in Bomadi.

Passengers Flock MMA2 as V’Nigeria Halts Operation

The domestic terminals of the Murtala Muhammed International Airport – General Aviation Terminal (GAT) and MMA2 – were crowded yesterday by passengers who scrambled to buy tickets from others airlines as Virgin Nigeria Airways stopped domestic operations for the fourth day.
The airline stopped operating domestic services since its imbroglio with the Federal Government which directed it to move its domestic operations from the international wing to MMA2.
THISDAY learnt that Virgin Nigeria records an average of 60 take-offs from the Lagos airport, conveying about 6,000 passengers to other destinations in the country from Lagos.
With its cessation of domestic operations, the passengers now besiege other airlines to book flights.
When THISDAY visited Virgin Nigeria counters at MMA2, the airline’s officials said they were not taking in passengers and did not know when they would resume operations again.
At the ticketing office of Virgin Nigeria, officers were attending to passengers who had bought the airline’s tickets before the impasse and were transferring them to other airlines.
Olu Fidel Ohunaya, former president of National Cabin Crew Association, told THISDAY that the passenger surge owed to the fact that some Nigerians prefer to fly by particular airlines and as Virgin Nigeria suddenly closed domestic operations, it reverberated negatively on the industry.
“After the air crash involving Sosoliso and Bellview airlines, government issued a statement that Aero and Virgin Nigeria were the only safe airlines in the country and since then people decided to fly the two airlines. While people were rushing to buy their tickets, other airlines would be flying half empty aircraft.”
It also emerged yesterday that the Federal Government might not have changed its position on its directive to Virgin Nigeria to move.
Industry experts are expressing worries over the financial impact the crisis would have on the airline.
A source told THISDAY that Virgin Nigeria leased its aircraft at very high costs from Virgin Atlantic when it started operations.
It is said to be paying Richard Branson, Chairman of the Virgin Group, for using the Virgin franchise, in addition to high salaries to the personnel seconded to the airline from Virgin Atlantic.
Some industry experts also query the validity of the Memorandum of Mutual Understanding (MMU) between Virgin Nigeria and the Federal Government, especially as part of the conditions stated that the airline “in its capacity as a flag carrier does not do or permit to be done anything which would violate Nigerian laws and regulations, including laws and regulations relating to matters of strategic security and economic interest of the Federal Republic of Nigeria.”
Security is being cited as the reason the Federal Government asked the airline to move its domestic operations to MMA2.

It is (arguably) a truism that the Obama phenomenon is a globally infectious malady. Obama is no longer only a US Presidential candidate, he has also become such a cultural and political icon that it is highly unlikely that there is any sizeable segment of humanity still unfamiliar with the name or the significance of his emergence as a viable contender for the highest political office in the world. I was, therefore, not quite surprised to observe a rather interesting display of affection and support for Barack Obama on a recent trip back home.

In spite of all the general shortcomings of our nation and the occasional blemishes we experience as a people, we Nigerians pride ourselves on being in tune with current social fads and very up-to-date on current affairs. That an Obama event will draw hundreds of well-to-do Nigerians, or that there will be such an enthusiastic manifestation of support and pride in the first black person with the most credible claim to the White House is a testament to the progressive nature of Nigerians as a people. No one can credibly accuse us (individually) of backwardness.

Unfortunately, as in most things we engage in as a people, a waft of odiferous criminality is threatening to envelop this ostensibly laudable display of support for the Democratic Presidential Candidate. The implications of such nefarious tendencies are indeed very significant for every well-meaning Nigerian, hence the need to quickly nip this in the bud lest a few misinformed (or criminally-inclined) elements add another layer of tar onto the already besmirched image of Nigeria (and Nigerians). We certainly do NOT need any reinforcement of the misconception that a Nigerian can never do anything without a criminal slant to it. This is the import of the following article.

