The Economic and Financial Crimes Commission on Tuesday, arraigned Nenadi Esther Usman, a former Minister of Finance and Director of Finance PDP Presidential Campaign Organization in the last general election; Femi Fani-Kayode also a former Minister and Director Media/Publicity of the PDP Presidential Campaign Organization; Danjuma Yusuf and Jointrust Dimensions Nigeria Limited before Justice M. S. Hassan of the Federal High Court Lagos, on a 17-count charge bordering on conspiracy, stealing, corruption and making cash payments exceeding the amount authorized by law.
The accused were alleged to have stolen and illegally disbursed about N4.9 billion Naira belonging to the Federal Government of Nigeria for political and personal uses.

The defendants pleaded not guilty to all the charges preferred against them.

Part of the charge reads: “That you, NENADI ESTHER USMAN, FEMI FANI-KAYODE, DANJUMA YUSUF and JOINTRUST DIMENTIONS NIGERIA LTD on or about the 8th day of January, 2015, within the jurisdiction of this Honourable Court conspired amongst yourselves to indirectly retain the sum of N1,500, 000,000.00 (One Billion, Five Hundred Million Naira) which sum you reasonably ought to have known form part of the proceeds of an unlawful act to wit: stealing, and you thereby committed an offence contrary to Section 18(a) of the Money Laundering (Prohibition) (Amendment) Act, 2012 and punishable under Section 15(3) & 4 of the same Act.

‘That you, NENADI ESTHER USMAN, DANJUMAN YUSUF AND JOINTRUST DIMENTIONS NIGERIA LTD on or about the 9th day of January, 2015, within the jurisdiction of this Honourable Court indirectly retained the sum of N300,000,000.00 (Three Hundred Million Naira ) which sum you reasonably ought to have known form part of the proceeds of an unlawful act to wit: corruption, and you thereby committed an offence contrary to Section 15(2)(d) of the Money Laundering (Prohibition) (Amendment) Act, 2012 and punishable under Section 15(3) & 4 of the same Act”..

In view of their plea, prosecuting counsel, Rotimi Oyedepo asked that trial commence immediately and that the case be given accelerated hearing.

However, counsel to accused: Fred Orbih (SAN), Ifedayo Adedipe (SAN), and S. I. Ameh (SAN) for first. Second and third accused respectively, informed the court of their applications for bail. But Rotimi said he needed time to respond to the applications and urged the court to remand the defendants in prison custody pending the consideration of the bail applications.

Justice Hassan ruled that, “since the prosecution was only served bail application yesterday, and in the interest of justice, it will be fair if the prosecution is given the opportunity to respond”.

He, therefore, ordered that the defendants be remanded in prison custody and adjourned to Friday, July 1, 2016 for hearing of bail applications.

PoliticsCourt Summons EFCC For Freezing Fayose's Account by DONSMITH123(op): 2:28pm On Jun 28, 2016
Efforts made by Governor Ayodele Fayose to reverse the restriction order placed on his accounts frozen by the Economic and Financial Crimes Commission(EFCC) in Zenith Bank Plc was temporarily halted on Tuesday as the Federal High Court sitting in Ado Ekiti, deferred ruling on the mandatory order being sought to reverse the directive.
The EFCC had last week Tuesday allegedly frozen Fayose’s account numbers 1003126654 and 9013074033 in Zenith bank for alleged money laundering running into N1.2 billion being money allegedly taken from the $2.1 billion arms fund in the office of the former National Security Adviser, Col. Bello Dasuki.

Fayose through his lawyer , Mr Mike Ozekhome(SAN), had through an ex parte order deposed to on the 24th of June, 2016 by Bimpe Olatemiju sought a mandatory order unfreezing the accounts belonging and operated by him pending the determination of his interlocutory application.

Joined in the suit are the EFCC (1st defendant) and Zenith bank (2nd defendant). The order was supported by 18-paragraph affidavit , a lone Exhibit, which was a letter issued to Governor Fayose by Zenith bank confirming that the EFCC actually placed a restriction order on the accounts and a written address.

He also sought the leave of the court for the service of the originating summons on the defendants in their various addresses outside the jurisdiction of the court as contained on the order papers, supported by 17-paragraph affidavit.

