I don't expect that from
Let's stay on Imo...what about the constitutional spread? Insignificant? . Saying SC usurped the role of the electorate does mean the its judgement is not in order .APC foolishly played into the hand of SC.When this occurred SC reserves the right to do the needful on the matter. So it finally became the electorate on deciding the winner because of the foolishness of Bayelsa APC and inconsistencies in the identification of Lyons deputy. |

fergie001: https://www.dailytrust.com.ng/breaking-supreme-court-stands-down-for-judgement-in-imo-review.html . The SC accepted that votes belonging to APC were wrongly excluded. If added APC has more votes than the PDP.The APC is therefore the winner. It is the duty of the INEC to go back and do the addition of the other parties' votes for their future record. If there are irregularities in the addition INEC should provide answers to them. The Supreme court judgement is still in order unlike Bayelsa where SC usurped the role of electorate on deciding who would rule in the state. |

The Infectious Diseases Hospital was established at the Mainland Hospital in 2012 by the Lagos State Government with funding support from the United States Agency for International Development (USAID) and technical assistance from Family Health International (FHI 360) under the TBCARE project. The facility was initially an ultra-modern multi-drug resistance tuberculosis (MDR-TB) treatment centre.
During the Ebola Disease Crisis in Nigeria, the government decided MDR-TB treatment centre was a suitable place for the containment and treatment of Ebola Disease.
Since then, the facility has been upgraded by the Lagos State Government, the Canadian Government, the British Government, the US Government and various international agencies to enable it deal with various infectious diseases. It is one of the centres that is designated for the treatment of Lassa Fever and it is at this hospital that the Italian Corona Virus patient is being kept. [quote author=ImoFirstBorn post=86978222]Press Statement The Peoples Democratic Party (PDP) alerts that the All Progressives Congress (APC) is currently mounting pressure on the Supreme Court to restrain itself from reversing the flawed judgment on the Imo State Governorship election despite obvious mistakes in that judgement, which is now threatening the stability of our nation. The party, which hailed Wednesday's verdict of the Supreme Court on Bayelsa state governorship election, however noted that the elements and grounds for the demands by the PDP and majority of Nigerians for the reversal of Imo state governorship election judgment are completely different from those of Bayelsa. The PDP explained that its demand on Imo is not in any way in contestation of the authority and finality of the Supreme Court but a patriotic effort to assist the Supreme Court affirm its infallibility by correcting the inherent mistakes in the judgment which came as a result of misleading presentation to it by the APC. It is therefore instructive to note that the various election matters before the Supreme Court were brought on clearly distinctive grounds and each should be treated on its merit before the law. The party said the only reason APC was pushing for a review of the Supreme Court’s valid and flawless judgment on the Bayelsa and Zamfara governorship elections was to cause confusion and blackmail the Supreme Court from treating the Imo case on merit. The PDP maintained that the grounds for the reversal of Imo judgment are unambiguously constitutional and completely distinct from APC’s attempt to blackmail the Supreme Court with their demands on the Bayelsa and Zamfara states governorship election. The party therefore urged the Supreme Court not to succumb to the threats and blackmail by APC to push it restrain itself from looking at the merit of the Imo case; correcting the mistakes and reversing the flawed judgment. Forgery is a criminal act and its conviction affects a person participation and qualification in an election. The case in question started before election and concluded after it .So it is still in order. The federal high court to the supreme court can hear it before or after election. It is not restricted to the tribunal. |

Dansuqi: Bayelsa Election: Falana Says Supreme Court Is Wrong, Lacks Jurisdiction Adeshola Soyele and Akinola Ajibola Updated February 22, 2020 961
Mr Femi Falana
A Senior Advocate of Nigeria, Femi Falana, has reacted to the judgment of the Supreme Court on the governorship election in Bayelsa State.
In an exclusive with Channels Television, he said the apex court made a mistake when it treated a pre-election matter as a post-election case.
“What their Lordships ought to have done was to ask the lawyers, ‘can you address us with respect to our jurisdiction?’
“Because Section 133 of the Electoral Act stipulates that upon the conclusion of an election and once candidates are declared, any challenge of the conduct of the election, of the qualification of the candidates shall be heard and determined by an Election Petition Tribunal,” Falana stated.
On February 13, a five-man panel of the Supreme Court led by Justice Mary Peter-Odili sacked David Lyon and Biobarakuma Degi-Eremieoyo of the All Progressives Congress (APC) as the winners of the November 16, 2019 governorship poll.
The court then ordered the Independent National Electoral Commission (INEC) to withdraw the Certificate of Return issued to the APC candidates and issue fresh certificates to the candidate of the party with the next highest votes, and with the required constitutional spread of votes in the results of the election.
It disqualified Degi-Eremieoyo as a candidate in the election for submitting forged certificates to INEC, stressing that the deputy-governorship candidate had infected the joint ticket with which he and Lyon ran for and won the election.
This led to the declaration of Senator Douye Diri and Senator Lawrence Ewhrudjakpo of the Peoples Democratic Party (PDP) as the winners of the election and subsequent swearing-in as the governor and deputy governors of Bayelsa State.
The leadership of the APC and Degi-Eremieoyo have separately asked the apex court to review its judgement on the election.
In his reaction, Falana who has disagreed with the APC led government on many issues insisted that the apex court made a mistake.
He stressed that the court lacked the jurisdiction to entertain the matter, saying it should have gone before the Election Petition Tribunal.
Ahead of the review of the judgment by the Supreme Court, the senior advocate was hopeful that the opportunity would further develop and strengthen the country’s laws.
He said, “The election was held on the basis of the judgement of the Court of Appeal which was to the fact that yes! Degi-Eremieoyo changed his name many times, not that he forged any of his certificates; there was no such proof. Therefore, he can contest the election.”
“On the basis of that judgement, the people voted; which means by that judgement, the election was valid and legal.
“As of that date, there was no pending appeal before the Supreme Court whereby INEC could be accused of having violated the doctrines of lis pendens i.e. ‘since you knew a case was in court, why did you hold election? As was the case of Peter Obi and INEC,” he added.
Falana stated that it was after the conclusion of the election that the PDP filed an appeal in the Supreme Court.
He stressed, “With profound respect, the attention of the Supreme Court was not drawn to the legality of that appeal; the case had become spent.” https://www.google.com/url?q=https://www.channelstv.com/2020/02/22/bayelsa-election-falana-says-supreme-court-is-wrong-lacks-jurisdiction/&sa=U&ved=2ahUKEwjf-Mb6i-bnAhWxzIUKHQhFCm4QFjAAegQIAxAB&usg=AOvVaw3uIm2sDUoY1PNi7hEly6mT

