This has gotten out of hand.

I watched a (American) programme where they talked about an accident that happened on a bridge, after two weeks another accident happened on that same spot and the bridge was closed down for reassessment.

But this is Nigeria where peace mass transit has been killing Nigerians like chickens and the government is busy doing nothing.

Abeg na country be this?

I think the way out for him is to go find a senior custom officer that would plead on his behalf so he can pay the correct duties.

Copying NASS, press when you are in the wrong side of the law won't help him.

He's on the wrong side of the law but this law has a fine attached which he has not been given a chance to even pay which I think is the height of corruption. But if you know any senior custom official that is still in service I won't mi d if you send the contact. Thanks much

I remember Themadame's thread at the auto section questioning the authenticity of the documents given to car buyers by the Cotonou dealers now that land importation of cars have been banned.

The crooked dealers and buyers alike want chop her head. Well, the laws are clear and I have no empathy for buyers who despite all warnings think they are too smart and fall for the sweet mouth of Cotonou car dealers. Now gbege don happen, where's the dealer?

But that's not the main issue you see, the problem is he has accepted that the papers are fake and hence agreed to pay the required duty but they are not naming a price in fact they seem to have another motive which he does not know. If I am asked to assume I'll say maybe they want to sell off the car to someone they know.

My friend paid 105k to bribe on 2010 camry. It was brought tru cotonou and duty was paid though it was too small based on why they told him. The car has been registered since 2015

And am sure he was probably not issued any receipt for the payment. The most annoying part of my guys issue is that since the car was seized they are not even asking him for money, it's like they don't want to release the car to him and they are not giving him any valid reasons.

Lalasticlala, Mynd44 please help push this to front page so the authorities may do something about this. It can happen to anybody.

I'm sure there are lots of Indian drug dealers as well as Indian drug users who fuel the trade so why would they focus so much on Nigerians?

You are right about them also having Indian drug dealers no doubt but the reason they chose Nigerians especially says a lot.

Someone else mentioned me. On this thread and gave me a first hand experience of the level of crime committed by Nigerians there. He in that virtually everyday in the papers there is news about Nigerians caught either with drugs or involved in scam. So I think the attacks are more attached to the crimes being carried out there by Nigerians.

Let me give you two examples:
My 1st few days in India i had to be reporting to d security men @ d school gate because my ID wasnt ready yet, den one of those days d head of security asked me "they hang people in Nigeria?" i said "no", then he added "in India, we hang people". I got the message immediately!
Secondly: wen i was chatting with my lecturer b4 going to india, he had to speak with me and asked specifically: "do you do drugs and all other bad stuff? Because i know of my colleagues that regret having Nigeria due to drugs issues and i dont want to be a victim". I laughed so hard on d call but assured him.

Until i got here b4 i understood d extent of damage our peeps have done. Had some more experiences but i'm lucky in d city i am. There is no day i read the paper here without a report of nigerian caught with drugs and/or nabbed doing fraud (mostly online and telephone scam), and dis is a small city oo, now imagine what it'll be like in big cities like Delhi, Mumbai, kolkota, Chennai, Bangalore etc.
Dont be suprised that most of those people u see protesting are part of d problem, although we have to admit that there are also good ones and these suffer d wrath of d mob/citizens more. The bad ones know how to move v.well and only get caught by the police!

That's a sad situation. But sincerely since you are there do you think India is richer than Nigeria?

This is sad. How did we get to this point where negatives is what they mostly say about Nigerians outside the country. Only If our leaders didn't steal so much there would have been jobs and other provisions available here.

Same old political strategy when you have less to offer.

Make things terrible bad then the people complain then bring it back to how it was then they hail you. All this have strategies have been written down in books and we'll get wiser as a people if we read more and learn from history.

Tenants have right, so do House owners.
If you are not a bonafide tenant, you cant enjoy the "rights" of a tenant, under the law.

So, the crux of the matter is for you to establish that he is NOT a Tenant in that premises but rather he is Trespassing on your property.

*get the original tenancy agreement of the tenant he is squatting with, from the Lawyer (I dont trust that your Lawyer one bit!).
*get the real tenant to "communicate with you" in writing that the has vacated the residence. You can send him a chat message asking if he is still interested in the house but you must phrase it in a way that will make him to say NO.
For example, tell him their are some charges that he needs to pay (Security charge, Maintenance charges, e.t.c that amounts to #100K), and you want to know if he should be billed, on the assumption that he is still holding unto the place!

I am sure he will quickly tell you that he is no longer responsible for the place!

Armed with that "exchange of communication", you can just reply him that since he has vacated the place, you will no longer demand such money from him nor establish further communication with him and just wish him well in his new abode.

Now, go back to the "Squatter" and let him know that he is TRESPASSING on your property.
Dont even say he is squatting at all.

Give him two days to disappear (ofc, he wont).
Report a case of "Trespassing on private property" to the Police and charge him to court.
In the meantime, you have the right to recover your property as the law does not protect anyone committing an offence.
Double Lock the place and let him go and bring Police (The same Police that you have reported him to, for Trespassing!)

As for the Mediation Center, simply tell them you dont know him and that you have reported him to the Police for trespassing on your property.
Since he is the one that would be claiming he is your Tenant, the onus is on him to provide evidence of a tenancy contract between YOu and HIM.

Now, (if you want to be nice...l am not) he can be advised to leave the place, with a "written undertaking" in place, in a week or two weeks time (Its not your business if he sleeps under the bridge, he is obviously a trouble maker and such people dont deserve any pity).
Dont agree to more than two weeks, be firm on this because after that length of time, you are going to "dash him" some "Squatter Rights" which you dont want to.

On the contrary, he might prove stubborn:
Charge his Trespass case to court .. while he will charge you to court for violating his "tenancy rights", as a Landlord!
Your Lawyer will insist, at the Mediation Centre, that there is an ongoing "Criminal case" on the matter and as such, it super-ceeds a "Civil case" of Tenancy.
A Criminal case must finish before the civil part/matter can be heard!

So, he gets docked for trespassing..... and You win that case because you did not rent the place to him nor did you have any rent Contract with him.

His defence will be that "he sublet the place" from the previous Tenant.
You will debunk that by saying the previous tenant has vacated the place and you dont know who he is andneither are you a party to subletting, which is unlawful and illegal.
(That "written communication" you established with the bonafide tenant, is your proof)

Apart from the fact that subletting is illegal, you actually dont know him. Finito.
He could be fined or jailed for Trespassing. I dont give a f*ck!

The Civil case will die a natural death, using the same arguments above (ofc, he wont even show face again.)

You see why l said l dont trust that your Lawyer?
he should have laid all these down on the table for you.

Now, can l have my "pay" for this brief, please? l wrote it at 3am!