Ozekhome said the order was brought pursuant to order 26 rule 8(1) of the Federal High Court Civil Procedure Rule 2009 and Section 44(1) of the 1999 constitution which gives the court the discretionary powers to adjudicate on such matter.

Citing the case of Abdulaziz Nyako Vs EFCC to buttress his position that the anti-graft agency has no power to freeze Fayose’s account without valid court order, Ozekhome added that the action was a flagrant negation of the Section 308 of the constitution, which conferred absolute immunity on the government against civil and criminal procedure.

CrimeMan Arraigned For Raping Three Daughters by DONSMITH123(op): 12:37pm On Jun 28, 2016
For allegedly raping his three daughters, a 48-year-old man, Micheal Ogbar, on Tuesday appeared before an Ikeja Chief Magistrates’ Court.

The Chief Magistrate, Mr Tajudeen Elias, refused to hear his plea and remanded him in kirikiri prisons.

Elias said the court had no jurisdiction over the case and therefore transferred the matter to Apapa Magistrates’ Court.

The accused, who lives at Oke-Ogba Street, Badagry, a suburb of Lagos, is facing two counts of defilement and rape.

The Prosecutor, Sgt. Rafael Donny, told the court that the offences were committed between January and May at the accused’s residence.

Donny said that the accused raped his two daughters and defiled the third daughter.

“The accused sexually abused his 24, 20 and 10 year-old daughters,” he said.

The offences contravened sections 137 and 259 of the Criminal Law of Lagos State, 2011.

“This is a cross I am prepared to carry. If yielding to the nefarious agenda of a few individuals who are bent in undermining our democracy and destabilising the Federal government to satisfy their selfish interests is the alternative to losing my personal freedom, let the doors of jails be thrown open and I shall be a happy guest,” Saraki added.

PoliticsI’m Ready To Go To Jail – Saraki by DONSMITH123(op): 4:56pm On Jun 27, 2016
Following his cases in several courts, the Senate President, Bukola Saraki has insisted that he would rather go to jail than yield to some nefarious agenda of a few individuals who are out to destroy democracy.
Saraki said this in a statement he issued shortly after he appeared at a Federal High Court in Abuja alongside three others for alleged forgery of senate rules.

The Senate President who is also facing criminal trial at the Code of Conduct Tribunal, CCT, for false assets declaration described his latest legal battle as proof of the “persecution and distraction” he is currently enmeshed in.

The statement reads, “Today we the leaders of the Nigerian Senate reiterate our innocence against the charges filed by the Attorney General of the Federal Government of Nigeria at the Federal Capital Territory (FCT) High Court on the allegations of forgery of the Senate Standing Rules document.

“In our view, the charges filed by the Attorney General represent a violation of the principle of the Separation of Powers between the Executive Branch and the Legislative Branch as enshrined in our Constitution. Furthermore, it is farcical to allege that a criminal act occurred during Senate procedural actions and the mere suggestion demonstrates a desperate overreach by the office of the Attorney General. These trumped up charges is only another phase in the relentless persecution of the leadership of the Senate

“This misguided action by the Attorney General begs the question, how does this promote the public interest and benefit the nation? At a time when the whole of government should be working together to meet Nigeria’s many challenges, we are once again distracted by the Executive Branch’s inability to move beyond a leadership election among Senate peers. It was not an election of Senate peers and Executive Branch participants.

“Over the past year the Senate has worked to foster good relations with the Executive Branch. It is in all of our collective interests to put aside divisions and get on with the nation’s business. We risk alienating and losing the support of the very people who have entrusted their national leaders to seek new and creative ways to promote a secure and prosperous Nigeria. As leaders and patriots, it is time to rise above partisanship and to move forward together.”

Saraki stated that a nefarious group within the government of President Buhari have seized the apparatus of Executive powers to pursue their selfish agenda.

“This latest onslaught on the Legislature represents a clear and present danger to the democracy Nigerians fought hard to win and preserve. The suit filed on behalf of the Federal government suggests that perhaps some forces in the Federal Republic have not fully embraced the fact that the Senate’s rules and procedures govern how the legislative body adjudicates and resolves its own disputes,” he said.

The Senate President maintained that he would continue to rise above all persecutions and distractions.

