The Joint Admission and Matriculation Board (JAMB) and relevant stakeholders have agreed on the minimum cut-off point for admission into tertiary institutions in Nigeria.

It was unanimously agreed at the 2022 Policy meeting that 140 will be the minimum cut-off point for admission into a university. 100 was voted for Polytechnics and Monotechnics, while 80 was voted for Colleges of Education.

The cut-off point was the collective decision of all heads of tertiary institutions, private and public, taken at the 2022 Policy meeting chaired by the Minister of Education, Mallam Adamu Adamu, in Abuja.

JAMB Registrar Prof Ishaq Oloyede explained that the aforementioned points are the minimum, but that does not mean that institutions must comply wholely to it.

“Institutions have the liberty to determine their cut-off point but must not be below the cut-off agreed at the policy meeting,” he explained.

Vice Chancellor, Nnamdi Azikiwe University, Prof Charles Esimone, was among the people that adopted the motion at the meeting.

ENUGU ADVERTISEMENT EXECUTIVE HAS NOT COMMITTED ANY OFFENCE KNOWN TO LAW, EFCC SHOULD RELEASE HIM IMMEDIATELY

My attention has been drawn to a statement by the EFCC on their verified social media accounts where it is reported that the Commission arrested a certain outdoor advertisement Executive in Enugu State for hosting two billboards with the inscription “2023: ENUGU PDP LEARN FROM 2007 ELECTION. EFCC IS COMING WITH KOBOKO ON CORRUPT CANDIDATES.”

In the statement, the Commission claims that the advertisement executive was arrested because of the two billboards bore the name and logo of the Commission. The Commission also claims that the billboards “bore offensive messages”, and that it was used to “threaten the aspiration of some politicians in the state in the build up to the 2023 general elections.”

The reasons given by the EFCC for their action in this case are baseless, false and legally unfounded. The use of the logo or name of the EFCC is in itself not a criminal offence. There is no Section of the Economic and Financial Crimes Commission (Establishment) Act, 2004 that makes the mere use of the name or logo of the EFCC, without more, a criminal offence.

Section 6 (q) of the EFCC Act provides for the functions of the Commission which includes: “carrying out and sustaining rigorous public and enlightenment campaign against economic and financial crimes within and outside Nigeria.”

By Section 24 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), citizens have a constitutional duty to assist law enforcement agencies in the discharge of their functions.

Thus, the Commission should encourage, and not penalize or persecute citizens, who engage in rigorous public enlightenment campaign against economic and financial crimes. There is no doubt that the message in the billboards are geared towards discouraging economic and financial crimes. In essence, the Concerned Enugu Citizens in Scotland who sponsored the adverts are only discharging their constitutional duty. The message in the billboards is patriotic and timely.

What offence has the advertisement executive committed to warrant his arrest by the EFCC?

Those are saying that the advert amounts to impersonation of the EFCC are wrong. Those who hold this erroneous view should be properly guided on the elements of the offence of impersonation. For the offence of impersonation to be constituted in law, there has to be a criminal intent (mens rea).

Section 484 of the Criminal Code Act specifically defines impersonation in general as follows: “Any person who, with intent to defraud any person, falsely represent himself to be some other person, living or dead, is guilty of a felony and is liable to imprisonment for three years.”

In the billboards, it is clearly written that the advert is sponsored (powered) by “Concerned Enugu Citizens in Scotland.” It is therefore illegal, mischievous and ridiculous for the EFCC to arrest the advertisement executive despite the apparent fact that the advert is not credited to the EFCC or any officer of the Commission. There was no intent whatsoever to defraud any person. There is nothing in the billboards that warrants the obnoxious arrest of the advert executive or anyone for that matter.

The abbreviation “EFCC” is not a registered trademark of the Economic and Financial Crimes Commission (EFCC). Even if it were a registered trademark, the unauthorized use of same should be seen as a trademark infringement which is a civil wrong and not a criminal offence. Any citizen can legally use the abbreviation or acronym “EFCC” for legal and legitimate purpose.

Similarly, the use of the EFCC’s logo is not a criminal offence, except where it is used with a criminal intent.

Let the Commission refer Nigerians to any Section of the EFCC (Establishment) Act, 2004 that criminalizes the use of the logo or name of the Commission for public enlightenment purpose by citizens. If such prohibition existed, movie producers for example who constantly use the name and logo of the EFCC for enlightenment or for artistic and entertainment purposes would be liable to prosecution.

In law, it takes more than a physical act (actus reus) for a crime to be committed. There must be mens rea (criminal mind or criminal intent). These two elements must coexist. This is in accordance with Section 36 (12) of the 1999 Constitution which states that no person shall be punished except the offence and the punishment for same are expressly defined in a written law.

“Offensive EFCC Campaign Adverts” as alluded to by the EFCC is not an offence known to law in Nigeria.