It has come to my attention that, upon the conclusion of the recent pro-Obama confab in Nigeria, a number of the organizers have been reaching out to well-to-do Nigerians, soliciting funds on behalf of themselves and their organization with a promised that such funds will be utilized to support the candidacy of Barack Obama in the United States. A more laughable version of this spiel claims that the collected fund will be “shipped” to the Obama campaign to be used as it wishes.

Let me hasten to make the following indubitably clear:

I have not been personally solicited, so I do not have a first-hand confirmation of this effort – I rely on trusted reports, and I accept responsibilities for their inaccuracy, if they turn out to be inaccurate.

I am not a lawyer, certainly not one specializing in US Electoral Laws. I am relying extensively on publicly available information to proffer an opinion here, and such opinion should not be construed as authoritative in the substance under discussion – I encourage the reader to engage in a measure of due diligence and do his/her own research.

Having sufficiently inoculated myself against charges of sloppiness (or worse), let’s proceed to the gist of the story here. I trust the reports of solicitation for campaign funds by a number of (apparently) well-meaning Nigerians in Nigeria on behalf of the Democratic Presidential Candidate to be accurate and I intend to use this medium to point out that such solicitation is not only illegal, but that contributing to such efforts is also criminally illegal.

Now that we have summarily dispensed with the obligatory news report references, let’s examine what the law has to say with regards to campaign contributions by non US citizens. For this, we rely on the constitutional authority on everything related to presidential elections in the United States of America – The Federal Election Commission (FEC):

The FEC is an independent regulatory agency established in 1975 to administer and enforce the Federal Election Campaign Act (FECA). That statute limits the sources and amounts of the contributions used to finance federal elections, requires public disclosure of campaign finance information and--in tandem with the Primary Matching Payment Act and the Presidential Election Campaign Fund Act--provides for the public funding of Presidential elections.

According to the FEC’s aptly-named “Foreign Nationals Brochure”, anyone who falls into one or more of the following designations is considered a “Foreign National” for the purposes of election laws:

Foreign governments;

Foreign political parties;

Foreign corporations;

Foreign associations;

Foreign partnerships;

Individuals with foreign citizenship

Immigrants who do not have a "green card."

There are, of course, a few exceptions to these classifications, but for the purposes of our discussion, we will limit our classification to that provided above.

By law, no one so classified above is permitted to make any financial contribution to anyone who is a candidate for an electoral office in the United States of America. No one, period. Not individual. Not corporations. Neither their agents, nor their golden retriever. The relevant portion of the regulation is as follows:

The Federal Election Campaign Act (FECA) prohibits any foreign national from contributing, donating or spending funds in connection with any federal, state, or local election in the United States, either directly or indirectly.  It is also unlawful to help foreign nationals violate that ban or to solicit, receive or accept contributions or donations from them.  Persons who knowingly and willfully engage in these activities may be subject to fines and/or imprisonment.

The rules could hardly be clearer on this particular subject than is explicitly stated above. The US law does NOT allow any candidate (or his/her agent/proxy) to directly or otherwise solicit campaign contributions from anyone who is not legally permitted under this regulation. Many a political careers have been ruined for a less serious offense as this, and it is rather inconceivable that a presidential candidate’s campaign will not be on top of this, as illustrated in the news reported cited above.

The objective I have set out to accomplish here is to clearly point out that a pro-Obama campaign in Nigeria CANNOT:

Solicit funds on behalf of the Obama Campaign.

Spend such funds on behalf of the campaign in any way that directly influences the election.

Legally give the funds so collected directly to the campaign.