“Let it be abundantly clear, both as a citizen and as a foremost Legislator, I will continue to rise above all the persecution and distraction that have been visited on me. In the words of Martin Luther King Junior, “the ultimate measure of a man is not where he stands in moments of comfort and convenience, but where he stands at a time of challenge and controversy”.

“I will remain true and committed to the responsibilities that my citizenship and my office impose on me. Without doubt, the highest of those responsibilities is the steadfast refusal to surrender to the subversion of our democracy and the desecration of the Senate.

PoliticsSaraki, Ekweremadu’s Supporters Clash With Journalists Over Images by DONSMITH123(op): 12:13pm On Jun 27, 2016
A mild drama played out at the Federal Capital Territory, FCT, High Court sitting in Jabi on Monday as some loyalists of those standing trial attempted to prevent reporters from taking photographs of the accused persons.

The supporters used sheets of newspapers to block the front of the pressmen’s camera in an attempt to stop them from taking photographs of the accused.

This led to a heated argument between the reporters and the alleged loyalists.

The incident happened shortly after Justice Yusuf Halilu stood down the matter of alleged forgery of senate rule in 2015.

Saraki alongside his deputy and the former clerk had earlier pleaded not guilty to the two count charge.

PoliticsFG To Unveil Plan For Affordable Housing Monday by DONSMITH123(op): 4:19pm On Jun 24, 2016
The Federal Government will on Monday unveil its plans towards the provision of affordable houses for Nigerians in line with the electoral promises of the ruling All Progressives Congress.

The Minister of Power, Works and Housing, Mr. Babatunde Fashola, will make the plan public on behalf of the government at the Affordable Housing Summit 2016 being put together by the ministry in partnership with German Development Cooperation.

A member of the summit’s Technical Working Group, Mrs. Eucharia Alozie, disclosed this to journalists in Abuja.

Alozie who is the ministry’s Head of Public Private Partnership Unit was joined at the briefing by the Principal Consultant of Value Chain Project Consultants Limited, Dr. Joshua Egbagbe and the Leader of the Value Chain Unit of GIZ, Mr. Christoph Pannhausen.

“The minister will be unveiling the Federal Government housing plan to the public during the summit. We will also produce blueprint that will be implemented very soon,” she said.

She explained that the summit would serve as a platform where the public and private sectors would share ideas and proffer sustainable strategic framework for housing delivery in Nigeria.

She said the ministry would use the opportunity of the summit to identify the challenges facing the sector and proffer solutions.

According to her, the summit was different from an earlier one where a housing roadmap was launched.

Alozie assured Nigerians that the event would not be talk shop but more of action.

She said the summit would address the five pillars on which affordable housing stood.

The pillars, according to her, are land‎; incentive and concession; off-takers strategy; housing finance; skill development and technology.

Also speaking, Pannhausen said the summit would come up with a blueprint that would be implemented in the subsequent months and years.

He said the affordable housing would be placed more on the door steps of the private sector ‎who understand the market and how to invest in it.

PoliticsI’ve Never Been Involved In Any Fraudulent Activity – Edo APC Candidate, Obaseki by DONSMITH123(op): 5:06pm On Jun 23, 2016
The flag bearer of the All Progressives Congress, APC, in the Edo state gubernatorial election, Mr. Godwin Obaseki says he has never been involved in any fraudulent activity, debunking reports in the social media that he was under investigation by the Economic and Financial Crimes Commission, EFCC.
Obaseki, in a chat with newsmen in Benin City, said issues raised by the late Humphrey Idisi family against a German firm have nothing to do with him, stressing that he is just a shareholder.

“I don’t have a case with the EFCC. I am on the board of several companies. This is a German company that owns rig in Nigeria. They have a partner who died many years ago and unfortunately, his estate has not been properly managed.

“His other businesses have gone bankrupt. The company saw a petition by some of the children claiming that the company was owing their father.

“There was an agreement that showed that the company paid everything due to the man. The family has been having quarrels and internal issues.

“If somebody is owing you, why go to the EFCC? There is a civil process to do so. It has nothing to do with me. I didn’t manage the company. I am just a shareholder and on the board of the company. I didn’t take money from anybody. I have never stolen, I have never taken anybody’s money before.”
