The Abuja Division of the Court of Appeal yesterday granted the application by Eyitayo Jegede (SAN) challenging the judgment of the Justice Okon Abang of the Federal High Court Abuja which ordered the Independent National Electoral Commission (INEC) to remove his name and replace it with that of Jimoh Ibrahim. Jegede emerged as the Peoples Democratic Party (PDP) governorship candidate in Ondo State governorship election from the faction of the Senator Ahmed Makarfi, while Jimoh Ibrahim emerged from the Senator Ali Modu Sheriff faction. The Makarfi faction was the first to submit the name of its candidate to the INEC. After the submission, the Sheriff faction approached the Federal High Court sitting in Abuja to challenge the submission of Jegede’s name. In his ruling, Justice Abang ordered INEC to remove Jegede’s name and replace it with that of Ibrahim. Though not a party at the lower court, Jegede had, through his counsel, Chief Wole Olanipekun, approached the Appeal Court for leave to appeal as interested party. But Biyi Poroye, who is the Chairman of the PDP in the state for the Sheriff faction opposed the application. His lawyer, Beluolisa Nwofor (SAN), asked the court not to grant the application. Ruling on the application, a full panel of the court in a unanimous decision upheld the submission of Olanipekun and granted the application as prayed. Reading the lead judgment, Justice Ibrahim Salauwa held that Jegede had been able to prove to the court that he was affected by the judgment of the lower court. The court also held that the notice of appeal filed by the applicant should be deemed as properly filed and that the applicant should file and serve all his processes on the respondents within 24 hours. The court then gave the respondents three days for file their reply. Earlier, the court had dismissed an application filed by the Sheriff faction asking that the panel set up by the President of the Court of Appeal (PCA), Justice Zainab Bulkachuwa, to hear all the appeals relating to the governorship disputes in the state be disbanded. The court held that no litigant had the power to challenge the administrative power of the court’s president to set up a panel to hear a matter and as such, she did not need to consult the litigants before setting up a fresh panel. The court then dismissed the application for lacking in merit. The Sheriff faction had written a petition alleging that the first panel led by Justice Hannatu Sankey collected bribes of N350 million from the state Governor Olusegun Mimiko. The justices denied the allegation but chose to disqualify themselves from further participation in the appeals. A move by loyalists of Jimoh Ibrahim to frustrate an appeal against his governorship candidacy in Ondo State was foiled by the Court of Appeal on Thursday. The court dismissed an application filed by factional members of Mr. Ibrahim’s Peoples Democratic Party, PDP, challenging the jurisdiction of the new panel set up to address the Ondo State crisis. Through their lawyer, Beluolisah Nwofor, the party members questioned the newly constituted panel set up by the President of the Appeal Court, Zainab Bulkachuwa. Ms. Bulkachuwa reconstituted the panel of three judges led by Ibrahim Salauwa, following an application by a factional chairman of the PDP in Ondo State, Biyi Poroye. Mr. Poroye, also a loyalist of Mr. Ibrahim, had petitioned the National Judicial Council challenging the former panel led by Jummai Sankey, and alleging fraud against Mr. Sankey. Ms. Bulkachuwa, subsequently, dissolved Mr. Sankey’s panel and constituted that of Mr. Salauwa to handle the suit. The nine members who filed Thursday’s application form the 1st to 9th defendants in an application filed by another Ondo State governorship candidate of the PDP, Eyitayo Jegede. Mr. Jegede is challenging an October 14 Federal High Court judgement that recognised Mr. Ibrahim as the authentic candidate of the PDP for the November 26 governorship election in Ondo State. The first to ninth defendants, all members of the party from Mr. Ibrahim’s faction, said the constitution of a new panel over a pre-election matter amounted to an abuse of their right to fair hearing. Their lawyer, Mr. Nwofor, said the matter was not time-bound and that the ‘hasty’ manner of approach adopted by the Appeal Court President would affect their right to fair hearing. He, therefore, prayed the court to disband the panel, saying it lacks jurisdiction on the matter. But delivering its ruling on Thursday, the judges rejected the application. “This is an application that should not be allowed to see the light of day. Assuming that this panel is subject to any review by any court; this should not be the court. “It is unimaginable that a panel set up by the President of the Appeal Court should be questioned by us,” said Mr. Ibrahim. Other members of the panel, who contributed to the ruling, said the new panel was set up after the first defendant, Biyi Poroye, made his allegations. They wondered why the defendants seamed not satisfied with the court’s consideration of their petition. “This is a motion by the first to ninth defendants who have made numerous applications to achieve a sinister motive,” the court said. The court also granted the application by Mr. Jegede demanding that the appeal court set aside its rules and allow him appeal previous judgements on the Ondo governorship election by the Federal High Court. Eyitayo Jegede The Federal High Court recognised Mr. Ibrahim’s PDP candidacy after it recognised Ali Sheriff as the national chairman of the party.