The message in the advert is positive; it promotes the “war” against corruption that the EFCC is supposed to be waging. It is rather ironic that the same EFCC that claims to be investigating politicians regarding the source of the humongous sums they are using to buy nomination forms is now antagonizing patriotic citizens who are warning corrupt politicians to be mindful of the same EFCC.

The claim by the Commission that the billboards were used to threaten the aspirations of “some politicians in the state” is false and misleading. The message in the billboards was specifically targeted at corrupt candidates and politicians. There is no where in the billboards where the name of any particular candidate or politician was mentioned.

It is therefore astonishing, that a Commission that is statutorily mandated to fight corruption, is now holding brief for corrupt politicians in Enugu State. No matter how we look at it, this action by the EFCC is a setback on the war against corruption and should be roundly condemned.

I call on the Commission to immediately release the advertisement executive, publicly apologize to him, and pay him adequate compensation for the malicious damage to his billboards. The Commission should arrest the corrupt politicians in Enugu State and the rest of the country who are using stolen public funds to promote their insatiable political campaigns and ambitions.

This is a needless persecution and distraction. If the Barwa-led EFCC is in now officially supporting corrupt candidates and politicians, the Commission should say so without equivocation. The advert is commendable, and the Concerned Enugu Citizens who sponsored it should be commended by the EFCC and the public.

The Federal High Court sitting in Abuja, on Wednesday, declined to grant bail to the detained leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, pending the determination of the treasonable felony charge the Federal Government preferred against him.

Trial Justice Binta Nyako held that Kanu must explain the reason why he breached the previous bail that was given to him, before he could enjoy another favourable discretion from the court.

“Until the issue of absence of the defendant for his trial, with all the bail conditions breached, is determined, the instant application of the defendant for bail will at best be premature and it is refused.

“However, the defendant is at liberty to refile the application”, Justice Nyako held.

The court noted that Kanu’s trial had since 2015, suffered various setbacks owing to over 19 interlocutory applications that have been filed in the matter.

It, therefore, implored the parties to allow the case to proceed on trial to enable the charge to be determined, one way or the other.

Kanu had in the application he filed pursuant to sections 6(6) and 36(5) and (6) of the 1999 Constitution, as amended, as well as sections 161, 162, 163 and 165 of the Administration of Criminal Justice Act, ACJA, 2015, prayed the court to release him on bail, pending by determination of the charge against him.

He equally prayed the court to order the Department of State Services, DSS, to produce the medical report of the defendant who is currently in its custody.

Kanu, told the court that he was severely tortured for eight days in Kenya, before he was repatriated back to Nigeria for continuation of his trial.

He alleged that his health condition deteriorated, following “a highly poisonous substance” he said was injected into his system, which he said is causing him to have constipation and increased heart beat.

Insisting that the DSS lacks the necessary medical facility to cater for his health needs, Kanu, told the court that he was confined to solitary confinement where he alleged that he was daily exposed to mental torture.

The IPOB leader told the court that he has “credible and reliable sureties”, pledging that he would not commit any offence while on bail.

Besides, Kanu, argued that he has not been tried or convicted by any court of law in the country, contending that he was entitled to bail.

He further drew attention of the court to the fact that he was previously released on bail on health ground.

However, FG, urged the court to refuse the bail application, insisting that Kanu, having realized the gravity of the case against him, would run away from the country and not make himself available for trial.

The Christian Association of Nigeria, has called for a nationwide protest over the gruesome killing of Deborah Samuel, a 200 level student of Shehu Shagari College of Education, Sokoto.

The CAN President, Rev. Olasupo Ayokunle, in a letter addressed to all bloc leaders, urged Christians to hold peaceful protests within their church premises on Sunday May 22, 2022.

He made the call against the backdrop of the Thursday killing and setting ablaze of the female student by an angry mob that accused her of blasphemy.

The letter dated May 14, 2022 and signed by CAN’s General Secretary, Joseph Daramola, reads: “I have been directed by the CAN President, His Eminence, Rev. Dr. Samson Olasupo A. Ayokunle, to request all Church Leaders, through your various Churches to organize a PEACEFUL PROTEST in honour of one of our daughters, DEBORAH YAKUBU who was gruesomely murdered on Thursday, 12 May, 2022 at the Shehu Shagari College of Education, Sokoto in Sokoto State by some Islamic extremists.

The protest will take place on 22 May, 2022 in the afternoon by 3:00 Pm in every Secretariat of the Christian Association of Nigeria (CAN) nationwide and not on the streets in order to avoid further loss of lives. Those without CAN’s Secretariat may use any church with big premises.

