This is not investigation but appeal.

No investigation but argument on what was jundicely delivered by Abang. Where Poroye who brougy the case was the one who brought lawyer to defend the case without allowing the affected party to be represented.

Is that a judgement

I just finished reading that report and NOWHERE in it, it was stated the Appeal Court will deliver judgement in one week or before election. The only specific directive from the panel is for Jegede team to serve all respondents in the appeal within three days of its decision.

As it is, judgement may be dispensed before the election but it is not guaranteed.
Like your former submission on this matter.

The difference in our position is that while I doubt a decision will be reached before election, you are sure the case will be resolved before then.

No need to argue further. In about 10 days from now, we will see the outcome. No need to fight brother.

Politics#ondodecides2016: Jegede To File Appeal In 24hours And Jimoh 3 Days To Respond by engineerboat(op):
The Abuja Division of the Court of Appeal yesterday granted the application by Eyitayo Jegede (SAN) challenging the judgment of the Justice Okon Abang of the Federal High Court Abuja which ordered the Independent National Electoral Commission (INEC) to remove his name and replace it with that of Jimoh Ibrahim.

Jegede emerged as the Peoples Democratic Party (PDP) governorship candidate in Ondo State governorship election from the faction of the Senator Ahmed Makarfi, while Jimoh Ibrahim emerged from the Senator Ali Modu Sheriff faction.

The Makarfi faction was the first to submit the name of its candidate to the INEC.
After the submission, the Sheriff faction approached the Federal High Court sitting in Abuja to challenge the submission of Jegede’s name.
In his ruling, Justice Abang ordered INEC to remove Jegede’s name and replace it with that of Ibrahim.

Though not a party at the lower court, Jegede had, through his counsel, Chief Wole Olanipekun, approached the Appeal Court for leave to appeal as interested party.
But Biyi Poroye, who is the Chairman of the PDP in the state for the Sheriff faction opposed the application. His lawyer, Beluolisa Nwofor (SAN), asked the court not to grant the application.

Ruling on the application, a full panel of the court in a unanimous decision upheld the submission of Olanipekun and granted the application as prayed.
Reading the lead judgment, Justice Ibrahim Salauwa held that Jegede had been able to prove to the court that he was affected by the judgment of the lower court.

The court also held that the notice of appeal filed by the applicant should be deemed as properly filed and that the applicant should file and serve all his processes on the respondents within 24 hours.

The court then gave the respondents three days for file their reply.

Earlier, the court had dismissed an application filed by the Sheriff faction asking that the panel set up by the President of the Court of Appeal (PCA), Justice Zainab Bulkachuwa, to hear all the appeals relating to the governorship disputes in the state be disbanded.

The court held that no litigant had the power to challenge the administrative power of the court’s president to set up a panel to hear a matter and as such, she did not need to consult the litigants before setting up a fresh panel.

The court then dismissed the application for lacking in merit.
The Sheriff faction had written a petition alleging that the first panel led by Justice Hannatu Sankey collected bribes of N350 million from the state Governor Olusegun Mimiko.

The justices denied the allegation but chose to disqualify themselves from further participation in the appeals. After the panel recused itself, the case file was returned to the PCA, who in turn set up a fresh panel to hear the matter.

I don't think Jimoh Ibrahim's lawyers are fools. They will file so many technical jargon to delay the appeal judgement. They may even file an appeal to the supreme court against the leave of appeal granted by the appeal court. If they do that, they will ask the appeal court to wait for the supreme court to decide the matter before hearing and ruling on Jegede's appeal.

Saraki has shown everybody that if you have the money to employ good lawyers, you can stall the judicial process for as long as you want. We have just 16 days to the election, it's not really pretty good for Mimiko and Jedege despite the little victory they achieved yesterday.
Good point. But it must be emphasized that Poroye and Ibrahim are killing their own arguement by that Petition against tjr first panel.

The president court of appeal and CJN had requested that both of them appear before them to defend their affidavit against the judges.

But till this morning Both of them refuses to appear and defend their affidavit on the petition.

You will wonder why Ibrahim lawyer was called Absentee lawyer yesterday.

How special Appeal court panel decided Uba’s case in just 24 hours

ADEFAYE
24 DEC 2011

By Tony Edike

The five-man panel of the Court of Appeal that nullified Senator Andy Uba’s election yesterday heard and decided the matter involving Anambra South Senatorial seat in about 24 hours.

The panel was constituted specifically to hear pending cases from controversial National Assembly elections held in Anambra State.

The members of the panel, according to Vanguard checks, were drawn from five different divisions of the appellate court with a mandate to handle the pending cases.

The panel was said to have arrived Enugu on Wednesday and sat throughout the day during which they heard about nine motions brought by various  counsels in the matter.

As learnt, efforts by Uba”s counsels to get the panel to do a through job since none of the members had the history of the matter were reportedly rebuffed.

The matter was concluded late Wednesday evening  with only the justices, lawyers and court clerks present.