It should be noted that while a non-citizen is legally permitted to actively support (and even canvass for) a US candidate for electoral office, and while such non-citizens can make material contributions and otherwise participate in electoral activities not related to a specific political office/position, it is quite illegal for such non-citizens to even ASSIST in soliciting campaign contribution or other material contribution on behalf of any candidate (or the candidate’s PAC):

Under Commission regulations  it is unlawful to knowingly provide substantial assistance to foreign nationals making contributions or donations in connection with any U.S. election.  11 CFR 110.20(h).  "Substantial assistance" refers to active involvement in the solicitation, making, receipt or acceptance of a foreign national contribution or donation with the intent of facilitating the successful completion of the transaction.  This prohibition includes, but is not limited to individuals who act as conduits or intermediaries.  67 FR 69945-6 (November 19, 2002) [PDF].

It is also illegal to receive or accept such contributions:

As noted earlier, the Act prohibits knowingly soliciting, accepting or receiving contributions or donations from foreign nationals.  In this context, "knowingly" means that a person:

Has actual knowledge that the funds solicited, accepted, or received are from a foreign national;

Is aware of facts that would lead a reasonable person to believe that the funds solicited, accepted, or received are likely to be from a foreign national;

Is aware of facts that would lead a reasonable person to inquire whether the source of the funds solicited, accepted or received is a foreign national.

I do not want to cast aspersions at the organizers of the pro-Obama confab in Nigeria. On the contrary, I salute their efforts and wish them a lot of success in furthering political awareness within the country. Who knows, through their championing of the Obama cause, our political “leaders” may learn one or two things about how politics is supposed to be conducted in a modern society.

No foreigner (Nigerian or Martian), who is not also a US citizen is legally permitted to contribute to the Obama campaign. No such person is legally permitted to solicit contributions on behalf of the Obama campaign, and the Obama campaign is expressly prohibited from ACCEPTING such contribution even if collected. The Campaign cannot even acknowledge such effort.

It is, of course, perfectly legal for the organizers of the pro-Obama efforts in Nigeria to solicit and accept contributions to furthers their causes, but it is incumbent upon the organizers to be transparent in this effort, and to avoid anything that may be interpreted as under-handed machinations to fool people into thinking that their contributions will be shipped off to the Obama campaign in a DHL bag.

Please support Obama, but please do so with the utmost integrity, lest we continue to perpetuate the ignominious perception of Nigerians as a bunch of ne’er do well, two-bit criminals.

The ultimatum handed Julius Berger, Nigeria's construction giant, by the Movement for the Emancipation of the Niger Delta (MEND) may be deeper than what was originally revealed, according to Saharareporters’ findings from MEND operatives.

MEND's ultimatum to Julius Berger will be the second major misfortune to hit the construction behemoth, whose Nigerian business remains its largest source of revenue, but German investigators are saying it is also the greatest source of corruption, according to information gleaned from state prosecutors handling Bilfinger Berger investigations. Bilfinger Berger is Julius Berger’s parent company.

Earlier this year, a major German news magazine, Der Spiegel, revealed that Bilfinger Berger was under investigations by the Wiesbaden public prosecution office. The paper, quoting German state police sources, said the investigation pertained to suspicion of bribery for a construction project in Nigeria in the 1990's that had been a subject of serious investigations by French and US authorities.

In an exclusive interview with MEND's operative in charge of information, Jomo Gbomo, Saharareporters obtained details of the reason why MEND singled out Julius Berger for attack in its first–ever advisory targeting multi-national corporations outside of the Niger Delta region.

Gbomo told Saharareporters that after Julius Berger pulled out of the Niger Delta region due to the harassment it received by way of kidnapping, and a recent harassment by an angry mob in Abuja following a major auto accident that killed 11 commuters, MEND decided to go after Julius Berger in Abuja because the federal capital had become the hub for its corrupt activities.  Gbomo told SaharaReporters, "We reasoned that since the company did not have any qualms abandoning the projects in the Niger Delta, its main milking cow, they should respond the same way in Abuja."

Elaborating on MEND’s allegations that Julius Berger had tried to bribe the militants with $20 million, Jomo Gbomo explained that the secretary to the Federal government, Baba Gana Kingibe used some state governors in the Niger Delta to undertake telephone negotiations with top commanders of MEND to accept the bribe and withdraw the threat to expel Julius Berger from Abuja.