Dansuqi: You are right thats if it is not in connection with election.if you are filing it based on elections,it must be within the statutory time allowed.if it is now within a civil court and not in connection to any election,it is now a criminal case and therefore cannot affect a deputy governor as the cloth of immunity will now be activated legally Though there inconsistencies on the demacation between criminal and pre election matters even at the supreme court The apex court believes that a pre election matter caanot be swept away under the cover of criminality which immunity covers.Regardless of anyway it comes a pre election.matter is treated as such. |

Now that there's a new governor, how will the petition of today be calculated? Is it from when the initial election was held or from the 13th when a new governor was declared? Pls note that a case of forgery can be opened at any time .It is a pre election matter which can be presented before a high court . |

No government can employ over 100 000 graduates we are producing every year. The solution is the reduction in retirement age to 50 and all retirees are paid their gratuities immediately so as to establish businesses. This will pave way for new ones in the public and private services.. This is the basis of the SC judgement. Joint ticket before swearing in ,you are on your own after assumption of office.only if the matter was brought after the swearing in. However if the matter is brought before the swearing in it is a pre election matter and principle of joint ticket still applies even after assumption of office . My own concern is how joint ticket contradicts other electoral provisions which pave way for a rerun election . |

Dansuqi: My anger is that all cases of falsification and forgery against governors similar to that of degi were ruled in favor of governors.see agi vs ayade 2016 supra Pdp vs wike 2019 supra Nyong vs Donald duke 2004 supra Useni vs lalong Pdp vs masari. They were clear cases of discrepancies and forgery but either the courts discountenanced the facts or declared them not fundamental in nature.there is no difference with that of bayelsa lalong, masari and wike's own were very glaring.
That of 1999 was from the appeal court so lets not cite it. Even in pdp vs adeleke, glaring facts of falsification, impersonation and forgery were unearthed . To add to your beautiful submission why is this affecting Lyon? Why voiding votes on joint ticket? Why not meteing punishment on the ering candidates? What did the CJN say on it when they were having in-house discussion on it? There must be consistency on SC judgment on election matter. |

Dansuqi: I agree.the issue of ambiguities and vagueness must always be avoided by judges.there are so many cases flogging these matter particularly amaechi vs pdp ors supra . I agree with your submission .However there are even contradictory precedences on the matter. In Muazu 1999 a fresh election was ordered wvn when the ticket was joint.I believe SC should align its judgement on election considering diverse positions of the constitution and electoral act and arrive at a reconciliatory conclusion on it. This I think affects Bayelsa judgement and I think it should be reviewed regardless of the stupidity and inconsistency of names of the disqualified deputy governor. |

Dansuqi: Is it mandatory that a judge gives clear consequential orders in his judgment? Is there a clear difference between a judge saying you are guilty of the charges and also saying you are guilty and hereby sentenced to 5 years imprisonment? . Judgement must be clear and devoid of ambiguity ....You are guilty as charged is a pronouncement of guilt, penalty is not indicated. So to make it full and complete sentence must accompany guilt. In law judges must do away with vagueness and ambiguity. |

Dansuqi: When me and ejimatic were hammering on how fatal the absence of the judge will be,did you not laugh as usual? Honestly, you shouldn't be arguing with me on this.
The matter will be decided on the amount of errors pointed out in the judhment or the weight of the errors.matters raised by lawyers in court and ignored by judges will be key not bringing entirely new things that were never canvassed like agabi is doing . Wale Olanipekun raised salient issues for consideration. These are not technical issues but what are in the constitution and electoral laws. While there are inconsistencies in Degi names the SC did not consider other parts of the electoral laws and constitution to prevail on the Bayelsa matters especially on voiding of votes.Let awaits the supreme court review on all the matters. |
