Having bad and toxic loans is NOT a bad thing as banks make provisions for it in their books, what is alarming in Nigerias case is the huge level of non performing loans. He was given such by the judge because he was prosecuted under that law despite having a new law that has a more severe punishment. If that law had been repealed or amended, there won't be opportunity/loophole for the prosecutor to charge him under such archaic law. What makes you think a person of interest might not be subjected to processes of such archaic law in academic institutional environment? The new law will repeal the old law and enact the new one to replace the old one that usually the practice. The case you reference can only happen if the court case was instituted before the commencement of the new law. |
