PoliticsMD Faints In Court After Conviction For Subsidy Scam by DONSMITH123(op): 5:28pm On Jan 13, 2017
Ramon Oladimeji and Oluwatosin Omojuyigbe

The Managing Director of Ontario Oil and Gas Limited, Mrs. Ada Ugo-Ngali, fainted on Friday at the Lagos State High Court in Ikeja after being convicted of N754m oil subsidy scam by the court.

Ugo-Ngali, who had stood in the dock while Justice Lateefa Okunnu was delivering judgment in a N1.9bn subsidy scam trial in which she and three others where defendants.

She slumped as the judge was about to pronounce the sentence.

The prosecuting counsel for the Economic and Financial Crimes Commission, Mr. Rotimi Jacobs (SAN), had pointed out to the judge that the offence carried a seven-year jail term and urged the judge to impose the maximum sentence.

But before the judge could pronounce the sentence, Ugo-Ngali passed out.

As the lawyers in court and her loved ones rushed to aid, Justice Okunnu, noting the state of things, adjourned the case and reserved her pronouncement on the sentence till January 16.

As she regained consciousness, Ugo-Ngali was panting loudly while her lawyers frantically called for medical personnel and an ambulance to take her to the hospital.

The convict was eventually carried out of the courtroom by her lawyers and loved ones into a waiting black jeep which sped out of the court premises.

Ontario Oil and Gas Limited; its Chairman, Mr. Walter Wagbatsoma; Ngo-Ngali; and an official of the Petroleum Products Price and Regulatory Agency, Mr. Babafemi Fakuade, had been arraigned by the EFCC on August 1, 2013.

The EFCC, in the eight counts pressed against them, alleged that they were involved in a N1.9bn fuel subsidy scam.

The charges centred on conspiracy, obtaining property by false pretences, forgery and uttering.

Pronouncing her judge on Friday, Justice Okunnu found Wagbatsoma and Ngo-Ngali guilty, holding that they defrauded the Federal Government to the tune of N754m in oil subsidy transactions totalling N1.7bn.

The judge, however, discharged and acquitted Fakuade, holding the charge of forgery brought against him was not sustainable.

“The case against the third defendant is that he helped in forging the Shore Quality Certificate; what I see before me is that he only signed the document while acting in his capacity as an PPRA official.

“It is not right in criminal cases to infer guilt without concrete evidence, there is no proof that he was aware that the documents were false.

“The prosecution have not been able to prove the case of forgery against the third defendant,” Justice Okunnu held, freeing Fakuade.

In finding Wagbatsoma and Ngo-Ngali guilty, the judge held, “The defendants defrauded the Federal Government of N340m in the third quarter of 2010 and N414m in the fourth quarter of 2010.

“According to a forensic audit by Akintola Williams Delloitte, the defendants did not remit an excess of N754million to the Federal Government.

“The first defendant knowingly received the sum in excess of what the fourth defendant (Ontario Oil and Gas Limited) was entitled to.

“In my opinion, he contributed to the false pretence.”

Justice Okunnu further held, “The second defendant is the MD of the company, she is the alter – ego of the fourth defendant and was aware of the going ons of the company.”

After pronouncing his client guilty, Ngo-Ngali’s lawyer, Mr. E.D. Onyeke urged Justice Okunnu to temper justice with mercy.

“The second defendant has health challenges, in the course of the trial she has had cause to visit doctors abroad to take care of her health issues as the health care system in Nigeria is poor.

“As the MD, she is an employer of labour whose workers depend on her managerial abilities, her workers will suffer more than necessary especially in this period of recession,” Onyeke pleaded.

“It is our humble plea that court grants her a custodial sentence starting from the day she was arraigned,” he added.

Responding, however, the prosecutor, Jacobs, said, “The minimum sentence of the offences which the convicts have been convicted is seven years.

“A custodial sentence will be sending a wrong signal to the public that the rich cannot go to prison and will be a hindrance to our fight against corruption.

“There is also no medical report regarding the alleged ill health of the defendant and the prison has medical facilities, if they can provide for the poor, they can provide for the rich.”‎

TravelFG Begins Rehabilitation Work At Kaduna Airport Despite Senate’s Opposition by DONSMITH123(op): 2:01pm On Jan 13, 2017
The rehabilitation of the new terminal building of the Kaduna Airport which will serve as alternative for both local and international passengers has begun.

This development follows the closure of the Abuja international airport for six weeks, starting from March 8, 2017.

The roads linking the Kaduna airport to the city are currently under construction.

On Thursday, the Minister of State for Aviation, Mr Hadi Sirika and Minister of Transportation, Mr Rotimi Amaechi, appeared before the Senate to explain the reason for the planned closure of the Nnamdi Azikwe International Airport and why Kaduna is the best alternative.

Sirika, insisted on the closure of the Abuja airport which was constructed in 1982 as the runway has exceeded its lifespan of 14 years.

The Senate is vehemently opposing the closure of the Airport, saying the diversion of flights to Kaduna will endanger lives of Nigerians.