“We are to hold placards with some succinct message like “WE DEMAND JUSTICE 4 DEBORAH,” “NO MORE KILLING IN GOD’S NAME”, “ENOUGH IS ENOUGH,” “POLICE, STOP UNPROVOKED KILLINGS IN NIGERIA,” “CHRISTIANS ARE NOT SECOND CLASS CITIZENS,” “KILLERS OF DEBORAH MUST BE PROSECUTED,” “WE CONDEMN RELIGIOUS KILLINGS,” “WE SAY NO TO ISLAMIC EXTREMISTS.”

“We urge those who could afford it to make use of the traditional media and the social media and others can use only the social media to give it a wide coverage in other to sensitize the whole world. We also call on Nigerian Christians in diaspora to join us using our embassies all over the world.

“The occasion can also be used to pray for Deborah’s family and friends, peace for the country, victory for the Church and godly political leaders in the coming general election.”

The Joint Admissions and Matriculation Board (JAMB) has announced the release of the 2022 Unified Tertiary Matriculation Examination( UTME) results.

Head, Public Affairs and Protocol, JAMB, Fabian Benjamin, said this in a statement on Saturday.

The board directed candidates to send UTMERESULT to 55019 using the same phone number that was used for registration.

The statement reads: “To check the 2022 Unified Tertiary Matriculation Examination (UTME) result, all a candidate needs to do is to simply send UTMERESULT to 55019 using the same phone number that he/she had used for registration and the result would be returned as a text message. This is the only process of checking the 2022 UTME results for now as the Board has not uploaded it on its website for obvious reasons.

Godwin Emefiele, Governor of the Central Bank of Nigeria (CBN), has filed a suit before a Federal High Court in Abuja over the alleged plan to disqualify him from the 2023 presidential primaries slated for the end of this month.

The Independent National Electoral Commission (INEC) has given political parties a deadline of June 3 to submit their candidates for the 2023 elections.

On Friday, Daily Trust had reported how some groups purchased the expression of interest and nomination forms of the ruling All Progressives Congress ((APC) for Emefiele.

This had triggered outrage as many called on the CBN governor to step down.

Governor Rotimi Akeredolu of Ondo State, who described Emefiele’s interest in the 2023 Presidency as “a joke taken too far”, had asked President Muhammadu Buhari to fire him if he refused to step down.

Some lawyers had argued that Emefiele was unfit to run going by Section 84 (12) of the Electoral Act.

The section states that no political appointee at any level shall be a voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election.

But in documents seen by Daily Trust, Emefiele, through his lawyer, Mike Ozekhome, argued that he is not a political appointee and by provision of the constitution, he is expected to resign a month before the February 25, 2023, presidential election.

“It is our respectful submission that the plaintiff is not a political appointee as envisaged by the Electoral Act and as he seeks to contest for the Office of the President in the new electoral calendar, he shall only be governed or guided by the Constitution of the Federal Republic of Nigeria, (1999), as amended, which requires that he gives at least thirty (30) days’ notice of resignation, withdrawal or retirement from the office of the Governor of the Central Bank of Nigeria before any elections,” the document read.

He also contended that a Federal High Court in Umuahia, Abia State, had nullified section 12 (cool of the Electoral Act.

INEC and the Office of the Attorney-General of the Federation (AGF) were joined in the suit.

On Saturday, Emefiele declined the presidential forms bought for him, saying he would use his resources to purchase them if he is interested in the race.

Speaking further on the 2023 Presidency, Emefiele said God would decide for him “in the next few days”.

The Lagos State government has shut down Chrisland Schools indefinitely amid allegation of rape.

A 10-year-old pupil of the school was said to have been raped by her schoolmates during a trip to Dubai.

The incident sparked outrage on social media, with many calling on government to act.

In a statement on Monday, the state Ministry of Education said investigation into the matter was ongoing.

The state government disclosed that the allegations of sexual violence involving students of Chrisland School are being investigated by the relevant Ministries, Departments and Agencies (MDAs), including the Ministry of Education; Office of Education Quality Assurance; Ministry of Youth and Social Development; Ministry of Justice, and the Lagos State Domestic & Sexual Violence Agency.

The statement jointly signed by the MDAs, revealed that the criminal allegations had been escalated to the Commissioner of Police.

“In view of the allegations, we are committed to ensuring that adequate medical and pscyho-social support is provided. This is to reassure members of the public of the State Government’s commitment to safety and child protection, especially in ensuring that all child-centered institutions within the state, formulate and implement policies and systems that are compliant with the Executive Order (No.EO/AA08 of 2016), Lagos State Safeguarding and Child Protection Program.”

The State Government therefore reminded the general public that anyone who engages in any visual depiction of sexually explicit conduct involving of a child commits an offence and is liable to custodial sentence of 14years. “This includes producing, distributing, receiving, or possessing an image of child pornography.”

Daily Trust had earlier contacted the school for its reaction to the incident.

A representative of the school had said who spoke over the phone had said, “Yes, this is Chrisland School. I am not permitted to speak on the issue. We will soon release an official statement. Thank you.”