Kingibe, the Seceretary to the Federal Government, has denied this claim, but MEND has shut down that denial. "We are not at all surprised by his (SGF’s) denial. What do you expect from a man with a presidential ambition? It must have been a surprise to the criminals in government that we spilled the beans. The GMD of NNPC has confirmed that the government offers bribes to militants so Nigerians will not be deceived by his denial.”

Elaborating further on the bribe attempt, MEND said, "An offer of $10m was first made on Friday, August 8, 2008, then increased to $20m the next day."

Asked to identify the governor involved, Gbomo said, “Let us keep the governor out since his role was to plead for the statement to be written to favor the government."

Jomo further explained that if Julius Berger refuses to heed its ultimatum, MEND may not immediately respond with violence saying, "If Julius Berger does not quit, those expecting an attack immediately will be disappointed. At the time of our choosing, they will pay the price for disobedience."

He added that its ultimatum and threats against Julius Berger is only applicable to expatriates working with the company, as the Nigerian government and the company do not value its local workers.

And asked if MEND's threats against a company operating outside of the Niger Delta area meant that it was expanding its scope of attacks, the MEND spokesperson responded, "We want to expand the theater of conflict. Abuja is significant because it is a city built by Julius Berger with Niger Delta crude oil as payments by a desperate Ibrahim Babangida. Abuja cannot continue to grow with the wealth from the region, while politicians are preparing for a summit or whatever they want to call all it to the detriment of the region."

MEND also addressed the broader question of Julius Berger’s involvement in official corruption in Nigeria. "We all know how this company has supported military despots and corrupt politicians,” its spokesman said.  “We know how they bribe them with houses and are very much involved in inflating contracts as kickbacks.”

He lamented how the company “has gotten away with murder” in Nigeria through poor safety standards in its construction sites. “When you visit Germany, road construction sites have adequate reflective signs to warn on-coming vehicles but this is not so in Nigeria where vehicles crash head-on to concrete roadblocks at night without any consequences to the company who have the backing of our corrupt officials."

The MEND spokesperson also touched on the nature of Julius Berger’s pre-eminence in Nigeria, by saying, "How many people even in Germany have heard of them?” he asked. “Are very good roads and bridges not built in South Africa and the USA by companies other than Julius Berger? The company is preferred here (only) because they support corruption."

When reminded of the warning by Nigeria police that MEND operatives would meet their death in Abuja if they make any attempt to attack Julius Berger expatriates, Gbomo responded, "That is the beauty of fighting guerrilla warfare that can deploy car bombs. The so-called federal might is what we are waiting for so that Nigeria stops postponing the doomsday to the conflict that is long overdue."

On the nature of an imminent attack, he said, "We do not plan to attack them the way they see it. It is impossible to protect every German worker in Nigeria and we plan to use unconventional tactics. By even having heavy security around them, that is a victory for us because that will be changing the face of Abuja to begin looking like the Niger Delta."

He noted that if a JB worker were to be captured in Lagos or have his vehicle blown up, it would have an impact on Abuja.  “We are confident the Germans have enough common sense to comply, as I doubt they have any faith in the police or military", he said. 

Saharareporters has found that Kingibe has a relationship with Julius Berger dating several years back. The SGF, like many other Nigerian public officials, has benefited from Julius Berger kickbacks. Our findings show that the construction company built a multi-million dollar house for Kingibe in Abuja.

Located off Gana Street in the highly priced Maitama area of Abuja, the house was acquired by the South African Embassy on a lucrative rent deal.

It would be recalled that last year, we reported that Julius Berger had shipped out most of its computers to another African country where it maintains technical presence.  The computers, which contained sensitive information that could potentially put Julius Berger officials in jail, were then systematically destroyed by techies flown in from Germany.
