deebaby05: Good day wonderful people in the house! Congrats to those that have scaled the ILR and naturalisation hurdle and goodluck to those of us coming behind. Please i need an urgent clarification, i and my kids will be 60 months in Dec 2022 but expiry on our BRP is May 2023. When can we apply for the ILR? 28 days b4 Dec 2022 or 28days b4 expiry on BRP. Really confused.
Thanks Hi deebaby05, Congrats in advance, you are nearly there. You are eligible to apply for ILR Set M 28 days before the 5th year anniversary of your ARRIVAL in the UK. I suggest you aim to apply between 26 - 20 days before your 5years anniversary. All the best. PS: I encourage you to read this thread from the beginning as the question you asked has been previously answered on page 2 *by @abubarakat. |

Please how did you evidence your results for the Life in UK test as I was not given a certificate? Once you have passed the Life In The UK test, you will be provided with a reference number. That is the only evidence you will need for both your ILR and citizenship applications. 1 Like |

The journey that started more 5 years ago has now come to an end with passport application now in sight.
Good luck to everyone still in the process. Hi @abubarakat, please can I ask how long it took for your naturalisation application to be approved from the date of biometrics? Your wait time appears pretty short, as I read that it usually takes about 6 months. Are you aware if there is a priority service for this? |

Alohetij: Hello,
I have now received my ILR. Thanks to everyone for providing helpful information.
I used the priority service (it comes up only at midnight).
Biometrics was done on March 2nd, got an approval email about 2 hours later. I received my card today (March 7th). Do you mean the Super Priority Service - SPV (1 day)? Because I can't seem to find Priority Service (5 days) on their website despite night camping and waiting for over 2 nights now. |

newbie715:
Yes, my timeline really stretched out. Other applicants on other settlement routes even without priority were getting responses in 6 weeks, the long wait was annoying but I didn't sweat it, I changed jobs in the middle of the application, my new employers just sent the request form to check my immigration status and they got a response fairly quickly which was good.
I have never used a lawyer in any of the many applications I have made.
I paid £2389 + 19.20 biometric fees
I have included my document list:
Below are the documents I used ILR (SET M):
Identification documents: My passport data page Spouse Passport data page NARIC certificate for English Language Degree Certificate Marriage certificate Children birth certificate
Proof of Co-habitation: Gas and Electricity bills Letter addressed to me from HMRC Bank Statement NHS appointment Letters Bank Letters
Proof of Income: I always use only my spouse's income His 6 months bank statements (last one within 28 days) His 6 months pay slips stamped and signed by HR(last one within 28 days) Letter from his employer (within 28 days) confirming date of employment, full time/part time, salary and authenticity of pay slips
Accommodation: Mortgage Statement Council tax bill
Life in the UK Test
Note that there will be no IHS fee requirement. Very helpful, thank you for sharing. I will use this as a guide early next year for my application. 1 Like |

newbie715: Just a few things I didn't know before I started researching for my application that may be useful to other people.
180 days absence rule does not seem to apply to ILR SET (M). Check this link out
https://www.freemovement.org.uk/the-180-day-absence-rule-doesnt-apply-to-people-with-a-spouse-or-partner-visa/
I didn't try this as I didn't exceed the allowed absence but the information might be useful to someone.
At the time I applied, SET (M) was taking ages to process, a lot longer than other routes. I am not sure if that is normal or if it's due to the pandemic and backlog. Although, one can always pay for priority and have a much quicker turnaround. I didn't as I wasn't in a hurry so didn't see the need or justification to spend the additional fee.
As with FLR (M) you can get your employer to perform right to work checks after you put your application in or if you are switching jobs.
Remember that the date of application is your online submission date so all documents should ideally be dated prior to this date not the biometrics enrolment date. Don't forget the 28 day rule for your documents.
All the best. Thanks for setting the ILR page up. |

profemebee: Hi hi,
Please does the nos of days you're out of the UK before you renew the spousal visa count when you eventually want to apply for ILR and then British citizenship?
With all my travels, i have been out of the UK for like 60days.. will that become a problem eventually when i want to renew spousal visa next year Or during ILR in 3years ish time?
I'm asking so i know when to cap my trip.. My advice is that you factor in the number of days you've been out of the Country into your calculation for 5 years. In essence 365 days x 5 years = 1825 days. So if your 5 years was meant to be due by 1st Jan 2022, but you've been away for 60 days, add an extra 60 days to your wait time. It then becomes c.7th March 2022. That way you are sure that you have a total cumulative time of 5 years in the Country prior to your application. There's also a limit to the length of time you can be away from the country within your 2.5/5 years wait, I advise you to investigate so it doesn't jeopardize your application. All the best! |

foxyvisa: Good day house. Its being quiet in house for weeks. Please I need clarity on my 5 years indefinite leave to remain (ilr) calculation. I am on the 5 years route. My BRP first issue was 11th December 2017 (11/12/2017). Arrived UK 30/12/2017. I have been given extension and it expires 21/7/2023. With this calculation, (date of first issue to expiry) its 5 years 7 months. In order to qualify for 5years ilr application, should I wait till my BRP expires 21/7/2023 (which will be 5 years 7 months)? Or can I calculate exactly 5 years from date of issue 11/12/2017, which will be 11/12/2022 and apply? To summarise my date of first issue to expiry is 5years 7months but I want to apply exactly 5years from first issue (due to school admissions timing). Please I need the house opinions, must I wait till brp expires (28 day rule considered) or simply calculate 5 years from first brp issue. Thanks. Hi foxyvisa, My understanding is that you need to show evidence that you have been living in the UK for 5 years to apply for ILR, if you are on the 5 years route. In essence, if you arrived in the UK on 30/12/2017, then you should be eligible to apply for ILR from 30/12/2022. For me, I arrived here in February 2017 and I intend to apply for my ILR by February 2022, despite my BRP expiring in May. There are quite a number of benefits going on the ILR as compared to being on a temporary visa, so no need to delay. The earlier the better, especially as laws change all the time. All the best! |