The author of the article raised some valid points but he failed to acknowledge that the case can be fast tracked. Counsel to Jegede has applied for an accelerated hearing which would ensure speedy adjudication. It is still a puzzle why Jegede, a senior advocate, waited this late before he challenged the substitution of his name with Jimoh's name in court.
Jegede did not wait.

The case was delivered on 14th october by abang. They approach abang to obtain leave of appeal which Abang refuse on the 27th of october. Several high court cases restrain INEC from substituting his name. But INEC acted on abang rule.

Hence the latest ruling of Appeal

The position of the LAW as at today: Jegede's Application for Leave
to appeal Justice Abang was Granted, but Leave to appeal doesn't mean Jimoh Ibrahim's name has been
removed from INEC list. It simply means that Jegede has the right to appeal Abang's judgement, Now
this is the procedure as provided by Civil procedure rules of Nigerian Courts.: Jegede will file appeal
after that he will transmit record, he will follow it with filing of his brief of argument while Biyi Poroye will
file a Respondent brief to be followed by reply brief by Jegede. After all these, the appeal would be
entered for hearing. All these cannot take less than 90 days. Meanwhile Poroye has filed an appeal
against the Judgement of today which will still drag and drag. Either PDP supporters likes it or not,
Jegede cannot be part of an election that will hold in 16 days time. I personally advise PDP supporters
who are more educated and sensible should try and educate the public and not misleading them. Jimoh
(ARABA) Ibrahim remains the authentic Candidate for PDP in the Coming Election, Jegede is OUT for
now till all the pending applications are settled legally in the court of law and not on the streets of
Akure jubiliating what they don't know. They should be crying by now for not appealing Justice Abang
judgement of June,2016 or better still, Let Iroko and his protegee look for Plan B..
Going by your logic. The just concluded Appeal take just 1 week. And 3 days.

So stop you consolation. This is an accelerated Appeal.
All counsel have been mandated to file their written brief before Monday.

PoliticsOndo 2016: Appeal Court Stops Ploy By Jimoh Ibrahim’s Loyalists To Delay Suit by engineerboat(op): 7:07pm On Nov 10, 2016
A move by loyalists of Jimoh Ibrahim to frustrate an appeal against his governorship candidacy in Ondo State was foiled by the Court of Appeal on Thursday.

The court dismissed an application filed by factional members of Mr. Ibrahim’s Peoples Democratic Party, PDP, challenging the jurisdiction of the new panel set up to address the Ondo State crisis.

Through their lawyer, Beluolisah Nwofor, the party members questioned the newly constituted panel set up by the President of the Appeal Court, Zainab Bulkachuwa.

Ms. Bulkachuwa reconstituted the panel of three judges led by Ibrahim Salauwa, following an application by a factional chairman of the PDP in Ondo State, Biyi Poroye.

Mr. Poroye, also a loyalist of Mr. Ibrahim, had petitioned the National Judicial Council challenging the former panel led by Jummai Sankey, and alleging fraud against Mr. Sankey.

Ms. Bulkachuwa, subsequently, dissolved Mr. Sankey’s panel and constituted that of Mr. Salauwa to handle the suit.

The nine members who filed Thursday’s application form the 1st to 9th defendants in an application filed by another Ondo State governorship candidate of the PDP, Eyitayo Jegede.

Mr. Jegede is challenging an October 14 Federal High Court judgement that recognised Mr. Ibrahim as the authentic candidate of the PDP for the November 26 governorship election in Ondo State.

The first to ninth defendants, all members of the party from Mr. Ibrahim’s faction, said the constitution of a new panel over a pre-election matter amounted to an abuse of their right to fair hearing.

Their lawyer, Mr. Nwofor, said the matter was not time-bound and that the ‘hasty’ manner of approach adopted by the Appeal Court President would affect their right to fair hearing.

He, therefore, prayed the court to disband the panel, saying it lacks jurisdiction on the matter.
But delivering its ruling on Thursday, the judges rejected the application.

“This is an application that should not be allowed to see the light of day. Assuming that this panel is subject to any review by any court; this should not be the court.
“It is unimaginable that a panel set up by the President of the Appeal Court should be questioned by us,” said Mr. Ibrahim.

Other members of the panel, who contributed to the ruling, said the new panel was set up after the first defendant, Biyi Poroye, made his allegations. They wondered why the defendants seamed not satisfied with the court’s consideration of their petition.

“This is a motion by the first to ninth defendants who have made numerous applications to achieve a sinister motive,” the court said.

The court also granted the application by Mr. Jegede demanding that the appeal court set aside its rules and allow him appeal previous judgements on the Ondo governorship election by the Federal High Court.
Eyitayo Jegede

The Federal High Court recognised Mr. Ibrahim’s PDP candidacy after it recognised Ali Sheriff as the national chairman of the party.
Mr. Jegede, alongside Governor Olusegun Mimiko of Ondo, are members of the Ahmed Makarfi-led faction of PDP