Several people are feared dead in an early morning bomb blast in Madagali town in Madagali Local Government Area of Adamawa.

An eye witness who simply identified himself as Baba, said the blast occurred near a checkpoint at the entrance of the town.

“We heard three blasts near the checkpoint where people gathered to be screened before entering the town as you know today is market day.

“The suicide bombers blew themselves up alongside the two vigilante members that approached them,” Baba said.

Speaking on the development, the member representing Madagali/Michika Federal Constituency, Mr Adamu Kamale, said he got the report but that the information showed that there was no death.

“Information available to me showed that there was no death in the blast, except that some people sustained injuries,” Kamale said.

He called for more deployment of troops to comb the Madagali axis of Sambisa which he said was still habouring insurgents.

When contacted, the Chairman of Madagali Local Government, Alhaji Yusuf Mohammed, also confirmed the incident but said he could not give details because he was not in town.

“I was outside the town for an official engagement but I was called and informed about the incident. That is all I can tell you for now,” Mohammed said.

PoliticsAregbesola Orders Ex-Commissioners Out Of Government Quarters by DONSMITH123(op): 3:55pm On Jan 12, 2017
Scores of political gladiators in Osun, as well as residents of the state were in total confusion on Thursday as news filtered in that former commissioners and other aides of the governor have been ejected from their official quarters in Osogbo as a result of the directive from the office of the Chief of Staff to Governor Rauf Aregbesola, Alhaji Gboyega Oyetola.

DAILY POST reliably gathered that the directive has continued to generate a lot of tension among the former aides, who have continued to reside at their official apartments despite the dissolution of the cabinet after the completion of Aregbesola’s first term in office in November 26, 2014.

The governor is already in the 26th month of his second term in office without constituting a cabinet, and strangely, former Commissioners and array of Special Advisers still operate their offices and maintain official apartments at the government’s quarters.

A reliable source at the government’s circle told DAILY POST that most of the former aides of the governor still perform executive role under the guise of ‘”consultancy.”

For instance, the introduction of standard scale for market women in 2016, coined “Osuwon Omoluabi” which was launched by the Ministry of Commerce, Cooperative, Industry, and Empowerment, was practically handled by the former Commissioner in the Ministry, Mr Jayeoba Alagbada.

Also, the recent establishment of Osun Job Centre by the administration of governor Rauf Aregbesola was coordinated by the former commissioner in the state, Ms. Mobolaji Akande.

In addition, the 2016 Christmas Carol, organised by the government of Osun, had the former Commissioner for Information, Mr Sunday Akere as the head of the organising committee, and the prime mover.

However, calls were put through to the Chief of staff, Alhaji Gboyega Oyetola without any response. The text message sent to him for comment was not also replied till the time of filling this report.

PoliticsBREAKING: Buhari Sends ‘revised’ List Of Ambassadorial Nominees To Senate by DONSMITH123(op): 11:36am On Jan 12, 2017
President Muhammadu Buhari has sent a revised list of 46 non-career ambassadorial nominees to the Senate for legislative approval.

President of the Senate, Bukola Saraki, read Buhari’s letter to the lawmakers during plenary on Thursday.

The Senate had rejected the first version of the list due to over 250 petitions against the nominees, two of whom rejected their nomination.

In the new list, while retired Justice George Oguntade (Lagos) and Ahmed Ibeto (Niger) maintained their nomination, several new names have emerged on the list.

Biafra: Buhari is a terrorist who committed treasonable felony in 1983 – Nnamdi Kanu, co-defendant

The incarcerated leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, his fellow defendants, Chidiebere Onwudiwe, Benjamin Madubugwu and David Nwawuisi, on Tuesday allegedly described President Muhammadu Buhari as a terrorist.

Kanu, Onwudiwe, Madubugwu and Nwawuisi are currently standing trial before Justice Binta Nyako of an Abuja Federal High Court on an 11-count charge bordering on terrorism and treasonable felony.

Speaking shortly after Wednesday’s proceedings, the IPOB leader accused President Muhammadu Buhari of committing treasonable felony in 1983.

In a visibly angry voice, Kanu said, ‘’You want to try somebody who is learned; are you mad. How can you jail me idiots?’’

‘’Buhari committed treasonable felony in 1983’’ ‘’Nigeria is an expired country.’’

Madubugwu on his part said, ‘’ Uwazuruike must come out and testify. Hausa Boko Haram everywhere. Try your father in secret not me and see idiots.

‘’Do you see it; we are even with handcuffs inside the court? This is what Buhari is doing. This is one of the intimidations. Can you see it? ‘Secret trail to defend Nigeria created by human beings?

“Nigeria was created 1ST January 1914 and Nigeria expired on 31 of December 1983. Nigeria is a fraud. I have nothing in common with an Hausa man and Yoruba man.”

Earlier, Kanu had rejected his secret trial, “I SHALL NOT BE TRIED SECRETLY WHILE MY ACCUSERS accused me publicly.”

During the proceedings, Kanu’s legal team had accused security operatives of harassing and killing some IPOB members who visit Kanu in Kuje prison.
